ach day, we move closer to destruction. For thus is the law of the universe for everything to descend towards chaos with the passing of time. Each day, we age and become less and less of who we once were. Less content. Less noble. We degenerate, we age, we die. Every passing day is an added shove towards the pool of disorder. We exert effort, we strive to organize our lives in the hope of improving our situation, and yet we are aware that in the end, nothing of the order we established will remain. And yet we continue to struggle. We create to defy entropy. We try to achieve greater heights, for we value progress. For in creation, we destroy chaos. Such is the nature and contradiction of life. Can we defy destruction? Can we battle chaos? For a time, I think we could. For you came and made me realize I can do more, achieve more. Together, we planned for a shared future of creativity and passion. And soon, we were living our dreams. We were together in each step, scheming and thinking of innovative ways to combat lifes perennial woes. We managed to sustain our dreams of transformations. We told ourselves we succeeded. And yet we yearned for more. And the things we yearned for Oh boy! Until that day when you told me you wanted leave. You said you were becoming stagnant, and development is not possible anymore for we reached the summit that we wanted to climb. And so, you said, we needed to part ways and weave new narratives. I was devastated, but I agreed. For we need to move forward. Such is the law of the universe. Staying put is not an option. Sooner or later we have to make our moves. Move towards what? Destruction, I guess. I was devastated. I wanted to tell you that you should stay and we should continue creating. But I knew it will be a lie. For we have stopped creating for some time now. We were stuck in a standstill, unmoving, unflinching, trying to be content of what we have. We were living a lie. We were not creating this standstill is called preservation. We struggle. And we dive into chaos. For we cannot remain motionless. What goes around comes around. So onward we go. Today, we managed to put things aside. But tomorrow, my friend, we will destroy to create anew.

Reshaping narratives
The edicts of social justice, the extraordinary national experience, and the prevailing national consciousness, all command the great departments of government to tilt the balance in favor of the poor and underprivileged in the interpretation of the law Philippine Supreme Court, in Hacienda Luisita Incorporated (HLI) vs Alyansa ng mga Manggagawang Bukid ng Hacienda Luisita (AMBALA), et al. For decades, the story of Hacienda Luisita has been one of exploitation and suffering. Farmers told of stocks amounting to wages of P9 per week; of debt passed down through generations; of attempts to organize and protest, only to be met with gunfire and violence. A community of over 10,000 families spread out across a vast sugar plantation, all tilling land they would never own, because the 6,400-hectare spread was already owned by a single family: the Cojuangcos, among the wealthiest and most powerful clans in the Philippines. One farmer put it succinctly: Buong buhay ko, ito lang ang lupang masasabi kong akin, he said, holding up his hands to show the dirt under his fingernails. Hallmarks of a lifetime of hard labor. More blood has been spilled in the name of Hacienda Luisita than we, as a nation, can ever forget. Government troops opened fire on unarmed farmers marching to Malacaang in the Mendiola massacre of 1987. Farmers on strike were brutally dispersed in the Hacienda Luisita massacre of 2004. And countless others have died one by one over the years, gunned down or tortured and killed for joining unions or participating in protests. Last week, the narrative was altered forever. In a landmark case concerning the distribution of HLI, the Supreme Court ruled overwhelmingly, 14-0, in favor of the HLI farmers union AMBALA and other respondents. James Liwanagan (SDO), a gaping loophole in agrarian reform law, is hard-won validation for farmers everywhere fighting to gain ownership of the land they till. It proves, at last, that the land they have tilled for generations belong to them, morally and legally. While the decision is a victory, however, there are a few points yet to be resolved. The SC asserts that landowners should receive compensation for the property that will be distributed to farmerbeneficiaries. This interpretation of the law is backed by President Benigno Noynoy Aquino III, who claims that his opinion is objective, since he has already sold his shares in HLI but in fact, Aquino remains a top shareholder in the manufacturing arm of HLI, the Central Azucarera de Tarlac. Certainly, Aquinos interest in HLI cannot be denied. Some analysts even argue that the SC ruling is a by-product of deepening fissions among the ruling elite, and the Arroyoappointed SC is merely hitting back for the criminal charges filed by the Aquino administration against former president Gloria Arroyo. Such drama aside, however, the issue is simple. If the distribution of land to farmer-beneficiaries is just, then the long decades they spent as underpaid laborers of HLI was unjust. Shouldnt that be compensation enough? How much has been reaped in profits from HLI since the 1950s, when the Cojuangcos first availed of government aid to take over the land, with the promise that they would distribut[e] the hacienda to small farmers? Also, if the HLI case sets a precedent of compensation, landlords can make land redistribution impossible by demanding unaffordable payment for their land. These problems highlight the flaws of existing land reform law, primarily the Comprehensive Agrarian Reform Program (CARP) and its current extension, CARPER. This SC decision does not validate CARP; in fact, it is a testament to the failure of the law, since it was the provisions of CARP (including the SDO) which allowed the Cojuangcos to evade land reform for so long. It is also CARP which the President invokes in asking for compensation for landowners. Thus, this latest development in the HLI issue is a pivotal moment, but not a conclusive victory. At the heart of the enduring call for genuine agrarian reform a cause for which countless have died, and countless more continue to fight for is the question of justice. It has been delayed long enough; we call on the President and his family to immediately take steps to begin distributing the land. And as HLI farmers move forward, let their triumph pave the way for other peasants to continue in their own struggle for land reform.

Kris, this is not political persecution. Your brother is the president, right? Its not Marcos whos pitted against you now; its the farmers of Luisita and the Filipino people. If you really take to heart your Lolo Pepes advice to fight for what is right, then you should have distributed the land to farmers long ago. You remember your familys suffering very well but seem to not know the suffering of your tenants.

One in every ten applicants for the Socialized Tuition and Financial Assistance Program (STFAP) in UP Diliman filed an appeal for lower bracketing this year, according to data recently obtained from the Office of Student Scholarships and Services (OSSS). Data showed that 287 out of the total 3,421 STFAP applicants in UP Diliman (UPD) this year filed an appeal for lower bracketing. However, eight of the 139 deliberated appeals were retained in their original brackets. The remaining 148 appeals have yet to be decided, pending deliberation. These results clearly indicate that the 14-page STFAP application form cannot really quantify the students capacity to pay, said Student Regent Ma. Kristina Conti. The formula used in the STFAP cannot calculate all factors of poverty indicators, she added. Pero bakit nga ba marami ang nag-a-appeal o bakit ba kailangan pang mag-appeal? Data also showed that in UPD, only one in every 100 students is granted free tuition while one in every five STFAP applicants actually applied for bracketing. One in every 100 students is under bracket A. STFAP is a bracketing system that categorizes students based on their capacity to pay. First instituted in 1989, students were classified into nine numeric income brackets of the Numerical Bracketing System and it was revised in 2006 into the present six income brackets of the present Alphabetic Bracketing Scheme (ABS). Upon enrolment to UP, students are first assigned to either bracket A or B. Those who belong to a lower bracket apply for STFAP. Those who are unsatisfied with their bracket assignment, submit an appeal, according to the OSSS. family income from above P500,000 to one million, and pay P1,000 per unit. Meanwhile, bracket C and D students pay P600 and P300 per unit, respectively. On the other hand, bracket E1 students whose family income ranges from P80,000 to P135,000 enjoy free matriculation, while bracket E2 students whose family income is below P80,000 also enjoy free tuition plus a semestral stipend of P12,000. The current system assumes that everybody is a millionaire until proven otherwise, said Conti. Also, the STFAP policy review conducted by the Office of the Student Regent in July revealed that 90 percent of UPD students were assigned to brackets higher than what they actually applied for. Five out of the 15 bracket A students who filed for appeal were rebracketted into bracket D, after the deliberations of the Diliman Committee on Scholarships and Financial Assistance. Meanwhile, forty of the 50 appeals of UPD students who were initially in bracket D were rebracketted to bracket E2. Bicam to pass P1.8T natl budget today

After reconciling differences in their respective versions of the 2012 national budget through a bicameral conference (bicam), thae Senate and House of Representatives (HOR) are set to approve today the proposed P1.816 trillion national budget for 2012. While the consolidated version of House Bill No. 5023 or the General Appropriations Bill for 2012 has yet been released as of press time, the Senates amendments to the bill is more likely to prevail, said Senator Edgardo Angara, one of the upper chambers representatives to the bicam. The Senate has approved on third and final reading its version of the appropriations bill on November 22.. Under the Senates version of the bill, state universities and colleges (SUCs) will receive P22.41 billion, which is P322 million higher than the P22.09 billion originally approved by the HOR. The Senate increased the budget of SUCs by realigning P322 million from the budget of other government agencies including the Department of Science and Technology, Department of Agriculture and the Commission on Higher Education (CHEd). The additional funding may have increased the budget of SUCs nominally but there was actually no substantial increase for maintenance and other operating expenses (MOOE) that covers the costs of utilities such as electricity and water, and for capital outlay (CO) or the fund for construction and renovation of infrastructures, said UP Diliman Student Council Chairperson Jemimah Grace Garcia.

Innovation clusters

The increase in the aggregate budget of 112 SUCs across the country, including UP System, was actually earmarked for research and development in five areas of

specialization dubbed as innovation clusters, said Angara. The allocation of the budget will be expertise-based where only SUCs specializing in agriculture and precision farming, mining technology, algae research, information and communications technology (ICT), or disaster science and management will be supported, explained Angara. The Senate maintained the House-approved budget of SUCs which allocated P18.9 billion for personal service (PS) or the fund for the salaries of faculty and other employees and almost P3 billion for MOOE. For UP, the Senate approved the P5.74 billion budget passed by the HOR. Of the approved budget, around P4.85 billion was allocated for PS and P698 million for MOOE. Meanwhile, for the third consecutive year, SUCs including UP will not receive a budget for CO. The Senate, however, upheld the P200

million allocated by the House for acquisition of medical equipment for the Philippine General Hospital. Despite the increases introduced by the House and Senate, the approved budget of SUCs is far from the P45.8 billion budget that SUCs need next year, said UP Student Regent Ma. Kristina Conti.

In protest of the meagre budget allocation to SUCs and other social services, students and members of several progressive youth groups barged in the Philippine Coconut Authority (Philcoa) Building in Quezon City last November 25, where the bicameral conference was being held. The Senate decreased the 2012 budget of the Department of Health by P200 million from this years P42.28 billion to about P42 billion next year. On the other hand, the Senate approved a P39-billion budget allocation for President Benigno Aquino IIIs conditional cash transfer program dubbed as Pantawid Pamilyang Pilipino Program (4Ps), which has been widely criticized as a dole-out program. The Department of Defense also got one of the biggest shares in the 2012 budget with P106.9 billion. The government has prioritized funding band-aid solutions such as the 4Ps at the expense of funds for basic social services such as education and health, said Recedes.

BOR defers Avila case verdict anew

After postponing the verdict for administrative cases lodged against UP Cebu Dean Enrique Avila during its October 27 meeting, the Board of Regents (BOR) elected to again defer making a decision on the case during its November 24 meeting. The decision for the Avila case has been rescheduled to a special meeting on January 18 for the BOR to set proper rules, guidelines, and precedents to answer Avilas appeal. The BOR wants to be careful in handling the cases since there are no clear rules with which to decide on the new points raised in Avilas appeal, Student Regent Ma. Kristina Conti said. At present, the BOR only follows the procedures under the UP System Code and the Uniform Rules on Administrative Cases in the Civil Service (URACCS), she explained. In March 16, several UP Cebu faculty and staff filed a complaint against Avila, Ernesto Pineda and budget officer Alsidry Sharif for acts of gross negligence and grave misconduct. In the Administrative Disciplinary Tribunal (ADT)s findings, Avila, Pineda and Sharif were found guilty of three charges of gross neglect of duty and grave misconduct. The three respondents, however, filed an appeal to the BOR on September 28 for the reversal of the dismissal from office verdict approved by UP President Alfredo Pascual on August 26. According to Section 52 of the URACCS, penalty for grave offenses of gross neglect of duty and grave misconduct is dismissal. However, the ADT notice only stated dismissal from office and did not clarify if this included the appointment of Avila as permanent faculty member, according to Avilas appeal. Avila did not commit any of the grounds for removal or suspension as faculty stipulated in the UP System Code, according to the appeal. The embattled dean also raised the issue of whether his and Pinedas combined 63 years of service to the university could mitigate the penalty. The appeal also asked for UP President Alfredo Pascual and another member of the BOR to inhibit from voting on the case after complainants and respondents raised issues on Pascuals hasty and premature decision on the case. Pascual has already inhibited

himself from participating in the discussion on the Avila case in the BOR since the September meeting. However, Vice President for Legal Affairs Hector Danny Uy has yet to confirm if there is enough jurisprudence and precedent for members to be inhibited from the case. The BOR is still exploring the possibility of raising or lowering penalties for Avila, Pineda and Sharif, Staff Regent Jossel Ebesate said. Meanwhile, complainants can submit their comments on Avilas appeal to the BOR until December 3.

Maj. Gen. Jovito Palparan at iba pang hinihinalang sangkot sa sapilitang pagdukot sa mga mag-aaral. As of now, maayos naman ang takbo ng kaso, pero may pangamba pa rin kaming hindi maparusahan ang mga nagkasala, ani Concepcion Empeo, ina ni Karen. Simula Hulyo 8, nagsagawa ng sunod-sunod na pagdinig ang DOJ investigation panel upang imbestigahan ang pagkakasangkot nina Palparan at iba pang miyembro ng Armed Forces of the Philippines (AFP) sa pagdukot sa dalawang estudyante. Nagtapos ang mga pagdinig ng DOJ noong Setyembre 23. Ayon kay Atty. Julian Oliva, legal counsel ng mga kaanak ng biktima, 30 araw lamang ang palugit na ibinigay ng DOJ sa investigation panel nito upang makapaglabas ng resolusyon. Gayunman, wala pa ring inilalabas na resolusyon ang DOJ hinggil sa kaso hanggang sa ngayon. << from page 3 In response to these complaints, UP President Alfredo Pascual has assigned Vice President for Academic Affairs Gisela Concepcion to head a STFAP policy review which aims to simplify and streamline the application process and bracketing scheme. The UP administration plans to implement the changes by June next year.

Deceptive quantifier

The recent number of STFAP applicants who were classified under bracket E1 and E2 total to 369 or 11 percent of the total number of STFAP applicants, according to the OSSS. The OUR, however, registered that only 338 or only one percent of the E1 and E2 students enrolled this second

semester. The small discrepancy, however, still follow the trend that the number of UP students granted free tuition is declining to one in every 100 students since its over two decades of implementation when one in every five students received free tuition. Since the first semester, the number of bracket A students surged to over 3,000 percent after the UP administration imposed stricter measures for bracket B certification to strengthen a weak rule and ensure the integrity of the STFAP implementation, Pascual said in an earlier statement. However, feedback from the

OSR policy review revealed that the more stringent requirements only discouraged more students to actually apply for STFAP. UPD University Student Council Chairperson Jemimah Grace Garcia said that STFAP only makes tuition increases palatable to students when in fact, hinahayaan nating mapunta ang budget natin sa military and debt servicing. Kaakibat kasi ng tuition increase ang STFAP. Pag tiningnan mo nang mabuti, kaunti lang talaga ang naaabot ng STFAP. Luisita farmers doubt HLI action on SC ruling

Despite the Supreme Courts (SC) directive to distribute to the farmers the land housing the countrys largest sugar plantation, farmer-beneficiaries expressed reservations on the sincerity of Hacienda Luisita Inc. (HLI) to execute the SC ruling. Decades of deceit

The Cojuangco-Aquino owned HLI, extending through ten barangays in Tarlac, is subject for distribution under the governments Comprehensive Agrarian Reform Program (CARP). However, HLI came up with an SDP in 1989, wherein farmers chose to become stockholders in a referendum. In 2005, the Philippine Agrarian Reform Council (PARC) revoked the SDP after finding the plan inconsistent with some provisions of CARP including the distribution of home lots to farmers. In a July 5 ruling, the SC affirmed the PARC decision while ruling that another referendum shall take place to let farmers choose between stocks and lands. While we affirm the revocation of the SDP on Hacienda Luisita, the Court cannot close its eyes to certain operative facts that had occurred in the interim, the decision read. Just compensation?

During the course of his administration, Aquino has inhibited himself from commenting on the land dispute. With the high courts decision, however, Aquino said the HLI owners must be justly compensated. In agrarian reform, there are two objectives: number one, empower the farmers so that they could have their own land to till. Second, dont exhaust the capital. There should be just compensation for the land owner, Aquino added. Isat kalahating oras ng kasaysayan

Mistulang usok ang mga tanong, nakabitin sa hangin. Ano nga ba ang nagbago mula nang naitatag ang Unang Republika? Anong kaibahan ng buhay noon sa ngayon liban sa kalayaan? Bakit nagpapatuloy ang mga suliranin ng lipunan noon sa ngayon: paghihirap ng mga magsasaka at manggagawa, pakikialam ng Estados Unidos sa pulitika, pamamayani ng mga multinasyonal na korporasyon sa ekonomiya ng Pilipinas? Ito ang panganib sa pag-aaral ng kasaysayan: ang malinis at payak na pagsasalansan sa nakaraan, ang pag-ipon ng kaalamang hindi dumudulo sa mas malawak at mas matalas na pagsusuri sa mga bagay na nagpapausad sa kasaysayan.

Higit sa anupaman, ang kasaysayan ng Pilipinas ay nabuo at binubuo ng mga pagkilos ng sambayanang Pilipino laban sa mga dayuhan at lokal na mapang-api at mapagsamantala, sa mga sistemang nagpapanatili ng ganitong kalagayanmula sa himgasikan laban sa kolonyalismo ng Espanya at imperyalismo ng Estados Unidos, hanggang sa patuloy na pagkilos laban sa mga bagong porma nito sa kasalukuyan. Ngunit ilang taon pa bago ko narating ang ganitong pagunawa. Samantala, sa araw na iyon, pagkatapos ng isat kalahating oras ng paglalagom sa kasaysayan ng Pilipinas, panginoon ang linis ng ayos at porma. Mga lumang dilaw na police line at maliliit na piraso ng kahoy ang nagsisilbing palatandaan sa eksaktong lugar na pinangyarihan ng trahedya dalawang taon na ang nakararaan. Bahagyang naikukubli ng malagong talahib ang malawak na espasyong nagsilbing huling hantungan ng mga biktima ng isa sa pinakamalagim na masaker sa kasaysayan ng bansa. Dito sa bayan ng Ampatuan, Maguindanao, naganap ang walangawang pagpaslang sa hindi bababa sa 57 kataong kinabibilangan ng mga sibilyan, abogado at mamamahayag. Kalakhan ng mga biktima ng masaker sa Ampatuan ay bahagi ng convoy ni Esmael Mangudadatu, na nakatakdang magsumite ng certificate of candidacy sa pagka-gobernador sa tanggapan ng Commission on Elections noong Nobyembre 23, 2009 kasama ng kanyang mga kaanak. Malay sila sa panganib na kaakibat ng biyaheng iyon, ngunit sa puntong iyon, walang sinumang nakabatid na patungo sila sa kanilang huling hantungan. Kabilangsakanilaangmagkatrabahong sina Victor Nuez at Mac-mac Arriola, kapwa mamamahayag na pinaslang sa gitna ng tungkulin. Patumpiktumpik pa ang mga katrabaho ng kanyang asawa, ngunit alam niya sa sariling masamang balita ang hatid ng mga itokumpirmado, wala na si Mac-mac. Dalawang linggo siyang naghintay sa UNTV office upang muling masilayan ang kanyang asawa. At nang dumating na ang pagkakataong iyon, buong tapang niyang hinarap ang malamig na bangkay ni Mac-mac na nakasilid sa isang kabaong gawa sa kahoy. Nakatakda sanang magpakasal ang dalawa noong Disyembre 2009 sa kasalang-bayan sa General Santos. Subalit hindi na nila nagawang magpalitan ng pangakong magsasama habang buhay, sa hirap man o ginhawa. At ang musmos na si Japhet ay lalaking walang ni isang alaala ng kanyang ama.

Sa kasalukuyan, tanging 93 lamang sa 196 na hinihinalang suspek ang may kaso habang dalawa pa lamang sa mga pangunahing suspek ang nakukulong, ayon sa National Union of Journalists of the Philippines, samahan ng mamamahayag. Kabilang ang mga biktima ng Ampatuan Massacre sa malalang talaan ng mga paglabag sa karapatang pantao sa bansa. Sa ilalim ni Dating Pangulong Gloria Arroyo, may 1,206 biktima ng pulitikal na pamamaslang, 226 biktima ng pagdukot at libo-libong dumanas ng tortyur, militarisasyon, at iba pang uri ng paglabag sa karapatang pantao, ayon sa grupong Karapatan Human Rights Alliance. Ngunit patuloy pa rin ang mga paglabag sa karapatang pantao

hanggang sa kasalukuyan. Sa ilalim ng administrasyon ni Pangulong Benigno Aquino III, nakapagtala ang Karapatan ng 55 biktima ng pulitikal na pamamaslang, 8 kaso ng pagdukot at libo-libo pang biktima ng pagyurak sa karapatang pantao. Sa ikalawang anibersaryo ng masaker, nagsindi ng kandilat nangalampag sa Mendiola sina Nanay Catherine at Erlyn kasama ang iba pang naulila bilang paggunita sa alaala ng mga biktimat pagpapaalala kay Aquino na silang mga naulilat nawalan ay patuloy na nagmamatyag at naghihintay ng hustisya.

Mahaba at masalimuot ang kalbaryo nina Nanay Catherine at Erlyn kasama ang libo-libo pang nagluluksang mga kaanak at kaibigan. At habang patuloy na naaantala ang pagkamit ng hustisya, handa silang manindigan at ipagpatuloy ang nasimulang labansa mga hukuman man o lansanganhanggat wala nang mga pangakong kailangang maipit sa nagbabanggaang interes ng iilan.
