FAITHFULLY TAKE NOTICE that DEFENDANT submits this trial brief, setting
forth a factual summary of the case and issues currently remaining for trial.

Trial by jury demand

ARBITRARY & CAPRICIOUS REVIEW:

Lucifer, plaintiff, by and through his government of sin alleges that (JEHOVAH)
("DEFENDANT") is unfair, unjust, restrictive and that HIS commandments are not able to be
kept.

1. This action is brought pursuant to GOD’S CHARACTER TRANSCRIPT and its

provisions.

2. Plaintiff, Lucifer, is a former covering Cherub and a former citizen of heaven, which is
under the jurisdiction of GOD’s kingdom of glory. Plaintiff and his government of sin are
currently mismanaging Planet Earth, subjecting its citizens to the curse of "sin and death."

3. DEFENDANT, CREATOR, YESHUA HA’MASHIACH, JESUS CHRIST, GOD, has set

forth HIS kingdom of grace as a provision for the citizens on Planet Earth; a contingency plan
compelled only by love (1John 4:8, 16). Additionally, DEFENDANT functions only in
righteousness (Psa. 145:17): and, therefore HIS character is unchanging and irreversible; as
change within HIS character would compromise the safety of the entire universe.

4. In direct response to Lucifer’s allegations, Defendant bore long with Plaintiff, as a

means of mitigating and minimizing the damages, however, Plaintiff was not satisfied with his
created capacity and, he was determined to usurp Christ's position.

5. Plaintiff’s discharge from his at-will position in heaven was as the result of his own
action of wanting to commence his own government. Lucifer elected to terminate his position as
head covering Cherub: and, he chose to begin this action against his Creator, accusing Him of
being unfair and unjust. Most worrisome is plaintiff’s allegation that GOD’s (10) Ten
Commandments are not reasonable.

6. Plaintiff, Lucifer, could not be promoted above his former position (as covering
Cherub) because he, as a created being, does not have the capacity to sustain such a position.
 7. Since Adam, a son of God’s, decision to be subject to the government of sin, all of his
posterity have been impacted by this self-centered decision. Sadly, Adam’s posterity have
suffered greatly “under the law”- see Gal. 4:4; as sin when it is finished produces only death —
see James 1:15. Due to the emergence of “enmity” and since Adam’s fall, citizens of Planet Earth
have not been subject to the law of God, the Ten Commandments.

This case is pending, and it will remain unresolved until God’s remnant reproduce His
Character, obtaining victory over sin; assisted by Christ’s new spiritual line, provided by the
second and last Adam —see 1Cor. 15:45. Notwithstanding Adam’s election of sin’s government,
God’s final righteous generation (144,000 in number) will serve a purpose of ultimately
vindicating God’s character and government.

“When the character of Christ shall be perfectly reproduced in His people, then He will
come to claim them as His own." Regarding the great controversy between GOD and Satan
(a/k/a Lucifer “the Adversary”), God’s loving, governing principles and its demonstration will be
settled absent of the use of force. Ultimately, such a controversy must be resolved by a
demonstration of applied principles that must be manifested willfully by HIS 144,000, Spiritual
Jews (from varying cultures and nationalities). —see A Soul Sealed at Character Perfection
p. 72.

CONCLUSION:

And finally, due to res—judicata—collateral estoppel, a doctrine barring re—litigation,

CHRIST DECLARES: "…affliction shall not rise up the second time."
