Chapter 1
Introduction
1.1 1.2
The Central Information Commission presents the Annual Report for the year 2010-11 as mandated u/s 25(1) of the RTI Act 2005. The annual report focuses on the status of implementation of the Act by Public Authorities in accordance with responsibility cast upon them u/s 25(2) of the Act. These include, inter alia, status of submission of report, category wise analysis of returns, key aspects viz. no of applications received during 2010-11, details regarding number of officials designated as ACPIOs, CPIOs and First Appellate Authorities, manner of disposal of RTI applications, amount collected as application fee, additional charges and penalty etc. The data received have been compared with corresponding figures for the preceding years and analyzed in order to ascertain the pattern emerging in the implementation of the Act. The most noticeable aspect in the year 2010-11 has been the decreasing number of public authorities submitting annual returns for all four quarters and thereby for the whole year in compliance with their statuary responsibility under the Act. In fact, the hope of hundred per cent public authorities discharging this responsibility has continued to be a wishful thinking and distant dream. In the year only 67.5% public authorities submitted the annual return for all four quarters; thereby making the task of any meaningful analysis for discerning the pattern emerging in implementation of this path breaking Act extremely difficult. It is high time ministries/departments and competent authorities, so defined in the Act, take a hard look at this aspect and ensure that each and every public authorities under their control fulfill their obligation stipulated in the law without fail. The annual report also presents a comprehensive picture of activities and events associated with Central Information Commission; as well as its Plan and Budget during 2010-11.It would be pertinent to mention here that three august members of the first genre of Information Commissioners Shri Wajahat Habibullah the CIC, his successor in office Shri AN Tiwari the CIC and Prof. M.M. Ansari demitted their office after completion of their tenure. The contribution of these gentlemen for implementation of the Act through their well reasoned and erudite decisions and regular interaction with various stakeholders

Introduction for generation of awareness about the Act will always be remembered. Notwithstanding the fact that with passage of time the system does find suitable replacements; their absence would always be felt. 1.4 The Commission realizing the importance and necessity of implementation of provisions of section 4 of the Act to ensure setting out a regime of information, where citizen have to take minimum recourse to file an application for seeking information, passed an order directing all ministries/departments to take time bound action in this respect. The Commission also issued exhaustive guide lines regarding institutionalizing the entire spectrum of implementation of its directions spelt out in the order. Although, ministries/departments have initiated action pursuant to the order and guide lines; it is imperative that they ensure strict compliance with the direction of the Commission to achieve the cherished objective of transparency and accountability in governance. The efforts of the Commission, to use ICT in bringing about transparency and efficiency in its working, already recognized by users and expert agencies, received further boost by the Commission being awarded the Platinum Icon Web Ratna Award in the beginning of the reporting year. This has further strengthened the idea of e-Governance interventions through the involvement of ICT to achieve the twin objectives of on line filing of complaints/appeals and tracking the same by all stake holders. The Commission also took a step forward in the direction of online processing of appeals/complaints beginning with their filing to final decision. As of now one registry of the Commission is already performing this task online and one more registry is all set to emulate the example. It is expected that the process of handling appeals/ complaints should be paperless in the Commission in the time to come.

1.6 The Commission successfully organized its two day annual convention on 13-14th September, 2010; and provided a fruitful forum to all stake holders to discuss and deliberate issues and challenges in implementation of this path breaking Act; with a view to suggest the road map for the future.

Implementation of the RTI Act by Ministries, Departments and other Public Authorities in 2010-11
2.1 Introduction 2.1.1 Public Authorities are one of the key important stake holders, in addition to Citizens, Civil Society Organizations, NGOs and Information Commissions, responsible for the successful implementation of this path breaking Act. Hence, it is only appropriate that their performance during the reporting year 2010-11 is critically evaluated and meaningful inferences drawn with a view to finalize the future road map for improved performance. 2.1.2 This chapter accordingly gives detailed account of the status of implementation of the RTI Act 2005, by the central Government and its instrumentalities, during 2010-11 and comparative picture of selected performance parameters vis--vis the same for preceding years. 2.1.3 The responsibilities of every Ministry or Department, in addition to responding to requests filed in the form of an application under the Act, includes also as under:Section 25 (2) of the RTI Act stipulates that:Each Ministry or Department shall, in relation to the public authorities within their jurisdiction, collect and provide such information to the Central Information Commission or State Information Commission, as the case may be, as is required to prepare the report under this section and comply with the requirements concerning the furnishing of that information and keeping of records for the purposes of this section. Section 25(3) of the RTI Act stipulates that:Each report shall in respect of the year to which the report relates,(a) (b) the number of requests made to each public authority;

the number of decisions where applicants were not entitled to access to the documents pursuant to the requests, the provisions of this Act under which these decisions were made and the number of times such provisions were invoked; the number of appeals referred to the Central Information Commission or State Information Commission, as the case may

Implementation of the RTI Act by Ministries, Departments and other Public Authorities in 2010-11 be, for review, the nature of the appeals and the outcome of the appeals; (d) (e) (f) (g) particulars of any disciplinary action taken against any officer in respect of the administration of this Act; the amount of charges collected by each public authority under this Act; any facts which indicate an effort by the public authorities to administer and implement the spirit and intention of this Act; Recommendations for reform, including recommendations in respect of the particular public authorities, for the development, improvement, modernization, reform or amendment to this Act or other legislation or common law or any other matter relevant for operationalising the right to access information.
2.1.4 The Central Information Commission (CIC) accordingly solicits report from all Public Authorities in a prescribed pro forma; and has created a portal for posting the required report on line. The Ministries/ Departments/Public Authorities in turn submit their returns; and the analysis in this chapter is based on data reported by Public Authorities. 2.2 Status of submission of RTI Returns
2.2.1 It is essential to present an overview of the preparedness of the public authorities regarding status of their compliance with provisions of section 25 (2) and 25(3) of the RTI Act; before embarking upon any further analysis and attempting to draw any conclusion 2.2.2 The Commission, in view of inordinate delays by public authorities in submitting annual return in preceding years, introduced the system of submission of quarterly returns at regular interval during 2010-11. Every public authority was required to submit returns for each quarter in order to be eligible for assessment of its performance during 201011. The public authorities, who failed to submit return for even a single quarter have been treated as defaulter.

2.2.3 The present report therefore has analysed data received from only those Ministry/Department/Public Authorities, who have submitted returns for all four quarters. However, for the purpose of assessing total number of RTI applications received and the manner of their disposal during 2010-11, data from even those public authorities, who have submitted return for even one quarter, have been taken into account. 2.3 Ministry-wise Submission
2.3.1 During 2010-11, 65 Ministries/Departments were registered with the database of CIC; who were required to submit return in compliance
with the mandate u/s 25(2) and 25(3) of the Act. While all public authorities of 25 Ministries/Departments submitted their return regarding implementation of the Act, as prescribed by CIC; only 35% of the Public Authorities under the control of 6 Ministries/Department fulfilled their statutory obligation in this regard. A large number of public authorities under the jurisdiction of Ministry of Coal, Ministry of Consumer Affairs, Food & Public Distribution, Ministry of Corporate Affairs, Ministry of Finance, Ministry of Petroleum & Natural Gas and Ministry of Road & Transport did not submit their annual returns. However, none of the public authorities within the jurisdiction of 5 Ministries/Departments discharged their mandated statutory obligation at all. Ministry of Development of North-Eastern Region, Ministry of Youth Affairs and Sports, U.T of Dadar & Nagar Haveli, U.T of Daman & Diu and U. T. of Lakshadweep did not report the status of implementation of the RTI Act during 2010-11 to the Commission. While Ministry of Development of North-Eastern Region and U.T of Lakshadweep continue their defaulting status in respect of submission of the returns to the Commission; there has been 3 more additions to this list in comparison to 2009-10. 2.3.2 The number of Ministries/Departments, where all the public authorities reported the status of implementation of the RTI Act, has gone down from 40 in 2008-09 to 36 in 2009-10 and finally to 25 in 2010-11. It is indeed a matter of serious concern that a significant number of public authorities have failed to realize their statutory responsibility under the Act. It is also noteworthy that the number of Ministries/Departments where less than 50% public authorities reported their status rose significantly from 5 in 2008-09 to 22 in 2009-10; but again fell sharply to 9 in 2010-11. The figure below also reveals that the number of Ministries/Department, where none of the public authorities reported their status, went up in 2010-11 as compared to 2009-2010. The declining number of the public authorities in the matter of submission of returns about selected parameters to the Commission is not only disheartening but also does not augur well for effective monitoring of the implementation of the Act both qualitatively as well as quantitatively. The public authorities must by now realize and effectively streamline the system of submission of returns, an important and inescapable statutory requirement under the Act. It is felt that unless a senior officer is entrusted with the responsibility of effectively streamlining and implementing the system; fulfillment of this important statutory responsibility by hundred per cent public authorities will be a distant dream. Perhaps the institution of Transparency Officer, as directed by the Commission in its order regarding implementation of Section 4 of the Act, can certainly play an effective role in this regard.

2.3.3 It is worth mentioning that both the number of public authorities as well as their percentage, who have submitted their returns, have shown a fluctuating trend over the years (2006-07, 2007-08,2008-09 and 2009-10). In the year 2010-11, 1452 of 2149 (67.5%) submitted their return. However, during 2009-10, 1427 of 1847 (77.26%) public authorities submitted their return. The status of submission of the returns by public authorities has shown a clearly declining trend for the period 2008-09 to 2010-11. During the reporting year 2010-11 the number of public authorities, who have submitted their returns, has declined by approximately 10 percentage points.

2.3.4 The right of inclusion or exclusion of a public authority in the database rests with Ministries/Departments. A ministry may create as many departments; and each of the departments may in turn create and register as many public authorities in the database. It seems, however, that Ministries/Departments do not follow uniform basis of creation and registration of Public Authorities in the database. As a result some of the UT administration report as a single public authority, whereas others have multiple departments reporting as separate public authorities. This persistent problem needs to be addressed by the nodal Ministries/Departments in a manner that facilitates uniform registration concept and universal coverage to all public authorities under their jurisdiction. 2.3.5 The nodal Ministry/Department provides for a role based access to each of the public authorities created by them. It has been observed that some public authorities face difficulties in accessing the database due to either misplaced passwords or no passwords. As indicated above it is the responsibility of a ministry/department to provide for the passwords to the public authorities under their jurisdiction. The Commission as administrator of the central database informed all public authorities well in advance that in case they are not able to access the database for want of the password, they may approach the CIC for regeneration of a new password. It has also been observed that public authorities, although ready with their return, are unable to access the database of the Commission; since they are not registered for this purpose by their respective ministry/departments. The Commission offered to register them in the database once they sent a request to this effect duly endorsed by their ministry/department. The Commission received request from approximately 25 public authorities for providing passwords; and request from 12 public authorities for registration with the central database. 2.3.6 CIC stipulates firm timeline for reporting under intimation to all public authorities; and any extension of the same is also notified well in advance. However, the extant mechanism of some public authorities first reporting to the parent department/ministry; and the latter thereafter reporting to CIC may be resulting in transgression of the time line and consequent default on the part of some public authorities. It is significant to point out that this issue has still not been addressed by public authorities and consequent problem of delays and ultimate default continue to persist. It is also necessary to clearly emphasize that even nil status has to be reported to ascertain the number of registered public authorities submitting their annual return.

2.4.1 During 2010-11, the number of public authorities, in the category of Societies registered under Registration of Cooperative Societies Act, submitting their returns, was the highest in terms of percentage. It is heartening to note that growth in the number of public authorities in this category has been significantly higher this year in comparison to 2009-10 as regards compliance with provisions of sections 25(2) & 25(3). This can be attributed to increase in awareness/sensitization in the supply side due to various capacity building efforts by appropriate governments over a period of time. The extent of compliance among others was however significantly low as compared to 2009-10.
2.4.2 In terms of submission of returns to the Commission, organizations belonging to all categories have shown a decreasing trend except Departments under Ministry, registering a marginal rise of approximately two percentage points. The decreasing trend in this aspect needs to be scrutinized for effective remedial action. 2.5 RTI Application details in nutshell

2.5.1 The number of applications for information has been steadily increasing since 2007-08. Although the total number of RTI applications at the end of the year 2009-10 rose by approximately 73% as compared to the year 2008-09; it decreased by 11.33 % in 2010-11 as compared to the previous year. The opening balance of applications received under RTI Act at the beginning of a reporting year, i.e. the number of applications pending for disposal with the public authorities as on 1st April, is showing a fluctuating trend over the years. It exhibited a steady growth since 2007-08 to 2009-10 but came down significantly in 2010-11. 2.5.2 The number of cases where application for information has been rejected has also gone down considerably during 2010-11; though the receipts of the RTI application saw a negative growth as mentioned above. It could have been a matter of satisfaction if this negative growth in the number of applications for information were in the event of 100% public authorities submitting their returns; but alas this is not the case. As indicated above only 67.5% of the public authorities have submitted their returns in the reporting year. This poor compliance with

However the decreasing trend in the rejection of the RTI application by the public authorities is indicative of their motivation to perform still better and in a more positive manner in future. In 2010-11 only 5.14% of the applications were rejected as against 6.43% in 2009-10.

Implementation of the RTI Act by Ministries, Departments and other Public Authorities in 2010-11 Negative (-) sign is indicative of negative change over the previous year. As can be seen from the table above that the public authorities have denotified a large number CAPIOs, CPIOs and Appellate Authorities. These observations are of course based on the returns [submitted by around 68%] of the public authorities. The negative growth in the number of CAPIOs, CPIOs and the AAs are respectively 73%, 40% and 32.9%. 2.8 Details of amount collected as application fee, additional charges and penalty by public authorities

2.8.2 During 2010-11 there has been a significant rise of around 19 percentage points, in the collection of the application fee by the public authorities as against the previous year. The collection of the additional fee and the penalty has seen a decreasing rate of change of around 7 percentage points over the last year.

It is evident form the table and analysis mentioned above, that the number of rejections of RTI application is going down. This is possibly an indicator of increased effort on the part of public authorities to ensure compliance with provisions of the Act; besides strengthening the supply side of the information.

2.10.2 Use of various provisions of exemption for rejecting applications/No. of times various provisions were invoked for rejecting applications The pie chart in figure 2.10 indicates that on 57% of occasions, RTI applications have been rejected, fall in others category; in so far as reasons of rejection are concerned. The provisions of section 8 (1) were used on 24% of occasions to reject the requested information. There has been a significant rise of approximately 24 percentage points over 2009-10 in the rejection of the applications for reasons termed as others. The usage of reasons, termed as others, in such increasing proportion is inter alia also indicative of the fact that perhaps the requested information is not available in any material form as per definition of Information in the Act. This call for scrutiny and closer introspection by public authorities to ascertain and identify the provisions other than those in sections 8(1), 9, 11 and 24 being used for rejecting the requested information; since there are no other exemption clauses stipulated in the Act for rejecting a request for information. This also calls for urgent implementation of directions of the Commission in respect of Section 4 of the Act in letter and spirit so that Information is available to Citizens for taking and the need to ask for information is minimal.

A number of officials of Hindustan Copper Limited and STQC have been recommended for disciplinary action u/s 20 (2) of the RTI Act during

2010-11. However, these cases appear to be instances of delinquency on the part of individual officers; and it is expected that these figures would decrease over a period of time with increased awareness, sensitization and due diligence on the part of personnel working in various Public Authorities. 2.12 Compliance of recommendation of the Commission During this year the Central Information Commission introduced a block/column in the return to take stock of action taken by concerned public authorities on recommendations made by the Commission with a view to ensure compliance with provisions of Section 25(5) of the Act in their functioning. Most of the public authorities, however, informed about compliance regarding providing the information; thereby not understanding the whole concept of the information desired by the Commission. This aspect would be reemphasized in order to ensure compliance with recommendations of the Commission for systemic reforms/changes in the interest of citizen friendly best practices and good governance. Chapter 3
3.1.1 The Central Information Commission is the apex body created under the RTI Act 2005 to discharge two important functions to achieve the objective of setting out the practical regime of information enshrined in the preamble for securing access to information under the control of public authorities in order to promote transparency and accountability in the working of every public authority. The Commission performs these tasks through adjudication of appeals and complaints filed by citizens who are aggrieved by response of a public authority as well as by issuing directions and/or making recommendations to public authorities regarding adoption of improved/best practices and systemic changes/improvements in larger public interest befitting a responsive government. 3.1.2 This chapter presents an overview of efforts made by the Central Information Commission during 2010-11 to achieve these objectives and includes inter alia status of disposal of Appeals and Complaints, physical and financial achievements under Plan & non-Plan Budget and various important events. 3.1.3 However, it would be pertinent to mention at the outset that in the reporting year two Chief Information Commissioners Shri Wajahat Habibullah and Shri A. N. Tiwari and Information Commissioner Prof. M.M. Ansari demitted their office on superannuation; thereby bringing to an end the era of first generation of stalwarts after the Act came into force. Their contributions towards effective implementation of the Act through erudite decisions and frequent interactions with various stakeholders will always be remembered by the posterity. Some of the important landmark decisions pronounced by these august personalities, both individually and collectively, worth mention are disclosure of cut off marks of selected candidates by UPSC, SSC and other similar organizations, disclosure of norms and practices for allotment of agencies in petroleum products disclosure of Income-Tax returns of political parties, declaration of assets by Judges of Honble Supreme Court, disclosure of file noting etc.

3.2.1 The RTI Act 2005 stipulates two important means to achieve the objectives enshrined in its preamble: adjudication in case of inappropriate response from public authorities to a request for information and/or denial of information and effective implementation of Section 4; the latter envisaging effective record management including digitization and availability in electronic form, proactive disclosure of all information except those prohibited by exemption provisions of the Act and effective dissemination of information for the benefit of citizens. However, the Commission observed, in course of hearing of various appeals/complaints that although the RTI Act had been in place for five years, one of the key element of the law - Section 4 of the RTI Act was not being implemented in letter and spirit. Although there are ministries/departments and public authorities, which are relatively more transparent and open than others, most of them do not conform to the matrix of disclosure set-out in section 4 (1)(b) of the Act as well as practices relating to record management and dissemination of information held by and/or under their control. 3.2.2 The Full Bench of the Commission, vide its Order No. CIC/AT/ D/10/000111 dated 15/11/2010 under Section 19(8) (a) of the RTI Act, directed all Public Authorities to fulfill their obligations stipulated in Section 4 of the Act as per time line laid down for each activity. The Commission further directed that: (i) The information in compliance with Section 4 shall be up-loaded by every public authority on the portal set up for the purpose by the CIC. Every Public Authority shall designate one of their senior officer as TRANSPARENCY OFFICER (with necessary supporting personnel as required). The Transparency Officers shall: (a) oversee implementation of provisions of Section 4 and apprise the higher echelons of the management about the progress. (b) act as interface with the CIC regarding progress of (a). (c) help promote congenial conditions for positive and timely response to RTI-requests by CPIOs, deemed CPIOs (d) act as contact point for the public in all RTI related matters. (iii) Names of Transparency Officers shall be communicated to the Commission by every public authority.

Central Information Commission During 2010-11 3.2.3 The Commission directed every ministry/department to forward above mentioned directions to all public authorities under their jurisdiction. The Full Bench decision is available at annexure3 3.2.4 The directions of the Commission were forwarded along with suggested formats for uploading information regarding compliance with provisions of Section 4 including section 4(1)(b) to every Ministry/Department of the Government of India. The Commission also forwarded guidelines/ clarifications explaining respective roles of the CPIO and the Transparency Officer, level of Transparency Officer and the charter of duties of Transparency Officer. The guidelines clarified that the institution of the Transparency Officer is essentially an administrative arrangement for promotion of institutional transparency within the public authority and proactive and effective implementation of the provisions of Section 4 of the RTI Act, 2005. These included effective record management, digitization of records, networking and incremental and periodic proactive disclosure. It was suggested that the Transparency Officer would work out in consultation with Departmental Officers parameters of the Record Management, its classification and indexing, plan of action for digitization of documents and networking of digitized data etc and oversee and help implement the activities laid down in Section 4(1) (a) & 4(1) (b) of the RTI Act among others (the guidelines/clarifications is available at annexure4). 3.2.5 In compliance with above mentioned direction of the Commission, the Central Information Commission has also designated the Additional Secretary [Joint Secretary to the Govt. of India] as its Transparency Officer and enjoined the Joint Secretary [Law] and the Deputy Secretary [PP] to assist the Transparency Officer in ensuring effective functioning of the Central Information Commission as a public authority. 3.2.6 The ministries/departments were also advised to update details regarding Transparency Officers, provide website addresses of public authorities under their control as well as web page link where disclosures under section 4 are uploaded along with date of disclosure/uploading on the Submit Annual Return link of the web site of the Commission http://cic.gov.in. 3.2.7 The Commission made a conscious effort to put in place a Central Data Base regarding the total number of public authorities within the meaning of the Section 2(h) of the RTI Act registered with the Commission, its web page link, the web page link at which the proactive disclosure information are posted by the public authorities, the last date on which the disclosure has been uploaded/updated by the public authorities and details of Transparency Officers. Such an arrangement would facilitate
stake holders to review the status of dissemination of information by every public authority as enshrined in the act through a single portal http://rtiar.nic.in. The ministries/departments are required to review and monitor continuously the complete paradigm of implementation of provisions of Section 4 including web linkage with the portal of the Commission to ensure success of this endeavour. 3.3 Annual Convention - 2010
3.3.1 The 5th Annual Convention of the Central Information Commission was organized on 13th 14th September, 2010 at DRDO Bhawan, New Delhi. The theme of the convention was RTI: Challenges and Opportunities.

3.3.2 Dr. M. Veerappa Moily, Union Minister for Law & Justice, Govt. of India inaugurated the convention on 13th September, 2010 and Shri Sachin Pilot, Union Minister of State for Communications & Information Technology, addressed the Valedictory session on 14th September, 2010. The Key Note address was delivered by Shri Gopalkrishna Gandhi exGovernor West Bengal. Citizen charter with firm time lines for efficient delivery of goods and services and mechanism for grievance redressal and routinization of processes. All Public Private Partnership projects should be brought under the ambit of RTI Act at the signing stage itself by incorporating disclosure norms and scope. Media, NGOs and Civil Society Organisations must work together using RTI Act to raise vital governance issues and carry them to logical conclusion. Aadhar project of UIDAI should be integrated with the National RTI database to ensure interoperability among the Public Authorities in respect of disposal of RTI applications on similar issues. Transparency and Accountability is equally important in appointments to higher judiciary and its functioning with due consideration to its independence. The political leadership must continue to lead from the front and set examples to ensure that the Act meets its objective mentioned in the preamble.

3.4
3.4.1 E-Governance and increasing use of information communication technology (ICT) for efficient use of resources as well as improved delivery system has continued to be the most significant and important aspect of governance since mid-eighties. It has received tremendous boost with institution of Web Ratna Awards by the Government of India to acknowledge, appreciate and reward exemplary initiatives and innovations using the medium of World Wide Web.
3.4.2 The CIC Online initiative of Central Information Commission was awarded Platinum Icon in the Public Participation Initiative category (Annexure-5) by Honble Union Minister of Communications & Information Technology in the award presentation ceremony held on 19th April 2010 at Vigyan Bhawan, New Delhi. The CIC Online has been implemented to facilitate online filing of appeal and complaints before the Commission using simple & user friendly online forms designed in consonance with provisions of RTI Act. These forms have been fully integrated with the backend system in use at the Commission for online processing of cases. The efficacy of the backend processing system has been further enhanced through provision of twelve stage workflow arrangement with appropriate role based access. CIC Online system along with its integration with backend processing system is operational since December 2008; and large number of citizens are deriving benefit through this mode of participation. The system also facilitates proper monitoring of the entire range of activities relating to a case from its filing till disposal. CIC Online provides ample opportunity to citizens for voicing their concerns in case of delays and/or inaction in consideration of their appeals/complaints. The CIC Online filing of RTI Complaint and Appeal with the CIC has institutionalized the convergence of ICT with the Right to Information Act. The RTI Act, 2005 provides for establishment of a practical regime of information

Central Information Commission During 2010-11 so that citizens can secure access to information under the control of Public Authorities (PA) so as to promote transparency and accountability in the matters concerning with and working of the Public Authorities e.g. the Central Information Commission and the State Information Commissions. [http://www.webratna.india.gov.in] 3.5 Status of disposal of appeals/complaints
3.5.1 During the reporting year, the CIC registered 28875 appeal and complaints and disposed 24071 appeal and complaints. The Commission has successfully endeavored to dispose appeals/complaints filed before it expeditiously. The average annual disposal by individual ICs/ CIC during 2010-11 was 2675 as compared to 2165 during 200910. Although the average annual disposal by individual ICs/CIC has increased during 2010-11; the percentage of disposal has gone down slightly in comparison to the same during last year. The absolute number of appeals/complaints disposed by the Commission during the reporting year has also been considerably higher,; however, the percentage of disposal has decreased on account of twin reasons of sharp increase in the number of appeals/complaints and large number of vacancies against the post of Information Commissioners stipulated in the Act. 3.5.2These facts have been depicted in the table and graphs below:

3.5.3 The Commission in its meeting dated 26 10 2010 decided to launch a special drive to dispose of cases pending for more than three months. It also decided that apart from regular cases, the CIC/ICs will also be required to dispose pending cases. Accordingly follow up action was immediately taken and all cases pending for more than three months till 26 10 2010 stand disposed off.

The graph above indicates that the rate of relative change in number of appeal/complaints, filed before the commission and registered, shows a decreasing trend except for the year 2009-10; when there is slight increase. The relative change at which the RTI applications are being filed with the public authorities under the control of central government and its instrumentalities is however quite unpredictable; as evident from the figure 3.4. The absolute number of the RTI applications filed with the public authorities ordinarily should have gone up and thus the relative change would have gone up albeit may be at a slower rate in view of increased sensitivity among government functionaries about the Act and their consequent responsibility. However, facts emerging from

data submitted by public authorities regarding number of applications received during 2010-11 in the form of annual returns prompts for urgent effective action on the part of ministries/departments and competent authorities to ensure timely submission of returns for all four quarters by all public authorities under their control and an audit of number of applications received by them. In the absence of hundred per cent compliance in this regard by all public authorities registered in the data base of the Commission the correct position can not be ascertained. 3.6 Status of penalty during the year 2010-11
3.6.1 The Central Information Commission imposed penalty u/s 20 (1) of the RTI Act amounting to Rs 4666325 during the reporting year. The concerned benches of the Commission revoked the penalty order amounting to Rs 100000 in four cases, each amounting to Rs 25000; as new acceptable facts were brought before it by the affected parties. In one case the High Court of Judicature at Delhi has stayed the penalty order of the Commission amounting to Rs 25000 and in another case it modified the penalty amount to Rs 2500 from Rs 25000. Consequently, the penalty amount imposed by the Commission during the reporting year is effectively Rs 4538825. The Commission has received compliance report, by way of recovery, in respect of remaining cases for an amount of Rs 2572814.
3.7
Interns at CIC
3.7.1 Over the years increasing number of young students from various academic institutions have been approaching the Commission with a

Central Information Commission During 2010-11 view to function as intern in the Commission. It has now become a regular feature; and these interns/students are exposed to the basic nuances of the RTI Act and its implementation. During 2010-11 CIC had 11 interns from various Universities/Educational Institutions. This year one student from the University of management Singapore also functioned as intern in the Commission. As interns they were tasked with assisting the Commission on key aspects of its functioning, especially its quasijudicial role; besides understanding the RTI Act as such and its implementation. 3.8 Visits by various stakeholders
3.8.1 During the month of April, 2010 a group of 40 members of Indian Diaspora Youth visited the Commission and interacted with the Chief Information Commissioner, Sri Wajahat Habibullah. They were briefed about the role and various activities of the Commission. In the month of January, 2011 a group of 13 senior journalists from Bhutan interacted with Sri Satyananda Mishra, the Chief Information Commissioner. The group was interested to know about various steps taken and strategies of implementation of the RTI Act in the country. In February, 2011 a group of 17 women councilors from Karnataka visited the Commission and interacted with Sri Satyananda Mishra, the Chief IC. 3.8.2 Professor Sadeka Halim, Information Commissioner of Bangladesh Information Commission visited the Commission and met Sri Satyananda Mishra, the Chief Information Commissioner. 3.9 Implementation of Section 4 by the CIC as Public Authority
3.9.1 The Section 4 enjoins all Public Authorities to , maintain all records duly catalogued and indexed to facilitate the Right to Information, computerize all records appropriate to be computerized within a reasonable time and subject to availability of resources and network to facilitate accessibility, proactively disclose all information stipulated in section 4(1)(b) within 120 days of the coming into force of the Act and update every year and disseminate through various medium like electronic and pint media, notice boards, public notices, websites etc for the benefit of citizens keeping in view cost effectiveness, local language and efficacy of means of communication. The underlying philosophy is to put as much disclosable information in public domain as possible to ensure that citizen have minimum recourse to file application under the Act to seek information 3.10 Arrangement for implementation of Section 4(1)(a) 3.10.1 In order to comply with the requirement of the Act the Commission has undertaken a project of computerization of all records. In this

project, records are digitized, catalogued and indexed in such a manner as to facilitate access to these information all over the country through a network. 3.10.2 The project of digitization of documents/records pertaining to the cases of Appeals/Compliant commencing from December, 2009 has continued in the present year too. Around 24000 files containing about 12 lakh pages have been scanned, digitized/indexed and uploaded on the server till 2010-11 to make them available online in the intranet of CIC. These digital records are available all the time by various registries of the commission for their retrieval and reference. 3.10.3 Although the project of digitization was initially planned with limited objective; it was felt that with the aid of technical tool like webbased Digitized Record Management (DMS) System, Physical Record Management (PRM) System and some other software and hardware support, the project of digitization can be used to achieve wider objectives e.g. on line processing of appeals / complaints leading ultimately to paperless office. Accordingly, the commission has started scanning/digitization of day to day dak received in the Commission. These digitized dak can be uploaded directly on the intranet of the commission with a view to process them on line. To start with two pilot models have already been started and with suitable need based modifications in the hardware/software provided by NIC this model is likely to be implemented in all registries of the Commission to achieve the ultimate goal of paperless processing of appeals/complaints in the Commission. 3.11 Arrangement for Section 4(1)(b) The Central Information Commission has defined the responsibility of officials for mandatory review of various classes of information and their periodicity. All concerned officials are accordingly required to review after expiry of every six months the information pertaining to their area of responsibility and send revised/modified inputs to the nodal officer for compilation and uploading on the web site of the Commission. The guidelines in this regard are available on http:// cic.gov.in. The Commission has also constituted a core committee of officers for modifying FAQs for the website of the Commission. The proactive disclosure in respect of the Central Information Commission is available at http://cic.gov.in/Sec-4-Index.htm. In addition to information concerning section 4(1)(b)(i) to (xvi) other information relating to the main business of the commission is also uploaded and updated on the Commissions website periodically.

Central Information Commission During 2010-11 3.12 Activities relating to Administration and Establishment 3.12.1 Formulation of Staffing Norms The Commission from its very inception has been in dialogue with the Government for provision of adequate staff to discharge its quasi-judicial functions. In this area of abiding concern there has been a lot of inhouse thinking and constant interaction with Department of Personnel & Training. A study of the staffing patterns in other organizations viz. National Human Right Commission, Central Administrative Trbunal, High Courts discharging judicial and quasi-judicial functions, was also undertaken. During the year under consideration, the Staff Inspection Unit of the Department of Expenditure (Ministry of Finance) studied the work load of the Commission and made significant recommendations regarding requirement of personnel at various levels. The same was examined further and the Staffing Norm for the Commission has been approved finally and the Government has sanctioned additional posts raising the sanctioned strength of the Commission to 160 from the existing 116. The Commission has also submitted draft recruitment rules for various categories of personnels as required under the new staffing norm; and they are under consideration of the government for approval in consultation with UPSC. 3.12.2 Development of Post Retirement Cell The Commission has also put in place a system for finalization and disbursement of Post Retrial benefits of Information Commissioners and Chief Information Commissioner. This initiative of processing of Retirement benefit matters and formalizing Terms & Conditions of Service of Information Commissioners is a guiding reference for other Information Commissions across the country. 3.12.3 Management and Streamlining of Dak Efficient dak management is at the core of all quasi judicial activities initiated in the Commission. Continuous efforts were made for improving the efficiency of dak management through inputs viz. man power, infrastructure, and intellectual inputs in the form of appropriate software. In the year 2010-11 the Commission utilized the services of NIC to develop an improved system for dak receipt, management and monitoring and moved a step closer to paperless office initiating the process of Digitization of Dak. As a matter of fact, one of the Benches of the Commission has become became paperless with its entire Dak being managed on computers starting from registration of an appeal or complaint to its final disposal without opening any paper file.
3.12.4 Plan Scheme of CIC The Commission has taken initiative for generation of awareness among masses about the Act by developing appropriate audiovisual software and their telecast/broadcast on Doordarshan and All India Radio. In continuation of this effort, the Commission decided that on the occasion of the completion of Fifth Year of coming into force of the Act, the very concept of Right to Information as an empowering legislation should be widely publicized. Accordingly, a comprehensive publicity campaign was launched at the time of 5th Annual Convention in print and visual Media (Television), by inserting advertisements in national and regional dailies and telecast of thematic video spots. The campaign was conducted across the country in various national and regional television channels from the 10th to the 15th of September 2010. In the later part of the year an extensive audio-video campaign was also launched to spread the message of Right to Information across the country. The Audio-Video Spots were aired in regional languages as well, apart from Hindi, to reach out to people of the country speaking different languages and make them aware about the benefits of Right to Information. The Information Commissioners and Chief information Commissioner and other functionaries of the Commission participated in various training programs, workshops, seminars organized for government officials including CPIOs and other stakeholders to explain the nuances of the Act as well as to apprise them about latest decisions of the Commission and superior courts of law in this regard as a part of awareness generation endeavor. 3.12.5 Record Retention Schedule During the year 2010-11 Record Retention Schedule of quasi-judicial records was also finalized. There records are to be retained for a period of six months from the date of the final disposal of the case with the proviso that no such records shall be destroyed until any proceedings arising out of the final orders is pending either in the Commission or in any other competent superior court of law. The administrative and financial records shall be retained as per Record Retention Schedule common to all departments read along with Central Secretariat Manual of Office Procedure.

D.O.No.CIC/AT/D/10/000111 Subject : Implementation of Section of the RTI Act 2005 Reference Commissions directive dated 15.11.2010 under Section 19(8)(a) to the public authorities for time-bound implementation of Section 4 obligations under the RTI Act. 2. I invite your kind attention to the directive of the Commission for time-bound implementation of the provisions of Section 4 of the RTI Act, issued under the powers vested in it under Section 19(8)(a) of the RTI Act. Section 19(8)(a) of the Act states the following:19(8) In its decision, the Central Information Commission or State Information Commission, as the case may be, has the power to (a) require the public authority to take any such steps as may be necessary to secure compliance with the provisions of this Act, including by providing access to information, if so requested, in a particular form; by appointing a Central Public Information Officer or State Public Information Officer, as the case may be; Dated : 18.11.2010

(iii) by publishing certain information or categories of information; (iv) by making necessary changes to its practices in relation to the maintenance, management and destruction of records; (v) by enhancing the provision of training on the right to information for its officials;
(vi) by providing it with an annual report in compliance with clause (b) of subsection (1) of section 4; 3. The directive emphasizes that compliance with the Section 4 obligations by public authorities is at the heart of the RTI Act. It enjoined public authorities to accept transparency commitments by undertaking time-bound suo-motu disclosures. 4. Underlining that, transparency commitments and suo-motu disclosures would remain nothing more than vague promises, unless these are matched by tangible action through proper record-management-practices, and time-bound disclosure of several items of identifiable information under supervision and guidance of a senior officer of the public authority, this directive gives the following instructions:(i) Public authorities to carry out time-bound action to complete parts of their Section 4 obligation within 120 days.
(ii) The balance obligations, which involve sifting of records and making a conscious determination about what information can be brought into the public domain suo-

motu, is to be completed within six months. This is part of the record-management aspect of Section 4 of the Act. (iii) It commends designation by the public authority of a sufficiently senior officer as Transparency Officer, to oversee the implementation of the Section 4 obligations. These officers are also required to be the interface with the Central Information Commission on the one hand and the public on the other, about transparency aspects of the functioning of the public authority. 5. As per the provisions of the RTI Act, a large part of the Section 4 commitment by the public authorities was to be completed within 120 days of the Act coming into force, i.e. 15th June, 2005. Certain public authorities have made some serious effort in this direction, but the overall action in implementing this provision has been slow and halting. This has necessitated the present directive. 6. It is important to note that Section 4 obligates the public authorities to use the latest technologies to discharge their transparency commitments under that Section, subject to availability of resources. 7. Commission feels that it has now become necessary that the top echelons of the public authorities are sensitized about seriously addressing the several aspects of discharging their Section 4 commitments, including progressive digitization of data and use of other available technologies, to not only make transparency the hallmark of their functioning, but also to create the right conditions for the public to access the information through painless and efficient processes that shall be put in place. 8. The ultimate aim of the RTI Act is that public should have access to most information held by public authorities without the use of the RTI laws. Section 4 of the RTI Act is an initial, but necessary, prelude to achievement of that objective. Hence the importance of this Section. 9. I have been directed by the Commission to communicate to you its above mentioned directive for implementation by your Ministry / Department as well as all public authorities within your jurisdiction. It is requested that you may kindly issue appropriate directives to all top officers under your control as well as to the top officials of the public authorities controlled by the Ministry / Department to give immediate effect to the Commissions directive dated 15.11.2010. 10. It is further requested that the relevant details of the officer designated as Transparency Officer by your Ministry / Department may be intimated to the Commission in about twoweeks time. It is also requested that the public authorities within your jurisdiction may also be similarly instructed. 11. A portal is being set-up for uploading all the Section-4-compliance-related information. The idea is that an average citizen should be able to see for himself as to how public authorities have progressed in complying with the transparency obligations cast on them by Section 4 of the RTI Act. The details about the portal being developed shall be sent to you separately.

It is requested that your Ministry/Department as well as all public authorities under your jurisdiction may be instructed that the information relating to Section 4-compliance should be put-up on the portal in the format prescribed and annexed. 13. (ii) Oftentimes public authorities are unable to decide on what records and documents to be made public, or what parts of its action to be made open, mostly because of poor record-management-practices, which make it difficult to take focused decisions about what records to be made routinely available to the public.

Therefore, the first step towards promotion of transparency in the functioning of the public authority should be an improvement in the record-management practices. Section 4 lists-out the ingredients of record management in some detail. (iii) When the record management practices are fully established in the public authority, the next step is to categorize the documents in terms of what can be disclosed

voluntarily and what cannot be voluntarily disclosed. The second category could be some sort of a negative list a list of documents which a public authority is not in a position to bring into the open-category straightaway, but would examine its disclosure under RTI Act. (iv) The record-management practice, as much as possible, should be technologically driven. Technology should be used for efficient and wide dissemination of information subject to availability of resources and know-how. This is an additional requirement to the proper record-management practice commended by Section 4. (v) While Section 4 enjoins public authorities to perform certain tasks for voluntary disclosure of information within 120 days of the commencement of the Act, i.e. on 12th October, 2005, it allows them reasonable time for putting in place a good record management practice supported by technology. (vi) Section 4 also enjoins Public Authorities to update the proactive disclosures every year. 5. The time has come now when the public authorities must start a sustained drive to inform their governance practices with transparency and to take the series of small steps required to put in place a system which promotes it. Section 4 provides only a window to possible actions and, much more will need to be done in order to achieve the type of goals which are envisaged. 6. Therefore, by powers vested in the Commission by Section 19(8)(a) of the RTI Act, we direct that the obligations set out in Section 4 of the Act be discharged by the public authorities as per the time-limits set out against each activity. I. Record Management Obligation: Section 4(1) states that every public authority shall a) maintain all its records duly catalogued and indexed in a manner and the form which facilitates the right to information under this Act and ensure that all records that are appropriate to be computerised are, within a reasonable time and subject to availability of resources, computerised and connected through a network all over the country on different systems so that access to such records is facilitated; This translates into the following action points:1. 2. Catalogue records and index them for easy dissemination and disclosure. Computerize records in a phased manner subject to availability of resources.
Similar obligation is also cast on public authority by Section 4(1)(b)(vi) and Section 4(1)(b)(xiv), which enjoin publishing within one hundred and twenty days from the

enactment of this Act, (vi) a statement of the categories of documents that are held by it or under its control; (xiv) details in respect of the information, available to or held by it, reduced in an electronic form; It is directed that all public authorities implement the above obligations within 6 months (except for no.2 above). II. Personnel related details and functions of public authorities: The relevant portions of Section 4 calls upon public authorities to carry out the following:b) (i) (ii) (iii) publish within one hundred and twenty days from the enactment of this Act, the particulars of its organisation, functions and duties; the powers and duties of its officers and employees; the procedure followed in the decision making process, including channels of supervision and accountability; the norms set by it for the discharge of its functions; the rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions;

(vii) the particulars of any arrangement that exists for consultation with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof; (viii) a statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public; (ix) (x) a directory of its officers and employees; the monthly remuneration received by each of its officers and employees, including the system of compensation as provided in its regulations; the budget allocated to each of its agency, indicating the particulars of all plans, proposed expenditures and reports on disbursements made; the manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes;

(xiii) particulars of recipients of concessions, permits or authorisations granted by it; (xv) the particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use;
(xvi) the names, designations and other particulars of the Public Information Officers; (xvii) such other information as may be prescribed; and thereafter update these publications every year; 7. Public authorities were to have implemented these obligations within 120 days of the coming into force of the RTI Act on 15th June, 2005. In our experience, the action in this regard has been rather tardy. It is time that these directives of the law are fully implemented in a systematic manner through time-bound action. Commission, therefore, directs that these actions as ordained above shall be completed by all public authorities within a period of 120 days from the date of this order. 8. Commission further directs that, (i) The information in compliance with Section 4 obligation by public authorities shall be uploaded on a portal to be set up exclusively for this purpose by the CIC. Within 30 days of this order, each public authority shall designate one of their senior officers as TRANSPARENCY OFFICER (with all necessary supporting personnel), whose task it will be (a) (b) (c) (d)

to oversee the implementation of the Section 4 obligation by public authorities, and to apprise the top management of its progress. to be the interface for the CIC regarding the progress of (a). help promote congenial conditions for positive and timely response to RTIrequests by CPIOs, deemed-CPIOs. to be a contact point for the public in all RTI-related matters.
(iii)
Names of the Transparency Officers shall be communicated to the Commission by public authorities.
9. Commission wishes to emphasise, that as laid-down in Section 4(2) of the RTI Act, it should be the constant endeavour of every public authority to take steps in accordance with the requirements of clause (b) of sub-section (1) to provide as much information suo-motu to the public at regular intervals through various means of communications, including internet, so that the public have minimum resort to the use of this Act to obtain information.

10. Unless the key requirements of Section 4 are fully met by the public authorities suomotu, the objectives of this Act as enshrined in its Preamble and Section 4 itself cannot be realized. Hence this directive. 11. Each Ministry or Department shall forward the directives to Public Authorities under their jurisdiction exercisable under Section 25(2) of RTI Act, 2005.

Reference: D.O.No.CIC/AT/D/10/000111 dated 15.11.2010 Apropos the subject and reference cited, certain public authorities have requested clarification regarding the roles of the Transparency Officer (T.O.) vis--vis the CPIO, and the level of the Transparency Officer. 2. It is clarified that the institution of Transparency Officer is in fact an administrative arrangement for promotion of institutional transparency within the public authority through proactive and effective implementation of the provisions of Section 4 of the RTI Act, 2005. These include effective record management, digitization of records, networking and incremental proactive disclosures. 3. The CPIO and the Appellate Authority, on the other hand, are parts of the RTI-regime and, in that sense, are statutory officers under the RTI Act. Their functions shall be as defined in Sections 7 and 19(1) of the Act respectively. 4. Within the public authority, a CPIO will be free to seek guidance from the Transparency Officer about disclosure-norms both in its general and specific aspects. 5. The level of Transparency Officer, in any public authority, may vary depending on the availability of personnel of a requisite level. However, to be effective, a Transparency Officer should be of sufficiently high seniority in the organization, having uninterrupted and free access to the head of the public authority. He should also be able to effectively communicate and liaise with Divisional Heads of the public authority. It is, therefore, desirable that T.O. is either No.2 or No.3 behind the head of the organization, in the official hierarchy. 6. Job Chart of Transparency Officer
Transparency Officer (TO) shall be the main centre of all actions connected with promotion of institutional transparency commensurate with the letter and spirit of the RTI Act. In performing this role, the TO shall:

Act as the interface for the Commission vis--vis the public authority on the one hand, and on the other vis--vis the public authority and the general public/information seeker. Engage continuously, in implementing the Commissions directive dated 15.11.2010 regarding pro-active disclosures under section -4 of RTI Act, vis--vis the public authority concerned. Regularly monitor decisions of the Central Information Commission (http://cic.gov.in) with a view to identify areas of openness both generic and specific as a result of such decisions.

Ensure that all levels of employees of the public authority are sensitized about these decisions and their implications. Be responsible for issuing advisories, to officers/staff about need for sensitivity to institutional transparency and act as a change agent. Be responsible for sensitizing the officers/staff that the time limit stipulated in the RTI Act are outer limit for matters raised under RTI Act and officers/staff are required to be mentally tuned to disclose all informations, predetermined as open, within the shortest possible time on receiving request. iv. Be the contact point for the CPIO/FAA/Divisional Heads in respect of all RTI related matters of the Organisation. He will be the clearing house in all matters about making transparency the central point of organizational behaviour. Constantly remain in touch with the top management in the public authority about the strategy and the action to promote transparency within the organisation. Promote good management practices with the organisation centered on transparency. vi. Devise transparency indices for various wings of the public authority in order to introduce healthy competition in promoting transparency. Help set up facilitation centres within the premises of the public authority, where members of the public can file their requests for disclosure of specific information and can inspect the records and documents etc. Work out, in consultation with the departmental officers, the parameters of record management- its classification and indexing, plan of action for digitization of documents and records, networking etc and oversee and help implement the functions laid down in section 4 (1) (a) and 4 (1) (b) of the RTI Act. Prepare information matrix based on analysis of RTI applications filed before the public authority and response thereof and, suggest to the top management the need for

process reengineering, wherever necessary, as well as work out modalities of suo motu disclosure of such information. x. Be responsible for creating condition(s) in the organisation to establish an information regime, where transparency/disclosure norms are so robust that the public is required to have only the minimum resort to the use RTI Act to access information. Be responsible for operating a user-friendly website for various information relating to the public authority concerned, including inter alia search option. With the help of the appropriate wing of the public authority, set-up arrangements for training of the personnel to promote among them higher transparency orientation away from intuitive reflex towards secrecy, now common. Establish dialogue with the top management and key officials of the public authority regarding prevention of unnecessary confidentiality classification of documents and records under the Official Secrets Act and to check over classification.

CIC/AT/ D/10/000111 dated 18.11.2010; wherein a reference has been made regarding a portal for uploading of facts relating to compliance of section 4 of the RTI Act and related informations. 2. The Ministries/Departments/Public Authorities are hereby advised to visit the website of Central Information Commission at www.cic.gov.in. and open the submit Annual Return link available on it. The interface which opens, is the Log In interface; and the concerned Ministries/ Departments/Public Authorities have to provide the same password, already being utilised by them for submitting online Annual Return to the Commission. 3. The Public Authorities will now see the main menu page of the portal; which has three sections; namely Annual Return 2010-11, Master Updation and RTI Manuals/Disclosure. The Public Authorities are required to update the details regarding Transparency Officer in the Master Updation category. They are now required to provide the website address of the Public Authority including the web page link, where the disclosure under Section 4 of the RTI Act has been uploaded in the RTI manuals/Disclosure category. They are also required to indicate the last date of uploading/updating the disclosure on the website. The print screens in this respect are also enclosed for ready reference. 4.
