GUIDELINES

These Guidelines provide general advice and guidance on the use of OGCs Trade Marks and Crown Copyright (as defined in the Licence Agreement) and should be used in conjunction with the terms and conditions of the Licence Agreement. These Guidelines do not constitute legal advice and any organisation or person using these guidelines should seek their own legal advice. Please note that laws relating to Intellectual Property may vary from country to country. OGC and APM Group (APMG) do not accept any liability for any loss or damage arising out of reliance placed by any organisation or person upon these Guidelines. OGC has invested in the development and protection of its Trade Marks and Copyright and reserves all rights of ownership.
1. OGC LOGO

The list of trade marks, which are available through the scheme, are shown in Annex A and the logos in Annex B. The Licence Agreement you sign will contain the specific details of which trade marks and logos you have been licensed to use. For the avoidance of doubt the Licence Agreement does not grant you any right to use the Office of Government Commerce logos (the OGC logos) in any way. 2. USE OF TRADE MARKS 2.1 General (a) The Office of Government Commerce (OGC) limits the use of its Trade Marks to persons and organisations who have signed a Trade Mark (and Crown Copyright) Licence Agreement with APMG and have complied with the requirements of the applicable quality control or other checks as appropriate. In order to obtain permission to use the Trade Marks, or if you wish to use the trade marks in any way other than as detailed in the Licence Agreement then please contact the IPR Co-ordinator at APMG. 2.2 Displaying the Trade Marks (a) The Trade Marks must always be shown in their complete state as detailed in the schedules to the Licence Agreement and may not be amended or altered in any way without the permission of APMG. APMG will provide you with the appropriate digital artwork, which should be used when reproducing the logo Trade Marks onto your Product and materials. Whenever the Trade Marks are used there must be suitable space around them so that the Trade Mark is clearly distinguishable from any other trade marks, signs or text. The Trade Marks must not be used in a misleading way or to suggest ownership by another company or brand and must be clearly subordinate to the company and product identity.

Where the Trade Mark is a word mark (e.g. PRINCE2) and it is being used within the title of your Product or material, the Trade Mark cannot be used on its own and must be used next to other normal dictionary words within normal spacing, in its correct form and with the

correct symbology, (e.g. A Project Managers Guide to PRINCE2). The Trade Mark must not be used next to company, product names or trade marks of other organisations. (d) There must be suitable clear space around the Trade Mark, so that it can be clearly identified from any surrounding text, shapes or other trade marks. It should be clear exactly what constitutes the Trade Mark and what is merely surrounding wording or shapes (e.g. the Trade Marks cannot be placed inside another design like a box where that is not part of the existing design of the Trade Mark). 2.3 Colours (a) Where a Trade Mark is a word mark, the colour of the Trade Mark should be the same colour as the associated text (e.g. in a book title the Trade Mark should appear in the same colour as the rest of the title). Where a Trade Mark is a logo (this applies to the Endorsement Mark, the Licensed Product Mark and the Process compliant mark attached at Annex A), the following rules shall apply: The Endorsement Mark should be used in black lettering and design, where this is not practical it can be used in white lettering and design. The Endorsement Mark can be placed on any colour background provided that it's a solid, one colour background and the background colour may be seen through the mark. The Licensed Product Mark and the Process Compliant Mark should be used in black lettering and design, where this is not practical it can be used in white lettering and design. The Licensed Product Mark and the Process Compliant Mark can be placed on any colour background provided that it's a solid, one colour background and the background colour may be seen through the mark. The colour of the swirl must be either in the appropriate colour as detailed below or where this is not possible in black and white. The appropriate colours for the swirls are as follows: ITIL swirl: Pantone 1945 PRINCE2 swirl: Pantone 7447 MSP swirl: Pantone 7467 M_o_R swirl: Pantone 316 P3O swirl: Pantone 7449 P3M3 swirl: Pantone 3252 MoV swirl: Pantone 7526 MoP swirl: Pantone 541 (c) Where it is not possible to obtain an exact colour match on different types of paper or material, the colour reproduction should match as near as possible the original provided to you - if you need to colour match the swirl colour you should provide APMG with an example and obtain their written approval prior to use. 2.4 Size & fonts (a) Where the Trade Mark is a word mark, the Trade Mark should be used in the same size and font as the associated text (e.g. in a book title the Trade Mark should appear in the same size, type and font as the rest of the title). Where the Trade Mark is a logo, the logo(s) will be supplied to you in standard size and may be re-sized according to the needs of your Product and associated material provided that:

The logos are accurately re-sized in proportion to the original so that they do not appear stretched or squashed; and The Endorsement Mark logo is never smaller than 20mm across and is never larger than 60mm across. The Licensed Product Mark logo is never smaller than 20mm across and is never larger than 80mm across. The Process Compliant Mark logo is never smaller than 20mm across and is never larger than 80mm across. If the requirements of your Product are such that you need to make the logos either larger or smaller than these sizes please contact the IPR Co-ordinator at APMG. (c) (d) The font lettering must be as the original artwork provided to you, the fonts used are: The Endorsement Mark uses Arial Black The Licensed Product Mark uses Arial Black The Process Compliant Mark uses Arial Black The size of the Trade Mark should not be unduly disproportionate to any other trade mark or logo displayed on the Product or materials and must not be unduly prominent. In particular the Trade Mark should not be used in such a size that they are significantly more prominent than your own logos or trade marks as this could be misleading to the public. 2.5 Placing and number of uses Provided that you adhere to the conditions detailed in the Displaying the Trade Marks section above you may place the Trade Marks as follows: Any Trade Mark which is a word mark can be used as many times as required on the front and back covers of books, CDs, or other Products Any Trade Mark which is a logo may be placed in any position on the cover of books, CDs or Products and may be used as follows: o Either the Licensed Product Mark, Process Compliant Mark or Endorsement Mark may be displayed once on the front and once on the back cover of books or Products; and, Either the Licensed Product Mark, Process Compliant Mark or Endorsement Mark may be displayed once on the spine of a book or Product only where there is sufficient space to display the logo correctly (see section 2.4 above regarding size of logo).

Any Trade Mark which is a logo can be placed in any position on electronic Products and may be used as follows:

Either the Licensed Product Mark, Process Compliant Mark or Endorsement Mark may be displayed once on the front and once on the back cover of the Product packaging; Either the Licensed Product Mark, Process Compliant Mark or Endorsement Mark may be displayed once on the Product itself; and Either the Licensed Product Mark, Process Compliant Mark or Endorsement Mark may be displayed and also once within the electronic Product itself.

Any Trade Mark which is a logo may only be used once on a webpage. The same logo should not be replicated throughout that page. Trade Mark symbology The appropriate Trade Mark symbol must appear next to the Trade Mark on the first occurrence within any document (e.g. or ). If your document is a web document, the symbol must be placed on the first occurrence of the Trade Mark on each web page where it is shown. On any subsequent use of the Trade Mark within that document there is no need to use the symbol, but you may do so if you wish. Acknowledgement statements The appropriate acknowledgement statements (as detailed within the schedules to the Licence) must be used. The acknowledgement statements should be placed in a logical position on the Product or any associated material and should be in the same size as that of any other acknowledgement statements. For web based documents, the acknowledgement statements must appear either on the bottom of the page where a Trade Mark is used or be incorporated into a central acknowledgements page, accessible via a link displayed on the page where the Trade Mark occurs. 2.6 Endorsement Mark (a) The Endorsement Mark shall only be placed on a Product which has passed the Product Review. The Endorsement Mark shall not be available where: (b) Your Product contains an insignificant amount of material. It shall be entirely at the discretion of APMG whether this applies to your Product; If your product incorporates software which has not passed a usability test

Whilst OGC has satisfied itself that the Product is compatible with the requirements of its Trade Mark Licensing Scheme, neither OGC nor APMG shall accept any liability to you or any end user of the Product for any reliance placed by you or any end user upon the Endorsement Mark. If your Product uses the Endorsement Mark the following text must be displayed on your acknowledgements page Use of the OGC Endorsement Mark indicates that this product has been subject to a Product Review by APMG on behalf of OGC only for the purposes of its Trade Mark Licensing Scheme. APMG has not checked the accuracy of the information or its fitness for purpose and neither OGC nor APMG accept any liability for loss or damage arising from reliance placed on any information contained in this product.

Where only part of your Product has been approved to use the Endorsement Mark you should make it clear that the Endorsement Mark solely applies to that part of the Product or material and not for any other parts. We suggest you use the following statement in these cases: The endorsement mark only relates to the specific [insert relevant Trade Mark] content that has been reviewed and does not extend to the rest of the Product that has not been reviewed by APMG as part of their independent review 2.7 The Process Compliant Mark Wherever the Process Compliant Mark is shown it must be accompanied by a statement detailing the processes that have been reviewed and are compliant.

Marketing and promotional material (a) The Trade Marks must be used solely in accordance with the Licence Agreement and for the purpose of promoting the Product or materials to which the Licence Agreement applies. The Trade Marks must not be used to advertise your other Products or services and there must be a clear distinction and separation between the marketing material for the Product or materials to which the Licence has been obtained and other goods or services offered by you. When used on your website the Trade Marks cannot be used on pages that have no reference to the licensed Product and it must be clear that the Trade Marks are being used solely in connection with the licensed Product. The Trade Marks must not be used as a hyperlink. 3. USE OF COPYRIGHT (if appropriate) 3.1 Crown Copyright Text (a) Any text taken directly from an OGC publication or other OGC source must identify the source from which it was taken and the Crown copyright acknowledgement statement must also be included.

How to acknowledge the source This can be done in a number of ways and will depend largely on what suits each individual Product. Some examples are: A symbol, different colour/font and/or italics can be used to distinguish OGC text Quotation marks/inverted commas can be used around OGC text A small comment can be written after OGC text, e.g., This is the first process in PRINCE2. It is a pre-project process, designed to ensure that the prerequisites for initiating a project are in place. The process expects the existence of

a Project Mandate that defines in high-level terms the reason for the project and what product is required. (source Managing Successful Projects with PRINCE2 was produced by OGC). Alternatively inclusion of a page reference relating to where the quote can be found within the original source is also acceptable. (c) Crown Copyright statement The Product must include the following copyright statement: " Crown copyright material is reproduced with the permission of the Controller of HMSO and Queens Printer for Scotland Again this can be done in a number of ways and will depend largely on what suits each individual Product. You may include the copyright statement after each use of the text or alternatively where numerous amounts of text have been re-used you may wish to differentiate the text from other text and reference it back to the copyright statement, for example by: A symbol, different colour, different font, italics, etc Encapsulating within a text box Quotation marks or inverted commas around the Crown copyright text. It should be clear which differentiation method has been used at the beginning of the Product. 3.2 Crown Copyright Diagrams (a) Acknowledging the source Any diagram or table taken directly from an OGC publication or other OGC source must always include the source acknowledgement e.g. (source Managing Successful Projects with PRINCE2 was produced by OGC). Crown copyright statement As with the use of text, the Crown copyright statement can be included alongside the source acknowledgement or referenced back to a separate section, for example within a list of all diagrams and tables.

ANNEX A TRADE MARKS Your Licence Agreement will detail which Trade Marks you are entitled to use for the Licensed Product. The Trade Marks must be accompanied by the following symbology and acknowledgement statements. TRADE MARKS ITIL PRINCE2 MSP M_o_R P3O P3M3 MoV MoP TRADE MARK ACKNOWEDGEMENT STATEMENTS ITIL is a Registered Trade Mark of the Office of Government Commerce in the United Kingdom and other countries PRINCE2 is a Registered Trade Mark of the Office of Government Commerce in the United Kingdom and other countries MSP is a Registered Trade Mark of the Office of Government Commerce in the United Kingdom and other countries M_o_R is a Registered Trade Mark of the Office of Government Commerce in the United Kingdom and other countries P3O is a Registered Trade Mark of the Office of Government Commerce P3M3 is a Registered Trade Mark of the Office of Government in the United Kingdom and other countries MoV is a Trade Mark of the Office of Government Commerce in the United Kingdom and other countries MoP is a Trade Mark of the Office of Government Commerce in the United Kingdom and other countries

ANNEX B - LOGOS Your Licence Agreement will detail which Trade Mark logos you are entitled to use for the Licensed Product. Please see below on how to use the logos. Licensed Product Mark: These Trade Mark logos are available to applicants whose products have completed the Trade Mark or Trade Mark and Copyright Licensing Scheme. Only the appropriate logo as detailed within your licence may be reproduced.

These logos must be used in conjunction with the following acknowledgement statements: The Swirl logo is a Trade Mark of the Office of Government Commerce [PRINCE2 /ITIL] is a Registered Trade Mark of the Office of Government Commerce in the United Kingdom and other countries Endorsement Mark: These Trade Mark logos are available to applicants whose product has been endorsed via the APMG Endorsement Scheme. Only the appropriate logo as detailed within your licence may be reproduced.

The [PRINCE2/ITIL] endorsement logo is a Trade Mark of the Office of Government Commerce

Process Compliant Mark: These Trade Mark logos are available to applicants who have endorsed software tools via the ITIL Software Scheme. Only the appropriate logo as detailed within your licence may be reproduced.

These logos must be used in conjunction with the following acknowledgement statements: The Swirl logo is a Trade Mark of the Office of Government Commerce ITIL is a Registered Trade Mark of the Office of Government Commerce in the United Kingdom and other countries Wherever the Process Compliant Mark is shown it must be accompanied by a statement detailing the processes that have been reviewed and are compliant. The processes must be listed wherever the Process Compliant logo is used. Therefore, if using the logo on the front of a package they should be listed alongside the logo or be listed on the back alongside other information. If the logo is used on any marketing material, the processes should be listed on the same page/stand etc. All listings should be clear and legible.
