EXPLANATORY NOTE
People Empowerment and Public-Private Partnership form part of the development thrusts of the Province of Davao del Norte for 2010-2013 under the able leadership of Governor Rodolfo P. Del Rosario. Purok Leaders of the province as peacekeepers is consistent with people empowerment. Public-Private Partnership is maximized when the peace and order condition of the province is stable. In 2002, Tagum City pioneered the establishment of peacekeepers organization under City Ordinance Nos. 21 and 50. In the exercise of its review powers, this Sangguniang Panlalawigan has confirmed and approved both ordinances. Likewise, the Province of Compostela Valley has its own provincial peacekeepers for several years now. The purok leaders of the province shall compose the Provincial Peacekeepers Organization (PPO) of Davao del Norte. District 1 is composed of more or less 1,404 purok leaders and District 2 is composed of more or less 1,250 Purok Leaders (Total of 2,654 Purok Leaders). The legality, validity, importance, and necessity of peacekeepers justify the creation of a province-wide peacekeepers organization in Davao del Norte. Hence, this ordinance.

INSTITUTIONALIZING THE CREATION OF PROVINCIAL PEACEKEEPERS ORGANIZATION SUBJECT TO AVAILABILITY OF FUNDS.
BE IT ENACTED, by the Sangguniang Panlalawigan of Davao de Norte in a session assembled that:

SECTION 1, TITLE OF THE ORDINANCE. This ordinance shall be known as the Provincial Peacekeepers Organization (PPO).

SECTION 2. DECLARATION OF POLICY/RATIONALE. The peace and order in every purok is vital to the maintenance of the peace and order in the barangays, municipalities, cities and the province. The purok leaders can best assist, maintain and secure the peace and order in the respective puroks. The creation of the Provincial Peacekeepers Organization composed of purok leaders of the province is in line with Section 116 of Republic Act 7160. People empowerment, public-private partnership, economic progress and development are synonymous or consistent with a stable peace and order situation of the province. SECTION 3. SCOPE OF APPLICATION. This ordinance covers the Provincial Government of Davao del Norte composed of the Cities of Tagum, Panabo, and Island Garden City of Samal, and the Municipalities of Asuncion, Kapalong, Talaingod, San Isidro, New Corella, Carmen, Sto. Tomas, Braulio E. Dujali, SECTION 4. DEFINITION OF TERMS: a) Purok is a quasi-government unit under the general supervision and control of the punong barangay. b) Purok Leader leader of a particular purok, elected or appointed. c) Provincial Local Peace and Order Council an organization established and organized by the provincial and local government in accordance with Section 116 of the Republic 7160. d) Provincial Peacekeepers Organization (PPO) an organization composed of purok leaders duly appointed by the governor to assist in the maintenance of peace and order in the province. SECTION 5. COMPOSITION AND MEMBERSHIP. The Provincial Peacekeepers Organization (PPO) shall be composed of all purok leaders of Davao del Norte duly appointed by the governor as peacekeepers. SECTION 6. FUNCTIONS, DUTIES AND RESPONSIBILITIES. Members of the Provincial Peacekeepers Organization (PPO) shall: a) Maintain the peace and order in their respective puroks; b) Assist the province in the implementation of its peace and order plans, programs and activities; c) Coordinate with their respective local peace and order councils of the barangay, municipality, city, province, Philippine National Police, and national agencies or departments concerned; d) Submit annual written report to the office of the governor. Nonsubmission is ground to withhold the grant of year-end cash subsidy; e) Perform such other duties as may be directed by the governor. SECTION 7. GENERAL SUPERVISION. The governor shall be the chairman of the Provincial Peacekeepers Organization (PPO) with general supervision, control and authority over all its members. The Provincial Peace and Order Council shall assist the governor in providing administrative support to the organization.

SECTION 8. COMMENCEMENT AS MEMBER. Every member may discharge his/her duties and functions as provided in Section 6 only after he

or she shall have been appointed by the provincial governor as peacekeeper. SECTION 9. TERM OF OFFICE. The term of office of a member of the Provincial Peacekeepers Organization (PPO) shall be coterminous to his/her election or appointment into office as purok leader unless earlier removed or suspended in accordance with Section 10. SECTION 10. SUSPENSION OR REMOVAL. The governor may suspend or remove a member of the Provincial Peacekeepers Organization (PPO) on any of the following grounds: a) b) c) d) e) f) g) h) i) j) Disloyalty to the Republic of the Philippines; Culpable violation of the Constitution; Dishonesty, oppression, and misconduct; Commission of an offense involving moral turpitude; Abuse of authority; Unauthorized absence for three consecutive months; Non-submission of annual report; Removal or suspension as purok leader; Negligence of duty; Violations analogous to the above-enumerated grounds.

SECTION 11. VACANCY. In case of removal of a member from the Provincial Peacekeepers Organization (PPO), any of the kagawads of the purok concerned, upon endorsement by the punong barangay, shall be appointed by the governor as replacement. SECTION 12. ANNUAL GENERAL MEETING. There shall be an annual general meeting of the members of the Provincial Peacekeepers Organization (PPO) within December 1 to 15 of every year to be held at the place of every local government unit concerned. Purpose of the meeting is to orient members of the plans and programs of the province concerning peace and order. The annual report of the members is to be submitted during the said meeting. SECTION 13. SPECIAL MEETING. When national of local security is endangered or in times of emergencies or calamities, as often s the need arises, the governor may call for a special meeting of all the members of the Provincial Peacekeepers Organization (PPO). SECTION 14. FUNDING SUPPORT. Budgetary requirement and amounts to be incurred in connection with the operation of the Provincial Peacekeepers Organization (PPO) shall be charged to the peace and order funds of the province and other funding resources subject to its availability. SECTION 15. GRANT OF SUBSIDY. To complement their efforts in assisting the Provincial Government of Davao del Norte in the maintenance of the peace and order, every member of the Provincial Peacekeepers Organization (PPO) shall receive P1,200 year-end cash subsidy. The same to be released during the general meeting. The same maybe upgraded or increased by the governor as the need arises and if the budget so warrants.

SECTION 16. IMPLEMENTING RULES AND REGULATIONS. Upon approval of this ordinance, the governor shall promulgate implementing rules and regulations for its effective and efficient implementation through an executive order.

SECTION 17. LIMITATIONS. This ordinance applies only to all existing puroks duly created before the enactment of this measure. SECTION 18. SEPARABILITY CLAUSE. If for whatever or any reason any part of this ordinance shall be declared illegal or invalid, all other provisions or parts not affected shall continue to be in full force and effect. SECTION 19. EFFECTIVITY CLAUSE. immediately after its approval. Unanimously carried and approved. This ordinance take effect
