O R D E R: Government after careful e xamination of the matter in detail issue the following orders: 1. PROCEDURE FOR OBGTAINING BUILDING PERMIT :1.1. No person shall carry out any development or bu ilding construction activigty without obtainingpermit from the Authority, except in the following cases and unless exempted by State or CentralActs/Rules/Orders :- (a) No prior sanction of building applications are necessary for the construc tion of individual residentialbuildings in plots upto 100 Sq.mtrs. and height re stricted to 10 Mtrs. I.e. Ground + 2 Upper Floors(without stilts) subject to the following conditions:i. such plot should be less than or equal to 100 Sq.mtrs. as per the following:a. Part of an approved layout or sub-division.b. Allotted b y or purchased from a public agency like Housing Board,Housing Corporationetc.c. Covered byb pattas issued by Revenue Department.d. T.S. Record or Registered Sa le Deed of Date prior to the date of these Orders.ii. the construction shall be carried out, strictly in accordance with the MasterPlan/Z.D.P., ZoningRegulation s, Building Bye-laws/Rules etc.iii. the owner shall file with the local authorit y, copies of drawings of proposedbuilding along withnecessary fee/charges as fix ed by the local authoritiestogether with attested copies of ownershipdocuments a nd layout plan beforeundertaking the construction.iv. the owner shall file with the local authority an undertaking starting that he shall leave andsurrender lan d for road widening, if any, free of cost and he will not violate any rules, bui lding HUDA-BUILDING BYE LAWS Page 2 bye-laws, and that in case of violations the local authority would be at liberty to summarily removesuch deviations without prior notice and at owners cost.v. such application filed with the local authori ty shall be valid for a period of 3 years for completion ofbuilding and it would be mandatory to file building completion certificate with the concerned localau thorities. (b) In respect of construction of individual Residential buildings in plots upto 300 Sq.mtrs. and heightupto 10 mtrs. I.e., Ground + two Upper floors (without stilts) no prior approval from the localauthority/Urban Development Au thority is necessary, provided: that such type of individual residentialbuilding s are got approved from empanelled licensed personnel i.e., qualified Architects , Engineers,Town Planners and Surveyors; and it shall be ensured by the licensed technical personnel that theconstruction is undertaken and carried out as per t he approved building plans. Such plots should frompart of an layout or sub-divis ion approved by the competent Authority. Further,i. The licenced technical perso nnel shall be completely and solely responsible for ensuring that suchresidentia l buildings conforms to all regulations, bye-laws, other stipulations in force.i i. The construction shall be commenced by the owner only after filing with the l ocal authority a copy ofthe building drawings approved by the licensed technical personnel along with prescribed fee/chargesas fixed by the local authority toge

ther with attested ownership documents, copy of layout/sub-divisionetc., in the prescribed format.iii. The owners shall file an undertaking stating that he shal l leave & surrender the land affected in roadwidening if any, fee of cost and th at, he shall not violate any Regulations, bye-laws or the approveddrawings signe d by the licensed technical personnel and in case of any violations, the local a uthoritywould be at liberty to summarily remove the same without prior notice at the owners cost.iv. Such building drawings approved by the licenced technical p ersonnel shall be valid for three yearsfrom the date of filing a copy of approve d building drawing with the local authority, Building completionCertificate shal l be filed by the owner with the local authority through the licenced technical personnelwithin this period.v. If it comes to the notice of the local authority that the approval of building drawings are in violation ofrules or if the facts have been mis-represented in the following cases, the licensed technical personn elwill be held solely responsible and his license will e liable for cancellation , disqualification, etc.a. If the building proposal is approved in a plot formin g part of unauthorized Layout, or sub-division.b. If the building proposal is ap proved in violation of Zoning Regulations, Bye-laws, MasterPlan/Zonal Developmen t Plan etc.c. If the building proposal is approved in a plot of 300 Sq. mtrs. Or less but the same isactually having an extent more than 300 sq. mtrs. on ground .d. Where the dimensions of the plot are not tallying with documentary plan, gro und situationto that of sanction plan by licensed technical personnel.e. if the site details are wrongly represented in the drawings.vi) If it come to the notic e of the local authority that the owner after obtaining sanction of building by thelicenced technical person takes up the construction in violation of Rules, Re gulations etc., and againstsanctioned plan, action will be taken against such co nstruction as per rules including demolition by thelocal authority. HUDA-BUILDIN G BYE LAWS Page 3 vii) The local authority shall also monitor the construction o f above buildings and take necessary actionagainst unauthorised constructions/de viations as per rules. 1.2 However, any person can also apply to the concerned l ocal authority for sanction in respect ofbuildings in plots upto and including 3 00 Sq.mtrs. 1.3 For all other types of residential and non-residential buildings prior written permission of the localauthority/Urban Development Authority is n ecessary. 2. TIME LIMIT FOR GRANT OR REFUSAL OF BUILDING APPLICATION 2.1The time limit for disposal of building applications is as follows: a) Individual Reside ntial Buildings .. 15 days b) Other Buildings .. 30 days 2.2. If within the spec ified time period mentioned above the authority fails to intimate in writing to theperson or body who has submitted the application for building sanction its de cision of refusal orsanction, such applications together with plans and statemen ts shall be deemed to have beensanctioned, provided the deemed sanction shall no t be construed as authorising any such person orbody to carryout the constructio n or works in contravention of or against any regulations bye-laws or anyother l aw in force. 3. REVIEW OF REJECTIN OF BUILDING APPLICATIONS: 3.1 After rejection of building applications on technical grounds and within seven days Of such ref usalthe architect/Licenced Technical personnel and owner may represent the case to the local body on anyworking day between 3.00 p.m. to 5.00 p.m.After hearing, the concerned Authority shall communicate itsdecision on the representation wit hin ten days of such hearing.3.2. If the architect or owner or both are not sati sfied with the decision on their representation then hemay file a review petitio n along with 25% of permit fee together with reasons and grounds for reviewingea rlier decisions. The Review Petition shall be referred to a SELECT COMMITTEE who se decisionsshall be final. The SELECT COMMITTEE shall consist of the following: a. Two Practising Architects.b. One Retired Town Planner not below the rank of Joint Director At the time of Retirement.c. Chief City Planner/City Planner of c oncerned local authority or ChiefPlanningOfficer/Planning Officer of concerned U rban Development Authority who shall bethe conveners of the Committee for the ca ses of their jurisdiction.3.3 The Select Committee shall meet with in seven days from the date of review Petition filed andcommunicate its decision within ten d ays of its meeting. HUDA-BUILDING BYE LAWS Page 5 ** N o height restriction subject to setbacks as per rules and clearances from Fire S ervices &Airport Authority & as per the stipulations of Multi-storied Building R egulations. In case of individual residential building 15% of permissible F.A.R. shall be added forcalculation of gross FAR for areas such as garage, servant ro om, balconies, staircase, andportico. The common areas shall be included in the calculation of gross FAR by adding 30% ofprescribed FAR in the case of Group Hou sing/Apartment. In the case of Commercial/Institutional Buildings the Gross FAR shall be calculated by adding35% of the prescribed FAR. Common areas shall inclu de: a. Air-conditioning plant room, electrical transformer cabin, pump, - house. b. Watchman booth, garbage shaft. c. Corridors, Staircase, Lift blocks. d. Balc onies. The width of the balcony shall not be more than 1.2 mtrs. if the building setback is 4.00 mtrs.If the building setback is 5.00 mtrs. and above the maximu m width of the balcony can be 1.5 mtrs. 4.3 FOR EXAMPLE: In a plot proposed for Apartment complex/Group Housing Scheme, if theprescribed permissible FAR is 1.50 then the gross FAR shall be 1.50 + 30% of 1.50 = 1.95which shall include all co mmon areas & structures (excluding parking areas to be provided)and as illustrat ed below: BuildingOccupancyPlotsizePrescribedFARGross FAR (inclusive of common/ Areas structures exceptingParking areas.Total buildable area including common ar eas (exceptparking area in sq.mtrs.).Residential 1000 1.5 1.5 + 30% of 1.5 = 1.9 5 1950Non-Residential. 1000 1.5 1.5 + 35% of 1.5 = 2.025 2025 HUDA-BUILDING BYE LAWS Page 6 9. Minim plot size. 50 Sq.mtr. iii) Minimum width of plot 4.5 to 8.0 Mtr. iv) Minimum idth of internal road 9. 00 Mtr.v) Maximum No. of Plot permissible in a row. 8 vi) Minimum space between two blocks/row 6 mtrs. vii) Building set backs .. Front. 3.0 mtrs. .. Rear. 1.50 mtrs. viii) Maximum height of the building 6.00 mtrs. i.e.(Gro nd=One Upper floor) ix) Minimum Open space (park) in plots .. 10% ,,2000 Sq.mtrs . & above.x) Corner plots shall be splayed with 3 mtrs.B. ceeding 3 x 6 mtrs. in size with a maximum height of 2.50 mtrs. will be alloweda butting rear and side boundary only in case of plots of 300 Sq.mtrs. and above.B . A servant room not exceeding 9.0 Sq.mtrs. with a latrine of 2.00 Sq.mtrs. in a rea with a maximumheight of 2.75 mtrs. will be permitted in the rear open yard o nly in case of plots having an area of500 Sq.mtrs. and above.C. In case, if the site conditions or the design demands a 10% of relaxation of setbacks (exceptF.A .R) can be availed automatically by the individual in plots upto 300 Sq.mtrs. th is relaxation cannot be availed in respect of FAR and height of the building.D. No stilt Floor shall be allowed in individual residential buildings. If a portio n of the ground floor isused for parking it will be counter in FAR.E. The indivi dual residential buildings shall be permitted with 15% of permissible fAR toward sgarrage, servant room, balconies, staircase and portico. C. GROUP HOUSING / APA RTMENTS SCHEMES: 1. Group Housing Schemes means the development of buildings hav ing FIVE or more multiple dwellingunits and common services on a given site or p lot in single or multiple Blocks, with-out customery sub-division of land by way of individual plots.2. Minimum Plot Area : 450 Sq.mtrs.3. Minimum Abutting Road width : HUDA-BUILDING BYE LAWS Page 8 Group Housing shall be permitted on 12 mt rs. wide roads. However, Group Housing shall Also bepermitted on 9 mtr. Wide roa d subject to handing over of 3 mtrs. wide strip of land on the frontage ofplot t o the local authority free of cost, subject to the conditions that the Remaining plot shall be 450Sq.mtr. or more.The local authority shall pay the area and utl ise it for public purposes. Construction of compound wallwill be permitted after leaving 3 mtr. Wide strip.4. Maximum plot coverage : 40%Maximum permissible F.A .R. : Refer relevant statement5. Building set-back requirements :The following a re the minimum setbacks to bde left around the building: Plot size in Sq.mtrs. F or building height12.0 mtr. Or stilt + three floors. Above 12.0 mtrs. and upto 1 8 mtrs. i.e., stilt + five floors.Upto 1000 3.00 mtrs. 4.00 mtrs.Above 1000 & up to 2000 4.00 mtrs. 5.00 mtrs.Above 2000 5.00 mtrs. 6.00 mtrs. Note: i) In case o f front setback it will be as per building line i.e., 3.00 mts. upto12.0 Mtrs. 4 .00 Mtrs. for12.0 to 18.0 Mtrs. and 6.0 Mtrs. above 18.0Mtrs. road width or setb ack prescribed above whichever ishigher.i. The distance between two blocks shall not be less than half of the heightof the talleeerblock or building.ii. It is p ermitted to transfer one metre of setback from one side to the other side which neednot be uniform and at any given point such transfer should not be more than one metresubject to maintaining of minimum building line in the front.6. Ventila ting spaces for water closets and bathrooms if not open to front, sides or rear open spacesshall open to a ventilation shaft or size not less than 4.00 Sqmtrs. with a minimum of width of 1.5 mtrs. RECREATIONAL OPEN SPACE (TOT-LOT) a) Plot u pto 2000 Sq.mtrs. : 5% of plot areab) Plots above 2000 mtrs. : 10%The area left towards totlot shall be open to sky and should be provided on GroundLevel.In the case of group housing being developed with more than one block, theRecreational open Space may be provided with the mandatory open space between thetwo blocks after 3 metres wide circulation space is left along the building. PARKING REQUIREMENTS The standards of parking requirements for Group Hou sing/Apartments are modified asDetailed below:A. CAR PARKING: Authority Area Are a of Flat Parking Requirement (One car Parking space equal to 20 Sq.mtrs.)1. Mun icipal Corporation Area. a. Below 100 Sqm.b. Above 100 Sqm.1 Car/Every two flats 1 Car/Every one flat2. Other Areas of Urban Dev.Areas excluding Mpl. Corpn.Areas .a. Upto 40 Sqm.b. 40-60 Sqmc. 60-100 Sqmd. Above 100 Sqm.1 Car/Every 4 flats1 C ar/Every 3 flats1 Car/Every 2 flats1 Car/Every one flat3. Visitors Parking 1 Car /Every 10 flats. A. SCOOTER PARKING: For all areas(a) Upto 40 Sqm. 5 Scooters/ev ery six flats.(b) 40-60 Sqm. 3 Scooters/Every four flats.(c) 60-100 Sqm. 1 Scoot er/Every two flats.2. Visitors parking 1 Scooter/Every five flats. i. The parkin g shall be provided only on stilt floors.ii. In plots of 1000 Sq.mtrs. and above , where residential apartments are taken up two stit parkingwill also be permitt ed if necessary. To facilitate this developments, height restriction for constru c-tion on plots of above 1000 Sq.mtrs. is relaxed. However, such constructions s hould adhere totheMulti-storied building regulations.iii. In plots of 2000 Sq.mt rs. and above parking will be allowed in basement and on stilt floor. Thebasemen

t will be allowed from the building line on the front side, on remaining sides i t will bepermitted after leaving 1.5 mtrs. from boundary wall.iv. One set of Toi let of 1.2 M x 2 M separately for ladies and gents shall be provided in the Stil t Floor.This shall not be included in F.A.R.v. Parking requirements shall be dee med to have been fulfilled in a residential Group HousingComplex which is built within the maximum permissible F.A.R. if the entire stilt floor and/orbasement w herever permitted is used for parking except the portion used for the stair case & lift.9. SPECIAL REGULATIONS: 1. The following are the Special Regulations to maintain special characterstics of Banjara Hills andJubilee Hills areas covered by Block No.1 & 2 of Municipal Corporation of Hyderabad, Ward No.8 andPart of Bl ock No.3 of Municipal Corporation of Hyderabad Ward No.8 comprising.a) Areas cov ered by part of the Jubilee Hills Cooperative Housing Society s Layout. b) Areas cov ered by NISIET and Yousufguda Police Lines which fall within Zonal DevelopmentPl ans for the Planning Divisions IV and V.i. Maximum FAR for Residential Buildings .. 1.00ii. Maximum FAR for Notified Commercial Areas .. 1.50 HUDA-BUILDING BYE LAWS Page 10 iii. Minimum road width for commercial complexes subject to land us e as per MasterPlan/ZDP .. 18.00 Mtrs.iv. Maximum permissible height for Residen tial Buildings 10.00 Mtrs. 2. Building Line for plots abutting certain important R oads in Hyderabad.For certain important roads like Inner Ring Road, National Hig h-ways etc., to be notified from time totime and as given hereunder, a minimum b uilding line of 6 mtrs. is prescribed for all, types ofResidential, Institutiona l, Educational and Industrial Buildings.For commercial complexes and mixed occup ancies like shopping on Ground floor and other uses onupper floors a minimum bui lding line of 8 mtrs., is prescribed. However, the Upper floors are allowedwith front setback of 6 metres.However, if the front setback to be provided as per st ipulation is more than the building line mentionedabove, the same shall be provi ded.a. Inner Ring Road.b. Portions of National Highways passing through HUDA Are as.c. Road linking Ameerpet Cross Roads with Greenlands.d. Road between Lakdikap ool to the souther and of public gardens.e. Punjagutta junction to Lakdikapool v iz Khairtabadf. Liberty Junction to Narayanaguda Junction via Himayathnagar.g. L iberty Junction to Nayapool via Abids and Mojamjahi market. FEES AND CHARGES LEV IABLE FOR BUILDING & LAYOUT APPLICATIONS: A. Development Charges (under Section 27 & 28 of the AP Urban Areas (Development) Act, 1975 Rates as given in G.O.Ms No. 51, MA, Dated: 5-2-1996.B. Processing Charges: Building Applications @ Rs. 5/per sq. mt of proposed built up area;Layout applications and Sub-Division applic ations @ Rs 2/- per sq. mt of landC. Stationery & Publication Charges: Rs. 5000/ - per applicationD. In case of plots/sites in unapproved layouts or not forming part of any layout 10% proportionate open space charges and layout charges. E. HUD A Board charges (applicable in Appeal/ NOC Cases)At the time of application only 10% of Processing Charges are collected.
