This report will document the arrest of Joan Renee Zalk for felony menacing (verbal representation) and cruelty to animals following an incident that occurred at or near the intersection of Elm Avenue and Moorehead Avenue in the City of Boulder, County of Boulder and State of Colorado on 9-16-2011 at 0909 hrs. Zalk was arrested and transported to the Boulder County Jail where she was housed. The case is cleared with one adult arrest.

Narrative
On 9-16-2011 at approximately 0913 hrs., Officer M. West and I, Officer K. O'Toole, were dispatched to a felony menacing that stemmed from an animal cruelty call. Animal Control Officer T. Barnes was previously dispatched to the animal cruelty call. The original time and location of the call was at 0909 hrs. at the intersection of Elm Avenue and Moorehead Avenue. The reporting party, later identified as Jeremy Denbow, advised that a woman in a Toyota Camry was "walking her dog" by driving down Moorehead with the dog running along side the vehicle. At approximately 0912 hrs., a second reporting party, later identified as Debra Baros, advised she and another woman, Elizabeth Whaley, confronted the suspect at Street about the treatment of the dog. During that time, the suspect threatened the women by saying, "Excuse me? I have a gun in my car. Do you want me to get it?" While en route, dispatch advised that the suspect drove away from the address and parked at another address close by, Street, and went inside of the house. Dispatch advised the suspect returned to her car, got something out of it and brought it inside of the house again. Animal Control Officer Barnes was first to arrive and spoke briefly with Baros and Whaley. Officer Barnes then advised that the suspect returned outside. Barnes advised he was going to contact the suspect, later identified as Joan Zalk. Officer West advised that the original reporting party took a cell phone photo of Zalk and the dog outside of the car. (Officer Barnes later contacted Denbow and got a copy of the photo and placed it into property and evidence.) Officer West and I arrived shortly after. At the time of my arrival, Barnes was coming out of the house after having looked at the dog, a small tan or brown dog named "Cooper." At the time, Barnes advised the dog appeared to be in good condition. (Please see Officer Barnes' supplemental report for details.) Officer West was in contact with Zalk and I went to speak with the Baros and Whaley. Whaley told me that she was driving in the area of Elm Street and Moorehead when she saw Zalk driving slowly eastbound, approximately 15 to 20 mph. She observed that a small dog was running along side the driver's side of the vehicle while Zalk was holding on to a leash. "That poor dog was running its guts out trying to keep up," Whaley said. Whaley said she drove behind Zalk for sometime trying to determine if Zalk had found a lost dog or the circumstances of why the dog would be running outside of the car. As Whaley followed, Zalk would make motions for her to go around. Whaley said she realized Zalk was "walking the dog" and didn't pass because she wanted to try to stop Zalk. Whaley said a couple of people did pass, Zalk and the running dog. Whaley said it was very dangerous because the dog was running between the two cars. Whaley said she was also concerned for the dog because of on-coming vehicles and the dog was in danger of going under one of the tires. Whaley said she stayed behind Zalk and attempted to have her pull over by honking her horn. (I do not know when or what location Whaley began honking her horn.) Whaley said she followed the vehicle when it turned

southbound on to Street. At approximately , Zalk pulled to the right of the road. Whaley said she believed Zalk was trying to get her to pass. Whaley said she pulled along side of Zalk's vehicle and yelled through the passenger window of her white Volkswagen sedan, "What are you doing?!" Whaley said she did yell at Zalk because she was so upset at how Zalk was treating the dog. According to Whaley, Zalk replied that she was "just walking my dog" and that she "does this all the time." Zalk also said that she just lives up the street and everything was OK, according to Whaley. At approximately this time, Baros arrived in her minvan and parked behind Zalk's vehicle. Baros walked up to the driver's side of Zalk's car and said, "What are you doing?!" Whaley said she told Zalk, "That is not how you walk a dog," and told her to put the dog inside of her car. According to Whaley and Baros, Zalk continued to say its fine and "I live right there." Whaley and Baros again demanded that Zalk stop the "walk" and put the dog inside of the car. At this point, Zalk said, "Excuse me. I have a gun in my car. Do you want me to get it?" Baros said she immediately replied, "Are you threatening me?" Baros said Zalk did not answer her question but said, "I'm going home," put the dog inside of the car, pulled forward, drove approximately 50 feet, to Street, and went inside. Baros said that is when she phoned police. I asked Baros when she first saw Zalk. Baros said she was outside of her home, near Moorehead and Ash Avenue, when she saw Zalk "walking" the dog. Baros said she jumped into her car and began to follow Zalk and Whaley. I asked Baros how she felt when Zalk told her she had a gun in the car. Baros said, "I felt like she was going to use it." I asked if that scared her she said she did. Baros said, "I went to save an animal and she turned it into a hostile situation." I asked Whaley the same question. Whaley said she also believed that Zalk would use a gun. "I took it seriously. I've seen enough in my life to know what can happen," Whaley said. I spoke to Officer West who told me that Zalk said that Zalk admitted that she told the women that she had a gun in the car, but that she did so because she felt threatened by them. Zalk also said that the women blocked her path and felt there was no other way to get out of the situation. Zalk said that she did not have her cell phone in the car to phone police. Officer West also advised that the dog needs to walk "at least three miles a day" or it will go "ballistic." Additionally, West advised that Zalk said she had a concealed weapons permit out of Florida and was currently trying to get a permit for Colorado. However, Zalk said she currently does not own a gun and there was no gun in the car. I spoke with Whaley and Baros again. Again, I asked Whaley how the vehicles were situated. Whaley gave the same account--Zalk pulled over to the right side of the road and Whaley was parallel on the left side of Zalk's vehicle. Baros parked behind Zalk's vehicle, got out and walked to between the cars. I asked if Zalk was blocked in in any way. Whaley said she was not because she could always pull forward, like she did when Zalk eventually left. I asked what Zalk took out of the vehicle after she parked and came back to the vehicle. Whaley said she could not see well from her vantage point. "I didn't feel safe getting very close," Whaley said, but added that it looked like Zalk took several items out of the vehicle, including a pillow at one time. I asked Baros about the position of the vehicles and where people were. Baros gave the same account, except that she believed she parked behind both Whaley and Zalk, in between instead of directly behind Zalk. I asked if Zalk was ever blocked, or in a position where she couldn't leave. Baros said she was not and also pointed out that Zalk did leave without either person moving. Officer Barnes gave both Baros and Whaley voluntary statements and made arrangements to pick them up later. I spoke with Zalk directly. Zalk again said that she felt threatened by Whaley and Baros. Specifically, Zalk said that Baros seemed more aggressive. During the initial contact, Zalk said that Baros and Whaley demanded that she put the dog in the car. Zalk said she explained that she lived just up the street. According to Zalk, Baros was standing along the driver's side of the vehicle near the front fender, put her hand up in a "stop" motion toward Zalk and said, "You're not going anywhere." Zalk said Baros started to walk toward the front of her car, in front of her car. Zalk said Baros was standing in front. Her vehicle was parked behind and Whaley's car was on the left. Zalk

Zalk said, "That's when I kinda lost it. I said, 'Excuse me? I have a gun in the car. Do you want me to get it' At that statement, Zalk said Baros stepped away from her car, walked closer to Whaley's car and said, "Did you hear what she said? (to Whaley) and "Are you threatening me? (to Zalk.) Zalk said she was able to drive away at this point. I placed Zalk under arrest at 1015 hrs. Approximately 15 minutes before, a male friend of Zalk's arrived to the scene. Zalk advised that she and the friend had plans to go climbing. The friend, name unknown to me, declined to care for the dog. Officer Barnes impounded the dog. I transported Zalk to the Boulder County Jail. While en route, Zalk asked about the process and hoped that she could get out of jail quickly so she could still go climbing. Zalk also said she was sorry about trying to rush me on scene for "the end result." Zalk said, "If it is illegal to walk the dog that way, just tell me and I won't do it again. I just wanted to get my warning so I could go inside and pack my climbing gear." At the jail, I spoke with Officer Barnes. He advised that while taking the dog into custody, he observed new cuts and blood around the dog's neck. There was evidence of old blood and scabs also. Officer Barnes said there is lots of fur loss and some bumps around the dog's neck. On scene, Zalk did say the dog suffers from a rash, which she said he contracted at the humane society. Officer Barnes said he took photos of the injuries and rash and was having the dog examined by a vet at the Boulder Humane Society. Officer Barnes also advised that he spoke with the original reporting party, Denbow. Denbow told Barnes that he was "extremely fearful" for the dog the whole time it was running along side the car. Denbow said he also followed Zalk for one fourth to one half a mile, when the dog was running approximately 10-15 mph. Via RIS, I cleared Zalk. She was clear of wants and warrants and had no criminal history. In her wallet, I found a her concealed weapon or firearm license (expired) out of Florida. (See attached copy.) I cited Zalk with felony menacing, verbal representation, (18-3-206) and animal cruelty (18-9-202). Zalk was cooperative during my contact with her.

Narrative
On September 16, 2011 at approximately 0909 hours, I, Officer Taylor Barnes was dispatched by Boulder Police Communications to the area of Moorhead Avenue eastbound from Baseline Road. Dispatch advised the reporting party, Jeremy Denbow, (hereafter referred to as Denbow) stated he took a photo of a person, later identified as Joan Renee Zalk, driving a Toyota Camry while walking a dog on a leash. The vehicle was heading eastbound on Moorhead Avenue from Elm Avenue. At approximately 0910 hours, I went en route to that location.

At approximately 0913 hours, dispatch advised that the vehicle arrived at a residence on Street and that a second reporting party contacted Zalk. The reporting party advised dispatch that Zalk stated she had a gun. At approximately 0913 hours Officer Kathleen O'Toole (hereafter referred to as Officer O'Toole) went en route to that location. At approximately 0914 hours Officer Michael West (hereafter referred to as Officer West) went en route to that location. At approximately 0918 hours, I arrived on Street. I approached Street and observed a woman waving to me, later identified as Elizabeth Whaley (hereafter referred to as Whaley). Whaley stated Zalk parked the vehicle at Street and was carrying items from the car into the home. I observed Zalk exit the residence, walk to the car and take items out of the vehicle and walk towards the house. At approximately 0920 hours I contacted Zalk. I requested to speak with her and to place the items on the ground. I inquired if Zalk had a dog and she replied "yes." I inquired if she had just been walking the dog on a leash while driving a car. She stated "yes, what's the problem?" I requested to examine the dog and Zalk stated "ok, he's fine." I observed a tan and red short hair Chihuahua, neutered male, later identified as an approximately three year old named "Cooper." I was unable to closely examine Cooper as he was barking and charging the front door. Zalk stated Cooper does not like men and that he is nippy. I observed Cooper from the outside of the residence looking through the front glass door. Cooper appeared to be mobile walking on all four legs bearing weight normally. Cooper was not wearing a dog collar. At approximately 0919 hours Officer West arrived on scene and at approximately 0921 hours, Officer O'Toole arrived on scene. Officer West contacted Zalk. Officer O'Toole and I contacted two reporting parties. I spoke with Elizabeth Whaley (hereafter referred to as Whaley) and Debra Baros (hereafter referred to as Baros). Whaley stated she observed a vehicle driving eastbound on Moorhead Avenue from Elm Avenue. The driver was holding a leash out of the driver side window and a small dog was attached running alongside the car. Whaley continued to follow the moving vehicle trying to determine what the driver was doing with the dog. Zalk made gestures for vehicles to pass by. Whaley advised a few vehicles did pass while the dog continued to run alongside the vehicle near the center of Moorhead Avenue. Whaley continued to follow the vehicle at approximately fifteen miles per hour. I inquired if the dog was being dragged at any point. Whaley stated the dog was not dragged. She advised the dog was trying its hardest to keep up with the vehicle. She was not sure if the dog was going to be able to keep up. Whaley advised she was concerned for the dog and that the dog could have been severely injured by on-coming traffic or having been run over by the Zalk. I inquired how close the dog got to the tires while driving. Whaley stated she observed the dog get approximately one foot away from the vehicle's tires while driving at approximately fifteen to twenty miles per hour. Baros advised she observed a dog running alongside the vehicle while she was on the phone inside her vehicle. I was unsure of her exact location when she observed Zalk. Baros stated she hung up and followed the vehicle. She advised she thought that the dog was in danger. Officer O'Toole inquired about the threat Zalk made about having a gun. Please read Officer O'Toole's original report for details. I approached Zalk and requested to see the dog's leash. Zalk led me to the inside of the residence. I inquired if Cooper was her dog. She stated she was dog sitting Cooper while the guardian, Erin Livers (hereafter referred to as Livers), was out of town. I inquired when Livers would be returning. Zalk stated she was out of state returning Sunday. Zalk advised Livers owned the residence and she was caring for Cooper. Zalk retrieved and displayed a red nylon leash approximately four feet in length. She displayed the leash and advised it was connected to the dogs collar. She then put the dog collar on Cooper and held the leash in the air displaying the length. I requested she take the collar back off and allow me to see it. She provided me the black nylon collar displaying one identification tag with the following information: "Cooper, ." I inquired how Livers would feel about running Cooper next to a moving vehicle. Zalk advised Livers was aware and stated "she's ok with this." Zalk stated "she knows sometimes I run Cooper while I ride a bike too." I took the collar to my vehicle to research the tag information in the City of Boulder dog license computer data base. Cooper was not registered with a current City of Boulder dog license. I took blank voluntary statements to Whaley and Baros and requested they complete them. I provided my

business card and requested they contact the animal control department when finished with the statements. At approximately 1015 hours, the original reporting party, Denbow arrived on scene and contacted me. He advised he had a photo of Zalk driving a vehicle and the dog on leash running alongside the vehicle. Denbow stated he was "extremely fearful that the dog was going to be run over." He stated the dog was "inches" away from the tires at times. He also stated the vehicle was traveling between "ten and fifteen miles per hour." He continued and stated he was "surprised" the dog did not get run over. I provided a blank voluntary statement and requested that he email me the photo and complete the statement. He advised he would complete the statement while on scene. Denbow completed the statement and gave it to me. He advised he emailed the photo as well. At approximately 1015 hours I provided Zalk with a Notice of Impoundment and placed it with her belongings. I attempted to place Cooper in custody trying to leash him inside the residence. Cooper was barking and running away from me. Cooper ran towards the front door and escaped. Cooper ran to Zalk while she was placed under arrest inside Officer O'Toole's patrol vehicle. Cooper was attempting to get close to Zalk. After approximately two minutes I was able to leash Cooper and walk him towards my vehicle. Cooper became slightly calmer and I was able to place him inside my vehicle. I observed fresh abrasions underneath Coopers jaw on his neck near his trachea above the front right and left shoulder area. I observed complete hair loss and bumps on the skin in this area. The skin appeared to be red and irritated. I also observed freshly opened flesh with wet and dry blood spots. Some of the bumps displayed blood. Above and below the red and irritated skin area, the pigment of the skin appeared to be normal in comparison to the injury. I observed on the backside of Cooper's neck an impression in the fur where the collar would rest. The impression wrapped around his neck and was in alignment with the irritated skin area on the front side of his neck. It appeared as if the collar caused the irritation and open flesh on Cooper's neck. Cooper's paws and nails appeared to be uninjured from running. I placed Cooper inside a kennel inside my vehicle and shut the door. I cleared the scene at approximately 1033 hours. At approximately 1042 hours, I arrived at the Humane Society of Boulder Valley. I put a leash on Cooper above the injury area and walked Cooper inside the building into an examination room. I scanned Cooper for a microchip with a scanner and found the number "049383099." I then documented Cooper's injury with the following photos: 1)Case ID card. 2)Cooper's full body on his right side. 3)Cooper's right profile showing the right side impression in the fur on the backside of his lower neck and the right side of the injury on the front of his neck. 4)Cooper's right side neck area. 5)Cooper's chest and injury area. 6)Cooper's back side neck area. 7)Cooper's lower jaw, neck and chest area. 8)Cooper's lower jaw, neck and chest area. 9)Close up Cooper's neck area. I placed Cooper inside a kennel and contacted Dr. Lesli Groshong (hereafter referred to as Dr. Groshong). I requested that Dr. Groshong examine Cooper and document her findings. I posted Cooper's kennel with the Animal Impound Slip and Notice of Impoundment. While at the Humane Society I spoke with Officer O'Toole on the phone and advised her that I found injuries on Cooper that appeared to have been by the collar while running alongside the vehicle. Officer O'Toole stated Zalk mentioned that Cooper did have a skin problem that he contracted at the Humane Society. I was unable to locate any information on Cooper at the Humane Society of Boulder Valley. Therefore, I called the Longmont Humane Society and inquired about Cooper. Cooper was adopted by Livers from the Longmont Humane Society in May of 2011. Cooper did not have any known skin problems at that time. I requested a medical history report be faxed to the Boulder Police Records department. At approximately 1150 hours, I attempted to contact Livers by phone. I did not receive and answer. I left a message requesting a return phone call. At approximately 1211 hours, I cleared the scene at the Humane Society. At approximately 1400 hours I spoke with Livers on the phone at the animal control office. I explained what had

occurred with Zalk. I inquired if Cooper had a skin problem. Livers stated he had developed a skin problem after she adopted Cooper approximately four months ago. She stated Cooper developed a rash on his chest and would scratch it. She stated she was using a "topical" to treat the problem. She advised she took Cooper to Boulder's Natural Animal clinic for the problem. I later learned that this was false. On September 17, 2011 at approximately 1016 hours, I called Boulder's Natural Animal and inquired about Cooper. I was advised that Cooper had never been admitted for a skin problem and that a "topical" had not been prescribed. I inquired with Livers if she was aware that Zalk operated a vehicle and at the same time ran Cooper on leash. Livers stated she was not aware; however, she thought Zalk rode her bike while Cooper was on leash. I inquired about Zalk's relationship with Livers. Livers explained Zalk moved in with her several months ago and was planning on staying "indefinitely" until finding other arraignments. I advised Livers that Cooper had fresh open flesh and blood on his chest and neck area from what had appeared to have been from the collar while being ran by Zalk. I explained that I had photographed the injury and that Cooper was at the Boulder Humane Society. I also advised that I was going to have the veterinary clinic look at Cooper's injury. I requested that Livers contact our department when she returned to Boulder and that Cooper would be at the Boulder Humane Society until then. I cleared the phone call at approximately 1415 hours. The impoundment paperwork, photo and voluntary statement by Denbow, flashcard with photos I took documenting Cooper's injury were all placed into property and evidence at the Boulder Police department on September 16, 2011.
