ARIZONA STAR, TUCSON CITY COUNCIL, LAWYERS SPIN THEMSELVES INTO CORNER ON WARDEN AND THE FIRST AMENDMENT
If Tucson Mayor Bob Walkup thought his arrest last Tuesday of Tucson community activist Roy Warden was going to stop growing public concern regarding the issue of Tucson City Manager Richard Miranda and the apparent theft of more than one half a million dollars in public funds by Tucson City Attorney Mike Rankin, he badly miscalculated. And if the Arizona Daily Star thought their September 18, 2011 story regarding Wardens arrest, and their subsequent blocking of Wardens response to their story, was going to put the final spin on the issue, they are mistaken as well. Moreover; if The Star thought that by publishing the opinions of noted First Amendment attorney Michael Bloom, who apparently finds Wardens comments to be disgusting and Councilman Steve Kozachik, who called Wardens comments racist, they were going to further shape public opinion regarding Wardens conduct, they are flat out wrong, wrong, wrong. I stand by all the things Ive written or said since I burned a Mexican Flag in Armory Park in 2006 in opposition to Tucson City Open Border Policy and the economic policy of the Mexican government, which has been to intentionally exclude their poor to earn remittances, Warden said. Warden says he believes the entire Tucson establishment is opposed to his speech because, over the past five years, he has revealed their vested interest in Open Border Policy. Perhaps Mr. Bloom is disgusted by Wardens opinion that the Pima County Bar has a vested financial interest in Open Border Policy and the continuation of crime, misery and contention created by the presence of large numbers of illegal Mexican citizens in our community. Maybe Mr. Kozachik finds racist Wardens opinion that ProRaza, Kill the Gringo and send them back to Plymouth Rock rhetoric is vile, left wing propaganda, or maybe he thinks whoever burns a Mexican Flag or criticizes an Hispanic public official is a racist, per-se.

Whatever. In 2006 the Southern Poverty Law Center called Warden a racist and perhaps the most dangerous character to emerge in this years immigration debate. Youd think that the partisan dominated media would afford such a dangerous character an interview, an opportunity to express his viewpoint and embarrass himself, so the public could read his words and see for themselves just what a rascal he really is, wouldnt you? Not so. Not even once. Warden says hes had more than several substantive interviews with the media, some by national commentators, none of which has ever seen the light of day. CNN Rick Sanchez once told me, Roy, I can sell left wing propaganda and right wing racism, but nobody will dare to publish what you have to say. Warden, who has spent the last 5 years investigating Open Border Policy and the corruption of local media and legal institutions, says the era of media spin and vituperation regarding his conduct is nearing an end. He says his recent arrest will eventually bring the issue of Open Border Policy and Tucson City corruption into clear public view. Ive spent half a decade investigating and writing about the Pima County Good Ole Boys and the subject of Tucson City corruption, Warden says. Ive read numerous court documents and filed Public Record Requests under Title 39, all of which has revealed the apparent theft of more than one half a million dollars in public funds to pay the personal debts of Tucson City Officials, including Tucson City Manager Richard Miranda. On numerous occasions, ever since May 2011, Ive brought this issue to the attention of Mayor Walkup and the Tucson City Council and they refuse to look into it, or even comment on it, says Warden. Instead of taking action on his charges, the Mayor and Council have blocked Wardens speech, called it impertinent, racist and scandalous, and have had him arrested.

Now Warden says the time for making charge and counter charge is over. The media and public are going to have to review his commentary to the Tucson City Council, and examine the underlying charges. Theyre doing to me just what they did to Kevin Gilmartin, and Im not going to shut up about it, he said. Warden says that within the next several weeks hell file a Special Action in Pima County Superior Court to overturn Tucson City Policy regarding free speech before the Tucson City Council. Ever since I was first arrested for burning the Mexican Flag in 2006 the local bar, and the ACLU, has turned down my plea for help on First Amendment issues, time and time again. If Mr. Bloom, the First Amendment Coalition and the ACLU those staunch defenders of libertywant to put their money where their mouth is, if they are really interested in First Amendment issues, they can assist me with Amicus Briefs or they can stay out of my way, Warden says.
