PERFORMANCE BOND

KNOW ALL MEN BY THESE PRESENTS, THAT WE ,

hereinafter called owner, and , corporation incorporated under the
laws of the State of Maryland, hereinafter called Surety, are held firmly bound unto the
Montgomery County Planning Board of the Maryland-National Capital Park and Planning
Commission, in the sum of dollars, to be paid to the said Montgomery
County Planning Board and the Maryland-National Capital Park and Planning Commission or
its assigns, and this bond is binding upon ourselves, our heirs, executors, administrators and
successors, jointly and severally.

WHEREAS, the above named Owner has on Date of mailing of Planning Board Opinion
received conditional approval by Maryland-National Capital Park and Planning Commission for
Plan No. Preliminary Plan Number . The review included the approval of a Forest Conservation
Plan from said Maryland-National Capital Park and Planning Commission for certain
Reforestation and/or Landscape planting located within property at Address or Lot/Block, Subdivision
, Montgomery County, Maryland, as more fully described in Plan No. Preliminary Plan Number .

WHEREAS, it is a condition of the approved recordation of the record plat for

Preliminary Plan Name , Montgomery County, Maryland by the Maryland-National
Capital Park and Planning Commission, that a bond or other instrument of guarantee is issued
to secure the timely performance of all obligations to reforest and supplement landscaping as
shown on Plan No. Preliminary Plan Number .

NOW THEREFORE, the conditions of this obligation is such that above named owners
shall in all respects fully and timely comply with all the applicable terms, conditions, provisions
and requirements of the Reforestation and Landscaping schedule as set forth in the Forest
Conservation Plan (Plan No. Preliminary Plan Number ), as approved by the Maryland-National
Capital Park and Planning Commission, dated Date of Mailing of Planning Board Opinion , and shall
maintain said planting for a period of two years from date of planting. Owner shall fully meet
and faithfully and timely perform the Owner’s obligations in completing the work for which said
bond is issued in manner satisfactory to the Environmental Planning Division of the Maryland-
National Capital Park and Planning Commission. In the event the owner shall not comply with
all terms, conditions, provisions and requirements of the aforementioned schedule, the
Montgomery County Planning Board of the Maryland-National Capital Park and Planning
Commission may, at any time following its determination of non-compliance, in writing, make a
claim under this bond by contacting:

This obligation shall remain in full force and effect until a completion certificate has been
issued for the work described in the Reforestation schedule of the above-mentioned Forest
Conservation Plan.
