Hours Of Employment Regulations

Now known as Railway Servants ( Hours of Work and Period of Rest) Rules 2005 w.e.from 28-02-2005. HOER will apply to all non-gazetted railway servants including Casual Labour and substitutes, except those governed under Factories act, the Mines act, Minimum wages act and Merchants Shipping act. All Railway servants governed by the HOUR are presumed to be under Continuous classification unless they are declared to be otherwise by the prescribed authority. Classification of an employment cannot be of permanent nature. The changes takes due to increase or decrease of workload either for fluctuations in Traffic, or changes in time table or for other causes may arise for change of classification of an employment. The question may be raised by Administration itself or by (1) individual Rly employee, (2) recognized Trade Union, (3) Labour Enforcement Officer of the Labour Department of India. The workload of an employment may be assessed by conducting factual job analysis. Classification: (1) Intensive, (2) Essentially Intermittent, (3) Excluded, (4) Continuous.

(1) Intensive: The employment of a railway servant is said to be intensive when it has been declared to be so by the prescribed authority on the ground that it is of strenuous nature including hard manual labour with little or no period of relaxation. Eg: Telephone operators, section Controllers etc (2) Essentially Intermittent: . Daily hours of duty of a Rly servant normally include periods of inaction aggregating 6 hours or more ( including at least one such period of not less than one hour or two periods of not less than half an hour each) during which the Rly servant may be on duty but not called upon to display either physical activity or sustained attention. Eg: C class gate man, care takers of rest houses, attendants, bungalow peons etc. (3)Excluded: a) Staff employed in confidential capacity,b) Armed guards, c) Staff of Rly School imparting technical training or academic education, d) staff classified as supervisory, e) such staff of health and Medical department as may be specified by the prescribed authority etc.

(4) Continuous : staff who are not classified as intensive, essentiallyintermittent or excluded are continuous. Eg: Non supervisory clerks, Guards, drivers, ASMs Parcel clerks, etc. Classification Intensive Continuous E.I For workers not required Prep/Complementary work 42 hrs in a week 48 hours in a week 48 + 24 hrs when provided with quarters within 0.5 km from the work spot. And others 12 hrs extra For workers required to do Prep/Complementary work 42+ 3 Hrs for Prep/Complementary work 48 + max 6 Hrs for Prep/Complementary work 48 + 24 hrs when provided with quarters within 0.5 km from the work spot. And others 12 hrs extra 3hrs and 4 hrs Prep/Complementary work Short off: Short off means a short period of rest between the ends of one rostered duty and the beginning of the following fostered duty. It is a period of rest where it is less than 12 hrs in a roster of 6 hrs, 14 hrs in case of mixed roaster of 6hrs & 8 hrs, 10 hrs in case of continuous workers and less than 8 hrs in the case of EI classification. Long on : long on is a period of duty (excusive of period or periods of break) for long hours and spread over 8 hrs in the case of intensive , over 10 hrs for continuous and over 12 hrs for EI workers. Split shift: It means a shift, which is punctuated with intervals. During interval the employee is free to leave the work spot. Split of duty should not exceed three in all with the number of intervals being two. Any interval of less than half an hour should be treated as duty. Spread over: It is a period that includes spells of duty and periods of intervals. As far as possible, the spread over should not exceed 16 hrs, provided, the rest between 22 hrs and 6 hrs is not broken. It should be limited to 14 hrs if the rest between 22hrs to 6 hrs is broken.

( RBE 158/2008) Child Care Leave : Women employees having minor children may be granted child care leave for 2 years during the entire service. Paternity leave : a male employee including an apprentice with less than 2 surviving children are eligible for 15 days Paternity leave. Can be availed 15 days in advance or within 6 months of delivery. Refund the cost incurred by govt months in entire carrier. if quits within 3 years. The period spent on study leave shall be counted for earning both LAP & LHAP. (RBE 1/2011 dated 04-01-2011)
