My name is Jean-Paul Marceau and I work in the maritime business for 25 years. I am a ship captain for 8 years and I work for a CMA CGM subsidiary company for 3 years. Being a captain has both advantages and disadvantages . The biggest advantage of all is that Im very well paid so I can provide my family a strong financial situation. But with great power comes great responsibility. Peoples lives depend of my decisions, thats why it takes a strong character and a healthy judgement to be a ship captain. When I was younger I used to see things different and the 4

nowadays disadvantages of this job like being away from home, living an adventurous life were the attractive points in that time of youth. The vessel I work now is container ship of 222m length and 30 m breadth. It is well equipped , the crew is highly qualified and things have been smoothly running till now . We are transporting refridgerated fish in specialized reefer containers so it is very important that we deliver on time the cargo to protect the interests of both the shipper and the consignee. This the second month of the 4 months voyage on the following navigational route: North Sea- English Channel East Coast of France-West Coast of US.

STATEMENT OF FACTS

I, Jean Paul Marceau, Master of the vessel CMA CGM Florida, call sign 2AKU3, GT 54309 tons, properly stowed, manned and equipped, of London Registration, owned by CMA-CGM Company, hereby declare that my vessel, underway from Brest to New York on March 14th 2009, with a cargo of 5,078 containers, met with adverse weather that was not specified in the meteorological warning received on the mentioned date. 8

The weather conditions caused extreme rolling and pitching of my vessel. To protect the vessel and cargo from any losses or damage I ordered to alter course 50 degrees portside of the current course. Therefore our ETA-New York was retarded, which has resulted in a delay of 9 hours. I hereby deny all responsibilities for any damage caused by the bad weather situation. Signed: J.P. Dear Sir,

Please be advised that there is a discrepancy between ship- and shore figures covering 8,500 tons refrigerated cargo. During discharging at your terminal this 30th of March 2009 of the above mentioned cargo our first mate observed the following fact that was detrimental to the quantity / quality of the cargo: inadequate stowing and transportation of 300 tons of frozen fish, resulting in severe deterioration of quality due to thawing. In order to protect the interests of our principals, Belle Ile-Seafood Brest, we regret having to advise you on their request and on their behalf, that they hold you responsible for all costs, expenses and/or detrimental consequences which might result from the above.

February 22nd 2009 was the first day of our voyage from Europe to United States of America. Our duty is to deliver the cargo in time to best protect the interests of the Owners,shippers and consignees. The first port of loading was Bremerhaven , one of the most complex port systems in Europe. Bremerhaven, situated on the mouth of the river Weser, was founded just 175 years ago, making it one of the youngest cities in Germany. It owes its existence to a forward-looking port policy decision made in the early 19th century. Bremen's role as a seaport has been determined more by the maritime mindset of its citizens than by its actual geographic circumstances, which have often enough proved adverse throughout Bremen's thousandyear history as a port.

"Life and shipping are one in Bremen" said the famous Bremen poet Rudolf Alexander Schrder. The port of Bremerhaven has 40 years of tradition in container traffic and its numbered among the 25 largest container terminals in the world. The next stop was Europes largest seaport-Rotterdam. The port of Rotterdam has an ideal natural location. Its directly connected to the deep waters of the North Sea - the most heavily navigated sea route in the world. Major rivers such as the Rhine, Maas and the Schelde follow into the sea at Rotterdam. Rotterdam is situated in the heart of Europe. The European market of more than 500 million consumers and industrial centers in Germany, Belgium, France but also in Eastern Europe all within easy reach.

Due to its central location and excellent intermodal connections, Rotterdam is one of the world's most important cargo junctions. Each year, about 400 million tonnes of cargo are handled here and 34,000 sea-going vessels and 133,000 inland navigation vessels call at this port . After 8 hours of loading 2000 containers we set sail to our next port of call: Brest The largest port of the region Bretagne ,Brest is Frances busiest container port, and one of the largest in Europe. It has two dedicated container terminals that can handle almost 3.5 million TEUs (Twenty-foot Equivalent Units) a year. Over30% of the Frances import and export trade passes through the Port of Brest, and its road and rail connections link it to the countrys major markets, providing customers with a productive, consistent and quality service.

As such, the Port plays a pivotal role in keeping the countrys trade moving, and over 4,000 ships pass through its terminals each year including the very largest container ships afloat today. Brest is also one of the largest fishing ports of France together with Boulogne-Sur-Mer. The Atlantic coast of France has an extraordinary view : wild cliffs emerging from the ocean, stranded lighthouses in the middle of the raging waterscalled by the locals the Hell . The coast of Bretagne is full of little islands where the main occupation of the islanders is fishing for oysters. It can be a very well paid job , but also very dangerous because the streams are powerful and the high tide reaches almost 10 m twice a day. We were underway to New York on the 1st of March . Crossing the Atlantic Ocean is always an adventure even for the most experienced sailors. The weather can change from one hour to another and the ships biggest enemy is the hurricane.

In our 7th day of voyage we encountered a serious problem. Although the weather forecast looked just fine , the OOW noticed tat the wind was blowing harder, the sea was swelling, and the pressure was dropping . I was summoned immediately on the bridge and due to the new circumstances was forced to alter course 50 degrees portside in order to avoid an unannounced depresionary area . The consequence of my decision was a 9 hours delay for the next port of call:New York On the 14th of March , the city that never sleeps received us with arms wide opened. The Port of New York/New Jersey is the largest port complex on the East Coast of North America and is located at the hub of the most concentrated and affluent consumer market in the world, with immediate access to the

most extensive interstate highway and rail networks in the region. In addition, The Port Authority directly oversees the operation of seven cargo terminals in the New York-New Jersey region: Port Newark, Elizabeth-Port Authority Marine Terminal, Howland Hook Marine Terminal, Brooklyn-Port Authority Marine Terminal and Red Hook Terminal These Port Authority facilities, combined with Global Marine Terminal and other privately owned and operated facilities, make up the Port of New York and New Jersey. These facilities offer more cargo handling capacity than any other port complex on the east coast of North America. In 2008 the Port also handled 5.3 million loaded and unloaded TEUs (twenty-foot equivalent units). In addition, there are three passenger cruise terminals in the Port. Two are located in of New York: Manhattan Terminal in Manhattan, and the newly constructed Brooklyn Cruise Terminal in Brooklyn, the third is Cape Liberty Cruise Port in Bayonne, New Jersey.

Our next destination is Savannah , Georgia. The ship arrived in Savannah on the 23rd of March and transmitted the notice of readiness at 9:00 am. We received the ok at 13:00hrs.

The Port of Savannah, the second largest city and the chief port of Georgia, is situated on the southern bank of the Savannah River approximately 13 miles north of the Atlantic Ocean. The area surrounding Savannah is characterized by flat terrain with extensive marsh land. The Port, which is operated by the Georgia Ports Authority (GPA), consists of two terminals, Garden City Terminal and Ocean Terminal, which are both owned and operated by the GPA. Garden City Terminal is Savannahs dedicated container terminal. The Ocean Terminal is a combination breakbulk and RoRo facility that

handles a wide array of cargoes. On the 26th of March after discharging 1100 containers we set sail for our final port of call: Miami During our 4 days voyage weve experienced some trouble due to the Gulf Stream one of the strongest currents in Atlantic and Gulf of Mexico .The stream slowed us down a little and made us be extra cautious . March 30 2009 Welcome to Miami, Benvenuto a Miami as Will Smith says in one of his songs. Miami is known to be one of the top locations of the world, the fun metropolis, full of casinos, clubs and party people. The Port of Miami is among Americas busiest ports and recognized throughout the world with the dual distinction of being the Cruise Capital of the World and the Cargo Gateway of the Americas.

The Port contributes over $17 billion annually to the South Florida economy and helps provide direct and indirect employment for over 176,000 jobs. Although we thought the voyage ended with no unwanted surprises we were wrong. While discharging , the first mate noticed that 300 tons of fish was badly deteriorated due to inadequate stowing and transportation. I immediately wrote a letter of protest to the stevedoring company that
