10 years later, assessing impact of attacks on rights of same-sex couples

By LOU CHIBBARO JR. lchibbaro@washblade.com Ross Levi, executive director of New Yorks LGBT advocacy group Empire State Pride Agenda, worked in the groups lower Manhattan ofce in a different staff position at the time of the Sept. 11, 2001 terrorist attack on the World Trade Center. In what he describes as the rst horrifying hours following the crash of two hijacked jetliners into both World Trade Center towers, causing them to collapse, Levi said the ESPA staff joined other New Yorkers in helping survivors and victims any way they could. We opened the doors to our ofces, which were on 12th Street at the time, to people as they were eeing the World Trade Center site and coming downtown, he said. Many of them came right by our ofces and so people were coming in just to use the bathroom and get some water and make phone calls, he said. And in that way we were just a member of the New York family that had to go through this horrible event, Levi said. But Levi and other LGBT activists observing the Sept. 11 events as they unfolded said they quickly discovered within a week of the attacks that same-sex partners of those killed, injured or missing in the World Trade Center collapse faced additional hurdles in obtaining government and private sector assistance. He said ESPA rst became aware that same-sex partner survivors were being treated differently when the city and private relief agencies like the Red Cross set up an emergency station on a pier along New Yorks Hudson River where people could go to nd a family member missing and as yet unaccounted for in the World Trade Center carnage. Literally [gay] people had to go there, turn around, go back home and get some paperwork that spouses didnt have to get to prove a relationship existed, Levi said. You were nervous and scared and sad and then you had to go through that. And worse, other people turned them away, even with the paperwork, saying sorry youre not a family according to our guidelines. Activists reecting on the Sept. 11 tragedy this week said

Cop remains in jail after shooting trans women

Judge says ofcer poses danger to the public
By LOU CHIBBARO JR. lchibbaro@washblade.com
A D.C. Superior Court judge on Sept. 2 ruled that prosecutors established probable cause that an off-duty D.C. police ofcer committed an assault with a dangerous weapon for allegedly ring a pistol at three transgender women and two male friends during an Aug. 26 incident in Northwest Washington. Judge Ann ORegan Keary ordered Ofcer Kenneth Furr, a 21-year veteran of the force, held without bond pending his trial. Keary said evidence presented by police and prosecutors showed that releasing the ofcer would pose a danger to the community. The judges ruling came during a preliminary hearing in which First District police Det. James Freeman provided detailed testimony about his investigation of the incident. Freeman testied that the victims and at least two D.C. police ofcers who were in the vicinity of the shooting reported that Furr stood on the hood of a car in which the victims were sitting and red at them through the windshield. He said witnesses and the victims reported that the incident began about 4:40 a.m. at a CVS drug store at 400 Massachusetts Ave., N.W., when Furr and one of the shooting victims reportedly got

into a verbal altercation. Transgender activist Jeri Hughes said one of the transgender women involved in the incident told her that the verbal altercation inside the CVS store started when Furr approached one of the transgender women and invited her to engage in sex. Furr reportedly became angry when she turned him down, Hughes said, prompting the womans male friend to exchange words with Furr in an effort to get him to leave the woman alone. Freeman testied that Furr and the same person who argued with Furr inside the CVS store exchanged words outside

the store a short time later while Furr was sitting in his car parked nearby. According to Freeman, Furr reportedly retrieved a handgun from the glove compartment of his car, pointed it at the person and threatened to shoot the person, who is believed to be one of the male friends of the trans women. The same person returned to the CVS store and told a security guard that Furr had threatened him with a gun, a police afdavit says. The victim then met up with the other four people, including the three transgender women, and all ve got into one of their cars and followed Furr, who

drove away in his car, Freeman testied. When both cars reached the intersection of First and Pierce streets, N.W., Furr jumped out of his car and began to shoot at the car where the ve others were riding, Freeman told the court hearing. The shooting prompted the driver to crouch down to avoid being hit, causing the car he was driving to collide with Furrs car, Freeman said. Thats when Furr apparently climbed on the hood of the other car and red his gun through the windshield, the victims and police witnesses reported.

Lanier meets again with LGBT activists

Reinstates former GLLU supervisor after string of hate crimes
By LOU CHIBBARO JR. lchibbaro@washblade.com
D.C. Police Chief Cathy Lanier disclosed in an Aug. 31 meeting with LGBT activists that she has reinstated a popular police captain as head of the departments Special Liaison Division, which oversees the Gay and Lesbian Liaison Unit (GLLU). Laniers action comes four months after she drew criticism from activists and rank and le ofcers for replacing Capt. Edward Delgado as head of the liaison division with a civilian police ofcial who had little experience in crime-ghting activity. The chiefs appointment in May of Enrique Rivera, who specialized in internal administrative and policy matters, as Delgados replacement was viewed by some department insiders as a signal that she was diminishing the inuence of the liaison units, including the GLLU. Lanier denied those claims, saying Rivera would provide strong leadership to the division. Her announcement that Rivera was retiring from the department and Delgado would return to head the SLD was warmly received at her meeting last week with representatives of several local LGBT organizations, according to gay activist Peter Rosenstein, who attended the meeting. The meeting marked the third time Lanier has met with representatives of the LGBT community since Aug. 4, when she met with ofcials of Gays and Lesbians Opposing Violence (GLOV). That meeting followed a widely publicized incident in which D.C. police ofcers refused to take a report of an assault against ve lesbians in the citys Columbia Heights neighborhood by two men who shouted anti-gay names at the women. Lanier said the conduct of the ofcers was under investigation and told GLOV ofcials the ofcers could be red depending on the ndings of the investigation. The meeting on Wednesday came less than a week after an off-duty D.C. police ofcer was arrested for ring a handgun at three transgender women and two male friends who were sitting in a car at First and Pierce streets, N.W. One month earlier, a transgender woman was shot to death in Northeast D.C., with activists expressing concern that police took too long to alert the LGBT community about the incident. I genuinely believe Chief Lanier and all of her senior leadership team are sensitive to and concerned about problems with the LGBT community, said Aisha MoodyMills, a D.C. lesbian activist who attended last weeks meeting. But Im still extremely concerned that their values are not trickling down to the patrol ofcers on the street, Moody-Mills said. Theres a disconnect there, and Im not sure how the chief will address this. Rosenstein said he was optimistic that Lanier was taking steps to address a number of police related issues that have troubled the LGBT community over the past few years. Jeffrey Richardson, director of the Mayor Vincent Grays Ofce of GLBT Affairs, who organized the meeting with Lanier at Grays request, said he, too, was optimistic over Laniers efforts to address the LGBT-police related issues troubling the community. This was an opportunity to bring other people into the discussion with the chief, said Richardson. Rosenstein said Lanier, among other things, told those attending the meeting she would ensure that ofcers check off on police crime reporting forms that a crime is a hate crime whenever the victim indicates he or she was a target of hate violence. This section of the crime report will now require a mandatory check-off rather than the choice to check it off or not. Then the appropriate police investigator can make a nal determination as to whether the incident is a hate crime based on the legal denition, Rosenstein reported Lanier as saying. He said she also admitted that the GLLU is not at the full complement of seven members and a full-time sergeant since two of the people assigned are merely passing through the unit for 30-day stints for training. She said she would consider advertising for a sergeant but could not commit to that now due to a department wide reduction of police personnel related to budget reductions.

Ryan White funding delays resolved for AIDS groups

Baltimore reduced client services; Whitman-Walker weathered crisis
By LOU CHIBBARO JR. lchibbaro@washblade.com
A delay in the disbursement of federal Ryan White AIDS funds earlier this year that forced some community-based groups to reduce their services to people with HIV and AIDS appears to be resolved, according to ofcials with Baltimore and D.C. groups hit hard by the funding delays. Tom Bonderenko, executive director of Moveable Feast, a group that provides meals for homebound people with HIV/ AIDS in the Baltimore area, said his group hopes to resume full services to about 370 of its 1,200 clients that faced meal delivery cutbacks due to the funding delays. On this past Friday we did receive a reimbursement from the Baltimore City Health Department for some of our outstanding reimbursable funds, he said on Wednesday. Although we are still in a decrease service scenario for our clients, that will be adjusted in the next few weeks. Moveable Feast was among hundreds of community-based AIDS service organizations throughout the country adversely affected by federal AIDS funding delays initially caused by Congress taking far longer than usual to approve the federal budget for scal year 2011. The city health departments in D.C. and Baltimore, which normally receive the Ryan White AIDS funds and pass them on to the community groups, reduced their previously approved grants to these

Police Log
The following incidents were reported by the D.C. Metropolitan Police Departments Gay & Lesbian Liaison Unit:

On Sept. 5, while in the 1900 block of Minnesota Avenue, S.E., a man reported that he was approached by two black males who began to call him homophobic epithets. Complainant then advised that he ignored the suspects who were on bikes, at some point Suspect-1 got off his bike and punched Complainant in the face, suspect two approached from behind and punched complainant as well. Suspect one took complainants property. Both suspects ed on bikes. On Sept. 5, at 3:30 a.m. in the 2200 block of Chaplain Street, N.W., a man reported that he and a suspect had a verbal dispute over their relationship. Complainant reports that the suspect then became upset and struck him in the face with a closed st. On Sept. 5, at approximately 4:20 p.m. in the 5000 block of B Street, S.E., a woman reported that she and her girlfriend were involved in a verbal argument that escalated into a physical assault. The suspect choked and then struck the woman with a broom. The suspect was arrested at the scene. Complainant was provided government and non-government resource agency information. On Sept. 2, members of the First District requested assistance at 4th and K streets, N.W., in reference to a notice of infraction issued on a member of the GLBT community for a pedestrian violation. The pedestrian was advised of the reason for the issuance of the ticket as well as the options available to contest the ticket. On Sept. 2, members of the First District requested assistance at 1st and K streets, N.W., in reference to an arrest made of a member of the GLBT community. The citizen was stopped and issued a notice of infraction for a pedestrian violation. A background check revealed that the citizen had an outstanding bench warrant for her arrest. The suspect was arrested and transported to the district for processing. On Sept. 2, in the 1500 block of Butler Street, S.E, a woman reported that her domestic partner assaulted her by choking her and slammed her against the wall. Suspect was arrested and taken to the district for processing. On Sept. 2, in the 1600 block of Argonne Place, N.W., a citizen contacted police because earlier in the day he had a verbal altercation with his neighbor. The neighbor thought the complainant knocked on his door. The neighbor used homophobic epithets against the complainant. The complainant walked away with no further incident.

groups earlier this year when they could not determine when the federal funds would be disbursed. D.C.s Whitman-Walker Health and the D.C. group Metro Teen AIDS were among the groups encountering problems from the funding delays. According to ofcials with AIDS organizations affected by the delays, including Whitman-Walker Health, a miscalculation in Ryan White funding allocations for various cities and states by the federal agency that disburses federal AIDS funds created further delays. The U.S. Department of Health and Human Services Health Resources and Service Administration (HRSA) acknowledged last month that the delays could adversely impact as many as 500,000 people with HIV and AIDS throughout the country. HRSA spokesperson Marty Cramer told the Blade Wednesday the funding calculation problem has been resolved and HRSA is now forwarding the federal funds to cities and states, including D.C. and Baltimore. The situation is resolved, he said. The funding is out. Bonderenko said the funding delays forced his organization to reduce the number of meals it provides to its clients. Last week, he said he was hopeful but uncertain that HRSA would soon disburse the funds to the Baltimore City Department of Health, which, in turn, would reimburse Moveable Feast for services it has provided to AIDS patients under a city contract. Basically, we are out of money, Bonderenko told the Blade last week. We wont be able to assist 370 clients who depend on our service for their meals. Don Blanchon, executive director of Whitman-Walker Health, said his organization has also faced delays in receiving Ryan White funds for various HIV-related services it provides for lowincome HIV/AIDS patients. Blanchon said internal structural changes that Whitman-Walker made several years ago have enabled it to receive reimbursement for its services from patients eligible for Medicaid and for

private health insurance coverage. We got hit pretty hard, said Blanchon, who noted that the D.C. Health Departments AIDS administration reduced its grants to communitybased AIDS organizations due to the congressional budget delays and HRSA problems. But he said Whitman-Walker now has a diversied funding stream that allowed it to use income from other sources to weather this without having to cut any of its programs or services to its clients. Other organizations dont have those other funding streams and they may be forced to cut back on services to their clients, Blanchon said. Craig Shniderman, executive director of D.C.s Food and Friends, a much larger group than Moveable Feast that provides meals for people with HIV and other serious illnesses in the D.C. area, said that similar to Whitman-Walker, his group was able to absorb the funding delays and continue its services without interruption. During the rst half of the Ryan White grant period (March-August 2011) we experienced a very slight delay in receipt of our D.C. and Maryland Ryan White Funds, Shniderman said. However, this did not impact our ability to provide services insomuch as other funds available to us permitted Food and Friends to avoid any disruption in care, he said. Bonderenko and Blanchon said HRSA ofcials told leaders of AIDS groups like theirs in a telephone conference call in August that it expected to disburse all of the delayed funds in September. They said that during the same call, the HRSA ofcials acknowledged making a miscalculation in the allocation of Ryan White funds to states and cities, requiring them to take more time to recalculate the gures. Bonderenko said Moveable Feast struggled to use its own money to continue its programs while waiting for the federal funds to arrive. We basically have carried the federal government for three months, he said. There are hundreds of providers in this same position.

Calif. Supreme Court hears Prop 8 arguments

Considering whether anti-gay groups have standing to press case
By PHIL REESE preese@washblade.com
The California Supreme Court this week heard oral arguments over whether or not under state law civilian supporters can take the place of the state, specically in the federal case challenging Proposition 8. The hour-long hearing was followed by press conferences in which both sides expressed pleasure in the outcome. The court, however, still has 90 days to come to a decision, and both opponents and supporters of Proposition 8 will be watching closely for any indication that a decision is near. In August of last year, federal Judge Vaughn Walker found unconstitutional Proposition 8, the law barring marriage between two adults of the same sex created after a November 2008 ballot measure, ruling in favor of plaintiffs represented by the American Foundation for Equal Rights. The attorneys leading the charge against the law are former President Bush solicitor general Ted Olson, and former Al Gore lawyer David Boies, who in 2000 faced off in Bush v. Gore. While plaintiffs are seeking to restore marriage equality to California, proponents of the measure are attempting to appeal Judge Walkers ruling. The 9th Circuit Court of Appeals put the case, Perry v. Brown (formerly Perry v. Schwarzenegger) on hold in January after both Gov. Jerry Brown and Attorney General Kamala Harris refused to defend the law in court citing their own constitutional objections. When concerned citizen groups hoping to keep the law on the books attempted to ll in for the state to defend the law, the 9th Circuit asked the California Supreme Court to rule on whether or not the concerned groups can in fact defend the law in place of the state. The legal principle in question is whether the independent group has standing to press the case in place of the state, which has declined to pursue it. Though the Ninth Circuit will make the ultimate decision, the appeals court certied a question to the State Supreme Court of California on whether state law allows proponents of the ballot initiative to represent the state in the appeal in place of the state ofcials themselves. In February, the California Supreme Court agreed to address the 9th Circuits question, which led to this weeks hearing. If the State Supreme Court decides that the interest groups which include a well-funded conservative website called ProtectMarriage.com can indeed take the place of the state in defending the law, the Ninth Circuit is expected to follow the guidance, allowing the case to proceed through the Ninth Circuit despite the lack of involvement of any agents of the state. Likewise, if the California Supreme Court decides against the proponents of Proposition 8, the Ninth Circuit is expected to concur, which will end the appeals process at Judge Walkers decision overturning the law. The Proposition 8 ballot measure was passed in reaction to a decision by the California Supreme Court in 2008 overturning the states ban on same-sex marriages, which allowed roughly 18,000 same-sex couples to marry in California during the short window prior to the election. The Supreme Court has since upheld those marriages as valid, though new marriages cannot be recognized as a consequence of the proposition. The state also passed a law following the passage of Prop 8 that allows the state to recognize same-sex marriages performed outside of California during that same short window. Arguing for the proponents of Prop 8, Charles Cooper said the interest groups would be given standing if this were a state court case, while justices weighed whether or not the same standard ought to apply in this federal matter. Ted Olson, arguing for the plaintiffs, focused on the lack of precedent for such an intervention by an interest group, and claimed nding in favor of the Prop 8 proponents and granting their right to appeal would mean, essentially amending the California Constitution. He also argued that allowing Prop 8 proponents to take the place of the state in the case would set a dangerous precedent undermining the authority of the California Attorney General to make such decisions. Initiative proponents are elected by no one, Olson told the justices, according to Adam Bink of Courage Campaign and Kate Kendell of the Center for Lesbian Rights. Proponents took no oath to represent the people. When asked what the particular interest the proponents of Prop 8 had in continuing to defend the case, Charles Cooper responded to the justices, Our interest is to protect and defend our fundamental right to propose initiatives. We have to defend that. In response, the justices asked, Doesnt that right arise before the initiative is qualied? This court has never recognized any distinction between before and after enactment, Cooper responded. That wouldnt make any sense. What the proponents have a right to do is propose valid constitutional amendments. It is inescapable that they then have the right to defend that measure, before OR after enactment. Olson disagreed. They sure spent a great deal of time and money, and exercised their power to propose and enact. What theyre asking for is the power to represent themselves because of a particularized interest, which they dont have, Olson argued. My understanding of California law and case law is that the legislature doesnt have the

Attorney TED OLSON said hes condent the U.S. Supreme Court will ultimately nd Prop 8 unconstitutional.
WASHINGTON BLADE FILE PHOTO BY MICHAEL KEY

power to defend legislation in court unless it specically deals with the legislative power itself. There is no case, and Cooper agrees there is no case, in which the legislature has the power the proponents are claiming here. I think the initiative power is important, but the constitution of California fundamentally limits the power of the initiative and initiative proponents to exercise their right to propose and defend, thats it. After the hearing, representatives from the American Foundation for Equal Rights expressed condence in the outcome. Good justices ask hard questions, Olson said after the hearing, according to Bink and the Courage Campaign. Olson praised the Supreme Court justices, but emphasized he believes that no matter which direction the Supreme Court decides, the opponents of Prop 8 will prevail. Were sure the U.S. Supreme Court will agree with us, Olson concluded. Jon Davidson, legal director for Lambda Legal, seemed to concur. It is often impossible to predict from the questions asked by appellate judges how they will rule and today was no different, Davidson said in a statement. All of the judges on the California Supreme Court asked probing questions and seemed concerned about the implications of any decision they might make. We continue to hope that the Court will ultimately decide that small groups of unelected individuals who are answerable to no one should not be able to act on behalf of the state. Shannon Minter, legal director of the National Center for Lesbian Rights, who has argued before the California Supreme Court in favor of same-sex marriage, struck a more cautious tone when discussing her reaction to the hearing with veteran LGBT community journalist, Karen Ocamb.

I was concerned by the tenor of many of the justices questions today, Minter told Ocamb. The court has a responsibility to enforce the California Constitution, which gives elected state ofcialsnot private initiative sponsorsthe authority to decide whether to appeal a federal court decision invalidating a state law. Minter continued, Both conservative and progressive elected ofcials have occasionally exercised that discretion in the past by choosing not to expend state resources to defend invalidated measures. Permitting special interest groups to usurp that decision-making authority would dramatically change the current law and take a giant step down the road of turning California into a mobocracy. Minter expressed concern that a decision in favor of the Prop 8 proponents could have far-reaching effects, going beyond just LGBT issues. I was disappointed that, with some notable exceptions, too many of the courts questions today did not address the specic legal questions before them, but rather seemed to glorify the initiative process in the abstract and to abdicate a searching examination of the California Constitution in favor of emotional appeals to the people. The initiative process is already frequently misused to target vulnerable groups, due in part to the Courts past reluctance to enforce any meaningful limits on the process, even when those limits are mandated by the California Constitution, Minter concluded. I sincerely hope the Court does not compound that mistake by now giving initiative proponents an unprecedented new power to step outside of their proper legislative role and usurp the power that our Constitution gives only to elected state ofcials in the executive branch.

Calif. Gov. Brown to sign 2 pro-LGBT bills

SACRAMENTO Two major LGBT bills are headed to Gov. Jerry Browns desk for signature. The rst, Seths Law, is an anti-bullying bill that would establish antiharassment policies and programs at all California schools meeting specic criteria. A second bill would mandate California colleges collect sexual orientation and gender identity data, and designate staff to address the needs of LGBT students on campus, according to Equality California. The law would also require public colleges and universities to include a policy on harassment and intimidation as part of its student code of conduct. Seths Law is named for Seth Walsh, a California teen who hanged himself after being tormented by anti-gay bullying last year. Both bills are expected to be signed into law.

Pentagon to allow gay, lesbian magazine on bases

WASHINGTON According to the Washington Post, OutServe the magazine will go on sale Sept. 20 at U.S. military bases with the Pentagons blessing. The magazine which is targeted specically to enlisted lesbians and gays is published by the gay and lesbian active duty service members organization that launched last year with the help of social networks, like Facebook. The organization boasts nearly 4,000 members.

Mistrial declared in Lawrence King murder trial

LOS ANGELES A mistrial was declared after a jury was unable to reach a verdict in the trial of the 17-year-old teen accused of murdering 15-year-old Lawrence King in February 2008. The heavily scrutinized trial of Brandon McInerney had to be moved to Los Angeles due to the media attention surrounding the shooting of the young gay student, according to news blog FireDogLake. During the eight weeks of testimony, the jury heard from nearly 100 witnesses, with the defense leaning heavily on what is known as the gay panic defense, in which a defendant claims he or she acted in a state of violent temporary insanity because of homosexual panic. McInerney brought a gun to school and shot the victim in the back of the head twice at point blank range allegedly after King began wearing makeup to school. McInerney apparently also warned a friend he would be committing the act the day before.

Man curb stomped outside Salt Lake City club

SALT LAKE CITY A gay 20-year-old Salt Lake City man spent four days hospitalized, lost six teeth, and suffered a broken jaw as the result of a brutal attack that included what is called a curb stomp outside of a Salt Lake City club. According to Q Salt Lake magazine, Dane Hall was leaving Club Sound, which is gay themed on Friday nights, when he was attacked by four men wearing red shouting anti-gay slurs. After repeated punches and kicks, one of the assailants positioned Halls open mouth on the street curb, and kicked the back of his head, knocking out the teeth, while the others kicked Hall in the abdomen. The assailants stole $40 and Halls identication. A similar attack occurred at the same spot in April, but calls made from the cell phone stolen in that incident did not lead the police to the assailants. Both cases remain open. A fund to cover Halls $30,000 in medical expenses has been set up at a local bank, and both Club Sound and a neighboring bar are holding benets to raise money for Halls medical bills.

With the nation focused on President Obamas jobs speech this week, some advocates are hoping that employment protections for LGBT workers will be included in any new employment initiatives. Justin Tanis, spokesperson for the San Francisco-based Out & Equal Workplace Advocates, said the Thursday speech before a joint session of Congress is absolutely an opportunity for Obama to address the absence of federal protections for LGBT workers. I think any serious plan to get Americans back to work has to look at the forces that are keeping Americans from working and its clear that homophobia and trans phobia are still very present in the lives of LGBT people, Tanis said. As long as our country fails to address those, discrimination is going to continue. While some states have laws that prohibit employers from discriminating against LGBT workers, in many places these protections are non-existent. Firing a person based on sexual orientation is legal in 29 states, while ring someone based on gender identity is legal in 35 states. Federal legislation that would prohibit discrimination against LGBT people in most situations in the public and private workforce is known as the Employment Non-Discrimination Act. The bill is sponsored by gay Rep. Barney Frank (D-Mass.) and Sen. Jeff Merkley (D-Ore.). Tanis hoped that Obama would express vigorous support for the enactment of employment protections such as ENDA in Congress during his much-anticipated jobs speech. Its clear there needs to be a longterm plan for addressing anti-LGBT discrimination in the workplace whether it takes the form of ENDA or other measures, Tanis said. Whether President Obama will spend political capital to address the lack of non-discrimination protections for LGBT workers remains to be seen. A White House spokesperson declined to comment on whether the speech would be LGBT-inclusive. Last week, the monthly jobs report from the Labor Department revealed that the unemployment rate remains xed at 9.1

percent and a net of zero job growth took place in August. White House Press Secretary Jay Carney said last week the proposals Obama will unveil on Thursday would absolutely change these numbers into something more positive. The president will come forward with specic proposals that by any objective measure would add to growth and job creation in the short term, Carney said. And that will be part of a broad package that reects his commitment to grow the economy now and to build a foundation for economic growth for the future to ensure that we win the future. Some LGBT advocates are skeptical that these proposed policy changes would be inclusive of ENDA or, more generally, the lack of federal job protections for LGBT workers. Richard Socarides, president of Equality Matters, said he thinks the incorporation of LGBT job protections as part of these measures would be highly unrealistic. I dont think they will see the connection, Socarides said. To be candid, I dont think its a particularly good strategic opportunity. I think that all Americans including LGBT Americans want to see the economy improve and for the administrations policies to create jobs. Mara Keisling, executive director of the National Center for Transgender Equality, said she doesnt know enough about the presidents speech to say whether Obama should address the lack of federal job protections for LGBT Americans.

HHS expands hospital visitation rights for couples

Patients may designate visitors during hospital stay
By CHRIS JOHNSON cjohnson@washblade.com
The Department of Health & Human Services on Wednesday unveiled a new policy to enhance hospital visitation rights for same-sex couples. The Centers for Medicare & Medicaid sent a letter on Wednesday to states building off the memorandum President Obama issued last year mandating that hospitals receiving Medicare and Medicaid funds allow patients to designate their own visitors during a hospital stay, including a same-sex partner. In November, HHS issued the nal rule implementing Obamas proposed change. The letter sent to states on Wednesday provides the enforcement mechanism by which state survey and certication groups can ensure hospitals are abiding by the policy. Jesse Moore, an HHS spokesperson, said his department generally works with hospitals to bring them into compliance with rules and, at this point, HHS hasnt heard of any problems with the guidance related to same-sex couples. However, Moore said if a hospital doesnt comply with the new rule and fails to x the problem, HHS has the power to terminate a Medicare provider agreement. The guidance that will be given to state hospitals even if the patient isnt on Medicare or Medicaid. Don Berwick, the CMS administrator, said the updated guidance to states is benecial for same-sex couples and enhances the quality of health care throughout the country. This announcement is another step toward equal rights for all Americans, and it is another step toward putting the patient at the center of our health care system, Berwick said. All patients should be afforded the same rights and privileges when they enter our health care system, and that includes the same opportunity to see their signicant other. LGBT rights groups were quick to praise the updated policy as a means to ensure LGBT Americans are treated fairly during hospital stays. Rea Carey, executive director of the National Gay & Lesbian Task Force, commended HHS for issuing the updated policy in a statement as she said more work is necessary. Ensuring that the medical wishes of [LGBT] people are respected is an example of the federal government recognizing the life of LGBT families, Carey said. An emergency situation in a hospital is the last place where anyone should feel unsafe. While a positive step forward, it is critical we continue to work at all levels of government to make sure our families are fully recognized and treated fairly.

survey agencies marks the last step in implementing the change that Obama proposed on hospital visitation last year. Additionally, the letter also issues guidance mandating that hospitals recognize advance directives designating a same-sex partner as someone who can make emergency medical decisions for a patient whos incapacitated. The department claries hospitals should defer to patients wishes concerning their representatives whether expressed in writing, verbally or through other evidence unless prohibited by state law. HHS Secretary Kathleen Sebelius emphasized the importance of the policy change to LGBT couples in a statement. Couples take a vow to be with each

other in sickness and in health and it is unacceptable that, in the past, some same-sex partners were denied the right to visit their loved ones in times of need, Sebelius said. We are releasing guidance for enforcing new rules that give all patients, including those with same-sex partners, the right to choose who can visit them in the hospital as well as enhancing existing guidance regarding the right to choose who will help make medical decisions on their behalf. The new guidance updates the conditions of participation for hospitals participating in Medicare and Medicaid, which are the health and safety standards that these hospitals must meet. The change applies to all patients of these

Behind the scenes of the Obama campaign

LGBT staffers take key roles in 2012 effort
By CHRIS JOHNSON cjohnson@washblade.com
Editors note: This is the second of a two-part series. Visit washingtonblade.com for part one.

Gay and lesbian staffers have taken key roles ranging from public outreach to battleground state strategy in the campaign already underway to re-elect President Obama to the White House in 2012. The Washington Blade interviewed four gay and lesbian staffers working to re-elect Obama from the campaign headquarters in Chicago. This article is the second in a two-part series and features interviews with two of the campaign workers: Jamie Citron, LGBT vote director for Project Vote, and Karine Jean-Pierre, deputy battleground states director. As LGBT vote director for Project Vote, Citron, whos 28 and gay, is focused on monitoring the news developments and needs of the LGBT community. Established in

August, Project Vote is the Obama campaigns initiative aimed at encouraging participation among Democratic base constituencies, including LGBT Americans. Usually when I rst make it into the ofce, its trying to catch up on the community, Citron said. Its seeing what the conversations are, what the buzz was overnight on the listservs. Its about reading the blogs and reading the LGBT press and seeing what the top lines of the stories are today. Other daily duties for Citron are meeting with the rest of the Project Vote team to discuss the best ways for taking the Obama campaigns messages to the Democratic Partys constituencies as well as integrating the concerns of those constituencies into the campaign. Most important to me in my mind, each of us kind of gures out how we can work together across constituencies and make sure that we are engaging people as whole people instead of just focusing on one block at a time, Citron said. Citrons role with the Obama campaign is similar to his previous role at the Democratic National Committee, where

he served as director of the LGBT leadership council. Citron, who was also involved in the 2008 campaign, said he transferred back to the campaign to take a more direct role in the engine working the campaign to re-elect Obama. A Chicago native, Citron said he also wanted to return to the Windy City to be closer to his boyfriend of three years, Tyler, whos 33 and a lawyer living in the area. The two met in 2007 at an Obama fundraiser. Citron asked that Tylers last name be withheld. The scope of Jean-Pierres role is somewhat larger as she develops campaign strategy for the battleground states in 2012. A key task: providing resources to states and guring out the best way for them to get the word out for the campaign. To me, getting the president reelected right now is the most important thing that I can be doing with my life, Jean-Pierre said. Jean-Pierres role is similar to her duties in 2008 as the Obama campaigns southern political director. Upon Obamas election, Jean-Pierre became White House liaison to the Labor Department

and later became regional director in the White House Ofce of Political Affairs. For Jean-Pierre, the decision to work as part of the 2012 campaign as opposed to staying at the White House was an easy one. Under the Obama administration, the LGBT community has seen signicant achievements, including passage an expanded federal hate crimes law and repeal of Dont Ask, Dont Tell. In February, Obama declared that the Defense of Marriage Act is unconstitutional after initially defending the anti-gay law in court and has been ling legal briefs against the statute. Still, Obama has yet to fulll all promises to the LGBT community on which he campaigned in 2008. One notable outstanding goal is passage of the Employment NonDiscrimination Act. Obamas lack of support of same-sex marriage continues to disappoint LGBT advocates. But those working on the Obama campaign maintain has been a friend to the community and will continue to be an LGBT advocate during a second term in ofce.

Sept. 11 legacy: Shared loss, recognition of LGBT families

CONT INUED FRO M PAGE 01

New York City and New York State ofcials quickly recognized the inequities faced by same-sex partner survivors and took steps to change polices and laws to correct the situation. The changes began to take place, activists, said, following news media reports of the loss of individual LGBT people at the World Trade Center and at the Pentagon just outside Washington, which was hit by a third hijacked plane. It had such an impact because the loss was about death and relationships, said Jennifer Pizer, senior counsel for Lambda Legal, an LGBT litigation group, in a 2006 interview with the Blade at the time of the 5th anniversary of the Sept. 11 attacks. The grief and loss was the same between heterosexual and same-sex couples, and a perception of this seemed to come through to much of the public, Pizer said. Among the victims widely reported on by the media was Mark Bingham, a gay public relations executive and avid rugby player from San Francisco, who was one of the passengers on United Airlines Flight 93, which crashed into the countryside in Pennsylvania. Binghams mother said she spoke to him by cell phone after his hijacked plane was believed to be heading toward Washington, D.C. for another terrorist attack. She said she believes her son was part of a small group of passengers believed to have attempted to wrestle control of the plane from the hijackers. Authorities have speculated that passengers such as Bingham and others most likely intervened to prevent the hijackers from crashing the jetliner into a building in Washington, such as the Capitol or the White House. Bingham was among the 9/11 victims portrayed in the Hollywood lm United 93. Another of the victims widely reported in the media was American Airlines pilot David Charlebois, who was gay and an active member of the National Gay Pilots Association. Charlebois was serving as rst ofcer, or co-pilot, onboard American Airlines Flight 77 when terrorists hijacked the Boeing 757 jetliner and crashed it into the Pentagon. All of its crew and passengers perished along with dozens of Pentagon employees working in the part of the building struck by the plane. Charlebois surviving partner of 14 years, Tom Hay, was treated with respect and honor by American Airlines top brass and colleagues when more than a dozen uniformed company pilots and ight attendants attended Charlebois funeral mass at St. Matthews Cathedral in downtown D.C. It was a time when all Americans did

come together with a single, united focus, said David Smith, vice president of programs for the Human Rights Campaign and the national LGBT advocacy groups media spokesperson at the time of the Sept. 11 attacks. And there were extraordinary acts of kindness and recognition that this is an issue that needs to be dealt with, i.e., our families need to be protected, Smith said. But it also really brought into stark reality how the lack of recognition of our families causes real pain and at times almost insurmountable challenges that families that are protected by law through marriage dont have to experience. Levi said ESPA was pleased when, in response to requests by LGBT advocacy groups and media reports, then GOP Gov. George Pataki issued an executive order in October 2001 that included surviving partners of gay and lesbian victims of the World Trade Center attacks in receiving full spousal benets from the states Crime Victims Board. The order marks the rst ofcial step taken by any level of government in the nation to address the inequities faced by gay and lesbian survivors of the terrorist attacks in obtaining benets, ESPA said in a statement at the time. The New York State Legislature soon followed suit by passing three separate bills that included same-sex partner survivors in various state benets to be allocated to 9/11 survivors and their families. One provided state workers compensation benets to domestic partners of 9/11 victims. Another bill approved by the legislature enabled same-sex partners and their children to be eligible for a newly created World Trade Center Memorial Scholarship Program. A third bill passed by the legislature called on the federal government to include same-sex partners in federal relief programs for 9/11 survivors. A short time later, the Red Cross responded to requests by ESPA, HRC, Lambda Legal and other LGBT groups by opening up its disaster relief programs to same-sex partner survivors. Activists called the action historic and noted it resulted in badly needed relief for LGBT victims of Hurricane Katrina, which struck New Orleans and the Gulf Coast several years later. On the federal level, President George W. Bush and Republican members of Congress joined Democrats in approving a massive, $7 billion Sept. 11 Victim Compensation Fund. Ofcials said the program was aimed at providing a viable alternative to thousands of individual wrongful death lawsuits that likely would have emerged against airline companies and the company that operated the

WASHINGTON BLADE FILE PHOTO

World Trade Center if such a fund were not created. But LGBT advocacy groups once again discovered that the relief funds would likely be out of reach for surviving samesex partners of 9/11 victims. Among other things, the funds administrator, attorney Kenneth Feinberg, who had worked for the late U.S. Sen. Edward Kennedy (D-Mass.), said rules for who is eligible for receiving as much as $1.3 million in compensation payments would have to be linked to state probate laws and rules. At the time, no state probate law recognized same-sex relationships, even if they were made legal on the local level by a city or county domestic partnership ordinance. ESPA, HRC, Lambda Legal and other advocacy groups said they worked hard to lobby the U.S. Justice Department, which had jurisdiction over the compensation fund program, to take administrative steps to include same-sex couples survivors in the program. At the time, Feinberg told the Blade that while he was concerned about the plight of surviving domestic partners of the Sept. 11 victims, it was not feasible to include specic domestic partner provisions in the relief funds regulations. If I get in the middle of that ght and try and trump local probate law in a particular case, Ill be up to my neck in lawsuits, he said. Im not saying theyre not entitled, he said. Im not saying they are entitled. Smith of HRC said at least two of about 22 known LGBT partner survivors in the Sept. 11 attacks did receive compensation from the fund. Smith said the compensation payments came about, however, when surviving blood relatives chose not to challenge the same-sex partners application

for the compensation. In a separate development, HRC, ESPA, Lambda Legal and other LGBT advocacy groups created the September 11 Gay & Lesbian Family Fund to provide some relief to surviving partners who were ineligible for help from the federal relief fund program. In a May 2006 announcement, ESPA said the known surviving partners of gay or lesbian victims of 9/11 had received nearly $17,315 each from the new Gay & Lesbian Family Fund. ESPA said at the time that the groups raised a total of $378,812 for the fund, with only $11,193, or 2.9 percent, being spent on administrative costs. The Family Fund was established in December [2001] to help offset the discrimination gay and lesbian partners faced in obtaining benets automatically afforded to surviving spouses, including Social Security and Workers Compensation survivor benets, and compensation under the Federal 9/11 Victims Compensation Fund, the ESPA statement said. I dont think there is one of us who were of remembering age who lives their life the same on Sept. 11 at 8 oclock in the morning as we did at 10 oclock in the morning on that day, said Winnie Stachelberg, senior vice president for external affairs for the Center for American Progress, and who served as HRCs political director in 2001. And my hope is its changed us to respect our diversity, to honor our humanity, she said. I dont know if weve embraced those lessons but in this 10th year anniversary if we dont remember that we need to honor our diversity and our humanity we will not have learned from the tragedy of Sept. 11.

Its ofcial: Baldwin to seek Senate seat

CONTINUED FROM PAGE 01

think voters are going to hear me out and come to know that I am going to be a fighter. First up for Baldwin during the campaign: touring Wisconsin to listen to concerns and build name recognition among her potential constituents. In the months ahead, as I did over the past summer, Im going to be traveling the state, meeting with people in their homes and workplaces, Baldwin said. You certainly know Im well-known in the House district that I represent, but there are parts of Wisconsin where I have to go around and introduce myself. In the time she has spent speaking with voters, Baldwin said she has heard from people again and again just how disgusted they are with whats happening in Washington. Its clear to all of us that the middle class is getting completely slammed both in this economic environment and in this political environment, Baldwin said. I think we as the LGBT community can really understand the concerns we feel when we think our leaders arent taking our genuine challenges and struggles to heart. Chuck Wolfe, CEO of the Gay & Lesbian Victory Fund, praised Baldwin during the conference call and said her bid for the Senate will be an important race of our community. The Victory Fund endorsed Tammy in her first state legislative race back in 1992, Wolfe said. She hasnt lost a race. We hope we are able to help her continue that success rate all the way through 2012. The first major hurdle for Baldwin will be a Democratic primary challenge in September 2012. Both Rep. Ron Kind (D-Wisc.) and former Rep. Steve Kagen have been named as possible contenders, although Baldwin at this point is the only announced Democratic candidate. But polling has shown Baldwin to be ahead of both Kind and Kagen. During the conference call, Baldwin noted she voted in 2002 against the Iraq war resolution and in 1999 against the repeal of a financial regulation law known as the Glass-Steagall Act, which some say led to the financial crisis of 2008. Kind voted in favor of both measures. People will also recognize that I have a lifetime commitment to equality for all, Baldwin said. And I think theyll learn that Im not afraid to stand up to big and powerful interests. Asked whether she thinks shell have a Democratic opponent, Baldwin said, I have no idea, but Im prepared for

any eventuality. Polls have shown that Baldwin is the front-runner in a Democratic primary, but the situation is different during the general election. Both former Gov. Tommy Thompson and announced U.S. Senate candidate Mark Neumann are slightly ahead of Baldwin in the polls. But Baldwin dismissed this early polling and said any results obtained at this point would mostly be related to name recognition. She noted Thompson has held statewide office as governor and Neumann is a perennial statewide candidate, but she previously only had to be concerned about her House district. I think whats much more important in terms of building a campaign is that once voters, for example, know theres a candidate named Tammy Baldwin and shes a fighter for the middle class, then you have, more or less, a deeply and evenly divided state in terms of Democrats and Republicans, Baldwin said. Asked whether being an out lesbian will be an issue during the Senate campaign, Baldwin said she thinks Wisconsin will value her honesty about her sexual orientation. I have always since the beginning in all my adult life been out and honest about my sexual orientation, and I think that voters appreciate the values of honestly and expect integrity in their elected officials, Baldwin said. Still, Baldwin maintained the race wont be about me and instead will focus on the problems facing everyday Americans. It will be about the middle-class, the threats that theyre facing right now, the struggles that families are experiencing and which candidate for U.S. Senate is going to be the best fighter for them, Baldwin said. What will Baldwin do if confronted with homophobia and anti-gay attacks while on the campaign trail? The candidate pledged to respond to such attacks head on. To the extent that Im faced with it in my campaign, I plan on responding very directly, Baldwin said. The campaign is unfolding across the country, but to the extent that it is raised in the U.S. Senate race in Wisconsin, I am certainly not going to turn the other way. Asked whether shell promote LGBT rights, particularly the Employment Non-Discrimination Act, while on the campaign trail, the lawmaker said she has been talking about such issues in the context of larger discussions as she said Wisconsin in 1982 was the first state to enact protections based on sexual orientation. When I talk about the proud

tradition of the state of Wisconsin and labor and equal rights they are all in the same conversation, Baldwin said. People in Wisconsin feel proud of

those firsts, all of them, and view them as interlinked. Thats the same sort of way, I think, at the national level that we weave these things together.

Still mourning a friend, 10 years later

A beautiful morning gives way to tragedy and grief
violent act that I had ever seen. And, it was all happening on U.S. soil we were being attacked. I went outside of the bar to make some calls to my friends in New York. Many of them were traders in the nancial district. And I knew that Chris also worked at one of the rms on or near Wall Street. I was not sure at the time who among them actually worked in the Trade Center. It had never been important to know in which building they worked. I pulled out my cell phone and made a couple of calls. The calls failed. As the morning progressed and the news of the planes crashing at the Pentagon and in Shanksville, Pa., emerged, people drifted out into the street and began to contact loved ones. Texts soon started to come through on my phone. Everyone in my family that worked in downtown Washington was safe and in the process of putting together plans to get to their homes. I received a text from a guy that I was dating in Rehoboth. We had planned dinner that night as he was coming into town for business. He was at the train station in Wilmington: All trains cancelled. Talk later. I tried getting through to New York. Same rapid busy signal. Texts to my friends in Manhattan were not returned. In the days that followed, my friends and I would talk on the phone periodically. We had hope. Chris would turn up. I wore a picture of him on a string around my neck. In hindsight, I think it was my way of telling people that I was in shock. Chris was the last person that I would have imagined to be in the middle of this awful attack. He was innocent. I sat in my room one night looking at my caller ID and remembering the phone call that Chris made to me at 11:30 p.m. one night the week prior. I had just brushed my teeth and was getting into bed. I saw his number come up and I didnt want to answer. Given the time of night, I thought he would probably have been out to happy hour and would be annoying. I wasnt in the mood. Hello Foxy! Pick up your phone. Pick up your phone, its Chris. Well, alright, I will talk to you later. Bye Foxy! Yeah, he had gone to happy hour alright. This was my last communication with him. It was one-sided. I wish to this day that I had answered. In the ensuing years, when I thought about Chris and that infamous day, I often wondered how the events had played out for him. I had hoped it was quick and that he was quietly humming a U2 song while doing some busy work. He was a huge U2 fan and the idea that he could be play-

Its no secret that the stars are falling from the sky The universe exploding cause of one mans lie Look, I gotta go yeah, Im running out of change Theres a lot of things, if I could, Id rearrange Bono on U2s The Fly My college roommate, Chris, died on Sept. 11, 2001, when American Airlines Flight 11 crashed into the 95th oor of the North Tower of the World Trade Center. Chris, just 28 at the time of the attacks, worked in technical support for Marsh and McLennan in Tower 1. Marsh and McLennan is a U.S.-based global professional services and insurance brokerage rm. What follows is a description of how I came to learn that he was missing on the evening of 9-11. The color of the sky on the morning of Sept. 11 was probably the most beautiful blue I can remember. No humidity. No clouds. Living in Georgetown and working in Bethesda at the time, I spent about a half-hour in the car on the way to work in the mornings. At the time, I listened to CDs while driving so I was unaware of any activity in New York. I arrived before 9 a.m. at the ofce with my boss telling me hed just heard on the radio that a plane had struck the World Trade Center. In my mind, I did not think much of it. Probably a Cessna that ew off course, I thought. An accident. I went about my business. My boss continued to pay attention to what she was hearing on the radio. After she heard that the second plane had struck the World Trade Center, we all agreed to go across the street to Rock Bottom. We needed to see what we could not believe was happening at the towers. We were not the only ofce workers who had this idea. The bar was lled and the restaurant had lowered large viewing screens tuned to CNN. As I watched the horrifying images from New York, I could not even grasp the magnitude of this event. What was playing out before me was indeed the most

Flight 11 had struck the IT center for Marsh and McLennan the exact ofce where Chris worked. It was fast. But now, 10 years later, the memories are fresh, and its still painful.

I eventually found my way home that afternoon and sat in front of the television as most Americans did. As night fell, I sent out a text to my college friend that I knew did not work on Wall Street, but out on Long Island. Maybe he had heard some news. Is everyone OK? To this day, I will never forget the wave of sadness that overcame me as a result of the one-word response that I would soon receive. The text read: Chris. Nothing else needed to be said for me to realize that my college roommate, my friend, was among the missing.

ing back a U2 song in his head was not a stretch. Chris was musically inclined and would often play guitar and sing songs from Achtung Baby in college. In preparation for writing this piece, I sat down at my computer and read the Wikipedia entry that outlines the timing of events for the day of 9-11. As I navigated my way through some linked sites, I discovered that Flight 11 had struck the IT center for Marsh and McLennan the exact ofce where Chris worked. It was fast. But now, 10 years later, the memories are fresh, and its still painful.

Remembering gay co-pilot of Flight 77

Local connection brought the attack close to home for many
Children on 17th and L streets, N.W., in the District. I arrived at the ofce at 8:30 and heard the report about the rst plane hitting One World Trade Center. I then turned on the small TV in the ofce brother who worked in the Pentagon. We sat talking to each other and reassuring her that all would be OK until she nally was able to get word two hours later that her brother was not hurt.

It seemed surreal as we sat in the sunshine with coffee, watching the smoke rise from the Pentagon, and still not really knowing what had happened.

Sept. 11, 2001, is one of those days that I will always remember where I was and what I was doing. For those of my generation it joins the memory of Nov. 22, 1963, the day that President John F. Kennedy was shot. That afternoon I was a college student working in the rare books section of Donnell Library in New York. On 9-11, I was working in my ofce at the National Association for Gifted

in time to see the second plane hit Two World Trade Center. Our small staff sat transxed and like the rest of the world speculated about what was going on. Then shortly after 9:30 it was reported that a plane had own into the Pentagon. The ensuing reports and pictures of the re made it very personal to all of us in the ofce as one of the women working for me had a

At noon we left the ofce. The streets downtown were emptying out and some of the staff walked to the metro while I walked up Connecticut Avenue to Dupont Circle and spent the afternoon sitting with friends at Java House. It seemed totally surreal as we sat in the sunshine with coffee, watching the smoke rise from the Pentagon, and still not really knowing what had happened or what else would happen.

As the days wore on and people began to come to grips with the attacks we learned more about the hijackers. There were many public memorial services and funerals in D.C. including those for the school children and their teachers who had died on Flight 77, the plane that hit the Pentagon. Because of my involvement with Mayor Anthony Williams administration I became the intermediary between the family of David Charlebois, the gay copilot and 1st ofcer on Flight 77, and the administration as plans were made for his memorial service at Saint Matthews Cathedral on Sept. 18. I knew David and his partner Tom as did so many others because they were a part of the LGBT community in the District. It was only after that memorial service that life really began to move on. As I drafted this remembrance on Aug. 23, my chair and the building started to shake from what I was to learn was a 5.9 earthquake. But until I knew that, in an eerie way, the memories of 9-11 came ooding back.

OUR BUSINESS MATTERS

14th and U streets Arts District blossoms into more

Zoning modication allows for expansion of hospitality, nightlife
(DCCA) and the infamously lockstep attitude of the interchangeable Dupont ANC leadership of the time. Pitched battles over proposed citywide restrictions on music and dancing, and the neighbornightlife venues, home furnishings stores, clothing boutiques and new residential unit housing developments would follow. Long-time area residents, as well as those among the thousands of newer arrivals,

Much has changed on 14th Street since those early days of an evolving presence of pioneering entertainment businesses including both theater and arts establishments alongside a mere handful of bars and restaurants.

Washingtons neighboring Logan Circle and Dupont Circle areas are a stark contrast in business friendliness. The Logan Circle Community Association (LCCA) and the area Advisory Neighborhood Commission (ANC) spent the rst part of the millennium railing against the initial liquor licensed establishments on 14th Street, N.W., extending between downtown to U Street. However, a neighborhood poll conducted by LCCA at the time indicating that residents longed for dining and drinking venues startled the group. That eye-opener gradually modulated the groups regulatory posture and inuenced the closely connected Logan Circle ANC. This would estrange them from the rebrand ghts fueled by the notorious Dupont Circle Citizens Association

hoods sidewalk patio applications, liquor license moratoriums, license renewals and just about every new business proposed continued unabated to the west. Much has changed on 14th Street since those early days of an evolving presence of pioneering entertainment businesses including both theater and arts establishments alongside a mere handful of bars and restaurants. A tiny cluster of hospitality businesses were anchored by the newly remodeled Studio Theatre at 14th and P streets, along with the nearby Source Theatre and Woolly Mammoth Theatre (since relocated to Penn Quarter), among others. Studio Theatre founder and former artistic director Joy Zinomans dynamic vision and commitment had as much to do with revitalizing the Logan Circle area as the watershed opening of the Whole Foods Market in December 2000. Additional

joined the business community last year in pressing the District government to modify its zoning regulations and accommodate growth in the number of nightlife venues. In the 1980s, the city designated the still riot-scarred area that runs along 14th Street, N.W., from N Street to Florida Avenue and U Street from 9th to 15th (along with sections of 9th, 7th, P and Q streets) as a unique Uptown Arts Overlay District and decreed that only 25 percent of the linear frontage could be occupied by eating and drinking establishments. That was ne until it wasnt. About a year ago, potential alcohollicensed businesses discovered that only 12-feet of space remained, and the D.C. Dept. of Consumer and Regulatory Affairs (DCRA) announced that additional licensees could not enter the marketplace and existing licensees could not expand unless they received a special exemption from the

Board of Zoning Adjustment (BZA) a process that, even if successful, would take months or perhaps a year or more. The MidCity Business Association, itself launched in 1998 as the 14th & U Business & Arts Coalition, undertook a grassroots organizing effort advocating that the limit be raised. The business association argued that the zoning restriction would stall new projects and prevent existing ones from expanding, discourage entrepreneurs from investing in the area and send a strong message to local, regional and national investors that D.C. is business unfriendly a well-deserved criticism of the local government. Shortly thereafter, with the vocal support of D.C. Council member Jack Evans, the allowed streetscape percentage for utilization by bars and restaurants was doubled to 50 percent, paving the way for a number of new hospitality venues. The maturing corridors are now attracting restaurateurs from New York and elsewhere. A growing list of new and planned hospitality businesses will inject more vitality into the already bustling area. An additional 1,300 condominium and mostly apartment units at 10 new construction projects are underway to meet demand for additional housing density. Thats good for everyone including an arts community beneting from and supporting local hospitality and bodes well for continuing economic and social resurgence betting a world-class city that doesnt roll up its sidewalks at night.

FEEDBACK
have been working toward creating conditions in which suicide is no longer a common tragedy among sexual minority youth. The Gay, Lesbian & Straight Education Network (GLSEN) has been combating bullying, harassment, and discrimination in schools since the 1990s. Since 1998, The Trevor Project has operated as the leading national organization focused on suicide prevention efforts among LGBT and questioning youth. The Trevor Project provides The Trevor Lifeline, a confidential around-theclock helpline; TrevorChat, a suicide and crisis prevention online chat service; and a variety of other programs and resources for youth and schools. More recently, after the string of suicides last year, online columnist Dan Savage launched the It Gets Better campaign, which prompted thousands of youth, parents, LGBT community members, allies, celebrities, and politicians including the president of the United States to create and post videos on YouTube encouraging struggling LGBT youth that life does get better. Unfortunately, even the best efforts of GLSEN, The Trevor Project, and other organizations formed to aid LGBT youth are not enough. No number of YouTube videos assuring sexual minority youth that life will get better eventually can completely drown out the messages to the contrary that these youth see in school and on television everyday. When a teenager turns on the news and sees that another gay man was beaten up in Salt Lake City, that a group of transgender women and their friends were shot by a D.C. police officer, and that the Defense of Marriage Act still prevents same-sex couples from receiving equal protection under the law, they are told that it doesnt get better. This is unacceptable. We need to make it better, and we need to do so now. We all need to get involved in politics, in our communities, and in schools to make life better. Not just for LGBT adults, but for LGBT youth, too. In 1993, GLSEN founder and former Assistant Deputy Education Secretary for Safe and Drug-Free Schools Kevin Jennings was asked to edit the first-ever high school gay and lesbian history text. I have heard Kevin give many speeches in support of LGBT inclusiveness in schools, but he has always ended with the same story: As I was doing research, I learned of One Magazine, Americas first gay magazine, which began publication in 1953. I decided to read some, and came across this letter to the editor in Ones October 1954 issue: I will always remain willing to support, in my small way, any effort to reduce intolerance toward a minority group in the United States. Intolerance is basically as un-American as Communism. I realize the road ahead of us is long and difficult, but that part of the road already traveled has been pretty tough, too. People like Frank Kameny and Lilli Vincenz, Harvey Milk and Mara Keisling, and Kevin Jennings himself, have traveled a tough road, but they have still managed to make an incredible difference in the lives of LGBT youth. It is our turn, and our responsibility to the LGBT youth of the present and future, to keep traveling down that road. In honor of National Suicide Prevention Week, The Trevor Project is encouraging members of the LGBT and allied community to be a resource for youth who need to talk. To take the Talk To Me Pledge and join the Talk To Me campaign, go to trevortalktome.org. Samuel Garrett, Washington

This week, Sept. 4-10, marks the 37th annual National Suicide Prevention Week. This month also marks the one-year anniversary of nine LGBT teens across the United States tragically taking their own lives after enduring relentless bullying and discrimination in school. Unfortunately, although this tragic string of LGBT youth suicides was highly (and uniquely) publicized, it was not an anomaly. Studies conducted by the U.S. Department of Health and Human Services and independent research groups consistently show that between 30-40 percent of LGBT youth have considered and/ or attempted suicide at least once in their lifetimes. Even higher percentages are stigmatized, bullied, harassed, and assaulted for their sexual orientation or gender identity/expression in schools across the country. These statistics are absolutely unacceptable. No child should suffer like Seth Walsh or Tyler Clementi or any other LGBT youth who has tragically attempted or fallen victim to suicide. As LGBT adults, as American citizens, and as human beings, it is our responsibility to help end this tragic epidemic. Fortunately, a number of groups

Stage icons cabaret act, here Saturday, inspires wide-ranging stories and memories
By JOEY DiGUGLIELMO joeyd@washblade.com
Its a little tough coming up with questions for Broadway icon Patti LuPone. Her startlingly candid 2010 eponymous memoir is so unabashed, at rst it seems she left no obvious career stone unturned. Some called it pessimistic and lacking in joy. Others reveled in its no-bullshit tone that, some said, was uncanny in its ability to make readers feel they were sitting on a barstool with LuPone over several rounds of no-holds-barred career anecdotes. Thats how it feels interviewing her. During a nearly hour-long phone conversation from her South Carolina beach home the weekend of Hurricane Irene, LuPone is loquacious and chatty. She balks at no question and riffs and rants much as one imagines she does with friends. She can be merciless and lacerating with the gauche and ill-prepared this is a woman who does

I guess the advent of social media. Its brought me back in touch with so many people that I had lost contact with. ON WHAT DO YOU INSIST? Not nearly enough, Im not very assertive. But I always make sure I get breakfast, a meal before shows and rehearsals, and a nap when I can get away with it. I get really grumpy if I dont eat right. Just ask Murray. WHAT WAS YOUR LAST FACEBOOK POST OR TWEET? Roosevelt was right when he said, There is nothing to fear but fear itself. We have paid dearly for our paranoia. It was about an article on slate.com about the true costs of 9-11. IF YOUR LIFE WERE A BOOK, WHAT WOULD THE TITLE BE? The Trials and Tribulations of Living Small in a Big World

Brian Crane did some acting in high school and college but largely set it aside for several years while he pursued career and academia. Since 2004 hes been acting on a semi-pro level in various productions with American Century Theater, Washington Shakespeare Company and other local outts. He opens tonight in a production of Clifford Odets The Country Girl, the play that was adapted into the lm version that won Grace Kelly an Oscar in the title role, at American (meeting at the Gunston Arts Center Theater II, 2700 South Lang St. in Arlington visit americancentury.org for details). Crane says his role, Frank, is an artistic challenge. Its a very emotional part, he says. Frank goes through these really big swings and its got some interesting challenges. Its harsh and theres plenty not to like about Frank but you have to make him lovable or the play doesnt work. Theres something lovable and vulnerable about this man I could identify with. He lies, he manipulates but at the same time he has this disarming charm, like a grown-up kid. Crane, a 47-year-old Pittsburgh native, came to Washington in 1992 to do a pre-doctoral fellowship in anthropology at the Smithsonian. Hed been in Philadelphia for college (grad and undergrad) for 10 years before that. By day, hes director of Cultural Resources Division at Versar, a global project management company based in Springeld, Va. Crane and his partner, Murray Scheel, an attorney, live together in Foggy Bottom and have been together 16 years. Crane enjoys theater, backpacking and photography in his free time. He also loves to squeeze in Saturday afternoon naps when he can.

From left, VANESSA BRADCHULIS, BRIAN CRANE and KEVIN OREILLY in The Country Girl.

IF SCIENCE DISCOVERED A WAY TO CHANGE SEXUAL ORIENTATION, WHAT WOULD YOU DO? Not a thing. I was born this way (thank you Lady Gaga) WHAT DO YOU BELIEVE IN BEYOND THE PHYSICAL WORLD? That death does not have the last word, and that at the end of things, there will be wonderful surprises. WHATS YOUR ADVICE FOR LGBT MOVEMENT LEADERS? I miss ACT-UP. WHAT WOULD YOU WALK ACROSS HOT COALS FOR? To see my father again. WHAT LGBT STEREOTYPE ANNOYS YOU MOST? Cant think of one. WHATS YOUR FAVORITE LGBT MOVIE? Parting Glances made a big impression on me coming out. So did Torch Song Trilogy, but that was because I had a big crush on Matthew Broderick. WHATS THE MOST OVERRATED SOCIAL CUSTOM? Valentines WHAT TROPHY OR PRIZE DO YOU MOST COVET? I really admire the work of those actors I know who have won the Helen Hayes award. WHAT DO YOU WISH YOUD KNOWN AT 18? That it gets better. WHY WASHINGTON? I came here to work at the Smithsonian as a pre-doctoral fellow, and just stayed. And I love the theater scene here.

HOW LONG HAVE YOU BEEN OUT AND WHO WAS THE HARDEST PERSON TO TELL? Ive been out since graduate school, about 25 years. My mom was the hardest to tell because she and my dad took my brothers coming out so hard. WHOS YOUR LGBT HERO? Im not sure, maybe Walt Whitman, or Oscar Wilde for being so wonderfully amboyant in their art. Among the living, maybe Stephen Fry; he has such a charming and gentle wit, and he had the guts to give Shakespeare in Klingon a try. WHATS WASHINGTONS BEST NIGHTSPOT, PAST OR PRESENT? I still have fond memories of Tracks: that was the rst place I ever went dancing in D.C. DESCRIBE YOUR DREAM WEDDING. Im not sure Murray is the marrying type, but if we did, I would want it in our home church, St. Thomas Parish, with all our friends and family with us. WHAT NON-LGBT ISSUE ARE YOU MOST PASSIONATE ABOUT? The environment WHAT HISTORICAL OUTCOME WOULD YOU CHANGE? Thats hard. There are so many awful things, how could I choose? But in my own lifetime, the election of 2000 was such a rotten turning point for this country, and it left us so divided. WHATS BEEN THE MOST MEMORABLE POP CULTURE MOMENT OF YOUR LIFETIME?

Gay actress DELIA TAYLOR as Winnie in WSCs Happy Days featuring the imaginative set design work of Tony Cisek, also gay.

Standouts from the stage

Gay-fueled creativity abounds on local theater scene
By PATRICK FOLLIARD
The fall theater season is here. With that comes a deluge of new productions and for one longstanding local company, a new name. What was the Washington Shakespeare Company is now WSC Avant Bard, a clever adjustment better tting the troupes mission to boldly interpret the classics. WSCs season opens with Samuel Becketts Happy Days (through Sept. 25). Mostly a monologue, the 1961 absurdist work spotlights Winnie, an upbeat, chirpy woman who passes her days chatting endlessly while becoming increasingly immobilized in the hot sun in the middle of nowhere. And yet she remains cheery, unfazed by her situation. As Winnie, Delia Taylor, whos gay, brings intelligence, sensitivity and a lot of humor to the tough role. Beckett calls for his heroine to be stuck in a mound and most productions comply with some sort of sandy or rocky pile, but not here. Set designer Tony Cisek, also gay, takes another tack ingeniously locking Winnie into endless yards of fabric. Trapped in her dress like a little doll in a giant doll cake, she sits atop her sartorial prison talking, arranging her cocktail hat and rummaging through a capacious satchel in search of necessities ranging from a toothbrush to a long barreled pistol. Her conned world is backed by an endless curve of beautiful blue sky. Splendidly staged by director Jose Carrasquillo (gay too), the surprisingly poignant production comments on optimism and the eeting nature of life. Carrasquillo also displays terric timing as Winnies uncommunicative, slug-like husband Willie who makes his home in a hole behind his wifes skirts. (wscavantbard.org) Up-and-coming No Rules Theatre Company kicks off its season with Diane Sons Stop Kiss (through Oct. 2) at the H Street Playhouse. Its the story of two young women who are brutally assaulted after kissing in public. Acclaimed local actor Holly Twyford (whos gay) makes her directorial debut. (norulestheatre.org) Shakespeare Theatre Companys gay artistic director Michael Kahn begins his season with a world premiere production of Jean-Franois Regnards 1708 farce The Heir Apparent (through Oct. 23) adapted by the brilliant David Ives. (shakespearetheatre.org) Venus Theatre opens with the world premiere of The Stenographer (through Sept. 25) by Greek playwright Zoe Mavroudi. The two-hander featuring local bi actor Frank Britton and Amy Rhodes is essentially a tale about writing and what happens when writing implicates the writer. Housed in an intimate storefront venue in Laurel, Md., Venus mission is to foster the voices of women and children in the theater. (venustheatre.org) Ganymede Arts may have closed its doors, but the LGBT-centric companys former artistic director Jeffrey Johnson remains active. In October, Johnson and singer/songwriter Tom Goss (both gay) are joining forces for two nights of music titled Under the Covers (Oct. 21-22) at the Black Fox Lounge. The show offers a rare chance to see Johnson perform as himself and not his pink-haired alter ego. (pinkhairedone.com). The Studio Theatre starts off with The Habit of Art (through Oct. 16) by Alan Bennett, the gay playwright who wrote The History Boys. Based on a ctional meeting between poet W.H. Auden and composer Benjamin Britten (both Brits, both gay), the 2009 work is described as wistful and lthily funny. The strong cast includes a talented trio: Ted van Griethuysen, Patxon Whitehead and gay actor Cameron Folmar. In November, Studios gay artistic producing director Serge Seiden stages German playwright Roland Schimmelpfennigs The Golden Dragon (Nov. 2- Dec. 11), a comic look at people whose lives are interconnected by a Chinese restaurant. The ve- person cast (including the terric Sarah Marshall, whos you guessed it gay) cross age, race, and gender to play 15 characters. (studiotheatre.org) At Gala Hispanic Theatre, Spain-based gay director Jos Luis Arellano-Garca is staging Ay, Carmela! (Sept. 15-Oct. 9), the story of a vaudeville team forced to perform for Francos fascist troops during the Spanish Civil War. According to Galas associate producing director Abel Lopez, The playwright [Jos Sanchis Sinisterra] pays homage to gay Spanish poet and playwright Federico Garca Lorca by referring to him in a scene when Carmela speaks about meeting Lorca in the afterlife. The similarities surrounding Lorcas assassination by the fascists and Carmelas execution are striking. Both stood up for their beliefs and paid dearly for it. (galatheatre.org) The green-eyed monster is poised to stride the boards at Folger Theatre. Staged by Robert Richmond, the companys Othello (Oct. 16Nov. 27) features Owiso Odera in the title role, and reunites members of the creative team behind last seasons Henry VIII including celebrated gay designers William Ivey Long (costumes) and busy Tony Cisek (sets). Zehra Fazal whos best known for her one woman tour de force Headscarf and the Angry Bitch plays Bianca. (folger.edu) Signature Theatres fall season begins with two musical premieres: The Boy Detective Fails (through Oct. 16), the story of a kid sleuth who grows up to investigate the mystery surrounding his own sisters death. Its staged by Joe Calarco and composed by Adam Gwon (both gay). The Hollow based on Washington Irvings classic tale is staged by Matthew Gardiner and composed by Matt Conner (also both gay). Next up at Signature, E. Patrick Johnson performs his one-man play Sweet Tea: Black Gay Men of the South (Sept. 13-Oct .9). In this new work based on his acclaimed book, Johnson, chair of the Department of Performance Studies at Northwestern University, relays his own story and those of a dozen other men hes interviewed and come to know. And later in the season, Signatures gay artistic director Eric Schaeffer stages the musical Hairspray (Nov. 21-Jan. 29) adapted from John Waters 1988 Baltimore-set ick about big girls, big hair and racial segregation. In what might prove a stroke of casting genius, Schaeffer has tapped radio personality Robert Aubry Davis to play Edna, everyones favorite plus size house frau. Well just have to wait and see. Two entries into the festival feature gay themes. For more information go to a.com/silver. Labyrinth of Passion, a 1982 lm by Pedro Almodvar, is an outrageous comedy set in Madrid and follows the love story between a nymphomaniac pop star Sexilia (Cecilia Roth) and Riza (Imanol Arias), the gay son of the emperor of Tiran. The lm features Antonio Banderas as a gay terrorist. Highlights include the world premiere of Into the Lions Den, a new lm from Breaking Glass Pictures that follows three close friends who have grown bored with the West Hollywood scene. The trio decides that a cross-country road trip from Los Angeles to New York City is the solution to getting out of their rut. On the nal night of their journey, the boys decide to hang out at a secluded bar The Lions Den. Someone at the bar is watching them and planning an evening of unspeakable horrors. Hanna and the Hasbian, an Australian movie, tells the story of a lesbian couple, one member of which is about to declare herself a hasbian, no longer a lesbian. Breigh begins her search for Mr. Right, but discovers dating men is not as easy as she imagined. As usual, LGBT content at the multiplex is spotty. A few lms with gay appeal: Michelle Williams is the latest actress to tackle the role of Marilyn Monroe in My Week with Marilyn, which tells the tale of a week shared between Monroe and Colin Clark, a 23-year-old assistant on the set of The Prince and the Showgirl. BBC fave comes to Logo, Chaz puts on his dancing shoes
By JULIETTE EBNER
ABCs Dancing with the Stars starts Sept. 19 at 8 p.m. and this seasons cast is already generating buzz thanks to the inclusion of Chaz Bono, the shows rst trans contestant. Cher, Bonos mother, has taken to Twitter, blasting the critics and encouraging her followers to support him. His partner, Lacey Schwimmer, who danced with Lance Bass her rst season as a pro on the show, has shown support. I just think its absolutely ridiculous when people have anything negative to say about anybody other than themselves, Schwimmer told E! Online. Its not fair. Its not nice. And its degrading. I really get sad about it. Dancing executive producer Conrad Green has also spoken out. We thought Chazs story was pretty compelling, Green told E! Online. He comes from Hollywood royalty and obviously the personal changes in his life have been quite profound. Former Queer Eye for the Straight Guy, Carson Kressley, is also a part of the cast and will be dancing with Anna Trebunskaya. Modern Family, with gay couple Cameron and Mitchell, returns Sept. 21 at 9 p.m. Greys Anatomy returns with a twohour premiere on Sept. 22 at 9 p.m. When season seven ended, Arizona Robbins and Callie Torres, played by Jessica Capshaw and Sara Ramirez, had just gotten married after a pregnant Callie nearly died in a car accident. Seasons gallery exhibits feature bounty of mixed-media wonders
By JULIETTE EBNER
The Washington/Baltimore region, with its bounty of galleries, never ceases to astound with its endless exhibits of art. Among the seasons highlights are: The Fleckenstein Gallery (3316 Keswick Rd.) in Baltimore has a new exhibit, Travelin Shoes opening Oct. 5 featuring the work of Schroeder Cherry, Kylis Winborne and gay artist Rams Brisueo. Brisueo portrays male and female gures, some asexual and some with gender-bending qualities. His prole on the Baker Artist Awards website says he uses collage and painting to show layers of experiences and differences. By organically letting the work be painted over, rubbed out or scribbled on top of, but with great attention to the surfaces of things ... to texture and intuitive response, and with a conscientious distinction between spontaneous doodles and selected text, composition and personal associations come together in themes of mythmaking ... and compositional unity through space, shape and color, Brisueo says of his work. This exhibit is in afliation with the Black Male Identity Project and is part of Free Fall Baltimore. Gallery plan b (1530 14th St., N.W.) has two exhibits scheduled to open this fall. The rst, which opens today, will feature paintings by Kevin H. Adams. The second exhibit, which opens Oct. 19, will feature photographs by Kermit Berg and paintings by Delna Dastur. Industry Gallery (1358 Florida Ave., N.E., Suite 200) presents Meltdown featuring new work by Tom Price, which opens Saturday with a reception from 6 to 8 p.m. This is the British artist and designers rst U.S. solo exhibition. He specializes in modern furniture products, sculpture and lighting design. I like to think of myself as working in collaboration with materials, processes and phenomena and that the nal physical outcome is a product of mutual consent, Price says in a press release. Zenith Gallerys newest exhibit, which features monumental and pedestal sculpture and three-dimensional wall art by Julie Girardini, David Hubbard, Joan Konkel, Barton Rubenstein and Paul Martin Wolff, opened Thursday and will run through Jan. 7 at the Eleven Eleven Sculpture Gallery (1111 Pennsylvania Ave., N.W.). The Virginia Museum of Fine Arts (200 North Blvd.) in Richmond has several exhibits scheduled to open this fall. First up, opening today, is Vision from the Congo, a two-part installation of bear sculptures. The rst section features four sculptures by artists from the Pende culture, of the Congos Kwilu and Kasai regions that relate to the disruptions experienced by the Pende in the early 20th century. The second part features life-size sculptures by Rene Stout and Alison Saar, who draw from African art and culture in creating their works. Dec. 23 brings the opening of Elvis at 21, which features 57 photographs taken by Alfred Wertheimer when Elvis was on the brink of international stardom. For information on these exhibits and more, visit vmfa.museum/exhibitions. The National Gallery of Art (4th and Constitution Ave., N.W.) has a new exhibit, Warhol: Headlines which opens Sept. 25. This is said to be the rst exhibition to fully examine the works Andy Warhol, who was gay, created on the theme of news headlines by presenting about 80 works including paintings, drawings, photographs and more based largely on tabloid news. Warhols headline works also chart the shift in mainstream medias ways of delivering the news from a printed format to an electronic format. The headline motif encompasses Warhols key subjects, including celebrity, death, disaster and contemporary events.

Studio revival
Gay favorites outnumber LGBT acts on fall album release schedule
By DAVID PLACHER
Several singers and bands that have been out of the studio for eons have albums slated for fall. Buzz is highest for new releases from long-absent acts Blondie, the Bangles and Gloria Estefan. A few openly gay acts also have projects on the horizon. Lesbian folk rocker Catie Curtis just released her 11th album, Stretch Limousine on Fire. Curtis made headlines in 1997 when she won the Best Album Award from the Gay and Lesbian American Music Awards for Catie Curtis CD. Curtis is married to Liz Marshall and has two daughters. Curtis became ordained to ofciate weddings in 2010, inspired by her commitment to marriage equality. Some of her songs are written to reect this commitment. On Sept. 13, Blondie will release Panic of Girls, the bands rst album since 2003 and ninth album overall, but only the second album to be recorded outside of Manhattan. A whopping 35 songs were recorded during the sessions, but only 12 will make it onto the album. Front woman Debbie Harry is a long-time gay fave whose pop culture cred was cemented with her own Barbie doll a couple years ago. Tori Amos is set to release Night of Hunters, on Sept. 20. The album is sure to break music barriers with its genre blending. Amos calls the album a 21st century song cycle inspired by classical music themes spanning over 400 years. I have used the structure of a song cycle to tell an ongoing, modern story. The protagonist is a woman who nds herself in the dying embers of a relationship. In the course of one night she goes through an initiation of sorts that leads her to reinvent herself allowing the listener to follow her on a journey to explore complex musical and emotional subject matter. main themes explored on this album is the hunter and the hunted and how both exist within us. The Bangles, an all female American band, are set to release Sweetheart of the Sun on Sept. 27, a 12-track album. Theyve been working on their highly anticipated album since spring of 2009. When The Bangles started out, they were opening for Cyndi Lauper on her Fun Tour. Their performance caught the attention of Prince, who later wrote their famous song Manic Monday, which catapulted them into superstar status. Also out Sept. 27 is LeAnn Rimes 13th album, Lady & Gentlemen, a 12-track album with two bonus cuts. Also out that day is Miss Little Havana from long-dormant Gloria Estefan. First single Wepa premiered in May. Grammy-winning Mary J. Blige is scheduled to release My Life II: The Journey Continues on Oct. 4, her 10th studio album. Its a sequel to Bliges 1994 classic album My Life. The album is designed to be a reection of the time and lives of the people around her. Monica is scheduled to release her seventh album New Life on Oct. 18. Shes getting buzz for Anything (To Find You), the rst single, which is on the Hot 100 now. On Oct. 25, Kelly Clarkson releases Stronger. Anticipation is high as shes taken some artistic detours, not always successfully, on her last few albums. Also on Oct. 25, Coldplay will release its fth album Mylo Xyloto. Oddly enough, the album was inuenced by HBOs The Wire. Lyrically, this album will have more acoustics and more intimate feel than their previous album. Every Teardrop is a Waterfall, the rst single, dropped in June. Paradise, the second, goes to radio this weekend. Adam Lambert has an as-yet-untitled set ready for November. And bi neo-soul goddess Meshell Ndegeocello is out with a new album, Weather on Nov. 8 (she plays the Birchmere on Nov. 15). Listen for sparse, orchestral melodies and her usual thoughtful lyrics.

Buttock Contouring and Augmentation

Buttock contouring is a procedure designed to sculpt or enhance the shape of the buttock with the use liposuction, fat grafting, or placement of implants. Liposuction can be used to sculpt the buttock into an ideal shape. If the buttock size is small and augmentation is needed fat grafting can be used to add volume to the buttock. The advantage of fat grafting over other tissue fillers is that the fat belongs to your own body. In this way you do not have the risk of having a reaction to a foreign substance. In some individuals it is not possible to use fat for augmentation. In such cases a solid silicone implant is used for this purpose. A combination of procedures is sometimes needed to get an ideal result.

LuPone excited about reunion with Patinkin

CONTINUED FROM PAGE 23

not suffer fools gladly but today shes quick to laugh, happy to go anywhere the questions lead with the same degree of candor she incorporated in Patti LuPone: a Memoir. LuPone, 62, says her outspokenness is just how Ive always been. It didnt particularly come with time. Ive always been very candid and yes, its always gotten me in trouble to some degree. I just always think its important to tell ones truth. It is what it is. Its a difcult business and its a difcult business especially for a woman. Might her career have unfolded differently had she the unfailing politeness of, say, a Debbie Reynolds? I dont think anything would be different, LuPone says. Because then I wouldnt be me. Its who I am. Its the way I was brought up. This leads to a little philosophy. She rolls with it. Do you think about what if? Isnt a bit of that implied in the cabaret act, dubbed Coulda, Woulda, Shoulda that shell perform Saturday night at the Clarice

Smith Performing Arts Center at University of Maryland? (claricesmithcenter.umd.edu or 301-405-ARTS) Its a futile way of thinking, she says. Its just not who I am. Its like [playwright] David Mamet says, it is as it is. The universe is unfolding. Why regret anything? LuPone admits shes of the everythinghappens-for-a-reason mindset. The career slights have gotten easier the more shes able to look back and trace the pattern of my career. The one constant has been surprise, she says. She long ago gave up trying to control it or determine its course. Almost for every disappointment there has been serendipity. An example? She cites her chance to do Sweeney Todd in 2000, which started a chain of events that not only led to the 2005 Broadway revival of that show, but her chance to do several classic Sondheim roles with the Ravinia Festival over a six-year period that included Fosca in Passion, Cora in Anyone Can Whistle, two roles in Sunday in the Park with George and, of course, Rose in Gypsy, for which she won her second Tony in 2009.

I never thought in a million years, I would get to do that, she says. It never entered my mind. I hadnt done Stephen Sondheim and had, by that time, kind of written it off and just gured thats the way it goes. That led to the rest of my Sondheim roles and by the end, I nally had my Sondheim canon. Thats why I believe in destiny. If its to be, it will be. LuPone says the regret-tinged name of her act, which shes been performing off and on for about four years, is meant to be taken whimsically, not as any big treatise on regret. The format is loose enough she and accompanist Joseph Thalken, can rotate material in and out as they wish. The beginning of my career, beginning with my childhood, that part doesnt change, but the other songs we rotate a lot. She calls director Scott Wittman, whos gay, her very, very dear friend and says shes lucky to have him in my life both artistically and personally. With the business at hand this weekends concert duly addressed, LuPone is up for anything. She tackles a dizzying array of topics in our remaining moments. She calls same-sex marriage in her beloved New York loooooong overdue. Im thrilled to death and Im sure Ill be attending a lot of weddings, she says. This country is so insane sometimes, so tilted. I wish it would come back to its senses. That theater is so ephemeral and eeting by nature doesnt particularly bother her, she says. Despite last years book, shes not particularly inclined to look back. I have all the cast recordings but I never put them on, she says. I have an archive and scrapbooks thats one of the things that made the book so much easier to do but I dont even have a theater room really. I dont go back and look. Its a memory, a treasured memory, when I nish something. Besides, I cant really look at myself. Im not a big fan of me. She says having work-life balance, even in the arts, is important: You have nothing to bring to the boards if youre only living for the boards, she says. But does she care about her legacy since her greatest hits, so to speak, have been on the stage? Of course you care, but theres plenty of stuff on YouTube. Besides, the memory of it is always better than the actual footage. You cant really lm a theatrical production adequately. Seeing them on camera just doesnt do them justice. She admits shes had a beef for years with big-name movie stars swooping onto Broadway for brief runs and special treatment that sometimes even wins them Tonys. LuPone says for actors like her, whove made their career largely on stage, its highly frustrating. [The producers] will say, Forget you, I can get so and so, she says. But to do it

well, you really have to have the chops for it, the years of training. It must be maddening too, when movie stars of dubious talent land lm adaptations much more talented, but lesser known, stage stars originated, right? LuPone says yes and no. She admits there are lm treasures that can be equally good, but other times the casting is really ridiculous. Its not just money, though. LuPone says some actors have talent that merely translates better to either the stage or screen as the case may be. The difference, largely, is projection, she says. If they have no talent and theyre in the movie musical, then yeah, of course Im pissed off. But on stage you have to hit the balcony. The delivery is so much larger. Film is a much stiller medium. People tell me I have a stage face. Its too big for the camera, whatever that means. As soon as the words are out of her mouth, she thinks of exceptions and mentions Irene Papas and Anna Magnani. As one would imagine, LuPone writes at length in her book about her experience on stage with Andrew Lloyd Webbers Evita, for which she won her rst Tony. Curiously missing, though, is any mention of the 1996 lm version with Madonna. Yes, its true she was offered a cameo as Evitas mother LuPone laughs heartily recalling it but it was for a previous incarnation of the lm years before the Madonna version got off the ground. She claims not to have seen the Madonna version. I saw a little of it on the treadmill once, she says. It looked like a bore. There was no reason to see it. Broadway, she says, has suffered the same shortsightedness that also ails the recording industry and TV. Talent that doesnt hit big right out of the gate nowadays is dead in the water. In the past there were producers who supported and nurtured young composers and lyricists, who developed them and stuck with them. I was able to grow with a lot of these young playwrights and the audience was able to grow too. Now Times Square looks like a tawdry Las Vegas and people dont know what theyre looking for other than a chance to make a lot of money. Its the same thing with TV. I turn the TV on and just scream at my husband. Its the most boring piece of shit and theres more commercial time than there is dramatic time. Dont even get me started on reality TV. Its a bunch of coddling of stupid, ignorant people. While it doesnt take much to get LuPone ranting and lamenting, neither is it hard to induce warmth and delight. Shes thrilled to reunite with her Evita costar, Broadway legend Mandy Patinkin, for a joint show on Broadway this fall. Its great, she says. Very rarely do you get to work with someone again. For the most part it doesnt ever happen, at least for me. But with Mandy, are you kidding? I adore him. Hopefully well sell.

Best of the books

LGBT themes liberally peppered through slated fall releases
By TERRI SCHLICHENMEYER
Books, much cheaper than movies or TV shows to produce, provide the most copious bounty of LGBT options. Among the highlights: If you want something thats going to last you most of the winter, try Black Like Us: A Century of Gay, Lesbian, and Bisexual African American Fiction, compiled by Don Weise (Cleis Press, October). This brick of a book gathers the works several of your favorite authors, some of whom you might not know are gay. This is the kind of book you can get lost in and at 555 pages, youll be lost a while. The Unreal Life of Sergey Nabokov by Paul Russell (Cleis Press, November) is based on the real life of the gay brother of Vladimir Nabokov and tells the ctional story of Sergeys life, his contemporaries, his loves and his heartbreaking end in Berlin. Youll also want to check out Historys Passions: Stories of Sex Before Stonewall, edited by Richard Labonte (Bold Strokes Books, November). This anthology, written by four award-winning authors, imagines the lives of loving men in various historical settings. For young adult readers, check out Swimming in Chicago by David-Matthew Barnes (Bold Strokes Books, October). In this novel, a young man is dealing with his mothers suicide with the help of his best girl friend and an intriguing new love. Another book for teens is Speaking Out: LGBTQ Youth Stand Up by Steve Berman (Bold Strokes, September). In this book, young adults will read stories of adversity overcome, problems solved, issues brought forth, and what they can look forward to. In The Strangers Child by Alan Hollinghurst (Knopf, October), its 1913 and a young man has brought a love interest home with him from boarding school, only to have his sister fall for the boy, too. But with a few innocent words in an autograph book, secrets are buried shallowly and the young man and his entire family are changed for several generations. This is one of those sweeping novels that youll want to save for a rainy weekend day. Tom of Finland Life and Work of a Gay Hero by F. Valentine Hooven III (Bruno Gmunder Verlag Gmbh, November), a compilation, looks at Toms drawings from the earliest to more current times, and includes a biography. And if photography is the art you love most, check out Jim French Diaries: The Creator of Colt Studio by Jim French (also from Bruno Gmunder Verlag Gmbh, October). Youll also love paging through Gay in America, portraits by Scott Paseld (September, Welcome Books). In this gorgeously illustrated book, youll nd intimate and personal photography of gay men from around the country, taken over three years. Christmas Remembered by Tom Mendicino, Frank Anthony Polito, and Michael Salvatore (Kensington, September) is a three-story collection that brings back memories of holidays shared, holidays cherished and holidays best forgotten. Second You Sin by Scott Sherman (Kensington, September) is a thrillerwhodunit, in which part-time sleuth/call boy Kevin Connor must solve the murders of several New York City male prostitutes. Another mystery youll love this fall is Hells Highway by Gerri Hill (Bella Books, December). Someone thinks Californias Mojave Desert is the perfect place to dispose of womens bodies. On the case are FBI Agents Cameron Ross and Andrea Sullivan, two women who are more than just partners at work. Can their commitment to each other withstand the sand, the heat, and the mind of a diabolical killer?

Compromise to avoid relationship enders

Family, money and friends can pose problems early on
compromise with your partner on many different levels is hard work. One of the more challenging issues couples face that has to include a little give and take is agreeing on how money will be spent in the relationship. The nancial piece of partnership is something that typically comes with maturity of a relationship. There is no need to break this down on your third date. You and your partner should agree on distribution of nances in the lifestyle you live together. It doesnt matter if there is a discrepancy in income, but there needs to be a mutual understanding of how money is spent because this will cause issues (potentially relationship ending ones) if not explored. Have you ever loved dating someone but hated her/his family? Again, heres where youve got to do a little dirty work to keep your partner happy. If your partner says it is very important for you to attend dinner at Aunt Marges house on Sunday, you should put on a smile and a clean shirt and go. Do you need to go every weekend? Denitely not. Compromise on family visits because they arent going anywhere either. Another common issue in relationships is nding a compromise on time spent together versus being independent. To clarify, in most partnerships, one person enjoys more alone time than the other. Neither way is better than the other, but when communication isnt direct and open about this, one person can be left feeling hurt that the other person was ignoring them or not prioritizing them. Compromising with your partner is especially important for the healthy survival of your relationship if you are dating long distance. Be open and understanding to your partners needs without ignoring your own. In most long distance relationships, heavy issues such as nances, personal space and family time dont come up as often. The topics should not be avoided, however, because once you start to live in the same city, you run the risk of a relationship meltdown since personal preferences have been ignored and compromises yet to be agreed upon. Finding a life partner and being in a fullling, loving relationship is hard work and involves a lot of compromising. Partnerships require balance between both people. Remember that compromising doesnt have to mean losing control it means you are taking a proactive approach to understanding you and your partners differences. If theres anyone who thinks relationships are easy, theyre wrong. Maintaining a healthy relationship takes lots of compromise. This shouldnt be too daunting a task because when you care about someone, working to keep the relationship free of issues is something you wont mind doing. We admit guring out when and how often to compromise with your partner is sometimes confusing. Knowing when to throw in the towel is also important to understand. Start with yourself know your must haves and never wants before entering a relationship. There is a chance that youll still have to bend a bit on these issues, but for the most part, you can stick to your guns. There are a few non-negotiable issues most couples will agree that working on a compromise together will probably be a waste of time. These obvious relationship enders include just about everything that involves your partner treating you poorly emotionally, physically or mentally. Unless your relationship is an open one, cheating usually results in ending the relationship, without talk of compromise. Another relationship matter thats hard to compromise on is individual social groups. If you dont like your partners buddies, there is a good chance that this group isnt going anywhere just because you took a liking to their friend. You wont be able to keep your partner on a leash and with you 24/7. Get out of this relationship and move on. Another reason to run? If (s)he isnt willing to compromise, on anything, ever. Being inexible is a quality that is difcult to get on with. Being understanding and adaptable is attractive. Roll up your sleeves now: Coming to a

Botox is just one way to improve your appearance.

The art of looking good

Tips for improving your skin and shrinking your waistline
By DR. ROBERTA PALESTINE
There is a certain art to looking good, as you no doubt have discovered. Its human nature to improve ourselves in all aspects, and looking good is no exception. Many people know the behind-the-scenes tricks and tips, but do you? There are so many ways to improve almost anything on your face or body, the only secret is knowing whats out there and where to go. The rst important tip is to always see a board-certied dermatologist. There are several reasons for this. First, before having any cosmetic procedure you should always have your skin checked to make sure its healthy. Not only should you be getting an annual total body skin exam, but your dermatologist will be checking for anything suspicious while also advising you on treatments. The great thing about seeing a dermatologist who is both medical and cosmetic is that they have the unique blend that will optimally help you look your best. For instance, our motto is Blending Beauty with Medicine. A good cosmetic dermatologist will be up-to-date on the latest technology, and look for ways to enhance and improve your appearance through clinically proven methods. There is no need to waste your hard-earned money in places that do not offer clinical results. These days so many options are out there, that its easy to nd the treatments that work for you. Look for a practice that offers variety, to get the best results. Look for practices that have many options so that you and your doctor can come up with a customized plan. Now the fun part: How to look your best, while still looking like you? There are so many options to improve your appearance. Lets start with the face. Here are just a few of the things you can do: Botox and Dysport: Anti-Aging/ Anti-Wrinkle. Safely, simply and effectively improve the appearance of frown lines, forehead creases and crows feet. Dermal llers: Restalyne, Perlane, Juvderm, Radiesse, and Sculptra. Reverse sagging around the mouth/lips, under the eyes and plump up sunken cheeks. Fraxel Laser Treatment for Skin Rejuvenation to repair sun damage, improve the tone and texture of your skin and remove years from your appearance. Treats wrinkles, irregular texture, sun spots and age spots, and acne scars. IPL Laser Treatment Photo Facial/ Photo Rejuvenation Therapy. Intense Pulsed Light allows physicians to treat age and sun spots with this highly effective treatment for skin conditions associated with aging, an active lifestyle and sun damage. Treats brown spots, rosacea, redness and ushing, and small facial veins, and uneven coloration. Thermage treatment for a more youthful appearance. Tightens, contours and rejuvenates facial skin. All of these are non-invasive procedures with minimal to no downtime. What about your body? You diet, you exercise, you deny yourself dessert or the extra glass of wine, but you still have love handles that wont budge, or a belt that keeps moving up a notch. You know about liposuction, but what if you dont want surgery? There is a new and incredible technology called CoolSculpting by Zeltiq. It is a non-invasive and safe way to reduce fat without surgery. CoolSculpting targets fat cells, which are then eliminated through the bodys natural processes. CoolSculpting can be done in an hour, and you can return to normal activity immediately afterward, and it does not require any special diet or exercise programs. It is ideal for love handles, spare tires, and back fat. There are so many ways to look your best, you only need to nd a good cosmetic dermatologist and ask. It is an art, it is a science, and it is a passion.

Local Pet Boutique demonstrates the art of dog adoption

Studies have shown that owning a dog can add up to 10 years to your life. This research is based on the effectiveness of pet-owner relationships in reducing stress and preventing depression. Even senior citizen facilities are nding that having pets around elderly residents provides companionship, comfort and a positive outlook. The optimal place to search for your perfect dog or puppy is your local animal shelter or rescue group. They have endless varieties of pure breeds, mixed breeds and dogs of every age, size and shape. Many of these rescue dogs were initially owned by people with unrealistic expectations or the inability to adequately take care of their pets emotional and physical needs. These sweet dogs are anxiously waiting for new homes and loving owners. There are so many wonderful personal returns in dog adoption. Unfortunately, national gures indicate that about half the animals who end up in shelters are euthanized when there is a lack of caring owners who are willing and ready to step forward and provide them with loving homes. Wagtime Pet Spa and Boutique is a proud, active participant in a volunteer program with many local area shelters and rescue groups including Lucky Dog Animal Rescue, the Washington Animal Rescue League and Jasmines House. In addition to hosting adoption events and donating food and products to shelters, we also provide a free foster environment for up to 20 rescue dogs at our downtown D.C. facility. Fostering these dogs gives us the opportunity to work with and observe the pets temperaments and personalities rst hand. Our staff is exceptionally qualied to answer your questions about each dog and we can help

Our own gallery walls

By Valerie M. Blake Prudential Carruthers realTOrS
Writer and poet Oscar Wilde said, Art is the most intense mode of individualism that the world has known. Just look around your own home and youll know its true. We all go to open houses now and then, whether were searching for a home, checking out the competition, being nosy neighbors or looking for new decorating ideas. What we see on the walls can range from personal photos to framed posters to one-of-a-kind pieces from renowned artists. And our responses run the gamut from How stunning! to What were they thinking? When I first visit a home that I may be hired to sell I look at it with a critical eye, not to pass judgment on the taste of the owner but to determine whether there are improvements that should be made. I tell my clients that now is not the time to showcase their individualism but to focus on cleanliness, order and a model home flair that appeals to the mass market. Frequently, I recommend removing and storing personal photos and other items that may have a special place in your heart (but not on your walls) so they are not distracting to a buyer whose primary goal is to determine whether your home will be the one to buy. Most of us have had an I love me wall at some time in our lives. You know the one I mean. Its usually in the den, family room, or home office. First theres the photo of your high school team with your beaming smile as you hold the trophy you won in your junior year or perhaps its the group photo signed by the cast of the senior play when you starred as Little Orphan Annie. Next comes the high school diploma, the baccalaureate, one or two framed advanced degrees, a series of work or community-oriented awards and commendations and finally, the photo of you shaking hands with (insert name of politician or community activist of choice here). In the foyer, along the stairwell, or above the fireplace mantel one often finds the portrait wall where your family history is proudly displayed for all to see. Beginning with the black-and-white photo of your grandparents standing in American Gothic pose at their wedding, we move on to an unidentified child in a frilly dress or short pants who grew up to be your mother or father. There may be a few pictures of you as a baby, but probably the ones taken in the bath tub and on the bear skin rug have been relegated to the shoe box under the bed. The cap and gown photo comes next followed by the wedding pictures and candid shots of the happy couple, ending in some cases with a plethora of photos of the newest addition to the family. The parent wall isnt really a wall at all its the refrigerator. Think class schedules and calendars of after school events. Add homework assignments marked A+ and a crude but adorable Crayola drawing of a stick figure family standing in front of a house. Mix in a dozen magnets, a grocery list and an appointment reminder card from the orthodontist and there you have it. Once in a while I still run into what I call a Picasso wall one that pays homage to his blue period. And when I say

blue, I mean theres some stuff out there on peoples night tables or hanging over their beds that would make Logan McCree blush! You never really know what will offend someone. I have seen buyers cringe at Botticellis The Birth of Venus, giggle nervously at Klimts Adam and Eve and shield their childrens eyes from photos of the International Mr. Leather competition. Keep that in mind as I did while preparing my house for the local Home and Garden Tour last spring, reluctantly removing a tasteful-yet-revealing piece of

personal art from my own bedroom wall. So do you need to keep your surfaces art-free to attract a buyer? Absolutely not. Just remove the personal items, add some spackle and fresh paint and accent with pieces that are stylish, colorful and sized appropriately for the wall or room. And leave the refrigerator naked, in honor of Picasso.
