1number or the same individual tax identification2number.3Amendment 621 of the Constitution of Alabama4of 1901, now appearing as Section 111.05 of the5Official Recompilation of the Constitution of6Alabama of 1901, as amended, prohibits a general7law whose purpose or effect would be to require a8new or increased expenditure of local funds from9becoming effective with regard to a local10governmental entity without enactment by a 2/3 vote11unless: it comes within one of a number of12specified exceptions; it is approved by the13affected entity; or the Legislature appropriates14funds, or provides a local source of revenue, to15the entity for the purpose.16The purpose or effect of this bill would be17to require a new or increased expenditure of local18funds within the meaning of the amendment. However,19this bill does not require approval of a local20governmental entity or enactment by a 2/3 vote to21become effective because it comes within one of the22specified exceptions contained in the amendment.23 24A BILL25TO BE ENTITLED26AN ACT27 Page 2
 
1To amend Sections 3, 5, 6, 8, 9, 13, 20, 21, 24, 27,229, and 30 of Act 2011-535, 2011 Regular Session, now3appearing as Sections 31-13-3, 31-13-5, 31-13-6, 31-13-8,431-13-9, 31-13-13, 31-13-19, 31-13-20, 31-13-23, 31-13-26,531-13-28, and 31-13-29, Code of Alabama 1975, to make6revisions to the Beason-Hammon Alabama Taxpayer and Citizen7Protection Act; to amend Section 32-6-10.1, Code of Alabama81975, relating to the issuance of driver's licenses to foreign9nationals, to provide further for the definition of a foreign10national; to amend Section 32-1-4, Code of Alabama 1975, to11provide for custodial arrest for certain motor vehicle12violations; to require the Attorney General to defend law13enforcement officers under certain conditions; to require the14Administrative Office of Courts to submit a quarterly report15to the Alabama Department of Homeland Security summarizing the16number of cases in which an unlawfully present person was17detained by law enforcement and appeared in court for any18violation of state law; to require the Department of Revenue19to conduct annual searches of its records to determine if20multiple individuals have filed tax returns under the same21Social Security number or the same individual tax22identification number; and in connection therewith would have23as its purpose or effect the requirement of a new or increased24expenditure of local funds within the meaning of Amendment 62125of the Constitution of Alabama of 1901, now appearing as26Section 111.05 of the Official Recompilation of the27Constitution of Alabama of 1901, as amended.Page 3
