INTERVENOR-DEFENDANT THE BIPARTISAN LEGAL ADVISORY GROUP OF THE UNITED STATES HOUSE OF REPRESENTATIVES MOTION TO STRIKE PLAINTIFFS SEPARATE STATEMENT OF NON-ADJUDICATIVE FACTS For the reasons stated in the Memorandum of Law filed herewith, Intervenor-Defendant the Bipartisan Legal Advisory Group of the United States House of Representatives (the House) respectfully moves that the Court strike the Separate Statement of Non-Adjudicative Facts (July 15, 2011) (ECF No. 62), submitted by Plaintiffs in support of their motion for summary judgment, as unsupported by any procedural rule and as an improper attempt to circumvent the page limitations on Plaintiffs memorandum in support of their motion. In the alternative, to the extent a response is deemed necessary, the House disputes Plaintiffs statements of non-adjudicative facts, as further set forth in the Houses opposition to Plaintiffs motion for summary judgment. See Mem. of Law in Oppn to Pls. Mot. for Summ J. (Aug. 15, 2011) (ECF No. 82). A proposed Order is submitted herewith and oral argument is not requested.
