St Augustine Beach Community Garden Membership Agreement __________________________________ Name of Member Mission Statement: The purpose of the St Augustine

Beach Community Garden is to organize interested St Augustine Beach and Anastasia Island residents into a membership-based group that works together to perform gardening activities and create opportunities for social interaction. Our objective is to produce healthy organic food, to lower our carbon footprint, to master the art of gardening through collaborative learning, and to promote sustainable living. The City of St Augustine Beach, the landowner, approved a License for Limited and Temporary Use of City Property (Use Agreement) that authorizes St Augustine Beach Community Garden, Inc. (SABCG), a Florida Non-Profit Corporation, to operate a community garden within a specific area between A Street and 1st Street, on 2nd Avenue. The Use Agreement requires SABCG to install and maintain a perimeter fence and carry liability insurance. The liability insurance requires the community garden to operate as a membership-based group (Member(s)). The Use Agreement requires SABCG to keep the Garden in good order. The SABCG Board of Directors (Directors) is authorized by SABCG to act as its executive agent. There are two membership options available: an Affiliate Membership and a Garden Box Membership. Membership dues are paid in biannual (2) payments, half due by January 31st and the other half by July 31st of each year (Membership Dues). Affiliate Membership Full access to the garden Communications and notification for garden activities Membership Dues of $10 per year OR manage or assist with an appointed garden task Garden Box Memberships Full access to the garden Communications and notification for garden activities An assigned garden plot to cultivate and harvest Full use of the tools, barn and garden resources Manage or assist with an appointed garden task Membership dues of $50 per year The St Augustine Beach Community Garden (Garden) is designed for active gardening and participation by its Members. Members are required to abide by the Garden Rules and participate in maintaining the communal areas of the garden. Members that are assigned

garden plots are required to dedicate the time and pursue the knowledge necessary to keep an active, well-maintained garden and to follow the Rules Governing Plots. GARDEN RULES 1. The Garden is closed from dusk to dawn. 2. When exiting the Garden, Members are responsible for ensuring the Garden is locked if Garden is unattended by another Member. 3. The gate combination will not be disclosed to any non-Member. 4. Children under the age of twelve (12) must be accompanied and supervised by an adult (18 or older). 5. Non-disruptive pets are permitted if leashed and controlled by their owner. The owner is responsible for disposing pet waste outside of the Garden. 6. Smoking is prohibited within the Gardens perimeter. 7. Members must be considerate of the rights, needs, and safety of other Members and the visiting Public and with courtesy towards all. Harassment of anyone will not be tolerated. 8. If applicable, Members agree to manage one small garden task to help maintain the common areas of the Garden, subject to the Directors approval. 9. Members agree to use the Gardens tools responsibly, return them to the proper place, and turn off all water faucets. 10. If applicable, Members agree to pay Membership Dues on time. 11. Members must comply with all park rules and city ordinances. RULES GOVERNING PLOTS 1. Garden plots are assigned by the Directors (Assigned Plot). A Member that signs this agreement is considered the caretaker of the Assigned Plot and cannot transfer the Assigned Plot to someone else. 2. Members agree to use only organic methods when gardening and weeding. Members agree not to use any chemical herbicides, chemical pesticides or chemical fertilizers. 3. Assigned Plots will be allocated on a first-come, first-served basis. Current Assigned Plot holders have the right to renew their Assigned Plot. 4. Members may not tend to another Members Plot without that Members permission. 5. Members agree to actively garden by removing weeds promptly from their Assigned Plot and the immediate area surrounding their Assigned Plot and by harvesting produce in a timely manner. 6. Members agree to promptly treat or remove any diseased and/or insect infested plants from their Assigned Plot. 7. Members agree that SABCG can at any time treat or remove any diseased and/or insect infested plants from their Assigned Plot. 8. Members agree to keep all plants reasonably within their Assigned Plot boundary and to maintain the walkways and area surrounding his or her Assigned Plot clean of debris, trash and weeds. 9. Members agree to conserve the use of water by mulching their Assigned Plot to reduce water evaporation.

If a Member violates any of the Garden Rules and Rules Governing Plots after two warnings, then membership will be terminated and/or their Assigned Plot cancelled. POLICY TOWARD ABANDONED PLOTS Directors may consider an Assigned Plot abandoned in the case of clear signs of serious neglect, in which case SABCG may cancel the Assigned Plot and reassign the plot to another Member. Examples of serious neglect are: weeds over two feet in height, weeds covering most of the Assigned Plot, unharvested Assigned Plots, or Assigned Plots with seriously diseased plants or infested with insects. Garden meetings to discuss the Gardens operation are held the first Sunday of the month at 4:00 pm. Member attendance is voluntary. Member may use this venue to submit a written complaint (Complaint). Garden Directors will resolve the Complaint to the best of their ability. To the fullest extent allowed by law, the Member, by signing this Agreement, agrees to waive, discharge, hold harmless, and release from any and all liability for personal injuries (including death) and damages, St Augustine Beach Community Garden, Inc., its Officers, and the City of St. Augustine Beach resulting from the use of, or visitation to, the Garden. The Member understands and intends that this assumption of risk and release is binding upon the heirs, executors, administrators and assigns, and includes any minors accompanying the garden members to the Garden.
