I haven't seen this specific piece of info but one of the concerns about e-cigarettes, orbs, snus, etc is the lack of standardization of nicotine content and about the non-tobacco contents which are often unknown and potentially hazardous.

I just saw on this webpage http://tobaccoproducts.org/index.php/Camel_Sticks,_Camel_Orbs_and_Camel_Strips that the amount of nicotine from these products can be much higher (and last longer) than a cigarette. Sounds bad to me.

Unless you have a pressing feeling that one of the three directions take precedence, I think it makes sense to wait until Jan or Feb (it may take a month to have committee assignments worked out) and to continue any internal reorganization or strategic planning.

For the BOH meeting, I think we just need to respond in a timely fashion to the request to learn more about ecigarettes, Orbs, Strips, and Sticks. It could simply be: show some pictures of what they are, quote literature about the public health concerns, and state that we will see how it fits into our work plan after we come back to the BOH next year.

Let me know what you think.

Joby sent an email yesterday asking about an e-cigarette presentation. I spoke with Steve about it. Steve and I feel that you, Steve, Joby and I should meet to discuss next steps with the Board since we really didn't have an opportunity to get direction from them at the study session. Steve believes we should wait until at least January before raising additional tobacco policy issues with the board since we'll have new board members in 2011.

I can prepare a brief presentation on e-cigarettes if you would like. I think the question is then, what we'll we expect from the Board? Will the purpose be solely for information sharing or do we expect them to take a stance or give direction on e-cigarettes? If we don't expect them to give us direction at the November board meeting it might make more sense to give the e-cigarette presentation at a future study session where we can better discussion policy options.

Hi Anthony, One idea would be to send them info on the alternative tobacco products in their BOH packets or via email. There's a great demonstration of e-cigarettes on YouTube. This would be timely follow-up and would prevent us from having to repeat the presentation with new board members. Even if there's only two new board members their votes could be key to passing a policy or resolution.

One of the policy options, shared with you at the October 20th study session, is to take action which will result in the reduced use of tobacco by youth in Pierce County. As stated in the October presentation results from the Washington State Department of Health's Healthy Youth Survey indicates that the rate of tobacco use in 2008 among 12th grade youth in Pierce county is 21%. The current adult tobacco use rate in Pierce County is 16.9%.

A specific policy option presented on October 20th would be to ban the sale of e-cigarettes to youth in Pierce County. E-cigarettes do not actually contain tobacco so they can currently be sold to youth. Unfortunately, ecigarettes do contain nicotine and other chemicals that are hazardous to health and, while promoted as a way to stop smoking, when taken up by non-smoking youth could be the start of a tobacco addiction.

I've been told by staff at WA State Dept of Health Spokane is now in the process of preparing an ordinance to ban the sale of e-cigarettes in Spokane County. Annie......our Director (Dr. Anthony LT Chen) recently provided to all of the members of the Board of Health some information about e-cigs, including information about the resolution passed on Oct 5 by the board of the Spokane Regional Health District regarding "requesting that jurisdictions in Spokane County adopt policies prohibiting the sale of e-cigs and their component parts to minors." Dr. Chen went on to note that Spokane health department staff were drafting ordinances for use/adoption by local towns and cities.

So from my perspective Dr. Chen could be priming our board to consider a similar resolution. Unlike Spokane and King County health departments, we have yet to take the necessary steps to allow for full enforcement and the issuing of civil fines for violations of 70.160. But.....I do have as an assignment from my boss to start working on a resolution. I advised him that my first cut would probably include any and all of the harshest terms and the most fines (the reinspection fees can be very expensive once you start doing a full costing of staff time) implemented by other health departments in Washington State. I have 7-8 examples of resolutions/practices from other counties. If you, or anyone you know, have some examples please send them my way.

It would be great if you could join us at our December 3 TAP Summit meeting. Your work and insight about what's going on (or should be going on) in the anti-tobacco world would be very beneficial.

I shared that and he followed up with "and are you in agreement with PHSKC's ban?" "Are you going to follow suit?" I explained that we had presented information to the Board of Health last month about the health impacts of ecigarettes and nicotine candy but were still in the exploration phase to determine our options.

He asked for a timeline and I said we did not have one but were actively engaged in exploring what we could do about the health impacts on youth of e-cigarettes and the nicotine candy.

Dear Bruce, A federal appeals court recently issued a decision allowing e-cigarettes to continue to be legally sold in the United States under federal law. (E-cigarettes are battery-powered devices that provide inhaled doses of nicotine and, when used, emit vapor rather than smoke.) In 2009 the U.S. Food and Drug Administration (FDA) moved to establish authority over e-cigarettes as drugs or drug delivery devices by blocking the import of new e-cigarette shipments into the U.S. However, this month the court ruled in Sottera v. FDA that the FDA does not have the authority to continue to block the shipments. The court's decision does not necessarily apply to all e-cigarettes on the market. If an e-cigarette company markets its products as a smoking cessation aid, the FDA may still have the authority to regulate it as a drug or drug delivery device. The ruling also does not diminish the power of state or local governments to pass laws restricting e-cigarettes' sale or use. The FDA may choose to appeal the ruling to the U.S. Supreme Court. She said that so far she has about 20 customers. I told her that the BOH was considering a law prohibiting the sale of e-cigs to anyone less than 18. She said that she doesn't sell to anyone less than 18. She's hopeful that the BOH doesn't enact all of the prohibitions on using e-cigs as was approved by the King County BOH. I took the opportunity of this visit to provide her with one of my normal tobacco business kits. She said that she would be putting up one of the Mtn cling signs.

What I don't have covered is the legislative tracking form. I believe George has been completing the bill summary document, but someone, either you or George, should go to Sharepoint, click on "Legislative Tracking" and click on "EH" and enter the info for the bills mentioned below. These are the only ones that I'm aware of that pertain to Tobacco. Anthony and Steve routinely go to this spreadsheet to see check on bills.

Also, are there any PAN related bills that we should be tracking? If so, it would be good to designate someone from PAN to track in Sharepoint.

Thing should slow down by Feb. 18th. For non-budget related bills that don't make it out of committee, they're effectively dead. The number of surviving bills really dwindles at this point.

Christopher or Scott may have better local information than what I provided below. 1246/ 5380 would 1) Ban flavored tobacco (this appears to include e-cigarettes) 2) Require tobacco to be behind the counter 3) Remove preemption so locals could pass more restrictive tobacco ordinances and/or have local taxes 1246 just got a hearing yesterday 5016 would ban smoking in cars with kids under 18. Penalty would be a secondary infraction. Got a hearing and is scheduled for executive action today, so we'll see if it moves or not at 3:30 pm. 5039 would require insurance policies to cover cessation benefits. Got a hearing and was scheduled for executive action, but the lengthy testimony on marijuana pushed it off the agenda. HB 1683 and SB 5542 would allow cigar bars and tobacco retailers to have an endorsement allowing smoking. Cigar bars would have a $15,000 fee and tobacco shops would have a $5000 fee. One bill would deposit the money into education legacy fund that provides scholarships. The other bill puts money into a trust fund for basic health plan. No hearing scheduled yet. At the local level, King County put restrictions on e-cigarettes that includes: * restrict the sales of e-cigarettes or any other unapproved nicotine delivery devices only to people 18 and older; * prohibit free or highly discounted electronic smoking devices or unapproved nicotine delivery products; * prohibit the use of e-cigarette devices in places where smoking is prohibited by law. http://www.kingcounty.gov/council/news/2010/December/JP_Ecig.aspx I wasn't able to find any definitive document that the City of Spokane has passed its ban on sale of e-cigarettes to minors, but it is in the works. The actual final wording will be contained in different "Title" sections in the "Code of the Board of Health Seattle King County." Changes to Title sections are document using the type of form dated Sept 17, 2010, that Frank just provided. In December another form of this type, or "resolution," was passed by the PHSKC BOH adopting terms limiting the sale of e-cigs and where they can be used.

I believe that then all of the changes to their smoking policies (Sept 2010 and Dec 2010) got incorporated into an updated version of their Title 19.

The terms that PHSKC adopted on e-cigs were included in my second draft on the resolution that I provided to Frank on Dec 28.

1. Welcome and Introductions

New attendees to TAP: Kirsten Frandsen is now the manager of the Health Departments Tobacco Program.

2. Brief Announcements and Upcoming Events

Heidi This week Franciscan Health Systems implemented a tobacco-free hiring policy. All current tobacco users will be grandfathered in and not be required to quit, but will be given encouragement and support to quit.

Auburn Valley YMCA grant was renewed from the Muckleshoot Indian Tribe for a tobacco cessation and education program. The work will focus on Muckleshoot tribal youth, Free support groups, free workshops, community and medical provider education, and expanding the program to the YMCAs of Greater Seattle, teaching them about developing partnerships with their local hospitals and health departments, and Auburn businesses helping employees quit tobacco.

API New Year celebration on February 12 at the Tacoma Dome.

A retail shop in Lakewood has a machine for customers to make their own cigarettes. Bruce The US Bureau of Alcohol, Firearms and Tobacco (responsible for collecting and administering the $10/carton federal tax on tobacco) has initiated a suit claiming taxes owed on the use of these machines. A federal judge did not support the issuing of an immediate injunction to collect any taxes. The parties are to begin meetings in February.

Pat In the latest Time magazine there was an e-cig ad that took up one whole page.

Leonard Provided information on getting materials on the FDAs Break the Chain campaign from The FDA Center for Tobacco Products Clearing House. Break the Chain deals with not selling tobacco to minors.

Bruce Passed out information about an upcoming webinar on February 10 about the Role of hospitals in Tobacco Cessation, and information about an upcoming teleconference about local opportunities and implications of federal tobacco regulations (to be given by Sarah Ross-Viles).

On regular basis more ads are appearing for smoke-free facilities at local tribal casinos.

Joanna Brought in a copy of magazine based upon the Mad Men TV show. Lots of examples of smoking.

The second (new and improved) edition of Kick ButtsTake Names is now available.

Kirsten The Tobacco Program (now without any funding from the State) is being developed. The primary areas will be secondhand smoke, youth and cessation.

3. January TAP Minutes Approved

4. Drug Free Community Program

Leonard has been working on one of the local Drug Free Community Programs. They are very comprehensive and require a substantial amount of involvement and work. The programs generally include the following: Are funded at the rate of $125,000 per year for 10 years There are several local projects in process at this time Each project has broad community involvement and commitments The Milton-Fife project is related to ZIP codeswhich causes some problems. The projects are coalition driven The priorities of the projects need to deal with marijuana, alcohol and tobacco.

There are five groups with new applications in process. Maybe TAP could get involved with one or more of these projects if they are selected for funding.

5. Legislative News

Annie SB5039 Requiring private insurance companies to cover tobacco cessation treatment. A hearing was held with testimony by Heidi, Meghan Sullivan (TOGETHERThurston), Pat sent a letter of support. Joanna was in attendance. Joanna wrote a letter to her local Sen. Carol (a Republican) seeking his support. The bill moved on to the Rules Committee. Twenty groups showed support for the bill. The insurance companies had four representatives who testified against it.

The bill has now been referred to the Health and Long Term Care Committee. The organs are feeling positive about the bill getting passed this time.

HB1683/SB5542 provides an exemption for cigar lounges and stores from the Smoking In Public Places Act RCW 70.160.On Feb 10 it will be read at the Business Finance Services Committee and its scheduled for an executive session on Feb 11. *Pat wrote a letter to the TNT against this bill, which had many negative comments.

HB1246/SB5380 banning flavored other tobacco products and all dissolvable tobacco.

Greg......here are the Ordinances for SIPP for Sea-King and Kitsap***. For Spokane attached is their "Draft Enforcement Procedure" dated July 19,2010. I have a request in to them for an updated or final version of this procedure. I don't think that they did an ordinance in the same manner as SeaKing and Kitsap. I believe that they decided on their own that they had the authority to issue citations for violations and the $100 civil fine. When they've determined that someone gets a violation letter, they always then do a follow-up first reinspection and charge the business $100. If the business fails that first reinspection, they get another $100 civil fine and a second reinspection with a cost of $200 (I think). It goes up from there.

The Spokane Board of Health did pass Resolution #10-05 regarding restrictions on e-cigs. Copy attached.

Greg......here are the Ordinances for SIPP for Sea-King and Kitsap***. For Spokane attached is their "Draft Enforcement Procedure" dated July 19,2010. I have a request in to them for an updated or final version of this procedure. I don't think that they did an ordinance in the same manner as SeaKing and Kitsap. I believe that they decided on their own that they had the authority to issue citations for violations and the $100 civil fine. When they've determined that someone gets a violation letter, they always then do a follow-up first reinspection and charge the business $100. If the business fails that first reinspection, they get another $100 civil fine and a second reinspection with a cost of $200 (I think). It goes up from there.

The Spokane Board of Health did pass Resolution #10-05 regarding restrictions on e-cigs. Copy attached.

I now sort of have an idea of how PHSKC adopts new policies and regulations. The actual final wording will be contained in different "Title" sections in the "Code of the Board of Health Seattle King County." Changes to Title sections are document using the type of form dated Sept 17, 2010, that Frank just provided. In December another form of this type, or "resolution," was passed by the PHSKC BOH adopting terms limiting the sale of e-cigs and where they can be used.

I believe that then all of the changes to their smoking policies (Sept 2010 and Dec 2010) got incorporated into an updated version of their Title 19.

The terms that PHSKC adopted on e-cigs were included in my second draft on the resolution that I provided to Frank on Dec 28.

I am not sure what Christopher has sent you. Here is some information on e-cigs from our BOH and from the County and City.

I will have to get the final signed versions of the ordinances from the city and county. The city made a couple of amendments prior to passing in relation to the fines so that it matched the county. Also, our attorneys are looking at adding an amendment that gives police/SRHD authority to confiscate the items from youth.

I think that Christopher probably already gave you everything we have on enforcement. I will check with him later
