2012 Espanola Valley Art Festival (EVAF) Artist Booth Contract Contract Stipulations

Please read all terms and conditions prior to agreeing to this contract. Agreement to this contract constitutes agreement of the Artist to comply with all terms and conditions. Registering Artists will receive their name tag and other pertinent information, and must register prior to the booth setup.

Policies
Exhibited work must be original and be the work of only the artist(s) assigned to the booth Use of commercial kits or molds is prohibited. All Artists agree to all EVAF policies. Artists must define Reproduction or Limited Edition and disclose this information on the individual piece. By Contract submission all Artist agree to be present during the Festival hours of 9:00 am to 5:00 pm. Cash awards will be distributed after 5:00 PM on Sunday. Cash awards will not be distributed to Artists that have dismantled their booths to that time. All work must be safe, non-toxic and fit for the intended use. No part of the display may be larger than the booth space.

Booth Space & Fees FEES: $65.00 PER SINGLE OR $85.00 BOOTH SHARE (2 ARTISTS)
Booth spaces will be marked. A space may exist between booths. Artists are required to remain within the confines of their assigned space. What may seem to be expansion space is reserved for public and handicap access walk ways or emergency access. Booth locations may not be altered.

Display Materials & Equipment


Artists must provide their own display materials and equipment. Electrical connections are not available and generators are not allowed.

Loading & Unloading


Vehicles must be moved 30 minutes prior to the start of the art fair (by 8:30 am). Promptly move your vehicles to the designated parking area after your booth and display are set up. Vehicles may be pulled up for loading while your display is being dismantled, but not before 5:00 pm.

Booth Operation
The booth must be set up and ready for business by 9:00 am and may not be dismantled before 5:00 pm. The booth must be attended at all times by at least one adult.

Display by dealers or agents is prohibited. The EVAF has the right to refuse any Artist. Failure to comply with EVAF policies may make the Artist ineligible for future events. The EVAF and or city of Espanola has the right to ask any Artist not in compliance with policies and regulations and uncooperative artist to leave before the events end without refund or related expenses.

Artist Parking
Artists parking will be available at the Bond House parking lot (a map will be provided). Parking in the lot adjacent to the Festival is limited to loading and unloading. Parking in that area during the Festival is not allowed and vehicle4s will be towed from that area during the Festival hours of operation. You will be issued a parking pass when you register. Please be respectful of your neighbors and drive slowly. Parking in paved lots surrounding the facility will be limited to one hour parking during the Festival hours of operation. Parking will be monitored during hours of operation and vehicles exceeding the time limits will be towed.

Finalization of Space Reservation


Assignment of booth space is final and EVAF reserves the right to offer or refuse space rental to potential Artists. Booth assignments will be subject to availability, date of contract signature page receipt and media balance in the vicinity.

Cancellations
The EVAF reserves the right to cancel the Festival if it determines in its sole discretion that the volume and/or quality of artwork received prohibit staging of a successful event. If this is the case, all application fees will be returned to the Artist. Cancellation by on Artist will result in forfeiture of application fees. Be prepared for all types of weather the Festival will be open rain or shine!

Liability
Artist(s) assume entire responsibility and agree to protect, indemnify, defend and save the EVAF, the City of Espanola and its officers, members, employees, volunteers and agents against all claims, loss or damage to persons or property arising out of or caused by the Artists installations, removal, maintenance, occupancy or use of the Plaza de Espanola premises. The EVAF, and the city of Espanola, its agents or assigns will assume no responsibility for loss, damage, personal injury or other claims related to the Festival.

Artist Registration
Artist should plan to register at the Plaza de Espanola on Saturday September 29, 2012 between 7:30 and 8:00 am.

Special Effects & Presentation


Operational equipment, audio-visual, and sound/attention-getting devices must not interfere with the activities of the event and other Artists. The EVAF reserves the right to determine at what point sound constitutes interference and if it must be discontinued.

Artist: this person will act as the primary contact with EVAF By signing the contract, Artist agrees to the following: Insurance:
Artist agree that the city of Espanola. The EVAF and their respective officers, employees, agents and consultants are not liable for any injury, theft, or damage to either the buyer or seller, or their property, arising out of or pertaining to preparation for or participation in the 2012 EVAF; whether such injury, theft or damage occurred prior, during, or after the 2012 EVAF. Artists further agrees to indemnity, defend and hold harmless the city of Espanola, EVAF and their respective officers, employees, agents and consultants for and against any claims for such injury, theft, or damage. Artist understands that it is recommended that Artists carry their own general liability and product liability insurance, as the city of Espanola does not provide this coverage. Agreements: Artist has read and agrees to abide by all 2012 EVAF guidelines. Artist agrees to comply with all applicable local, state and federal taxes. Signature & Acceptance By signing this contract, Artist agrees to abide by the guidelines as well as such additional rules and regulations as the city of Espanola and EVAF deems necessary for the success of the Festival, provided these latter do not materially alter the Artists contractual rights. This contract will become binding once Artist returns the signed Contract. Booth Conduct
The character of the Booth is subject to the approval of the EVAF. The EVAF retains the right to refuse Artist meeting standards required or expected, as well as the right to curtail Booths or parts of Booths which reflect unfavorably upon the character of the event.

Termination of Artists Rights


In the event the Artist or their representatives, agents, or employees fails to comply with any of these provisions, or otherwise detracts from the general character of the event, the EVAF is permitted and empowered to terminate the Artists rights, and evict and remove the Artist or their representatives, agents, or employees from the premises, in which event the Artist is not entitled to any refund of amounts paid.

Prohibited Practices
The following are prohibited: Canvassing/distributing advertising materials outside of the Artist own booth. Entry into another Artists booth, examination, or photographing of another Artists booth without permission.

Pets are allowed, but must be on a leash no more than 6long, (you must pick up after your pet).

Release
Artist release and discharges the EVAF, the city of Espanola and their directors, officers, employees, agents, assigns, members and volunteers from any responsibility personal liability, claims, loss or damage arising out of or in conjunction with participation in the Festival. By signing the Contract Signature page, Artist acknowledges having received and read the 2012 EVAF Contract and agrees to abide by the Contact. EVAF reserves the right in its sole discretion, to advise Artist of any work that does not meet the standards set forth and Artists agree that such work will be immediately removed upon request of the EVAF. Failure to remove such work to abide by other rules set forth may result in Artists removal from the Festival and/or being prohibited from future participation.
