Formula 1 Circuit of the Americas Travis County Phases 1 through 3 Site Development Permits TNR Permit No. 11-0349, Phase 1, Issued June 28, 2011 TNR Permit No. 11-1156, Phase 2, Issued July 13, 2011 TNR Permit No. 11-1241, Phase 3, Issued July 20, 2011
Initiation and continuation of development of Phases 1, 2, and 3, and issuance of permits for future phases are conditioned on the following requirements: 1. Satisfactory progress toward addressing transportation, roadway, improvement, and traffic management issues raised by County staff in review comments submitted to the project engineer dated September 28, 2010, November 12, 2010, April 15, 2011, and June 9, 2011. 2. Completion and submission to the County by October 7, 2011, of a study and design for the widening to four lanes of Elroy Road and bridge from where the road is currently four lanes to where it intersects Circuit of the Americas driveway. Estimated cost is $150,000. 3. Completion and submission to the County by July 31, 2011, of a traffic study containing strategies to manage traffic during high volume events at the Circuit of the Americas facility, including improvements to the existing roadway system and plans for offsite parking and shuttling of patrons to and from the facility on buses. 4. Completion and submission to the County by August 31, 2011, of a public safety plan addressing emergency vehicle access, fire protection, emergency medical services, public assembly areas, parking, directing of attendees and vehicles, vendor and food concessions, and law enforcement. 5. Compliance with all other applicable federal, state, and local permitting and other regulatory requirements related to construction and occupancy of the Circuit of the Americas facility. The permit holder undertakes development of Phases 1 and 2 under this permit at the holders own risk and without assurance that a permit for any subsequent phase will be granted unless there is full compliance with the above conditions and all other permitting and regulatory requirements.

Earthwork, grading, and utility (water, wastewater, and drainage) improvements as included in the Formula 1 United States Site Improvements construction drawings dated June 13, 2011 and sealed by Charles Brigance, P.E., except for the exclusions noted under EXCLUSIONS below; Austin Energy Electric Substation (except for building structure as noted under Exclusion 1 below); and, STRUCTURES as they are listed under A through C below (see attached list for comprehensive listing): A. Race track and related safety improvements. Motor racing is dangerous. The design of the track and related safety features are beyond the scope of Travis County review. On the basis of FEMAs letter dated June 28, 2011, work may occur within areas that will be outside of the regulatory floodplain upon future acceptance by FEMA of the LOMR submitted in relationship to the work. Construction of each building above the foundation is not authorized at this time.

EXCLUSIONS not authorized for construction: 1. No BUILDINGS are authorized for construction at this time. Authorization to construct will be given only after the Travis County Fire Marshal has issued a permit to construct such building, and the

No STRUCTURES that are not specifically listed under AUTHORIZATIONS above are permitted for construction. Additional structures will be authorized as structural plans and geotechnical information is received and accepted by TNR, and the structure has been included in the scope of a TNR Site Development Permit. Under no circumstances may building construction or site construction occur within effective FEMA floodplain, except for those areas as described by FEMA in their letter dated June 28, 2011, related to the CLOMR submitted in relationship to the work. Paving of COTA Boulevard and the outer loop road is not authorized. Helipads are not authorized. Grass parking areas and associated internal drives are not authorized. No driveways connecting to Travis County roadways are authorized.
