BEFORE THE NOTARY PUBLIC ASANSOL AFFI DAVIT

I Anil Kumar Poddar S/o Sri Ram Lal Poddar, age 47 years old, resident at Hattala, PostBarakar, Dist- Burdwan , P.S.- Kulti, do hereby solemnly affirm and say as under:

1. That I am the Director of M/s PURE MINERALS & ENGINEERS SYNDICATE PVT. LIMITED having its registered office and Plant both at G. T. Road, Hanuman Charai, Post- Barakar, Dist- Burdwan and engaged in the business of Hard coke manufacturing. 2. That I am acquainted with all the terms and conditions of the Fuel Supply Agreement including clause no 4.4 of the agreement entered in to between the parties. 3. That I am competent /authorized to swear the affidavit on behalf of Pure Minerals & Engineers Syndicate Pvt. Limited. I hereby solemnly affirm and declare as follows:(a) That the entire quantity of coal sourced from Bharat Coking Coal Limited, Eastern Coalfields Limited and others for the month of April,2012 was consumed/utilized by the unit for the purpose for which it has been allocated. (b) That no coal has been mis-utilized in any way or used for any other purpose and /or sold, transferred/disposed of to any other person for any reason whatsoever.

In support of my above declaration I hereby submit the following statement pertaining to business transaction for the month of April, 2012. (i) (ii) Statement showing the details of end use of coal and about finished product status for the month of April, 2012 as mentioned in the enclosed format-I. Statement showing the details of finished products sold to various consumers/buyers during the month of April, 2012 as mentioned in the enclosed format-II, alongwith photocopies of challan and gatepass, issued for the above sale of finished products. That I am submitting the documents and will do so every month by 20th day of the month failing which coal supplied will be discontinued to me without any further intimation by BCCL. If any discrepancy in the documents or the information submitted therein is pointed out by any competent authority, FSA is liable for termination as per clause15.1.5 of the agreement read with clause- 4.4.

I hereby verify that what has been stated in the affidavit is true to the best of my knowledge and unit will be solely responsible for misuse of coal/ diversion of coal and BCCL, will be at liberty to take action in accordance with FSA. Any diversion or misuse if found prima facie by any authority, the coal supply can be suspended by BCCL with immediate effect and further action for termination of the FSA may be take.
