RESERVATION GUARANTEE
Guest Group desires to use certain facilities of The Salvation Army Echo Grove Camp and Retreat Center located at 1101 Camp Road, Leonard, Michigan and The Salvation Army is willing to allow the use of Camp Facilities only upon acceptance of the terms and conditions in this Guest Group Reservation Contract. Therefore, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, it is agreed as follows:

The term Guest Group as used in this Contract shall mean and include: (a) any organized group executing this Guest Group Reservation Contract, plus (b) every other person or organized group (whether or not named or referred to in this Guest Group Reservation Contract) who shall use the Camp Facilities by virtue of Guest Groups express or implied consent. Any person executing this Guest Group Reservation Contract on behalf of a Guest Group represents and warrants to The Salvation Army that such person has authority so to do and to bind all persons or any other organized group who shall use the Camp Facilities through the Guest Groups consent. Guest Group agrees to pay Echo Grove in advance for reservations for ______ people at $ ______ per person for a total of $ ______ (Total Reservation Fee). This Contract is effective only when signed by an authorized representative of the Guest Group and returned to Echo Grove with the Guest Groups reservation deposit as set forth herein. No alterations can me made within ninety (90) calendar days prior to the beginning of the retreat.

Guest Group understands a non-refundable Reservation Deposit of $ ______ must be submitted at the time of signing this Contract in order to guarantee a reservation. This deposit shall be credited to the Total Reservation Fee due from Guest Group under this Contract. Additionally, Guest Group shall submit a refundable Security Deposit to Echo Grove with their Reservation Deposit and this Contract. The amount of the Security Deposit shall be $ ______ . After Guest Groups departure, this Security Deposit will be refunded to the Guest Group representative executing this Contract, upon completion of a satisfactory inspection of the premises by Echo Grove personnel.

Guest Group agrees to respect the beliefs of Echo Grove Camp and Retreat Center, as stated in its mission statement and core values, throughout the duration of their stay at Echo Grove.

NO SHOW POLICY
In the event that the actual number of people attending the Guest Group Camp falls below the stated contract reservation within the ninety (90) calendar days prior to the beginning date of stated reservation, then Echo Grove will extend a 25% cancellation discount for each person not attending the camp.

CANCELLATION POLICY
Guest Group may cancel, alter or modify this Contract prior to ninety (90) calendar days before the Start Date without additional penalty. Such cancellation, alteration or modification must be submitted to Echo Grove in writing. In the event Guest Group cancels this Contract less than ninety (90) calendar days, but more than sixty (60) calendar days prior to the Start Date, Echo Grove shall be entitled to 25% of the Total Retreat Fee. In the event Guest Group cancels this Contract less than sixty (60) calendar days, but more than sixty (30) calendar days prior to the Start Date, Echo Grove shall be entitled to 50% of the Total Retreat Fee. In the event Guest Group cancels this Contract less than thirty (30) calendar days prior to the Start Date, Echo Grove shall be entitled to 75% of the Total Retreat Fee.

WAIVER FROM LIABILITY AND INDEMNIFICATION PLEASE READ CAREFULLY

In consideration for the privilege of using The Salvation Army Echo Grove Camp and Retreat Center, Guest Group, collectively and individually, by and through its undersigned representative, agrees to release The Salvation Army, its employees, agents, volunteers and other acting on its behalf from any and all liability of any kind and nature arising in connection with this Contract, and further agrees to assume any and all risk for any and all injuries, including death, that may be sustained by any member of the Guest Group in connection with the use of said premises. To the extent practicable, Echo Grove will, but shall have no duty or obligation to monitor enforcement of the Rules and Regulations, as amended from time to time, a copy of which has been provided to Guest Group simultaneous with the execution of this Contract, but shall not be responsible for actions or omissions of third parties. The undersigned waives any and all causes of action against Echo Grove and its affiliates, owners, agents, directors, officers, trustees, volunteers and employees, which might arise from any activity on or in connection with the Echo Grove facilities, failure to enforce the Rule and Regulations, and actions or omissions of third parties.

In the event the undersigned, a member or members of the Guest Group, or a third party or parties is injured in any occurrence in which the undersigned participates, the undersigned shall indemnify, defend and hold Echo Grove, its affiliates, owners, agents directors, officers, volunteers and employees harmless of, from and against any and all liabilities, claims, costs and expenses which arise from claims by such injured parties, including attorneys fees. I hereby authorize any medical treatment deemed necessary in the event of any injury while participating in any activity. I either have appropriate insurance or, in its abscence, agree to pay all costs of rescue and/or medical services as may be incurred on my/our behalf. Echo Grove shall not be liable for the loss or theft of, or damage to, the personal property or other valuables of any Guest Group or its members. Guest Group, individually and collectively, agrees to release, indemnify, hold harmless, assume liability for and defend Echo Grove, its affiliates, trustees, directors, officers, volunteers, employees and agents of, from and against all liabilities, damages costs and expenses including, but not limited to, attorneys fees, reasonable investigative and discovery costs, court costs and any other sums which Echo Grove, its trustees, directors, officers, employees, volunteers and agents may pay or become obligated to pay for injury, including death, to persons, or damage to property resulting from my/our use of said premises or from my/our actions or omissions and arising from any cause, including matters caused by the negligence of Echo Grove, its affiliates, trustees, officers, directors, employees, volunteers, and agents while acting within the scope of duties of such relationship to Echo Grove.

IN ADDITION
I certify that the undersigned and all members of the Guest Group are physically fit, and that they do not suffer from any injury, defect, ailment, illness or the like which could conceivably lead to injury or death from participation in Echo Grove activities. (Please initial _____) By signing this Waiver on behalf of myself and the Guest Group, I acknowledge that I have read and fully understand its terms and conditions. (Please initial _____) A fully executed original of this Waiver must be delivered and accepted by Echo Grove prior to beginning any activity at Echo Grove Camp and Retreat Center.

BINDING AGREEMENT
This is a legal Contract and binds the signer and their stated organization to the terms and conditions stated herein, and to Echo Groves rules and regulations which are hereby incorporated into and made a part of this agreement, which may be amended from time to time. Signer of this Contract hereby warrants and represents that he/she is a mentally competent legal adult, guarantees that he/she is authorized to execute this Contract, individually, and on behalf of the Guest Group identified on page 1 of this contract, and acknowledges receipt of said rules and regulations.
