TREND MICRO LICENSE AGREEMENT NOTICE TO USERS: CAREFULLY READ THE FOLLOWING LEGAL AGREEMENT.

USE OF THE SOFTWA RE PROVIDED WITH THE AGREEMENT (THE "SOFTWARE") CONSTITUTES YOUR ACCEPTANCE OF T HESE TERMS. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, PROMPTLY RETURN THE SOFTWARE AND THE ACCOMPANYING ITEMS (INCLUDING WRITTEN MATERIALS AND PACKAGI NG) TO THE LOCATION WHERE YOU OBTAINED THEM FOR A FULL REFUND. 1. LICENSE GRANT. Upon the valid purchase of a license to the SOFTWARE and excep t as otherwise specified in an accompanying license summary, invoice or other do cuments evidencing the purchase of the SOFTWARE license (collectively, "Suppleme ntal Agreements"), Trend Micro Incorporated ("Trend") grants to you a perpetual, non-exclusive, non-transferable right to use the SOFTWARE on file servers conne cted to a maximum number of user computers, and/or on a maximum number of deskto p user computers, not exceeding the number of user computers specified in the pa ckaging accompanying the SOFTWARE or in any Supplemental Agreements. This licens e to use the SOFTWARE is conditioned upon your compliance with the terms of this Agreement. You agree you will only copy the SOFTWARE into any machine-readable or printed form as necessary to use it in accordance with this license or for ba ckup purposes in support of your use of the SOFTWARE. This license is effective until terminated. You may terminate it at any point by destroying the SOFTWARE t ogether with all copies of the SOFTWARE. Also, TREND has the option to terminate this Agreement if you fail to comply with any term or condition of this Agreeme nt. You agree upon such termination to destroy the SOFTWARE together with all co pies of the SOFTWARE. 2. COPYRIGHT. The SOFTWARE is protected by United States copyright law and inter national treaty provisions. You acknowledge that no title to the intellectual pr operty in the SOFTWARE is transferred to you. You further acknowledge that title and full ownership rights to the SOFTWARE will remain the exclusive property of TREND or its suppliers, and you will not acquire any rights to the SOFTWARE exc ept as expressly set forth in this license. You agree that any copies of the SOF TWARE will contain the same proprietary notices which appear on and in the SOFTW ARE. 3. REVERSE ENGINEERING. You agree that you will not attempt to reverse compile, modify, translate, or disassemble the SOFTWARE in whole or in part. 4. LIMITED WARRANTY. TREND warrants that the SOFTWARE will perform substantially in accordance with the accompanying written materials for a period of thirty (3 0) days from the date of purchase. Any implied warranties relating to the SOFTWA RE are limited to thirty (30) days. 5. CUSTOMER REMEDIES. If the SOFTWARE does not conform to the limited warranty i n Section 4 above ("Limited Warranty"), TREND's entire liability and your sole r emedy shall be, at TREND's option, either to (a) correct the error or (b) help y ou work around or avoid the error. The Limited Warranty is void if failure of th e SOFTWARE has resulted from accident, abuse, or misapplication. Any replacement SOFTWARE will be warranted for the remainder of the original Limited Warranty p eriod. 6. NO OTHER WARRANTIES.TREND DOES NOT WARRANT THAT THE SOFTWARE IS ERROR FREE. E XCEPT FOR THE EXPRESS LIMITED WARRANTY IN SECTION 4 ("LIMITED WARRANTY"), TREND DISCLAIMS ALL OTHER WARRANTIES WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS OR I MPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTIBILITY, FITN ESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS. SOME JUR ISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON HO W LONG AN IMPLIED WARRANTY MAY LAST, OR THE EXCLUSION OR LIMITATION OF INCIDENTA L OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTH ER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION. 7. SEVERABILITY. In the event of invalidity of any provision of this license, th e parties agree that such invalidity shall not affect the validity of the remain ing portions of this license. 8. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL TREND OR ITS SUPPLI

ERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL OR INDIRECT DAMA GES OF ANY KIND ARISING OUT OF THE DELIVERY, PERFORMANCE OR USE OF THE SOFTWARE, EVEN IF TREND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL TREND'S LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT, TORT, OR ANY OTHER TH EORY OF LIABILITY, EXCEED THE LICENSE FEE PAID BY YOU, IF ANY. 9. GOVERNING LAW. This license will be governed by the laws of the State of Cali fornia as they are applied to agreements between California residents entered in to and to be performed entirely within California. The United Nations Convention on Contracts for the International Sale of Goods is specifically disclaimed. 10. ENTIRE AGREEMENT. This is the entire agreement between you and TREND which s upersedes and prior agreement or understanding, whether written or oral, relatin g to the subject matter of this license. 11. U.S. GOVERNMENT RESTRICTED RIGHTS. If this product is acquired under the ter ms of a (i) Civilian Agency Contract - use, reproduction or disclosure is subjec t to FAR 52.227-19(a) through (d) and restrictions set forth in the accompanying end user agreement; and (ii) DOD Contract - use, duplication or disclosure by t he Government is subject to the terms of this license unless superseded by 252.2 27-7013(c)(1)(ii).
