STATEMENT OF FACTS

On July 15, 2011 Petitioner, PAULA LUA did file a Verified Writ of Mandate to disqualify the Hon. Gerald Rosenberg for more than the appearance of bias. Further stating that she did not feel she would not have a fair and impartial hearing. At the time of filing the official court transcript were not available. Petitioner did receive the official court transcripts on or about July 26, 2011 for the June 30, 2011 court proceedings. Petitioner paid Adrianne Thompson, Official Reporter $39.00 for the transcript. At all times the Petitioner stated in her verified Writ of Mandate that the Hon. Gerald Rosenberg stated the following: I have a feeling you will be filing another demurred next time do it Ex Parte. At this time Petitioner states the official court

transcript is not a true and correct accounting of the June 30, 2011 court proceedings. Page 10 of the alleged official transcript has been altered. On July 20, 2011 Defense Counsel, Jone Osborn (interested Party) did as she was ordered to do by Judge Rosenberg she did file an Ex Parte Application For Order Shortening Time And To Specially Set Defendants Demurrer To The Second Amended Complaint (Ex 2). The declaration of defense counsel in support of her ex parte application states she was ordered to file the demurrer ex parte. However after all the fan fair bells and

whistles to appear impartial the defendants ex parte application was denied by Judge Rosenberg. Judge Rosenberg took the Petitioner September 12, 2011 trial date off calendar. If what is stated on page 10 of the June 30, 2011 official court transcript was true and correct why did Judge Rosenberg deny the ex parte application? Exactly 5 days after the Petitioner filed and served her verified Writ of Mandate, Judge Rosenberg decided to deny defense counsels ex parte application to set and serve the demurrer. Judge Gerald Rosenberg, Defense counsel, Jone Osborn and Adrianne Thompson, official Reporter all had some part in tampering and altering the June 30, 2011 official court transcripts in the matter of Paula Lua vs. Career Colleges. Further on page 2 third paragraph (official transcript) Jone Osborn counsel for the defense informed Judge Rosenberg of a clerical error in the June 30, 2011 Tentative Ruling, Judge Rosenberg immediate corrected the error. Jone Osborn as an officer of court had a fiduciary duty to inform the Judge that he failed to state what the deficiencies were in the FAC. Defense Counsel knew the error would garner her another
