Subject: Right to Information regarding declaration of backward Area


Unsatisfactory, Contradictory & Incomplete Information

Respected Sir/Madam,

I had applied a written request seeking information under RTI Act 2005. The details of application are
as follows –

Application submitted in person on 5th September 2006 wide Rs 10/- cash receipt no. 751068.

Follow Up

1. A letter PC.U.O. No. M-12019/4/2006-MLP dated 11 September 2006 signed by Dr Indu


Patnaik MLP (Advisor) was issued and reply was sought by Andhra Pradesh Government. It
was issued against cash fee of Rs 2/- wide receipt no. 751071 dated 14 September 2006.

2. A reply wide memo no. 5712/PlgXVIII/2006 dated 20th September by Planning Department
Andhra Pradesh Government, Shri G. Prasad who had further sent the request to Collector,
Chittoor District seeking reply.

3. A final processed reply wide no. U.O. No. M-12019/4/2006-MLP dated 28th September 2006
was furnished against payment of Rs 2 wide receipt no. 751075 dated 6th October 2006.

The unsatisfactory response and the contradiction has lead to confusion regarding information
supplied by CPIO and hence point wise clarification is sought.

Contradiction

1. As per letter PC.U.O. No. M-12019/4/2006-MLP dated 11 September 2006 signed by Dr Indu
Patnaik MLP (Advisor), it is mentioned that “The Planning Commission has not given any
directions to any institutions for backward area reservation for admission to Post Graduate
course, etc“. And wide letter PC.U.O. No. M-12019/4/2006-MLP dated 28th September 2006

Dr Indu Patnaik, Deputy Advisor (MLP) has endorsed the response by present District
Collector of Chittoor, Andhra Pradesh mentioning that certificates are genuine for seeking
admission at post graduate level in AIIMS, a central government institution..

2. In latest reply dated 28th September 2006, at point 2. clarification was sought by Chief
Planning Officer, Chittoor on 13th July 1988. In the next point no. 3, response by Govt of AP,
Finance and Planning Department it is mentioned that - the response was issued on 4th July
1988 as if the response was ready 10 days before the question was asked in writing ?

Its amazing that it has been accepted and endorsed by the Deputy Advisor MLP, Planning
Commission, Government of India.

How the reply is unsatisfactory ?

1. Question No. 4 remains unanswered - Please explain what does G.O.Rt. No. 365 Finance and
Planning (Plg-III) dated 27-10-XXXX means in simple English ?

2. Question No. 6 remains unanswered - Tirupati has been the second richest religious shrine
after Vatican in the world and yet was the backward area ? This fact is hard to digest. If it is
true then which areas of the country are marked as backward areas for availing
backward area reservation in educational institutes at present.

3. Since when education has become industry as per Collector of Chittoor ? Assistant Collector
of Chittoor has issued backward area for central subsidy for Industries in 1987 while in 1988
Collector of Chittoor included of education and other fields ? Kindly clarify ?

4. What does central assistance precisely means under six point formula G.O. Rt 365 dated 27
October 1975 of finance and planning department, Government of Andhra Pradesh ? Does it
means issuing backward area certificate for admission in post graduate course in central
Government institutes like AIIMS, IIT, IIM, AFMC outside the state of Andhra Pradesh or is
it valid only for the various educational institutions including central university in state of
Andhra Pradesh.

5. Why Planning Commission is not aware of clause G.O. Rt 365 which seeks central
assistance?

6. From which central government department does backward areas falling under G.O. Rt 365
gets central assistance ? Does the central assistance means decreasing the quilfying criteria at
post graduate level in medicine.

7. What is the criteria for declaring any geographical area of Republic of India as backward area
? Who is the right authority for this ? Is it the Assistant Collector/District Collector/State
Government/Backward Commission/Tribal Ministry … ? Please clarify ?

8. Does backward area comes under municipal limits of any town/city ? Plot no. 3, Press Guild
Colony, Alipuri Road, Tirupati of Chittoor district comes in municipal limits ? If not, at the
same Alipuri road is Sri Venkateswara Medical College recognized by Medical Council of
India, does it also falls under backward area ? Complete postal address is

Sri Venkateswara Medical College (Established in 1960), Alipiri Road, Tirupati - 517 507,
Chittoor District.

9. Is Tirupati a Taluk or a Mandal or a Block ? Please define Taluk, Mandal and Block
separately

10. Its not clear whether resident of plot no 3, Press Guild colony, Alipuri Road, Tirupati, Andhra
Pradesh - 517507 comes under Chandragiri Taluk or Tirupati Mandal or in 1987

11. In reply dated 28th September 2006, in point no. 4, it is mentioned that due to formation of
Mandal in Andhra Pradesh, Tirupati attained separate Mandal entity ? In which year it
happened ?

12. What are the legal documents to be submitted for availing backward area certificate issued by
Assistant Collector, Chittoor and District Collector, Chitoor ? The list and photocopies of
such documents be provided which Shri V. Krishnama Naidu must have submitted for
backward area certificate in public interest except AIIMS memo and telegram.

13. Is Central Planning Commission aware of backward area reservation in post graduate course
offered in Central Institution AIIMS, New Delhi ? Under what guidelines of Government of
India they have been giving admissions in post graduate courses ?

14. Since 1975 under G.O. Rt 365 Six Point Formula clause –
• Kindly furnish the list of candidates who were issued backward area certificates for
seeking admission in post graduate courses in Central Institutes like AIIMS, IIT, IIM,
AFMC etc.outside Andhra Pradesh ?
• What are their names and from which central institute they availed admission through
such certificates and for which course ?

15. We wish to know the names of


• Assistant Collector of Chittoor in 1987 who issued backward area certificate on 8th
April 1987 with present whereabouts
• District Collector of Chittoor in 1988 who issued backward area certificate on 16th
July 1988 with present whereabouts
• Present District collector who has sent reply to Planning Commssion, New Delhi.
• Name of the Chief Planning Officer, Chittoor in 1988 with his/her present
whereabouts

I request Planning Commission headed by Honourable Prime Minister of India to look into the matter
seriously before giving appropriate reply. It looks like case of misinterpretation of G.O. Rt 365, Six
Point formula in Central Government prestigious institution AIIMS.
