Fourth: (F4) Brothers and Sisters of Adult U.S. Citizens: 65,000, plus any numbers not required by first three preferences. On the chart below, the listing of a date for any class indicates that the class is oversubscribed (see paragraph 1); C means current, i.e., numbers are available for all qualified applicants; and U means unavailable, i.e., no numbers are available. (NOTE: Numbers are available only for applicants whose priority date is earlier than the cut-off date listed above.)
Employment-Based Preference
First: Priority Workers: 28.6% of the worldwide employment-based preference level, plus any numbers not required for fourth and fifth preferences. Second: Members of the Professions Holding Advanced Degrees or Persons of Exceptional Ability: 28.6% of the worldwide employmentbased preference level, plus any numbers not required by first preference. Third: Skilled Workers, Professionals, and Other Workers: 28.6% of the worldwide level, plus any numbers not required by first and second preferences, not
more than 10,000 of which to *Other Workers. Fourth: Certain Special Immigrants: 7.1% of the worldwide level. Fifth: Employment Creation: 7.1% of the worldwide level, not less than 3,000 of which reserved for investors in a targeted rural or high-unemployment area, and 3,000 set aside for investors in regional centers by Sec. 610 of Pub. L. 102-395. On the chart below, the listing of a date for any class indicates that the class is oversubscribed (see paragraph 1); C means current, i.e.,
Section 203(c) of the INA provides up to 55,000 immigrant visas each fiscal year to permit additional immigration opportunities for persons from countries with low admissions during the previous five years. The NACARA stipulates that beginning with DV-99, and for as long as necessary, up to 5,000 of the 55,000 annually-allocated diversity visas will be made available for use under the NACARA program. This resulted in reduction of the DV-2012 annual limit to 50,000. DV visas are
divided among six geographic regions. No one country can receive more than seven percent of the available diversity visas in any one year. For January, immigrant numbers in the DV category are available to qualified DV-2012 applicants chargeable to all regions/eligible countries as follows. When an allocation cut-off number is shown, visas are available only for applicants with DV regional lottery rank numbers BELOW the

The Department of State has a recorded message with visa availability information which can be heard at: (202) 663-1541. This recording is updated on or about the tenth of each month with information on cut-off dates for the following month.
*Employment Third Preference Other Workers Category: Section 203(e) of the Nicaraguan and Central American Relief Act (NACARA) passed by Congress in November 1997, as amended by Section 1(e) of Pub. L. 105-139, provides that once the Employment Third Preference Other Worker (EW) cut-off date has reached the priority date of the latest EW petition approved prior to November 19, 1997, the 10,000 EW numbers available for a fiscal year are to be reduced by up to 5,000 annually beginning in the following fiscal year. This reduction is to be made for as long as necessary to offset adjustments under the NACARA program. Since the EW cut-off date reached November 19, 1997 during Fiscal Year 2001, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002.

This was a case that could be described as sweet and sour. It started from a marriage ceremony in New York to an exquisite honeymoon in Aruba and ended up in near denial of permanent resident status before the U.S. Citizenship & Immigration Services until Attorney Famuyide was brought to the rescue. For many years, Attorney Famuyide has written numerous articles regarding traveling out of the United States with advanced parole by immigrants who have overstayed the period allowed on their I-94 card when they initially entered the United States. To date, many immigrants are still falling victims of the trap of advance parole. Advanced parole is a travel document provided by the USCIS to anyone who has a pending adjustment of status application as permission to travel abroad and return to continue to application for green card. The issuance of this document, according to the USCIS is not a guarantee that such an

Attorney Famuyide advised the couple that they could apply for waiver of the unlawful presence and if successful the 10years penalty could be waived by the U.S. Citizenship
& Immigration Services. All these started sometimes around the middle of 2011. Attorney Famuyide filed the application for waiver and put together a 200 page brief in support of the case. Three months later, the immigrant received his green card in the mail. Another mission accomplished, but at a huge cost. Most immigrants are very careless. They never bother to read anything in print. In the middle of the advanced parole approval, the U.S. Citizenship & Immigration Service put a warning there, but immigrants wont read it. The USCIS warned that any immigrant who has overstayed their entry by one year, if he or she voluntarily
travels abroad will be barred for 10years. If the overstay is for 6months, the person will be barred for 3years. If the couple read that portion of the approval, they would have been warned. It is very truly that the U.S. Citizenship & Immigration Services gives advanced parole without hesitation to immigrants with pending adjustment of status application to travel abroad. It is also true that in most jurisdictions, particularly New York District, the advance parole issued by the USCIS contain warning about Section 212(a)(9)(B)(i and ii) of the Immigration & Nationality Act which could render such an immigrant inadmissible either at the port of entry or at adjustment of status interview. If you have overstayed
your visa and have traveled on advanced parole subsequently, you might need waiver to pass your adjustment of status interview. It is not easy to obtain waiver. It is not just by completing the form. You will need to prove that your U.S. citizen spouse will suffer extreme hardship if you are deported. WASHINGTON U.S. Citizenship and Immigration Services (USCIS), marking a significant milestone in its efforts to provide relief to victims of crimes, has for the second straight year approved 10,000 petitions for U nonimmigrant status, also referred to as the U-visa. That said, a teacher can share that the behaviors exhibited by the child are consistent with ADHD and a doctor referral should occur. Diagnosing many illnesses and disorders can be difficult because many disorders mimic each other. Often it is a process of elimination.

The goal of the process is to decongest the courts and put a human face on the implementation of immigration laws particularly as it affects immigrants who might be qualified for the Dream Act. Some immigrants who might qualify under the Dream Act when
passed will benefit tremendously from this change in enforcement tactics. Some of these young people are already showing up in Court. If the government suspends their prosecution, they will have the opportunity to remain in the United States for the passage of the Dream Act. These are what will be done when ICE favorably exercises prosecutorial discretion, it essentially will decide not to assert the full scope of the enforcement authority available to the agency in a given case. In the civil immigration enforcement context, the term prosecutorial discretion applies to a
broad range of discretionary enforcement decisions, including but not limited to the following: deciding to issue or cancel a notice of detainer; deciding to issue, reissue, serve, file, or cancel a Notice to Appear (NTA); focusing enforcement resources on particular administrative violations or conduct; deciding whom to stop, question, or arrest for an administrative violation; deciding whom to detain or to release on bond, supervision, personal recognizance, or other condition; seeking expedited removal or other forms of removal by means

Mr. Doe is a wellpaid, hardworking, upand-about man in his forties. He has been healthy for as long as he can remember except for body aches once in a while which he attributes to hard work. He has a good health insurance plan but does not see the need to see a doctor because he feels fine. He developed some pain in one of his joints for some months but was unable to take time off his busy schedule. He stumbled on one of our articles in the US Immigration Newspaper and decided to check out the painful joint which had begun affecting the way he walked. He passionately requested, Doctor please write an appeal to men; many are like me who think there is no need to check out our bodies and by the time we do, a lot of damage has already been done. It will always be cheaper to test when there is no apparent problem than to treat an escalated health issue. Basic blood test that should be done should include a meta-
bolic profile (checks the major electrolytes, the kidney, liver); complete blood count (checks level of red and white blood cells); Lipids (cholesterol good and bad and fat); and urine as necessary. It is also good to get a baseline electrocardiogram when you are above forty. Other screening tests that are age-dependent will be offered to you. Take Home Message Good health is vital to enjoying all that you have worked for. Do
not let assumptions based solely on feelings deprive you of long life. It is not worth dying cheap in a nation where you could easily be checked and treated. After the greetings, Helen told them, This is my niece. I was just getting ready to come when she arrived. Im dropping her in her house when I leave here. Tammy entertained the visitors and they all talked together. Soon, Helen and the girl got up to leave. I thought you were coming to spend some time with us. Tammy said to Helen when she was seeing her off. That was the plan but I need to take my niece back home on time. Her mother doesnt like her to stay out late. Okay. We will be expecting you some other time. Tammy said. On Saturday, Richard and Tammy left the house in the afternoon. They visited Helens mother in the hospital and gave her some fruits and toiletries. From there, they went to the church for the couples programme. The senior pastors wife stood up and talked briefly. Her words were directed more
particularly at the women, encouraging them to be more responsive to their husbands, and try to meet their husbands needs especially in the area of sex. She and her husband were dressed casually. When she was through, she asked for comments. Four hands went up immediately. She signalled at Mrs. John. The slender woman looked at her husband and smiled as she got up. Mr. John pulled her hand to stop her. Richard saw it and said, Let her talk, Mr. John. Mr. John laughed. Smiling, Mrs. John started, Meeting my husbands sexual need is not the problem. The problem is that my husband is too singleminded! All the people laughed including Mr. John.
A tall man raised his hand and said, Can you please explain what you mean? The tall mans wife nudged him in the rib and said, She means that her husband is like you. Mrs. John continued, still smiling. My husband doesnt remember anything again when he has the urge. Is that my fault? Mr. John said in the background. I can meet his needs but first things first. I have to take care of the children, cook and clean the house but, she raised her hands up in surrender, he doesnt want to hear any such things until hes had his way. Laughing, her husband answered, You cant blame me. God said it is not good for the man to be alone. Everybody laughed.
Another woman spoke from the back. And the same God said there is a time for everything, a time to embrace and a time when you dont embrace. Everybody laughed loudly again including Tammy and Richard. Mrs. John went on. My husband doesnt seem to have that Scripture in his Bible. They all laughed. Richard found the discussions very interesting. The woman sat down and a pregnant woman got up. What do you want to say? Her husband asked, laughinh as he shoved his thick rimmed glasses up the bridge of his nose. The pregnant woman went ahead, anyway. A man from the left side said, But I dont understand what these women are talking about! Are you complaining because your husbands want you or what? Would you prefer they go out and leave you alone? The husband of the pregnant woman laughed. Dont mind them. They dont know what they are talking about. The woman sat down. A man got up, looking very serious. Im happy we are discussing this issue today because - he paused for effect to get everyones attention, the truth is that my wife and I have been struggling in this area for some time and Im afraid it may get out of hand. Some of the men were nodding their heads and making side comments. Tammy looked at the mans wife. She looked embarrassed. The man continued in that very serious tone. I love my wife. I want her. Every other thing is okay but this. He raised a finger up. And this is a very important part of our marriage. Im concerned. The way she behaves when I want her youll be surprised! Its as if Im irresponsible. In fact there have been times I asked myself if something is wrong with me. Some of the people laughed. Im serious! The man said. It is normal for all children to be inattentive, hyperactive, or impulsive sometimes, but for children with ADHD, these behaviors are more severe and occur more often. To be diagnosed with the disorder, a child must have symptoms for 6 or more months and to a degree that is greater than other children of the same age. Children who have symptoms of inattention may: Be easily distracted, miss details, forget things, and frequently switch from one activity to another Have difficulty focusing on one thing Become bored with a task after only a few minutes, unless they are doing something enjoyable Have difficulty focusing attention on organizing and completing a task or learning something new Have trouble completing or turning in homework assignments, often losing things (e.g., pencils, toys, assignments) needed to complete tasks or activities Not seem to listen when spoken to Daydream, become easily confused, and move slowly Have difficulty processing information as quickly and accurately as others Struggle to follow instructions. Children who have symptoms of hyperactivity may: Fidget and squirm in their seats Talk nonstop Dash around, touching or playing with anything and everything in sight Have trouble sitting still during dinner, school, and story time Be constantly in motion Have difficulty doing quiet tasks or activities. Children who have symptoms of impulsivity may: Be very impatient Blurt out inappropriate comments, show their emotions without restraint, and act without regard for consequences Have difficulty waiting for things they want or waiting their turns in games Often interrupt conversations or others activities. ADHD Can Be Mistaken for Other Problems Parents and teachers can miss the fact that children with symptoms of inattention have the disorder because they are often quiet and less likely to act out. They may sit quietly, seeming to work, but they are often not paying attention to what they are doing. They may get along well with other children, compared with those with the other subtypes, who tend to have social problems. But children with the inattentive kind of ADHD are not the only ones whose disorders can be missed. For example, adults may think that children with the hyperactive and impulsive subtypes just have emotional or disciplinary problems. ICE Deports Convicted Rwandan to Serve Sentence for Role in 1994 Genocide
DETROIT A convicted human rights violator, wanted by Rwandan authorities to serve a 19-year prison sentence for a murder conviction, was deported to Rwanda Tuesday by officers with U.S. Immigration and Customs Enforcements (ICE) Enforcement and Removal Operations (ERO). An arrest warrant issued by Rwandas Gacaca Courts, which have jurisdiction over genocide related trials, indicated that during the 1994 genocide, Marie Claire Mukeshimana, 43, acting with a purpose to murder, removed a child from a school in Save, Rwanda, and that her actions resulted in the death of the child. Mukeshimana was sentenced in 2009 before fleeing the country. Mukeshimana was removed to Rwanda on a commercial flight. She arrived in Kigali, Rwanda, on Dec. 21. Upon arrival in Kigali, ICE ERO agents turned Mukeshimana over to the custody of the Rwandan National Police. Mukeshimana attempted to enter the United States last year on a travel visa but was denied entry. She was placed in removal proceedings and has remained in ICE custody since then. In June, an immigration judge ordered her removed from the United States to Rwanda, a decision which was upheld by the Board of Immigration Appeals on Nov. 15, 2011. ICE is committed to rooting out human rights violators like Mukeshimana who flee their countries in order to evade justice, said ICE Director John Morton. While this removal cannot undo the pain Mukeshimana caused, we hope that the family of the victim will receive closure knowing that justice will be served. ICEs Human Rights Violators and War Crimes Center (HRVWCC) investigates human rights violators, including those who have participated in war crimes and acts of genocide, torture, extra-judicial killings, and violations of religious freedom, who seek to evade justice by seeking shelter in the United States. These individuals may assume fraudulent identities to enter the country, seeking to blend into communities inside the United States.

Re. Grace Eledan USI News Columnist There is so much happening in the world and so much to do that it is often amazing to find that many people are very, very lonely. Loneliness can mean: unhappiness as a result of being without the companionship of others or a place or life that is isolated, unfrequented or desolate. We must, however, not confuse loneliness with solitude. Loneliness is what gnaws at us when connections fail. But solo time is essential, it can help us think clearly, breathe calmly, and even feel content. According to this quote in the book, Facing Loneliness by J. Oswald Sanders, It is nothing new to be lonely. It comes to all of us sooner or later.. If we try to retreat from it, we end in darker hell. But if we face it, if we remember that there are a million others like us, if we reach out and try to comfort them and not ourselves, we find in the end that we are lonely no longer (Morris West, The devils Advocate) What makes us hap-
embrace new relationships. Easing Your Way Out of Loneliness. There was a certain woman in the Bible in Acts of the Apostles chapter 16 verses 13-15 called Lydia. She was a business woman from the city of Thyatira, who worshipped God. She met Paul and Silas while they were conducting prayer and she opened her heart to the teachings of Paul and also opened her home to them. She begged them saying, If you have judged me to be faithful to the Lord, come to my house and stay I believe that this opened her up to a lot of possibilities that would have enriched her life from that point on. Many people are so closed in because of one fear or the other that they miss out on
some relationships that would have added value to their lives. We must, therefore, extend ourselves. You might just be pleasantly surprised at what you will find when you do. Have an action plan. Thinking about how to help others or even seeking help can be very invigorating. Being creative about the things that we need to do will energize our minds so much so that loneliness disappears. The next thing we need to do is to be selective in forming relationships. You need quality, not quantity. Relationships must be satisfying and so we do not need to embrace the first person that smiles at us. Lastly, expect the best. Fear binds. If you find yourself constantly afraid concerning this area of your life, it

Many Christians have never been nor will ever be truly happy in their lives because Satan uses the cheapest opportunity he gets to cheat and rob them of their goodies. He prevents prayers from being answered by using the loopholes in our attitude of ingratitude against us. The devil is able to oppress and prevent the flow of Gods blessings from reaching you by capitalizing on your weakness of ingratitude. God inhabits the praises of His people, but as long as His people do not praise Him, it affords the devil the possibility to sit on their blessings. Do not be cheated anymore; start giving praise to God. Observations: It is a pity to report that most Christians are ingrates. We fail to appreciate God for His goodness. We wait till a big thing happens before we say thank you. We neglect to be thankful to God for everyday and everything,

Write a plan of action Have the children write up the familys goals and post it in the kitchen where everyone can see it. Whenever a family member seems to be going off course he or she can always be pointed back to the familys plan. SOUTH AFRICAN WOMAN ARRESTED FOR HIDING COCAINE IN HER DREAD LOCKS.
A woman was caught trying to smuggle 1.5 kilograms of cocaine in her dreadlocks on a flight to Bangkok, it was reported. South African, Nobanda Nolubabalo, 23, was arrested and held in Thailands capital after custom officers allegedly noticed a suspicious white substance in her hair. Officials later carried out a search and discovered she had allegedly matted the Class A drug into her dreadlocks before boarding a flight from Brazil. A search found traces of white substance which turned out to be cocaine. Nolubabalo was being held in custody after being held at Bangkoks International Suvarnabhumi Airport as she disembarked a Qatar Airways flight which had come from Sao Paolo via Doha. The Bangkok Post reported that the suspect had allegedly admitted trying to smuggle the drug and claimed she had done so after being hired to work as a drug mule by a Thailand based businessman for 1,200 pounds. Thailand has some of the toughest antidrugs laws on the planet, with judges permitted to impose the death penalty on traffickers. The South Africans arrest follows the execution of another South African citizen this week for drug smuggling in China. It is another brand new year; the year 2011 is gone for good, leaving us with only those things we were able to get out of living through the year. Some were able to get so much out of the year; some, not much, and some are still counting their losses. Some countries fought and unseated tyrannical leaders, some had a successful transition of government, some had their leaders give up on their own at the face of phenomenal national crisis, some went into war, some signed the peace pact, some were hit by natural disasters and struggled all through the year to wriggle out of the debris, most suffered economic depression while some surprisingly had economic advancement, recording more gains and less losses. It is the same story with corporations, groups, families and individuals. We all have different stories to tell and different souvenirs to

Kiloku, a promising young man who went on a mission which took him far away from his home and his people but never got to accomplish his mission because he allowed too many distractions. Kiloku misplaced his priorities and consequently failed those who counted so much on his unrealized dreams. We need to have a good appreciation of our dreams and ambitions and how well we did with regard to them in the period under review. It is difficult for most people to objectively assess themselves as being recommended here, this is because it is much convenient to pass the buck and blame others for whatever did not go right. But if one really takes a long, hard look at his or her life in the past year, it should not be so difficult to come to terms with the fact that there is need to take some measure of responsibility for whatever did not turn out right. The truth is that, our lives are defined by the decisions we make, thus, if anything goes wrong, we should know that we are the most culpable. The damage usually continues until a mistake is admitted. Sadly, some people never admit their failings until irreparable damages have been done. Another approach is to review some of the criticisms and displeasures registered against us by people in our world and contd on pg 27

contd from pg 26 make efforts to improve. We do not have to be so defensive every time we are criticized, especially when such is coming from those who should ordinarily be concerned about us. If your boss is complaining about something and your spouse complains about the same thing, then they must be seeing something you are not seeing and before it causes a major embarrassment, it is wise to do something about it. The purpose of self evaluation is to identify ones strengths and weaknesses. Your talents can give you recognition but your weaknesses will make you lose it faster than you gained it. People usually spend more time trying to be better at what they do best and take the necessary things they suck at for granted. At the end of the day, the society will not judge you based on what you do well, but on what you fail to do well. This is a good time for parents to ask their children what they think they are not doing right; spouses should ask themselves the same question. It is the only way we can make things better. You cannot keep doing the same thing time and time again and expect a different result each time. When you give people the opportunity to tell you what they think about you, you should look forward to hear some hard truths. As mentioned earlier, it takes humility and sincerity to learn and work at self improvement, but one is always better of giving those hard truths some serious considerations. Refusing to admit ones failings is a major problem on its own. Sometimes in 2011, I wrote about a young professional who was asked in the course of a job interview if he could identify any weakness he needed to work on, but said he could not think of any. He thought he could sell himself better by not admitting to having failings, but his failure to own up to his most obvious weakness was a significant factor that deprived him of the opportunity of getting that job. How can one work on being better when he has not seen the need to identify what he is not doing right? Being human raises an irrefutable presumption of imperfection. We all have our frailties; the great among men are distinguished by their ability to passionately build on their strengths while working very hard to get over their weaknesses. There is a lot of good in looking back but there is nothing good about living in the past. Court, New York, of fourth degree criminal possession of stolen property, namely, a credit or debit card, in violation of section 165.45(2) of the New York Penal Law, for which he was sentenced to 6 months incarceration with 5 years of probation and was required to pay restitution and fees. He was also convicted on February 26, 2009, in Greene County, New York, of forgery in the third degree in violation of section 170.05 of the New York Penal Law, for which he was fined and sentenced to 3 years of probation to run concurrent with his prior sentence. The Department of Homeland Security (DHS) initiated removal proceedings against the respondent, charging that he is removable based on his convictions for crimes involving moral turpitude. At proceedings before the Immigration Judge, the respondent argued that he was not removable because his convictions arose out of a single scheme of criminal misconduct. He also asserted his eligibility for cancellation of removal under section 240A(a) of the Act, 8 U.S.C. 1229b(a) (2006). In his decision, the Immigration Judge stated that the respon-
