Case 2: Gauri Dutts Missing Nephew


Gauri Dutt gave money to his servants for railway fare and other expenses, and sent them to different places in search of the boy. One of the servants, Lalman Shukla, the munim of Gauri Dutts firm, was sent to Hardwar. Later, after the servants had left, Gauri Dutt issued handbills offering a reward of Rs. 501 to any one who might find out the boy. He sent some handbills to Lalman Shukla also in Hardwar. Lalman traced the boy to Rishikesh and found him there. The boy was brought home. Gauri Dutt gave Lalman Rs. 20 for having found the boy.

Case 3: CDs in the Self-service Store


Tekso is a self-service superstore. A customer came across blank CDs of a reputed company being sold with the caption: 'buy one, get one free'. The customer was a music artist and used 25-30 CDs every month for storing music. This was a very good deal. He picked up all the CDs which were there on the shelf in his shopping trolley. At the cash counter, they counted it to be 396 CDs. The girl at the cash counter said he could take only five CDs. She suspected he was taking it for re-sale.

Case 4: Contract over the phone


M/s Girdhalal Purshottamdas and Co., based in Ahmedabad, had made an offer from Ahmedabad by long distance telephone to Kedia Ginning Factory and oil mills of Khamgaon to purchase cotton seed cake. Kedia Ginning Factory, on the phone itself, accepted the offer. Later, a dispute arose on performance of the contract. The case could be filed only in the court of the area where the contract was made. The question was whether the contract was made in Ahmedabad or Khamgaon.

Case 5: Dunlop Tyres


Dunlop Pneumatic Tyre Co. Ltd. had a price list for its products. It sold

tyres, with discounts, to Dew & Co. in October, 1911. A part of the
contract was that Dew & Co. would not re-sell the tyres below the scheduled price. In the even of a sale to a trade customer, Dew & Co.

would take a written undertaking that the tyres would not be further
re-sold below the scheduled price. Dew and Co. sold the tyres to Selfridge & Co. Ltd. Selfridge gave a writen undertaking that it would

not sell to the customers below the scheduled price. Further, it


undertook to pay 5 pounds for each tyre sold in breach of this contract to Dunlop Co. Ltd.. Selfridge sold some of the tyres below the scheduled price to its customers.

Case 6:
Ashish entered in a contract with Baman to buy stolen cars. Chandan, George and Yaksh get into a contract to do a bank robbery and share the loot. After a successful operation, they had a dispute among themselves in sharing the loot.

A government employee had agreed to obtain an employment for Deep in public service for a consideration of Rs.5 lakhs. After getting employment, the person refused to pay.
Vinit and Kamat had agreed to form a company to get share contribution and then misappropriate the sum.

Case 7: Mischief by one Party


Sabrawal had a car which had done 1, 50, 000 Kms. He represented to Rajesh that the car had done only 20, 000 kms. Sabrawal had repainted the car and tampered the meter. Rajesh accepted the offer to buy the new looking car for Rs. Two lakhs. He paid an advance of Rs. 40, 000. Later, he learnt from reliable sources that the car was actually old. Rajesh wants his money back. Sabralwal insists that he should pay the balance and take the car.

X resorted to physical threat and caused B to enter into a contract to deliver a truck load of goods for an appropriate price.

Original Export Certificate; and certificate of origin. The courier company had represented in its brochures and

advertisements that it delivered courier to destinations in


Europe within a week. The cover did not reach the destination. The courier company limited its liability to Rs

200 .Decide.
