Man and Women are two insuperable parts of human society. Women have played many roles in the evolution of humanity and without her humanity cant exist. She is the fountain head which springs out the strong pillars of every society. She is the real shaper of the future of every nation. From times immemorial women was been the symbol of Patience and Endurance. To respect and honor the womenfolk is and oaught to be preference of every civilized nation .India which is having the so-called democratic setup always cry the same cries for womenfolk but every one of us is well aware about the facts behind this clamour. In the long driven struggle for freedom everyone in Kashmir from a child to an old one has suffered and is still suffering but women of Kashmir who is an ocean of sacrifices has suffered the most. History bears the testimony how women in Kashmir have always suffered at the hands of alien rulers weather it were Afghans, Sikhs, Dogras and now the Indians all have struck harsh blows at the moral character of kashmiri people in general and Muslims of Kashmir in particular .Their soldiers have seen indulged in loot .arson, abdication and molestation of women. During the period of Sikhs& Dogra rule women were first tortured and raped and their tongues were cutoff so that they could notrevel the identity of culprints.Such Kind of harsh punishments were introduced only to keep the subjects in coustant awe and terror . Than came the turn of Indian rule which is no better in any sense than the Sikhs and Dogras. The Indian soldiers which India claims have deployed here since Oct 1947, for security purpose and indulged in such activities which are most in human and against all codes of morality .After the passing of each day the most repressive and worst kind of atrocious and violent methods are being used by the Indian forces against common masses in general and woman-folk in particular . Since their illegal occupation of Kashmir, to target the honor of kashmiri women has been their main weapon to crush the voice of kashmiri people for self-determination by Killings, Torture, Abduction, and Molestation and Rape they want to test kashmiri people of every worst kind of brutal weapons. Many of us are known and so many are unknown to the fact. How many mothers daughters and sisters of Kashmir have been victims of rape and molestation since the past 20 years at the hands of men in uniform At first it were only the Indian soldiers who used to commit such offences but now the local police force have also involved in the same kind of crimes .If we have a cursory look upon the past ,it will revel many woeful tales of so many unfortunate ladies whose modesty was targeted by the men in uniform Whenever we talk about the sexual harassment of the Kashmiri women the top most case which stuck our mind , burst our heart is the double rape and murder case of Aasiya and Neelofar of shopian village hardly in the history we could find such Shopian rape and murder case refers to the abduction, gang rape and murder of two young women by Indian Armed Forces in mysterious circumstances on the intervening night of May 29 and 30, 2009 at Bongam, Shopian district On Friday29 May 2009 Aasiya Jan and her pregnant sister-in-law, Neelofar, left for their orchad at Degan, Batpora around 5 pm. When they did not turn up till 8 pm their family members called them on their mobile phone and were told by them that they were on way to home and will be reaching within 15 minutes. When they didn't tirn up they called them again, but their mobile phones were switched off. The family member were worried and they informed their neighbors about the matter. After that, Shakeel Ahmad , husband of Neelofar and brother of Aasiya, went for searching them but was disappointed. He was told by a neighbour that the duo hadleft for home just when a patrolling party was passing through the area. He then approached police. At 10 pm, police party led by Station House Officer along with family members and villagers launched large scale search operation to trace outthe duo. But couldnt find them till 3 am and returned back. Later, at 5 am, 30thMay 2009, Shakeel Ahmad again went on search with the police party and found Neelofars body in

the Rambiara Nullah around 6 am at some distance from a CRPFcamp and Aasiyas body, a km away from the body of Neelofar

When the lady doctor came outafter examining the bodies locals insisted her to tell the truth. Neelofersfather and some locals brought a copy of Holy Quran and asked the doctor to swear by it. She broke down and revealed that the two ladies have been gang raped by atleast 15-18 persons Probe Ordered While on 31 May, 2009, Chief Minister of Jammu & Kashmir, Omar Abdullah, appointed Justice (retired) Muzaffar Jan to carry out the probe and complete the inquiry in one months time. The Superintendent of Police, Dr Haseeb Mughal and The Chief Prosecuting Officer, Abdul Majid Dar will assist in the probe, headed by Justice(retired) Muzaffar Jan.[9] The report would be subsequently tabled in the state assembly to make it public.[10] The notification issued in this regard by the Home Department, said that the Commission shall:ascertain whether there had been any foul play in their death and, if so, identify the person/persons responsible Probe Report On 14th June 2009, the commission with Justice(retired) Muzaffar Jan as its head ,questioned The Head of the Forensic Medicine Department, Dr Fareeda Noor, the Headof the Legal Cell of the Forensic Medicine department, Javed Iqbal Hafiz, and Shakeel Ahmad, Mushtaq Ahmad and Suhail Ahmad. The commission accused The Legal Cell head, Javed Iqbal Hafiz for delay in sending FSL report of victims, toShopian police, which he received on 2nd June, 2009 but kept it undisclosed for five days. The commission further mentioned FSL report, which confirms rape, asUNSETTLED and INDEFINATE to proof the cause death of the victims.Dr Fareeda Noor mentioned that cause of death could have easily identified if samples from vitalorgans like heart, spleen, brain were obtained at the time of post morterm. Hence, commission might order exhumation of the victims bodies to establish justified cause of death of the duo.The Commission Of Enquiry and Special Investigating Team on 17th June,

2009,questioned 4 Special Operations Group's officials and asked a woman police officer and an expert from forensic medicine from Srinagar to assist them in further progress.

Rejection to probe The High Court Bar Association on 01 June, 2009, rejected the probe ordered by the government demanding a sitting Judge of High Court or Chief Justice to carry out the probe instead of a retired Justice, Muzaffar Jan.[27] While, senior Hurriyat leader Syed Ali Shah Geelani demanded Amnesty International to probe the incident and also urgd the High Court Bar Association to probe the matter attheir own level so that the people could know the truth.[28] However, the Advocate General of Jammu and Kashmir, Muhammad Ishaq Qadri commented that the Commission of Inquiry headed by a sitting or a retired judge does not make any difference regarding the legality of its findings, which are recommendatory in nature in both the cases.Unionist leader of the opposition in the assembly and the PDP president,Mahbooba Mufti, also rejected the governments inquiry commission into the case,and called upon the prime minister, Dr. Manmohan Singh to review the performance of the states ruling coalition personally as according to her, it had failed to extent of not registering an FIR of rape and murder in the case. FIR not filed by police On 30th May, 2009, police launched inquest case of disappearance and accidental death under section 174 CrPc. However, no FIR was registered by police regarding the rape. Omar Abdullah, the unionist Chief Minister of the state claimed that the prime fact evidence confirms neither rape nor the murder of the duo, however,the family members describing this as baseless and fabricated version of police and claimed that the bodies of the victims had injuries and brusies and one of the bodies was naked while the trousers of other were open.Besides, the testimony of the lady doctor also confirms that the victims were "gang raped" and then Murdered

Protests, arrests and curfew As soon as the news about the incident spread in the Kashmir valley spontaneous protests started. These protests were followed by the strike call by the pro freedom leaders leaders. Demands for justice, self-determination and removal of the Indian occupational forces strated. As soon as the protests started police and Indian armed forces in order to halt the protests batten charged the protesters and fired repeated teargas canisters. Hundereds of people were injured and one person died due to the injury caused by a tear gas shell. During his funeral procession police and Indian armed forces used brute forces to disperse the people who where taking the funeral to Syed Ali Geelani's house who was supposed to offer the funeral prayers of the killed man. Around 50 people were injured by the heavy shelling and firing, including women and children. Many hurriyat leaders were put under house arrest or jailed. On 9th JUNE, 2009 On the call of The Hurriyat Conference(G), huge protest by students were seen in Srinagar, Phulwama, Shopian, Handwara, Kupwara, Varmul and Sopur.In Phulwama, students marched towards the Shopian to consol victim's family but were stopped 4kms to Shopian near Sheermal village by police and CRPF with lathicharge and tear gas shelling injuring 40 including many girls and 5 police men. 19students were admitted to The District Hospital, Phulwama where 16 were discharged later but 3 remained critical and kept under observation. In Srinagar, students of Kashmir University, Government Medical college, S P college, Islamia college and many more participated in the peaceful protests.

CBI Intervention On August 12 The Jammu and Kashmir Government decided to hand over the Shopian double rape and murdercase to Central Bureau of Investigation (CBI). The decision has been taken after the Jammu and Kashmir High Court, monitoring the investigation in the case, has said that it has no objection if the case is handed over to any investigation agency.

CBI Report

The CBI is pointed out the alleged irregularities by the team of doctors and the role of some of the lawyers in Shopian in fuelling the turmoil in the apple-rich district of the state, the sources said., mysteriously during the exhumation of the two bodies from the grave by the CBI, the report claimed that one of the victim -- Asiya -- was never raped. Rather their report stuck to the point that the both were actually never raped the cause of the death was drowining.

Errors in Cbi report However CBI failed to answer some of the simple questions . How come the two persons will get drowned in the three inchs of water . Why were the clothes of the due were torn . How come there were injury marks on the bodies of the Aasiya and neelofar. How come the CBI be so sure that the duo were never raped when they conducted the postmortem after 6 months while both the first two reports conduted by the doctors of the Distt hospital pulwama and by the doctors of Govet Medical college Srinagar have confirmed rape and murder. The J&K Govt later closed the case and the world watches the biggest betrayal to the two souls who are resting in peace in their graves ever.
