Council's Responsibilities 23. The Council will arrange for the cutting of the grass throughout the growing sessonand provide the 1op soil for filling in the holes or divots in the playing surface. However, it is the responsibility ofthe hirer to fill the holes and divots. 24. The council will provide the mnterials for use with its line marken However, it is the responsibility ofthe hirer to mark the lines. 25. The Council shall not be liable for the death or injury to, or damage to, or any expensesor other liability incurred by the hirer or any person in the exercise of this agreement. 26, 'I'he Council gives no warranty that the pitch is legally or physically fit for any specific purpose 27. The Council or its Sub-Committee shall be the sole judge as to the fitness of the grounds for play. 28 Council or its Sub-Committee resenes the right to close, without previous notice, ony ground unfit for the play owing to westher or othr conditions. 29. The Council or its Sub-Committe will make every effort to permit the playing of cancelled matches Bt weekends or in the venings, without obligation to refund any fees or guarantee the playing ofthse matches. 30, The Council will notify clubs of pitch closure via phone or email to the club secretary in the lint instance, and it is therefore essential that at least one email address is supplied with the application. Other conditions 31. This agreement shall determine immediately on notice serued by the Council at any time following any breach of this agreement. The decision of the Council is final. 32. Clubs found to be in breach of any terms and conditions of hire are liable to suspensionby the Council. The decision ofthe Council shall be final. Refunds will not be payable ifsuspended and the total hire fee will be charged as in condition 8(a). J3. Any variation ofthis agreement must be made in writing between the parties. 34. General L The pitches available for hire are situatedat: Althorne Recreation Ground, Summerhill. 2. Application forms for occasionalbookings will be forwarded to clnb secretaries upon request.All applications rvill be date stamped on their return to the clerk's office and pitches will be allocated in strict order ofreceipt and taking into accourt any previous payrnent record. Preferencefor the use ofCouncil pitches will be given to teams wrth playing mernberswho reside withrn the Parish of Althorne; applicants for pitches must make a signed declafation to this effect. Pitches not allocated to teans with Althome olavers will be allocated to nonresident teams. 4. Preferenceis given tojunior matchesplayed on Saturday momings and Sunday tnornings, and adult matchesplayed on Saturday afternoons md Sunday afternoons. Allocations will be advised by post or e-mail. Al acceptarce fonn u,ill be enclosed, which will require signing and returning to the Clert to the Parish Council. Please note: If after signing and returning the form, the hirer decides not to utilise the pitch, the hirer will remain liable for payment unless the Council is able to rc-allocate the pitch. Usage 6. To maintain a reasonable surface, pitches will only be allocated two matches each weekend and occasional midweek games, at the discretion ofthe Council or its Sub-Committee. The se6on extends from the fust Saturday in September to the last Smday in April. The season may be extnded at the discretion ofthe Council or its SubComrnittee iftoo many fixtures have had to be cancelled due to bad weather and state oftbe pitches dunng the playilg season.
