respectfully moves this Court, pursuant to Fed. R. Crim. Proc., Rules 29 (c) and 33, as follows: 1. For an order of this Court, entering a judgment of acquittal upon all counts

where the jury has found her guilty of health care fraud; specifically, Counts 1 3 and 6 - 10; and 2. For an order of this Court, entering a judgment of acquittal upon Counts 11 -

13, where the jury did not find her guilty of health care fraud, but failed to reach a verdict; and 3. For an order of this Court, entering a judgment of acquittal upon Counts 14

and 15, where the jury did not find her guilty of Unlawful Distribution of a Controlled Substance, but failed to reach a verdict upon Counts 14 and 15 ; 4. ALTERNATIVELY, and without abandoning the above motions, the

defendant respectfully moves this Court for an order granting a new trial upon Counts 1 3 and 6 10, pursuant to Fed. R. Crim. Proc., Rule 33. The above motions are filed pursuant to the provisions of Fed. R. Crim. Proc., Rules 29 (c) and 33; the declaration of defendant Rosa Martinez, M.D.; the testimony of Gordon Irving, M.D.; the testimony of Alexander DeLuca, M.D.; the testimony of the governments auditors/reviewers; the legal memorandum filed
