OF SAID ACT, IN THAT:

Respondent has interfered with, restrained and coerced employees in the exercise of the rights guaranteed in the Act and dominated or interfered with the formation, existence or administration of Complainant Union.; and failed to bargain collectively in good faith with Complainant Union which has been designated as the exclusive representative of employees employed by Respondent. Respondent violated Section 7-471 of the Act when it usurped the powers of the State Board of Labor Relations by unilaterally changing the contours of the bargaining unit during the term of a collective bargaining agreement. Respondent did not have jurisdiction to modify the existing bargaining absent a timely petition. Determining bargaining unit composition is within the purview of the State Board of Labor Relations. Specifically, Respondent has unlawfully removed the bargaining unit position of Clerk(s) from Complainant bargaining unit by reducing hours and creating positions outside of the unit to perform the same work assigning work to non-bargaining unit members. Respondent failed to bargain collectively with the Union as to the impact and had direct dealings with bargaining unit members. Respondent has engaged in antiunion animus by targeting bargaining unit positions to eliminate previously negotiated benefits.

Complainant seeks comprehensive statutory remedy including but not limited to an order to cause Respondent to cease and desist violating the agreement; to make all employees whole with interest and pay to Complainant all costs borne by Complainant in pursuance of this Complaint and compliance therewith.
