The permittees shall provide sufficient and ready access to allow measurements and readings to be taken from Monitoring Points 001, 002, and 003, and to allow the collection of grab and composite samples from Monitoring Point 001.

The permittees shall allow representatives of the City and the Metro District to independently utilize these facilities to collect samples or take measurements or readings. The permittees shall ensure that the monitoring facilities remain in satisfactory condition. The permittees shall also provide representatives of the City and the Metro District with any assistance and technical information required to operate the facilities.

Specific Effluent Limitations

The permittees are required to conform to all local limitations as described in the Citys Rules and Regulations Governing Wastewater Control (hereinafter referred to as the Citys Rules and Regulations) and the Metro Districts Rules and Regulations referenced in Section D.2 of this permit and the site-specific effluent limitations listed below. period, compliance shall be determined by the highest averaged value. To allow for fluctuations in discharge flow rate, pollutant limitations were developed for 20, 25 and 30 gallons per minute (gpm). The daily limits at 20 gpm apply to all discharges with a daily average flow less than or equal to 20 gpm; 25 gpm limits apply to all discharges with a daily average flow greater than 20 and less than or equal to 25 gpm; and 30 gpm limits apply to all discharges with a daily average flow greater than 25 and less than or equal to 30 gpm. The average discharge flow rate for any calendar day may not exceed 30 gpm. (c)

Because this limitation is based on or approximates Worker Health and Safety standards, any exceedance of this limitation shall require the permittees to cease discharge until such time as the treatment system is upgraded to a level that will prevent recurrence or the cause of the exceedance is otherwise corrected, and permission to resume discharge is given by the City and the Metro District (see Section F.1).

(d)

Compliance with this limitation is based on the estimated combined toxicity effects of all chlorinated dibenzo-p-dioxins/chlorinated dibenzofurans (CDD/CDF) congeners in relation to that of 2,3,7,8-TODD using the Inter national Toxicity Equivalents/89 (I-TEQs/89), The l-TEQs/89 are obtained by applying the international Toxicity Equivalency Factors ((-TEFs) below to the congener-specific data and totaling the results. Any totalized value beyond this limitation shall be considered a violation of the conditions of this permit. The following l-TEFs shall be used to determine compliance.

Not withstanding this numeric limitation, effective January 1, 2007, discharge from cooling towers, boilers, closed-loop heat transfer systems and any other cooling/heating system treated with molybdenum-containing water treatment chemicals is prohibited entirely. Where necessary, the Metro District may require that these wastes be physically prevented from discharging into the sanitary sewer system.

(h)

As per the Colorado Basic Standards and Methodologies for Surface Water 3.1.0 (5 CCR 1002-8) the radioactivity of surface water shall be maintained at the lowest practical level, not to exceed certain numeric standards. Compliance with these requirements shall be achieved by limiting the permitted discharge to the applicable radiochemical concentrations, which represent determinations of the lowest practical level or the calculated risk based limitations depending on discharge flow rate associated with specific numeric standards.

(i)

Any single analysis and/or measurement beyond this limitation shall be considered a violation of the conditions of this permit, except that it will not be considered a violation of the permit when the permit limit lies within the uncertainty range as measured by the reported counting errors for each particular analysis. The City and the Metro District reserve the right to specify maximum counting errors and/or minimum counting times, as appropriate, for radionuclide analyses. Compliance with this limitation shall be determined by the arithmetic average of all composite samples collected during discharge from process operations over a 24-hour period.

Per 40 CFR 141.26(b)(1), gross beta activity is used to demonstrate compliance with the beta particle and photon radioactivity drinking water standard used to derive this effluent limitation. (k)

Lowest practical level limits apply as absolute maximums to all discharges with a daily average flow less than or equal to 20 gpm. The calculated risk based limitations were more restrictive at daily average flow rates greater than 20 gpm. therefore, risk based absolute maximums apply to discharges greater than 20 gpm. Monitoring Point 002

Effective immediately, the permittees shall not discharge wastewater containing any materials or substances beyond the limitation below:

The limitation on explosion hazard applies at Monitoring Point 002, and at any point downstream in the Citys or the Metro Districts sewer system where explosion hazard may be reasonably attributed to the discharge as described in this permit. In the event there is a single reading of more than 10% LEL at Monitoring Point 002, the City and the Metro District shall determine, to their satisfaction, that the reading was caused by actual discharge and not by equipment malfunction, electrical power fluctuation or other similar circumstances beyond the capability of the equipment or site operator to control. The City and the Metro District shall then have the option to: (1) revoke the permit; or

(2) require the permittees to cease discharge until such time as the treatment system is upgraded to a level that will prevent recurrence. 2,

Prohibited Discharges

Unless otherwise provided above, the General Discharge Prohibitions set forth in Section 138-263(d) of the City Code and the Discharge Limitations on Wastewater set forth in Article V of the Citys Rules and Regulations and Sections 6.17 and 6.18 of the Metro Districts Rules and Regulations shall govern all discharges to the Publicly Owned Treatment Works (hereinafter referred to as the POTW) during the term of this permit. The POTW includes City and Metro District sewer lines and treatment plants. Copies of these documents are found in Appendix A of this permit. 3. Additional Limitations

Additional limitations may be developed by the City and the Metro District at any time, based upon a determination that the permittees do not have the capability to adequately treat the discharge, or the potential exists for jeopardizing the Citys or the Metro Districts treatment operations or compliance status with all applicable regulations, the environment, worker/public health and safety, or for any other reasons. E. SELF-MONITORING

1. At a minimum, the permittees are required to perform collection and analyses of wastewater samples with the frequency and type of measurement indicated. The City and the Metro District may increase the monitoring frequency if a sample is not in compliance with the limitations specified in Section D of this permit. Samples or measurements shall be representative of the discharge during normal operating

If deemed necessary, samples shall be collected from a treated representative discharge batch (approximately 20,000 gallons) as described in Section 1.1 of this permit. If the samples are in compliance with all regulated parameters and approval has been granted by the City and the Metro District to discharge the batch and commence normal operations, then, with the exception of WET, representative samples shall be collected on the first three days of continuous discharge, beginning with the first day of continuous discharge, for all pollutants listed in Section E.1 above. WET sampling must commence on the first day of continuous discharge, with samples collected in accordance with Section E.1(b).2 and the EPA guidance cited in Section E.1(h) of this permit. If three (3) consecutive daily samples are in compliance with all regulated parameters, the required sampling frequencies shall be reduced to those specified above. Compliance with the limitations for organic compounds shall be determined by samples collected using procedures contained in Appendix B of this permit. Failure to collect the minimum number of samples at the frequency specified is considered a violation of the terms of this permit. (b) Definitions:

Unless specifically stated otherwise, all samples must be handled, preserved and analyzed according to Title 40, Part 136 of the Code of Federal Regulations (40 CFR 136), Guidelines Establishing Test Procedures for the Analysis of Pollutants under the Clean Water Act, and amendments thereto. 1.

A grab sample is defined as an individual sample collected over a period of time not to exceed 15 minutes, and collected so as to be representative of the wastewater at the moment of sampling and of the parameter being monitored.

The analytical procedures used in the analyses of samples collected for selfmonitoring purposes for the referenced pollutants shall have reporting limits equal to or less than those listed. If approved reporting limits are not achieved, and compliance with any effluent limitations contained in Section D of the permit cannot be determined, resampling and analysis must be performed. Self-monitoring analytical results that are less than the reporting limits listed shall be considered to be zero for compliance purposes. For radionuclides, the limits are reporting limits calculated in accordance with the Minimum Detectable Concentration (MDC) protocol described in Upgrading Environmental Radiation Data, EPA 520/1-80-012, rather than method detection limits. rement. It is the responsibility of the permittees to ascertain whether or not the City or the Metro District has successfully monitored for this parameter during the calendar year. (h)

Chronic toxicity tests shall be conducted in accordance with the latest revision of Short Term Methods for Estimating the Chronic Toxicity of Effluent and Receiving Waters to Freshwater Organisms, Fourth Edition, EPA-821-R-02-013, the Region VIII EPA NPDES Chronic Test Conditions Static Renewal Whole Effluent Toxicity Test. Test species shall consist of Ceriodaphnia dubia and fathead minnows. At a minimum, the tests shall be run at a dilution of Lowry effluent: dilution water, made in accordance with the above EPA guidance, of 1:750.

There shall be no chronic toxicity to the survival or reproduction of Ceriodaphnia dubia or to the survival or growth of fathead minnows at or below the effluent dilution ratio of 1:750. Chronic toxicity occurs when the survival, growth or reproduction for either test species, when exposed to a dilution less than or equal to 1:750, is significantly less (at the 95% confidence level) than the survival, growth or reproduction of the control specimens and the survival, growth, or reproduction 1025 is less than or equal to 1:750. If more than 20 percent control mortality occurs, the test shall be considered invalid.

If chronic toxicity should be observed at or below the effluent dilution ratio of 1:750, the permittees must notify the City and the Metro District within 24 hours of becoming aware of the chronic toxicity. Additionally, the permittees must initiate an additional chronic toxicity test in accordance with the provisions of this section, within 48 hours of becoming aware of the chronic toxicity. If this second chronic toxicity test is found to exhibit chronic toxicity, the permittees must immediately cease discharge. At the discretion of the City and the Metro District, the permittees will be required to perform additional WET testing, for the failed species, to confirm the presence of chronic toxicity, conduct a Preliminary Toxicity Investigation (PTI) and/or undertake a Toxicity Reduction Evaluation (TRE)/Toxicity Identification Evaluation (TIE) to establish the cause of the chronic toxicity, and develop control of. or treatment for the chronic toxicity. Discharge may not resume without permission from the City and the Metro District.

At the discretion of the City and the Metro District, and upon written notice to the permittees, additional WET self-monitoring may be required at any time to verify the absence of chronic toxicity. (i)

CFR 136 does not contain sampling or analytical techniques for the pollutant(s) in question, or where the Administrator of the United States Environmental Protection Agency determines that the Part 136 sampling and analytical techniques are inappropriate for the pollutant(s) in question, sampling and analysis shall be performed by using validated analytical methods or any other applicable sampling and analytical procedures, including procedures suggested by the City and the Metro District, or other parties, approved by the Administrator. Appendix C contains a list of pollutants that do not have any analytical procedures approved by 40 CFR 136, along with the analytical procedures that must be used for those analyses. If an alternative method is preferred, a written request describing the alternative method must be submitted to the Metro District for approval. Alternative methods may not be used until approval is granted by the Metro District.

NOTIFICATION REQUIREMENTS FOR CESSATION OF DISCHARGE/VIOLATIONS


Notification Requirements for Cessation of Discharge

Upon the onset of any condition that would prevent the permittees from having adequate control over the discharge to meet the effluent limitations contained in this permit, the permittees shall immediately halt all discharges to the City and the Metro District.

In addition to the requirements contained in Section C of this permit, upon becoming aware of any violation(s) of the effluent limitation for 1,1dichloroethane, 1,1 -dichloroethylene, 1,1,1 -trichloroethane, 1 ,2-dichloroethene (trans), 1 ,2,4-trichlorobenzene, acetone, additive limit, benzene, carbon disulfide, chlorobenzene, chloroethane, ethylbenzene, heptachlor, PCBs, styrene, tetrachloroethylene, toluene, vinyl acetate, vinyl chloride, xylenes, or explosion hazard where footnoted as contained in Section D.1 of this permit, the permittees shall immediately halt all discharges to the sanitary sewer system and shall immediately telephone and notify the City (303-326-8050) and the Metro District (303-286-3000) of such violation(s). Notification must also be made to the EPA Lowry Site Remedial Project Manager and the Lowry Site State Project Officer. Discharge may not resume without permission from the City and the Metro District. If deemed necessary by the City and the Metro District to ensure compliance with the conditions of this permit, the permittees may be required to install additional pretreatment facilities, beyond those specified in this permit, before discharge is allowed to resume.

In addition, within 24 hours of becoming aware of an automatic termination of discharge associated with the explosion hazard monitoring equipment for reasons other than elevated LELs, the permittees shall notify the City and the Metro District by telephone or fax of such termination.
