SYNOPSIS

Class disturbance resulting in a Baker Act.


NARRATIVE

On Tuesday, March 20, 2012, at approximately 1155 hours, a disturbance call was dispatched at building 2, on the Florida Atlantic University (FAU) campus, in Boca Raton, Florida. A black female later identified as Jonatha B Carr Commuter Student (SUBJECT), who was reported, that while she was in her classroom all of a sudden she just started to yell at the instructor and at the entire class saying things like white people suck, Jewish people who think this world is theres which is not, I will fucking kill you at the holocaust events all over the world. Evolution kills, Havent thought about Asians yet. Carr kept going on and on about killing people. Before our arrival it was reported that Carr struck a white male, identified as Ryan Murphy who was attending class. Murphy left the area without being interviewed. We will contact Murphy during this investigation. It was also reported that Carr approached several students threatening and using profane language. She was reluctantly and forcibly escorted out of the room by two white males later identified as FAU employees. Upon my arrival I observed a black female lying face down in the grass area just south of building #2, I also observed two white males holding her down until I arrived. I then held her down with my hands on both of her wrists and I calmly asked her to calm down and she refused. Sergeant Boldin and I attempted to place her in a sitting position at which time she started punching me with a closed fist on my chest. For the safety of Carr and the University community, I then attempted to handcuff her and initiate a Baker Act because of her actions; because she was a harm to herself and others. I attempted to grab her wrist and she grabbed my shirt with her left hand and refused to let it go. Once the handcuffs were placed on her wrist, she started kicking and calling everyone sand niggers, white niggers and black niggers. She also stated that she will "kill everyone white people sucks. Carr refused to cooperate and walk to my vehicle to be transported to South County Mental Health Center (SCMHC). Officer Darrell had to bring my patrol vehicle near our location to place her into it. Carr aggressively resisted by lying on the ground and stiffening her body, Sergeant Boldin, Officer Cowart, Corporal Stewart and I had to lift her and place her inside the vehicle. She was not injured at this stage.

While placing her in the vehicle, she started kicking and screaming, then stiffened her body and refused to put her legs inside, I then attempted to grab her legs and place them inside but she kicked me on my right thigh. I told her if she did not place her legs inside of the vehicle I would tase her. She failed to comply with my multiple commands. She increasingly became more uncontrollable. At this point she gave me no choice but to tase her, after I advised her I would, I then initiated a drive stun on her left thigh at approximately 12:20:11 for approximately 3 seconds, she then placed her legs inside the vehicle. Carr was being transported to the Florida Atlantic University Police Department for processing but while in transit, Carr started screaming to let her out and take the handcuffs off of her and kicking the roof of the vehicle, the door and the windows. Before I arrived at the station, I requested over the radio to have officers standing by the back door to assist me to remove her and take her inside the station. After arriving, for her safety and my safety I decided to take her straight to South County Mental Health Center for further treatment. I had to use a hobble restraint on her legs to control her movements and she refused to comply and stiffened her legs again so I had to drive stun her for approximately 5 seconds on the left side of her torso. We then placed her legs back inside of the vehicle to keep her from hurting herself. Carr was not injured at this stage. Carr refused to stop swinging back and forth so we had to adjust the hobble restraint and she had to be drive stunned a third time for approximately 5 seconds on her left shoulder. Each drive stun was for the protection of Carr and the Officers involved. Carr was transported to South County Mental Health Center by Officer Cowart and me, with Corporal Stewart following from behind because of the way in which Carr was acting. When we arrived at South County Mental Health, Carr refused to exit the vehicle; I went inside the facility and requested their personnel to come out to assist us in removing her from the vehicle. We had to pick her up and physically remove her and take her inside the building. While inside the building the staff there asked her if she would get up off the ground and walk inside on her own power; Carr refused and had to be taken inside and placed on a bed. While in the room she started fighting with staff and had to be restrained to the bed by Corporal Stewart, Officer Cowart, South County staff and myself. While at SCMHC I spoke to Joyce Carr who is Carrs mother who just wanted to make sure that her daughter arrived safely at the facility. A Baker Act Form was completed at the SCMHC and a copy scanned to this report and attached. Victim/Witness Statements are also attached to this report. Professor White who escorted Carr out of the class room requested that Carr not be allowed to register for his classes in the future. He was referred to the Victim Advocate at FAU for further assistance.
