Gunters Landing Lagoon

Dear Mr. Kennamer,
The Department has completed a comprehensive evaluation of Gunters Landing
Lagoon in an effort to determine its compliance with applicable rules and
provisions of the National Pollutant Discharge Elimination System (NPDES),
ADEM Admin Code r. 335-6-6, and NPDES Permit No. AL0049719. This
evaluation is based on all available inspection and sampling data, discharge
monitoring reports, and other self-reported compliance information for the
period between January 2009 and January 2011. The Department observed the
following violations:
Permit condition LA requires that discharges be limited and monitored as
specified in the Permit. The discharge monitoring report for the monitoring
period listed in the table below indicates that discharges from outfall 0011 did
not comply with the permit limitations for E. coli, BOD and TSS % Removal,
BOD, and Fecal. A complete list of exceedances is listed in the table below:

Removal Average
Permit Condition I.C.2.b requires that a noncompliance notification report be
submitted to the Department should a discharge not comply with any limitation
of the permit. Noncompliance notification reports are to be submitted to the
Department with the next discharge monitoring report after becoming aware of
the noncompliance. As of the date of this letter, the Department has not
received the noncompliance notification(s) for the violation(s) listed above.

Permit condition l.C.1 requires that monitoring be submitted on a monthly
basis. The discharge monitoring report for the monitoring period of June 2010
indicates that the parameters listed in the table below were not submitted:

This notice of violation is made pursuant to Ala. Code 22-22-9(e) (2006 Rplc.
Vol.). All missing DMR data, noncompliance notification forms, and a written
report prepared by an engineer registered and authorized to practice in Alabama
describing the steps that have been taken to correct these violations must be
submitted to the Department such that they are received within 30 days from
the date of receipt of this notice. This submittal must be mailed or delivered to
Brittny Hooton at the Montgomery address listed above and must arrive at the
Department's Montgomery Office by the required submittal date. Failure to
submit the document(s) required by this notice is a violation of Ala. Code 22
22-9(c) (2006 Rplc. Vol.) and ADEM Admin. Code r. 335-6-6-.12(h) for which
civil penalties or criminal fines may be imposed.
Please be advised that the Department now offers electronic DMR submission
through our Electronic Environmental DMR Reporting System Program (E2
Program). The E2 Program allows the Permittee the convenience of submitting
electronic DMRs (eDMRs) and allows the Department the ability to electronically
validate the data and acknowledge receipt. In addition, the E2 Program saves
both the Permittee and the Department from expenses and wastes related to
paper-based DMRs. Details of the E2 Program are available on the
Department's website at http://www.adem.state.al.us/.
The Department encourages you to voluntarily consider pollution prevention
strategies to resolve these present and prevent potential future violations.
