Roommate Agreement: 1.

This agreement is made by and among the roommates named herein who have signed a rental agreement for a shared dwelling unit that makes the roommates jointly and severally liable for all terms of the contract. Execution of this roommate agreement does not alter the joint and several liabilities of the tenants under the rental contract with the landlord. However, it may be used if a dispute among the roommates arises. Failure to adhere to the guidelines found within this agreement will lead to immediate notification and possible eviction of the tenant. 2. Note: This agreement can be changed by one of the owners of the house at any time deemed necessary. Changes may be request by tenants of the house via email to brian@kruise.com . 3. Address of rental: 4319 Corral Canyon Road, Bonita CA 91902 4. Damages: Any and all damages where tenant or a guest of a tenant is responsible, said tenant will be responsible for the timely repair or payment for repair. 5. Extraneous payments: The rental property has high-speed internet provided by Cox Communications. The bill will be split among the tenants equally by the monthly costs. a. As of 06/20/2011 the bill is $50 total. In order to access the high-speed internet payment in the th form of cash, credit or check must be made out to: Brian Kruise by the 7 of each month or the internet will be cut off for lack of payment. b. There is no cable television in the house. If a tenant wishes cable television for their room it will be their responsibility to set up & pay for that service c. The private use of any landline telephone is not allowed without the express permission of the management. Landline telephone use is not part of the rental agreement.

6. Guests: Each roommate is responsible for the behavior of his or her guests. a. Guests shall not unreasonably disturb other roommates b. Guests must stay in the bedroom of the roommate who invited them, unless all other roommates agree that the guest may stay in a shared area. No guest may stay for more than four (4) consecutive days without the permission of all other roommates.

d. The tenant that invited a guest is responsible for cleanup for that guest (dishes, towels etc). 7. New roommates may move in only with the written permission of the landlord. 8. Quiet Hours: All roommates agree to observe quiet hours for sleep, study and other purposes on the days and times listed here. 11:00pm Sunday Thursday nights. a. Work hours: Work hours to be observed and also be made quiet: 8:00am 4:30pm Monday Friday 9. Pets: Pets are not permitted 10. Smoking: Smoking in the house is not allowed, even in the tenants room. Smoking must be limited to no closer than 5 feet from any entrance or open window. 11. Shared space: The living room, kitchen, garage and upstairs/downstairs restrooms is shared space, as such roommates must respect the shared space with use of the television, couches, counterpace

and cooking areas. Keeping these areas clean and clutter free as possible. Also making sure to not 2 hog the television or couches if possible. 12. Parking: Parking in the driveway is reserved for tenants and owners of the house, guests who park in the driveway must move their vehicles upon request by a tenant or house owner.

Household Duties: The following page lists the household duties expected to be performed by each tenant and guests of tenants.

13. Trash: If a tenant throws trash away in a trash can in a public space, thus making that trash can full it is that tenants responsibility to remove the trash from that trash receptacle and empty it into the large trash bin on the side of the house, and replace the trash bin in its original place afterwards.

a. If the trash receptacle had a trash bag inside of it, the tenant is also required to replace the trash bag with a new one. b. Large items such as oversized boxes or trash that will not fit inside the trash must be placed on the curb before trash is picked up the following Tuesday morning. c. Trash bins must be placed on the curb every Tuesday morning

14. Recycling: Plastic bottles (water, soda, etc), soda cans, & recyclable glass cans, are expected to be placed in either the recycling container under the counter, if the container is full the tenant is expected to sort its contents into the recycling containers outside. 15. Kitchen: Duties in the kitchen are: a. Dishes: Any time a dish, cup, utensil or other kitchen implement is used the person who used 1 that item is responsible to clean it within 2 hours of use. (E.g., dont let items sit on the counter or 1 sink, clean them immediately after use.) If an item such as a cup will be used continuously throughout the day, make sure it is obvious or keep the item in your own room. b. Counter space: If a mess or residue is left by a tenant or guest on any counter space, floor or 1 wall in the kitchen or bathroom it is expected of them to clean it within 2 hours of use. If a liquid is required that the liquid be properly soaked up and the surface that was wet be made dry. c. Dish Washer: If a tenant noticed that the dish washer is full when placing dirty items inside it, it is that tenants responsibility to start the dish washers cleaning cycle. If the dish washer is finished cleaning and a tenant notices that the dishes are ready to be un-loaded it is that tenants responsibility to un-load the dish washer and put the dishes away. That tenant has the right to ask of other tenants for help with this. If able other tenants should at that time help him or her in this task. i. Use of the dish washer is highly suggested, if a tenant does not know how to properly load or use the dish washer they may consult the addendum to this agreement or ask Brian Kruise for assistance. Do not start the dish washer unless it is full as this is a waste of water.

16. Lights: In effort to keep costs for electricity and the need to replace light bulbs down, all tenants will: a. Turn off lights when leaving a room; including when you will be back in that room >1 minute later. If a tenant will be out of a room for >1 minute they are expected to turn the lights in that room off, including restrooms. b. Lights in the kitchen: The lights in the kitchen do have a dimmer, however use of the dimmer reduces the life of the light bulbs themselves down quite a bit so please do not use the dimmer,

tenants and guests are expected to only use the large on/off button on the control panel if you wish to use the lights in the kitchen. 17. Bathroom: The tenants have one (1) shared bathroom on the second story of the house, this bathroom must be maintained and cleaned regularly and kept clean of any spills or stains. a. Items purchased for tenants bathroom: It is between the tenants who use the upstairs shared bathroom to work out payment for items used within including but not limited to toilet paper, paper towels, soaps etc. b. Inspection: routine random inspection of the tenants restroom are to be expected to make sure the living conditions of the tenants are up to standards, as well as to make sure that the restrooms are kept in an orderly manner c. Bathtub / shower: If a tenant or guest uses a product in the bathtub that might cause staining or discoloration, it is that tenants responsibility to make sure to clean the bathtub & shower so that staining and discoloration does not occur, either during or soon after use of the shower & bathtub.

d. Towels: Towels should be placed with the tenants who used the towels other dirty clothes to wash and be washed during the time their clothes & personal items are washed e. Toilet paper: If you use up the last useable amount of paper on a toilet paper roll you must replace the roller with a new roll. i. If you find that the new roll you placed is the last in the storage areas for new rolls, it is your responsibility to re-fill that storage area with new rolls, or add toilet paper to the household shopping list and make sure more get added. Public use: This bathroom may be used by guests or employees if other restrooms are not available.

18. Laundry room: The laundry room is a shared space between all tenants, and as such use of the washing machine and drier is shared between all tenants. a. Keep laundry room clutter free: If you bring items down to wash, these items must be washed, dried, and removed from the laundry room within 2 days of the start of the washing cycle. (E.g. Items started washing on a Wednesday must be removed before the end of that Friday) b. Do not leave towels or other items in the laundry room to wash later if you do not intend to wash them and remove them within 2 days of bringing them down. c. Soaps, drier cloths, bleach and other disposable cleaners are up to the tenants to keep stocked, do not use another tenants soaps etc on your clothing items or towels without the tenants express permission who owns the soaps & detergents etc.

d. Laundry room usage is for tenants only, not for guests to do their laundry 19. Living room a. The living room is shared space, as such all shared space rules listed above are also in effect b. The living room furniture, movies, electronics & hardware etc may be used by tenants and guests with care, any items moved from their original put away location must be placed back into their original put away location after use, these items include but are not limited to: i. ii. iii. iv. Movies & Games Etc.

20. Parties and social gatherings: a. Tenants will know that parties and social gatherings happen often in the house, as such tenants who invite friends over are solely responsible for their actions b. Tenants must give advanced warning of up to 3 days for any large (6 or more guests spending more than 2 hours in the home) parties to anyone other tenants who will be home during the time of the event. c. Tenants who wish to have 3 or more guests over must notify the other tenants that guests will be arriving, and when. If the other tenants object to this, within reason then guests cannot come over.

21. Backyard Usage a. Rules regarding common use such as putting things back to their original location after use, making sure that items are cleaned or put away are in effect for the back yard. It is the tenants responsibility to make sure that their guests clean up after themselves, or clean up after their guests personally. b. The tables and chairs must be maintained, this means cleaning off after use if a tenant or their guest makes any piece of furniture dirty or messy. c. i. ii. Pool use: The pool is a privilege, not a right. Heating of the pool is not included in the amount paid for rent 1. If a tenant wishes the pool heated, they will have to make sure that Robert or Sandi Kruise (619-271-7950) is notified and that an agreement upon payment is made for the cost of heating the pool. The pool may be used at any time, keeping in mind if quiet hours listed above. The pool may be used by guests of tenants with supervision at any time other than business hours 8am-430pm Monday-Friday, keeping in mind of guest rules & quiet times listed above. Towels are included in the cleanup of the outside. If a tenant or guest of a tenant uses towels or other pool equipment, it is up to the tenant whose guest used the equipment or towel to make sure that it gets put away upon the end of use of that equipment or towel. This means cleaning & drying, or just drying the towel if still clean and putting it back in the linen closet at the top of the stairs.

Clean: Means either washing with soap the dishes, cups, or silverware, or towels drying them off and putting them back into the drawers / cupboards where they originally came from OR rinsing off any large pieces from the dishes, cups, or silverware and placing them properly into the dish washer (view attached appendix for proper placement of items).

Hog: Overuse of any piece of the house without regard for other roommates. Example this could include use of the television or other living room or restroom equipment or for hours without allowing other tenants the chance to use them.

Full: when a trash or recycling receptacle is no longer able to hold any reasonably sized piece of trash, or if the trash or recycled items inside the receptacle are the same height as the walls of the receptacle they are in.

Dishwasher Loading: Please see the figure for proper loading of the dishwasher: Remember: Dishes must be rinsed thoroughly before being placed in the wash as it doesnt knock off food bits or caked on items. Lower Rack: Upper area of lower rack is where plates go, every plate is designed to fit in this area and face inward. The larger plates on the left and smaller plates on the right. If there are more larger plates than fit on the left they will also fit go on the right. This will however make less room for bowls

Middle area of lower rack This area is for bowls, small to medium size, facing forward to get the best rinsing, do not let bowls be covered by the bowl in front as it will not get clean

Lower area and left area are for larger bowls and pans if they will fit without crowding the washer Upper Rack: Right area is where very short cups go, coffee cups, shot glasses, measuring cups etc. Once these small items fill the right area the plastic shelf can be folded down to allow large utensils to be placed upon them. Middle right area is for very tall cups must go, as it is the only space tall enough not to hit the dishwashers moving parts when running Middle left: tall to medium cups or even overflow for bowls if needed Far left: Short to medium cups
