Nik Sapeia takes oath of innocence on Quran

Introduction Recently, Malaysia has seen it first case of attack on our respected former prime minister Tun Dr. Mahathir Mohamad. The man in accused of the attack, Nik Sapeia was found guilty of causing hurt by spraying dangerous substance for people including Tun. Once he was found guilty by the civil court, he took an oath of innocence on Quran to defend himself. I am doing it of my own free will after getting advice from the religious people. In Islam, this sumpah qazaf (swearing on the Quran) is made after one has been sentenced (by the court) to prove his innocence. (Nik Sapeia, 2010)1 The issue here is the use and misuse of taking oath on Quran. Firstly, he wants to take an oath on Quran but he was using qazaf, which is used on an accused of fornication and adultery. Secondly, he was already found guilty but yet he still wants to take an oath upon Quran to appear not guilty. So, this report is to further acknowledge people about the types and the consequences of misuse of oath in life. Prophet Muhammad SAW said:

Definition

Oath in Arabic is al-Aiman (

) which is the plural for the word al-Yamin (

).

Technically, the meaning of the word is hand because usually the Arabs would raise their right hands when they are taking their oath.2 They too, would beat their right hands with the right hands of people who are taking their oath. 3 Literally, it means to strengthen the subject of oath by coming up with a specific undeniable trusted proof.4 Generally, an oath is to swear by one of the Names of Allah or one of His Attributes to prove the correctness of something affirmatively or negatively, or to urge doing something or leaving it.5 Whoever makes an oath and breaks his oath should expiate for that by one of the following three forms of expiations: to feed ten needy persons or to clothe them or to free a person from slavery. If the person is unable does any of the above expiation, he should then fast for three days.6
