after being duly sworn to in accordance with law hereby state: 1. That we are heirs by right of representation to the intestate estate of the late ALBERTO BALDERRAMA , who at the time of his death sometime in _________________, was survived by his children one of whom is our late mother MARIA BALDERRAMA-ARAOJO who likewise died intestate on _________________. 2. That at the time of her death, our mother the late Maria A. Araojo has left no known personal debts obligations which have not been settled and her entire estate consists of her legitimate share to the intestate estate of her father, the late Alberto Balderrama. 3. That at the time of his death, Alberto Balderrama was the recorded owner of a certain parcel of land identified as Lot 975 of Pls-858-D Rapu-Rapu Land Subdivision situated in Barangay Binosawan, Rapu-Rapu Albay, consisting of Sixty One Thousand Six Hundred Ninety Nine (61,699) square meters more or less and declared for taxation under Tax Declaration No. (the Property) . A copy of the aforementioned Tax Declaration is herewith attached as Annex A and made an integral part of this instrument. 4. That by these presents, WE: CELIA A. CAMCAM, JIMMY B. ARAOJO, JOSE ANTIPAS B. ARAOJO, BENITO B. ARAOJO, AND GLEN B. ARAOJO hereby expressly and freely WAIVE, RENOUNCE and TRANSFER our right of representation and participation to the extent of respective portions over the Property subject of the intestate estate of the late Alberto Balderrama in favor of our co-heir, JUAN B. ARAOJO in recognition of the fact that he, together with the other surviving heirs of the late Alberto Balderrama have actually cultivated the Property for more than 30 years.

5. That by these presents , we hereby affirm that we are the only heirs of the late MARIA B. ARAOJO and have not intentionally or inadvertently omitted to name and include in this instrument the participation of any other surviving heir. 6. That by this presents also, we hereby affirm and confirm the acts of our brother Juan Araojo together with the other surviving heirs of Alberto Balderrama respecting the Property more particularly in selling the same to Rapu-Rapu Minerals Inc. and hereby raise no opposition or disagreement therewith.

NOW THEREFORE, for and in consideration of the foregoing premises and invoking the provision of Section 1 Rule 74 of the Rules of Court, the aforementioned heirs of the late Maria Araojo, and by virtue of their right of representation to the intestate estate of the late Alberto Balderrama , hereby agree by these presents to adjudicate our respective legitimate portion in the manner herein set forth, subject only to the liabilities imposed by Section 4 Rule 74 of the Rules of Court in favor of any other possible heirs, creditors, and other persons who may be deprived of their lawful participation in the estate of the decedents for the period of two (2) years.

THAT FINALLY, we hereby affirm that we have executed this instrument out of our own free will without force , intimidation or violation upon our person, and that we have hereby received our just and proper shares and have no further claim or demand against each other in connection with the above-described parcel of land.
