UniversityofBristolresponsetoPostLegislativeReviewoftheFreedomof InformationAct
TheUniversityofBristolwouldliketooffersomecommentsinrelationtotheaboveconsultation regardingtheFreedomofInformationAct(FOIA).UniversitiesUK(UUK)issubmittinga comprehensiveresponseonbehalfofthesectorbutwewouldliketoaddourindividualvoicetothe review.TheUniversityfullysupportsallsubmissionsmadebyUUKintheirresponse. WeshouldfirststatethattheUniversitydoesbelieveinbeingopenandtransparentaboutits activitiesandweproactivelypublishagreatdealofinformationonourwebsiteinrelationtothe Universitysbusiness,itsgovernanceandfinances. Highereducationinstitutions(HEIs)holdadifferentpositiontomostbodiessubjecttoFOIAasthey donotprovideapublicservice,unlikelocalcouncilsandotherpublicfacingbodies,andreceive oftensubstantialamountsoftheirfundingfromprivatesources.Theseconflictingpositionscan causedifficultiesforHEIswhenFOIrequestsarereceived. Costofcompliance ThecostofcompliancewithrequestsmadeunderFOIAisofmajorconcern.Requestsreceivedby theUniversityhaveincreasedfrom49in2007to142in2011withoutanyfurtherresourcededicated torespondingtorequests.Requestsarealsobecomingmorecomplexandtimeconsumingandoften servelittlepublicintereste.g.theuseofFOIAbycommercialorganisationsconductingtheirown customerresearch. ThisincreaseaddsanextraburdenacrosstheUniversityandstaffcanbedivertedawayfromtheir dayjobsforuptotwodayswhenrespondingtoasizeablerequest.Thereductionoftheappropriate limitundersection12oftheActfrom450(18hours)toamorereasonabletimeperiod(perhaps sevenor12hours)wouldbewelcome.Thiswouldallowlargerequeststoberefusedmoreeasily andthereforereducetheinstitutionalburden.Itwouldalsoreducetheresentmentfeltbystaff towardsFOIA. Atpresent,wearenotabletotakeintoaccountthetimetakenforconsideringFOIAexemptions, researchingcaselawandredactingexemptinformationwhenmakingacalculationofthetime estimateforarequest.Thesecanbethemosttimeconsumingpartsofdealingwitharequestandit wouldbehelpfulifthesewereincludedinacalculationundersection12oftheAct. ArequestermayalsosendaroundrobinrequesttoallUKHEIsatthetouchofabuttonthatcan causeahugeamountoftimeandmoneybeingspentcollectivelyacrossthesectorasover150 institutionsattempttoprovideinformation.TheHigherEducationStatisticsAgency(HESA)ishelpful whenlargescaleroundrobinsaremade,butitsprofilecouldberaisedsorequestersknowwhere theycanobtainsectorwideinformation. Researchandprivatefunders AsFOIAappliestoallinformationheldbytheUniversity,researchdatainrelationtoaprivately fundedprojectissubjecttorequestsmadeundertheAct.FOIAisinplacetoprovidetransparencyin

thespendingofpublicmoneybutourpositionunderFOIAcouldleadustoreleaseinformationthat hashadnopublicfundingwhatsoever.ThiscanalsocausetensioninrelationshipsbetweenHEIsand privatefunderswhennegotiatingcontractsandduringtheresearchitself.Thiscouldleadtoa reductionintheamountofprivatefundingreceivedatatimewhentheamountofpublicmoney beingallocatedtohighereducationhasbeenreduceddramatically. Withthisreductioninpublicfunding,attractingprivatefundingwillbecomemoreimportantforHEIs andourabilitytomaintainrelationswithprivatefundersisintegraltothat. Publicationschemes UnderFOIA,wearerequiredtomaintainapublicationschemethatlistsalltheinformationweare committedtopublishonaregularbasis.Whiletheprincipleiswellintentioned,ourwebsiteis essentiallyourpublicationschemeanduserslookingforinformationshould(hopefully)beableto findtherelevantinformationorpersontocontactrelativelyeasily,leavingthepublicationscheme itselflargelyredundant. Asstated,webelievetheUUKresponsewillcovertheseareasingreaterdetailbutwewishtohave theUniversityscommentsrecordedandaddedtotheconsultationresponses. February2012
