Summary of status describe especially problem encountered during project implementation, including proposal for changes and reason for changes in time schedule, outputs and budget Internal Problem: The two psycho social community workers Mr. Ansar Ahmad of Tanda block and Mr. Dinesh Kumar Anal of Pindra block gave resignation due to their personal reasons. One Model Block Co-ordiantor Ms. Farhat Shaba Khanam of Badagaon block resigned due to her marriage.i After the interview Mr. Digvijay Singh selected as Psycho-community worker of Tanda block, Ms. Chhaya of Pindra block and Mr. Chandra Shekhar as model block co-ordinator Badagaon The resignation has not influenced to the planned implementation of the project as PVCHR is working in that area from long time. Already Mr. Digvijay Singh and Mr. Chandra Shekhar are trained in testimonial therapy in Chitrakoot workshop and being a journalist Digvijay know the local field and Chandra Shekhar is local resident of same block. But time will take in training of Ms. Chhaya 12. Assessment of overall progress The overall progress of the project is according to the planned and activities frame out in project proposal. Activities Preparation for organizing workshop Honor Ceremony Manual in Hindi Broad basing of NATT

By Result PVCHR/JMN is in process of doing financial agreement with Mr. Waliuallah Ahmed Laskar, Barak Human Rights Committee (BHRC) in Silchar, Assam for the workshop on Testimonial Therapy (TT) from 5th September to 15 September, 2011. NATT member organization Institute of Social Development Trust did honor ceremony on 15th May, 2011 in his officeii Manual published in local language Hindi Visit to NATT members Wide Angle, Human Rights Alert, Khelen and Dynamic Action Group (DAG), Lucknow for sharing & learning of testimonial therapy. 11 organizations subscribed for-membership of NATT Consultation through European Union with Sanjog organizations based in Kolkata working on the trafficking issue and Welthurngerhilfe project on Kashmir were interested in testimonial therapy. Followup visit to the survivors (supported through testimonial therapy) in Loktak along with Ms. Renuka Srinivasan from European Union. Dynamic Action Group (DAG), Peoples Vigilance Committee on Human Rights (PVCHR), Voice of People (VOP), National Alliance on Testimonial Therapy (NATT), Right to food & work, Uttar Pradesh, Detention Watch organized regional convention on the issue Torture and attacks on Minority. Schedule Caste, other backward Caste, women and human rights defender and rule of law at Ravindralaya Lucknow on 26th June, 2011.iii In the program 31 survivors (supported through testimonial therapy) and 5 barefoot workers Mr. Pintu Gupta, Chotel Lal, Ram Dayal, Yasin and Lakshman were honoured. Around 1700 people participated in this convention and 268 complains had been given to the Chairperson, National Scheduled Caste Commission and 243 complains to National Human Rights Commission on regional convention.

42 survivors were psychologically supported through testimonial therapy 5 folk schoolxiii & 7 Honor ceremonyxiv in which 262 people participated in folk school and 1025 in honor ceremony Street play on the testimonies of three survivors was performed in the folk school and other testimonies were on other social issues to create awareness. . To select cases for the direct & immediate assistance such as legal,xv Meta-legal interventionxvi 161 petition sent to the National Human Rights Commission and National Scheduled Caste Commission apart from the regional convention.

/11 (DG) on dated 9th May, 2011 directed to prepare the list for the watchfulness of actors of witch hunting such as the ojhas ; Sokha and the other people involved in this type of activity. Meeting held with an effort to create awareness against social evil in presence of the village head, village pachayat member in the affected village. NHRC issued notice to Additional District Magistrate, Varanasi for fact statement & enquiry in the case of Ram Dayal, Bonded Labour. Immediately Director General of Police (DGP) is responding on the complain sent through email.

On 20th June Governor issued notice to District Magistratexxii and FIR lodge against brick kiln ownerxxiii Media Fellowship Meta Legal: The testimonies taken during Manipur workshop were used for the advocacy purpose Rashini Yengkhom, Under Secretary (Home) sought some information in 11 testimonies from PVCHR and report on 5 survivors of torture and organized violence have been sought from Police department.xxiv The National Human Rights Commission (NHRC) on 28th June, 2011 issued notices to Uttar Pradesh Chief Secretary and Director General of Police regarding the arrest of a senior journalist who reported about the death of deputy CMO Y S Sachan. xxv Honb High Court took Suo Moto on the news published in Times of India and Amar Ujala on 14th June, 2011 "Hope dries in parched land: 515 suicide in five months" Peoples' Vigilance Committee on Human Rights (PVCHR) on 15th June, 2011 sent email to Honb' Chief Justice, Allahabad High Court and Chairperson National Human Rights Commission, New Delhi.xxvi NHRC issued notice to Chief Secretary, Uttar Pradesh.xxvii NHRC issued notice to Uttar Pradesh Government on Dr Sachan's death: Calls for report to District Magistrate and Jail Superintendent's explanation over non intimation of death in judicial custody within 24 hoursxxviii 6 stories published for sharing and learnings of testimonial therapy

NHRC issued notice in the cases submitted during meeting on the situation of Human Rights Defender held in Paradkar Smiriti Bhawan, Varanasi on 16th March. 2011. Declared 9 December as Human Rights Defenders day and strengthen the complain system against the violation of Human Rights Defendersxxix Testimony of Kamlesh Musahar published in cover page of Legacy India magazinexxx The National Schedule Commission called for the report from Superintendent of Police, Varanasi. NHRC transferred the case to State Human Rights Commission u/s of the protection of Human Rights Act, 1993 for disposal in accordance with the provision of Act.xxxi RTI was used to obtain the information from National Human Rights Commission in the case of Hirawati.xxxii

Midyear assessment with Governing Board: The members of the Governing Board were also invited to participate in the regional convention on 26th June at Lucknow. To observe the impact of testimonial therapy in breaking of silence and empowerment of survivors which leads into testimonial movement against TOV. In evening the five manuals was presented to them. They appreciate and approved the manuals. Mr. Upendra Kumar presented about the model block process and Ms. Shirin Shabana Khan presented about the development of the project in last six month. She also explained how testimony is influencing the commissions. Model Process: The bridging the gaps among various communities of shudra and ati shudra finished due to continuous folk discussion and testimonial movement. Now more survivors are participating in folk school which has great impact on the community, People seem very aware and openly stating their problem. The participation of womens is more than men. The community people themselves are giving application on the Tehsil day (every Tuesday of the month the Sub Divisional Magistrate sit in the tehsil) and now they are talking of their rights. The folk - School or honor ceremony is attended with much enthusiasm

Problem Encountered: The problem encountered in five model blocks of Uttar Pradesh and Uttarakhand are very much common. 1. Survivors: Police is continuously making pressure on the survivors for making compromise and also given threat to involve them in fake case. For e.g. Police cheated and terrorize a survivor Kamlesh Mushar and took his fake statement. Government lawyer in the influence of perpetrator is taking more money from survivor for the advocacy.

2. Human Rights Defenders/Community Workers: Even model block co-ordinator (MBC)/psycho social community worker (PSCW) received threat to be involved in fake case. Many times survivor became dependent to the MBC/PSCW to accompany them in the department/office, which create problem to them. Recently PVCHR three activists Mr. Upendra Kumar, Mr. Mrityunjay and Mr. Shiv Pratap Chaubey were threaten by the Sub Divisional Magistrate, Sadar for taking of the case of bonded labour.xxxiii Mr. Mangala received threat by the Incharge of police out post Kathiraw under Phulpur police station in Varanasi in case of rape xxxiv NHRC issued noticexxxv Dr. Lenin Raghuvanshi received threat from Hindu facist forces Missionaries, Pakistanis and Lenin Raghivanshi of PVCHRxxxvi Tie Up EU Project: 15 survivors were psychologically supported through testimonial therapy.
I.

Moradabad riot: On 16 February, 2011, an incident of communal violence took place at the Sahaspur village in Moradabad district. Following this unfortunate incident, Uttar Pradesh state police, Rapid Action Force (RAF)

and Provincial Armed Constabulary (PAC) committed brutal repression of the persons belonging to the Muslim minority in the village.xxxvii Governor BL Joshi has asked state Home Secretary to take full action on the alleged one-sided action of the police against the minority community.xxxviii
II.

Mohd. Abdul Aziz the fourth grade employee of Aligarh Muslim University died in custody on 8th May, 2011. He was picked up forcefully from his house by police and he died in custody. Letter was sent to National Human Rights Commission and Director General of Police (DGP). DGP issued notice to S.S.Pxxxix FIR registered under section 302/452/323/506/120 case no. 344/2011 against Rashid son of Nabbi, Sobaran Singh, Zahid, Samartha, Mittal S.I Jalil Ahmad SSI A.K Tyagi & other policeman.xl

Mohd. Isa Azmi of Varanasi was brutally tortured by the Nadesar police outpost incharge Mr. A.K Singh police due to minority status. He revelled medico legal and 11 injuries in his body. The National Commission for Minorities has sought report from Director General of Police, Uttar Pradeshxli Communal riot: On 24/25 April, 2011 midnight the communal person fire the house of Mohd. Inam son of Sri Nasir Ahmad house no. 593/13, Shastri Nagar Meerut in UP of India. He recognized all the person involved in the inhuman activites and informed the police,But police is doing nothing for recoganisation of Hindu rioters. While burning the house the voice of glass creaking is heard. the communal people were saying n Hindi "Mar jao Katuo" (die you muslim). When police official came non of them ran but they were chanting the slogan "Har har Mahadev" in front of police (doing praise of the God for good work in Hindu religion). Police filed FIR against Muslim rioters and they fired against them but if you look in this video their is no action against hindu rioters. Hindu rioters taking in the front of them "Katwa do suwaro ko" (kill these pigs means Muslim) it is noted that which is prohibited as haram in Muslim religion. In the firing Mohd. Indam half year child Aakifah and his wife Sahista burned very badlyxlii. The Governor of Uttar Pradesh issued notice to Chief Secretary.

UNDP:

Can dalits make a claim of their fundamental rights in the Raj of Ms. Mayawati an analysis report was prepared on the cases of dalit atrocity in Sonbhadra and Allahabad.xliii Director General of Police (DGP) started the enquiry and NHRC issued notice to Superintendent of Police of Sonbhadra and Senior Superintendent of Police of Allahabad.

Others: 1) After long formal and non formal meeting with various organizations associated with PVCHR and National Alliance on Testimonial Therapy (NATT), PVCHR as secretariat formally launched Detention Watch. Detention Watch special poster launched on 26th June i.e. regional convention. Mr. Upendra Kumar is looking the detention watch and doing continuous advocacy on the cases of detention. 2) A new blogspot www.petition-nhrc.blogspot.com was created for the posting of petition sent to National Human Rights Commission. Continuous doing petition on the media coverage of the violation related to civil & political rights with focus social and Economic rights. Dr. Mohan Lal Panda is sending the petition to NHRC. Which result NHRC issued notice to more than 7 chief Secretary of the states. 3) Dr. Lenin Raghuvanshi, Ms. Shruti Nagvanshi & Dr. Mohan Lal Panda met with the Mr. Surinder Singh Oberoi, Advisor, International Committee for Red Cross, Dr. P.L Punia Chairperson, National Schedule Caste Commission and Mr. Anil Parashar, Joint Registrar & Focal Point, Human Rights defenders, National Human Rights Commission in New Delhi.

Dr. Lenin Raghuvanshi & Dr. Mohanlal Panda visited Manipur for making a plan for two years intervention in leadership of Wide Angel and also met with other organizations for the subscription of NATT. They also discussed with Ms. Renuka Srinivasan, Project Manager (Human Rights), Delegation of European Union to India. Which result Testimonial Therapy for rehabilitation topic is included in Capacity Building Workshop for EIDHR projects August, 2011. 5). Supervision meeting

The three days supervision with of the model block staffs held in Tanda block of Ambedkar Nagar district from 6 th 8th June, 2011. The meeting was attended by Dr. Lenin, Shirin Shabana Khan, Upendra Kumar & Model Block staffs. Topic: 1. 2. 3. 4. 5. 6. 7. 8. 1. Team building/team work a). Field Visit: to develop the peer group support the field visit in the presence of Model Block Manager visited the, Chintaura, Mubarakpur, Ahladadpur villages of Tanda Block of Ambedkar Nagar district and participated in the folk school through street play. The street plays were focussed on the issue of TOV and also on the few testimonies such as Ram Kripal, a survivor of displacement, Hazra Khatun, health negligence. During the folk school three survivors were honoured.

b). Group work: The staffs were divided in the group of two preparing the observatory report of the folk school cum street play. 2. Testimony & Meta Legal Advocacy The staffs were again asked to focus on the testimony and to re-check before submitting the testimony & M&E questionnaire. For the advocacy purpose please ensure the testimony contain basic information such as complete address of the survivors etc. Also keep the mobile number of survivor in M&E for any emergency contact. The 17 survivors of displacement were psychologically supported through testimonial therapy. 3. Capacity of community leaders: Capacity building of community leader on the issue of D.V Act, SC/St Act & D.K Basu guideline at block level. It was also planned to organize state level meeting. 4. Folk school: It was decided in the meeting to organize a big folk school in all four model blocks in the month of July August. The minutes and the outcome of the folk school should be used for the advocacy. 5. Six month experience in the field highlighting positive and negative: The staffs were divided according to the block wise to highlight the positive and negative consequence faced during six month in field. 6. Planning for the celebration of 26th June The field staffs were informed to prepare the petition in the name of concerned commission and also to confirm the people participation and expense to Manager Model Block before 15th June. 7. Discussion on Monitoring and Evaluation questionnaire: After discussion few more basic question were added in the M&E questionnaire for smooth tracking such as Place of testimony taken: workshop/model block/office/other
