ASSOCIATION Surallah, South Cotabato CONSTITUTION AND BY-LAWS We, the teachers of Surallah North District, Division of South Cotabato, Surallah, South Cotabato, in order to foster goodwill, understanding and cooperation among ourselves, and in order to establish an association that will embody our ideals, uphold this teaching profession, justice through unity, have mutually agreed to form as we hereby form, an association for which we ordain and promulgate this constitution. ARTCLE I NAME AND DOMICILE Section 1. The association shall be known as the SURALLAH NORTH DISTRICT PUBLIC SCHOOL TEACHERS ASSOCIATION. Section 2. The domicile and office of the association shall be in the Surallah Central Elementary School where the office of the District Supervisor is located. ARTICLE II MEMBERSHIP Section 1. All Public Elementary School Teachers assigned within the District of Surallah North whether PERMANENT, PSB, LSB, Contractual and retired shall be automatically members of the association. Section 2. All Contractual, Retired, Reassigned teachers outside the district are considered members of the association unless he/she withdraws his/her membership status as amended. Section 3. Every member hereof shall be required to pay a monthly contribution of 10.00 for the operational expenses of the association. Section 4. Every new member hereof shall be required to pay a membership fee of 50.00 only and 200.00 to become Trust Fund of the Association. Section 5. Any member who failed to update their mortuary obligation, the mortuary scheme shall be followed. ARTICLE III OFFICERS/DUTIES AND FUNCTIONS Section 1. The association shall have the President, Vice-President, Secretary, Treasurer, Two (2) Auditors, Press Information Officer and Two (2) Business Managers. All of whom shall be elected in the manner wherein provided, and shall hold office for a term of Two (2) years until their successors are duly elected.

Section 2. The President shall be the head of the association. He shall preside at all meetings and deliberations of the association and of the Board of Directors. He shall represent the association in public occasions of vital interest to the association, and in case of emergency of any member or such matters of urgency vital to the interest of the association. Section 3. The powers and duties of the President shall devolve upon the Vice-President in case of absence, or disability of the former or whoever is next in rank. Section 4. The Secretary shall keep the minutes of all meetings of the association and Board of directors and shall be the custodian of all papers and records of the association. Section 5. The Treasurer shall collect and issue official association receipt for all fees, dues and contributions according to its purpose. He/she shall receive all amount of payments from , take charge of all funds, properties and amounts of the association, render general financial and property reports every end of school year and as required by the board, and shall be liable for the safekeeping of such funds and properties of the association in accordance with the law. Section 6. The Auditors shall check the accounts, funds, and or properties and inspect the book of the treasurer and the association as required. They shall keep track the receipts and expenditures of the association and may approved outlays of expenses according to the best interest of the association as provided by its by-laws. Section 7. The Press Information Officer shall assist the President in his dealings with the public and shall serve as liaison between the public and the association. He/ She may write and release articles and news about the association and publicize bits of information that may enhance the interest and welfare of the association. Section 8. It is the duty of the Business Managers to manage the affairs and activities exclusive of the association; produce certain needs of the association as may be required by the board. Section 9. The number of officers and the name of their offices may be changed at the beginning of each term upon the recommendation of the board and with the approval of at least two-thirds (2/3) of all members present. ARTICLE IV Board of Directors Section 1. The association shall have a Board of Directors composed of the officers of the association and presidents of the School Teachers Association as ex-officio members and the Administrators of complete elementary schools. The district supervisor shall serve as the association adviser. Section 2. The president shall act as the Chairman of the Board. Section 3. The following shall be the duties of the board of directors. 3.1 Serve as advisory body on the activities of association 3.2 Act as policy Making Body of the Association 3.3 Act on emergency measure

ARTICLE V Meetings Section 1.In all meetings of the association and Board of Directors, the Parliamentary or Democratic procedures shall be observed as the case maybe. Section 2. Regular meeting of the BOD shall be held on the last Friday of June, Last Friday of October and First Friday of March at 1 oclock in the afternoon at the District EMIS Office. Section 3. The First Regular General Assembly shall be on the First District Meeting and Second General Assembly will be during the during the Year-end District Meeting. Section 4. In case of Emergency, the BOD shall meet at the call of the President. ARTICLE VI Elections Section 1.Elections shall be held during the First General Assembly which will coincide with the First Regular Meeting of the district as maybe called for. Section 2. Any member is qualified to run in any position except for school administrators who automatically become members of the board. All elections shall be through secret balloting. Section 3. Association officers shall act as board of election inspectors provided they dont run for any position.

ARTICLE VII Term of Office Section 1. Every elected officer shall serve for a term of two (2) years and can run in different position for the next election. Section 2. Any elected officer promoted as a school administrator shall finish his/her term unless he/she opts to resign from the position. ARTICLE VIII Teachers Welfare Section 1. There shall be a Mutual Aid System (MAS). The association will tender a necrological service with simple snacks to every member who passed away. Section 2. No other fees except those duly recognized and approved by local, provincial, and national association shall be collected or imposed without the approval of at least two third (2/3) of the members present. Section 3.The Surallah North Public School Teachers Association will sponsor a simple retirement program with snacks to every member who retires. Section 4. Any retiree who doesnt want to have a district retirement program is entitled to receive a plaque and love gift from the association.

ARTICLE IX Guiding Principles Section 1. The association shall be non-sectarian and non-political. Section 2. Projects and activities not subversive in nature and not contrary to the existing laws of the country or policies of the Department of Education maybe undertaken by the association. Section 3.Democratic principles shall guide and govern the spirit and actuation of this association at all times. ARTICLE X Impeachment Section 1. Any officer of the association who shall be found guilty of any crime, felony or misdemeanor by any court of law or found incapable of discharging his duties as evidence by lack of interest shall be removed from office by three (3/4) votes of the members of the association. In such case a special election for the purpose of filling up the vacancy shall be called by the president of the association. ARTICLE XI Quorum Section 1. A majority of the members of the association shall constitute a quorum.

ARTICLE XII Amendments Section 1. The Constitution and By-Laws shall be amended upon proposition by any member of the BOD and approved by at least three fourths (3/4) of the members. ARTICLE XIII Effectivity Section 1. The Constitution and By-Laws shall be enforced upon approval by the members of the association. ARTICLE XIV Vacancy of the Office Section 1. Major Positions will follow succession of position and this applies only for President and Vice-President. Section 2. For transient positions such as school association presidents as ex-officio, succession of position is from their respective association. Section 3. In case of vacancy of the treasurer the secretary will temporarily take over until a new treasurer is elected.

SURALLAH NORTH DISTRICT PUBLIC SCHOOL TEACHERS ASSOCIATION MUTUAL AID POLICIES

1. In case death of any direct member, every member must pay the amount of 200.00 as Mutual Aid to the beneficiaries. The Treasurer shall collect the amount and be given to the beneficiaries of the deceased member of the association one week before the burial and upon submission of the death certificate. 2. In case of death of a wife or husband of a member, the amount of 100.00 shall be collected from each member of the association. 3. In case of death of any legal parents (Father or Mother) and any legal child of a member, the amount of 50.00 will be collected from each member of the association. 4. Every single member of the association is entitled to receive a mutual aid of 100.00 for his/her parents (Father or Mother) and the amount of 50.00 for his/her brother or sister from each member regardless of status. 5. The beneficiary or beneficiaries shall submit a photo copy of Death Certificate and accomplished the voucher for record purposes. 6. Every member should pay the Mutual Aid to their school treasurer and the school treasurer remit the said mutual aid to the association Treasurer.
