1. Iam still awaiting your response to my repeated requests for getting my statement recorded before a Magistrate under the provisions of Section 164(1) of the Code of Criminal Procedure 1973.
Please find annexed herewith, copies of some relevant documents which have been already submitted to the SIT during the course of my deposition. Perusal of these documents should convince you that: a. For some inexplicable reason, Ahmedabad City Police was exceptionally lax in making preventive arrests on 27/02/2002, despite the anticipated likelihood of widespread retributory violence in view of the VHPIBJP sponsored Gujarat Bandh Call on 28/02/2002. b. Most Police/Administrative Units in Gujarat, including Ahmedabad City, delayed the imposition of curfew despite the widespread outbreak of communal violence. c. The Police action, during the first 48 hours, in most of the violence affected areas, including Ahmedabad City; was not only grossly inadequate, but overtly iniquitous. d. The requisition and effective deployment of Army was irreparably delayed.

alive, the entire State of Gujarat has witnessed spontaneous and violent manifestations of anguish and outrage at the said attack. A total of 618 incidents of serious communal violence have been recorded from all across the State. A gist of the reported incidents is annexed as Annexure-I. Reports of violence are still coming in from various parts of the State. The law enforcement machinery of the State, despite being grossly overwhelmed by the spread and intensity of the spontaneous violence on 27/02/2002 and 28/02/2002, made all possible efforts to prevent and contain .the communal violence. The police used Tear Smoke and resorted to firing at various places in order to disperse the rampaging mobs. A total of 1626 persons have been detainedlarrested so far, in connection with the post 27/02/2002 violence. The Police has fired 1988 rounds to control the riotous mobs. 49 persons have died so far in Police firing. One policeman has been stabbed and burnt alive, one Policeman has been shot dead by miscreants, whereas two other policemen have sustained stab injuries in the current violence.

The police force available with the State was apparently inadequate to effectively prevent and control the spontaneous communal violence of such magnitude. I n order to facilitate the maintenance of law and order, prohibitory curfew under section 144 of the Cr.P.C. was enforced at all major trouble spots across the State. The details of Curfew Imposition are annexed herewith an Annexure-II. All the resources available with the State Police, including the State Reserve Police Force have been optimally deployed and the law and order situation of the State is fast returning to normalcy, although tension continues to prevail in certain communally sensitive areas of the State. Looking to the gravity of the situation, in addition to the BSF and CRPF-RAF already deployed, the services of the armed forces have also been requisitioned in aid of civil authorities. 'The current deployment of the State Reserve Police Force, Central Para Military Forces and the Armed Forces is annexed herewith as Annexure-III.
