UNITED STATES UNOPPOSED MOTION TO CONTINUE SENTENCING Comes now the United States of America, by and through the undersigned counsel, and moves this Court to continue sentencing for the defendants above until on or after August 1, 2012, as grounds therefore says as follows: 1. On or about December 20, 2010, defendant Massey entered into a Plea Agreement

with the United States. On or about April 22, 2011, defendant Gilley also entered into a Plea Agreement with the United States. Pursuant to their Plea Agreements, the defendants have agreed to assist the United States by providing truthful information when called upon to do so by the United States. The United States has agreed to evaluate each defendants assistance when it is complete and, if appropriate, make a recommendation to the Court concerning the defendants sentence under Section 5K1.1 of the United States Sentencing Guidelines. To date, neither defendant has been sentenced. Pursuant to this Courts orders dated September 1, 2011 and September 26, 2011 the defendants are scheduled to be sentenced on April 23, 2012. 2. The United States respectfully requests that the Court continue the defendants

sentencings until on or after August 1, 2012. The United States anticipates that the need for the

defendants cooperation will continue for the foreseeable future. As such, the United States believes that the requested continuance is necessary to properly evaluate the extent of the defendants assistance as set forth in their Plea Agreements. 3. Counsel for each defendant supports the governments request for a continuance. For the foregoing reasons, the United States respectfully requests that the Court grant the United States motion to continue sentencing in this matter.
