1 Section 1. Subdivision 2 of section 4212 of the public health law, as 2 amended by chapter 180 of the laws of 2004, is amended to read as 3 follows: 4 2. It shall be the duty of the person having lawful possession, 5 charge, custody or control of bodies of deceased persons, to keep a 6 record in a bound book or an electronic log of any and all bodies of 7 deceased persons thereafter coming into his or her possession, charge, 8 custody or control and of the disposition made of said bodies, showing 9 (a) the name of the deceased person, if known, (b) the dates of death 10 and burial or other lawful disposition, if known, (c) the names and 11 places of residence of relatives of the deceased person, if known, (d) 12 the name of the person who claimed the body of the deceased person for 13 interment or other lawful disposition, (e) the name of the university, 14 college, school or institute to whom the body of the deceased person was 15 delivered or released, and (f) the opposition of the deceased to the 16 dissection or autopsy of his or her body as indicated by an identifica17 tion card carried upon his or her person. This record book or electronic 18 log shall be open to the inspection of the officers and agents of 19 universities, colleges, schools or institutes entitled to receive bodies 20 of deceased persons. Any electronic log kept pursuant to this subdivi21 sion shall preserve a record of any addition, deletion or change made in

BILL NUMBER: A6902A SPONSOR: Hevesi TITLE OF BILL: An act to amend the public health law, in relation to records of bodies of deceased persons PURPOSE: The purpose of this bill is to allow of Office of the Chief Medical Examiner to maintain electronic mortuary logs. SUMMARY OF PROVISIONS: This bill amends subdivision 2 of section 4212 of the public health law, as amended by chapter 180 of the laws of 2004. JUSTIFICATION: Current law requires that all Chief Medical Examiner's offices keep a bound printed mortuary log containing identifying information relating to the deceased. As technology has advanced since this requirement was established, all of this information is also recorded electronically. The requirement to maintain a printed log is outdated and duplicitous. This bill allows the Office of the Chief Medical Examiner to either maintain these records electronically or continue the use of the bound log. LEGISLATIVE HISTORY: This is a new bill. FISCAL IMPLICATIONS: None to stale. EFFECTIVE DATE: This act shall take effect immediately.
