Applicant: Property Location: Requested Action: Purpose: City of Chardon n/a Text Amendment Amendments to Section 1125 of the Planning & Zoning Code to adjust the fees for sign permits and zoning permits. Allow field change requests to be approved by staff and no additional fees to be charged as long as no cost is incurred by the city. Remove contractor registration fees from the Planning & Zoning Code. 1125.187 SIGN PERMIT FEES. (a) A permit fee of one hundred dollars ($100.00) shall be charged for all non-exempt temporary political/election issue signs which are identical in size, configuration and text copy. (b) A sign permit application shall be filed for each classification of sign (for example, a wall sign or freestanding sign). The application may include all the signs in that classification. A fee of one hundred dollars ($100.00) shall be charged for each application. A fee of $100 shall be paid with an application for a zoning certificate. A fee of $50 shall be paid for each additional sign. A business moving from one location in the City which uses an existing sign at another location within the City shall pay 50% of the sign permit fee. (Ord. 1403. Passed 10-8-92; Am. Ord. 1433. (a) Fees for site development permits (see 1125.188) shall be charged and paid at the time of the applicable submittal according to the following schedule: PROJECT FEE* One- and two-family dwellings New house (cost per dwelling)

A fee of one thousand dollars ($1,000.00) for a zoning amendment application shall be paid with the application. In addition, the applicant shall

(a) Deposits shall be made with the City prior to construction, for singlefamily, two-family and multi-family dwellings and condominium units as follows: (1) New single-family dwelling construction: $1,000 (2) Addition: $500 minimum (3) New construction two-family dwelling and multi-family dwelling: $1,000 per dwelling unit. (4) New construction single-family condominium unit: $1,200 per unit. (b) Deposits, prior to construction, for commercial, industrial and other types of occupancies are as follows: (1) New buildings: $25 per front foot of lot or building line, whichever is greater. $2,000 minimum. (2) Additions or alterations: A. $12 per front foot of lot or building line, whichever is greater. $1,000 minimum. B. If the alteration or addition is to a unit or units in a multiunit structure, the deposit shall be the percentage of the area of the unit or units as it relates to the total area of the structure or structures on the parcel multiplied by the amount calculated under subsection (b)(2)A. above. $1,000 minimum deposit.

(c) Deposits required hereunder are in addition to all other deposits and fees required by the City and shall not be used for or applied to any other fee or charge. (d) Irrespective of the foregoing deposit requirements, any owner occupying a residential dwelling and who is performing all work for which a permit is sought or who is the general contractor for which a permit is sought shall be exempt from the requirement of making any cash deposit hereunder. A personal bond only shall be required of such owner-occupant. The bond shall be on a form prescribed by the Law Director and shall include an authorization to charge the owner- occupant for any sum necessary to replace and/or restore any damage caused to municipal property during construction, or for the proper grading or draining of the premises, if not completed as required by the Codified Ordinances and municipal specifications. (e) An applicant for a zoning permit who is registered as a contractor shall guarantee that a "closeout sheet" listing all subcontractors and employees who performed services or labor for the project, and the amount paid to each, is submitted prior to issuance of the occupancy permit. (f) Whether or not the deposit was made prior to the effective date of this subsection, when more than 12 months have passed since the initial deposit required under this chapter; and, further, when construction has not been completed by the deadline imposed in the Municipal Approval, then the Planning and Zoning Administrator or designee may seek forfeiture of the balance of the deposit to the municipality by application to Council. Council may declare the deposit forfeited to the municipality after a public hearing. The owner of the deposited fund shall be given prior written notice by certified mail sent at least 14 days prior to the hearing before Council and be given an opportunity to present evidence why such deposit should not be forfeited. (Ord. 2075. Passed 8-9-01; Am. Ord. 2140. Passed 12-12-02.) 1125.192 SUBMITTAL CONFERENCES. (a) The applicant shall not be charged a fee for the first pre-submittal conference. A fee of $820 shall be charged for each additional pre-submittal conference and post-submittal conference (see 1145.14). (b) Applicants for submittal conferences shall be responsible for paying all expenses not included in the fees set forth above (see 1103.17) for any technical and/or engineering services deemed necessary by the City to perform the reviews and enforcement required by City ordinances. Charges for services by the Municipal Engineer and other municipal consultants shall be billed separately at current contract rates. (Ord. 2209. Passed 6-10-04; Am. Ord. 2279. Passed 3-30-05.)

1125.193 FIELD CHANGE REQUESTS. (a) A fee shall be charged for each review of a field change request to modify plans, specifications or other documents for projects which have previously been approved by the Municipal Planning Commission (see 1149.92). The fees shall be as follows: (1) (2) (3) For each municipal staff review of a field change request, $615 For each field change request heard by the Planning Commission, $375 (in addition to the staff review fee in division (a)(1) of this section. Staff has the authority to approve field change requests and no additional fee would be assessed unless there is an additional cost incurred by the City

(b) Applicants for field change requests shall be responsible for all expenses not included in the fees set forth above (see 1103.17) required for any technical and/or engineering services deemed necessary by the City to perform the reviews necessary under the Codified Ordinances. Charges for services by the Municipal Engineer and other municipal consultants shall be billed separately at current contract rates. (Ord. 2279. Passed 3-30-05.) 1125.20 CONTRACTOR REGISTRATION FEE.
