As used herein, writing means any handwriting, typewriting, printing, photostating, photographing, photocopying, transmitting by electronic mail or facsimile, and every other means of recording upon any tangible thing any form of communication or representation, including letters, words, pictures, sounds, or symbols, or combinations thereof, and any record thereby created, regardless of the manner in which the record has been stored. 1. Each statement of Economic Interests (Form 700) filed by any employee, consultant, or independent contractor of the City since January 1, 2008. 2. Any Conflict of Interest Code adopted by the City and currently in effect. 3. Any travel and/or reimbursement policy adopted by the City and currently in effect. 4. Any and all agreements or contracts, along with any revisions or amendments thereto, between the City and any of the following persons and/or companies: a. Curt Pringle & Associates b. Frank Hill c. John Karns d. Karns & Karabian e. Joseph Ruiz f. Mike Roos & Company g. Steve OSullivan h. Larrache Land Co. i. Valley Vista Services j. City of Industry Disposal Co. k. Zerep Management Co. _____________________________________________ 1 Public records, as defined by Government Code Section 6252(e), includes any writing containing information relating to the conduct of the publics business prepared, owned, used, or retained by any state or local agency regardless of physical form or characteristics.

5. Any and all writings related to any benefits provided by the City to the Mayor, City Council members, and/or any member of any city commission, board or authority from January 1, 2008 to present. (Benefits are meant to include, but are not limited to salary, stipends, health and/or dental coverage, retirement programs, car allowances or vehicles provided by the city , cell phones, computers and/or internet service provided by the city, credit cards, expense accounts, travel allowance, housing subsidy payments, etc.) 6. Any and all expense reports and/or reimbursement requests submitted by and/or paid to the Mayor, City Council members and members of any city commission, board, or authority since January 1, 2008. 7. Any and all credit card statements for any city credit cards from January 1, 2008 to present. 9. Any and all writings documenting the Citys authorization or creation of the Industry Property and Housing Management Authority. 10. Any and all agreements executed by the City with any firm or person to provide property management services for property in which the City has an ownership interest. 11. All rental agreements executed by the City since January 1, 2000 for the rental of any city owned property. (To assist in narrowing your search, I do not seek to view any records for temporary rentals such as events, or short term (less than two weeks) rentals.) 12. Any City policies or procedures, whether formal or informal, relating to rental property owned by the City, or the management thereof. 13. Any and all writings relating to who is responsible for the property management of any City owned property. 14. Any and all writings related to any loans made by the City to any employee, consultant, elected official or City commission/board/authority member. 15. Resolution No. OB 2012-03 and supporting materials provided to the Board members for review in consideration of the recommended action to adopt this resolution. 17. Any and all writings related to the disposing of Agency-owned properties. 16. Any and all writings related to any properties that were transferred back and retained by the Successor Agency to the Industry Urban-Development Agency from the City of Industry. 8. Record of any property in which the City has an ownership interest.

20. Any and all writings documenting the City appointment process and/or policy for selecting or appointing members to any commission, board or authority. 21. The City Charter and any/all amendments or revisions thereto. Government Code, section 6253(c), requires that: Each agency, upon a request for a copy of records, shall, within 10 days from receipt of the request, determine whether the request, in whole or in part, seeks copies of disclosable public records in the possession of the agency and shall promptly notify the person making the request of the determination and the reasons therefor. Government Code, section 6253(b) requires that these records be provided to me promptly and specifically states that: Except with respect to public records exempt from disclosure by express provisions of law, each state or local agency, upon a request for a copy of records that reasonably describes an identifiable record or records, shall make the records promptly available to any person upon payment of fees covering direct costs of duplication, or a statutory fee if applicable. Upon request, an exact copy shall be provided unless impracticable to do so. Additionally, I would like to direct your attention to Government Code, section 6253.1, which provides: When a member of the public requests to obtain a copy of a public record, the public agency, in order to assist the member of the public make a focused and effective request that reasonably describes an identifiable record or records, shall do all of the following, to the extent reasonable under the circumstances: 1. Assist the member of the public to identify records and information that are responsive to the request or to the purpose of the request, if if stated. 18. Any agendas or minutes where any ad hoc committee was created by the City Council or any City Board, Commission or Authority since January 1, 2008. 19. Any and all writings documenting any City owned property either transferred, or being proposed for transfer, to the State.

2. Describe the information technology and physical location in which the the records exist. 3. Provide suggestions for overcoming any practical basis for denying access to the records or information sought. If you claim that any of the records I have requested are not disclosable, please provide me with a written response including the legal justification for your decision, as required by Government Code section 6255(a)-(b), which states: The agency shall justify withholding any record by demonstrating that the record in question is exempt under express provisions of this chapter or that on the facts of the particular case the public interest served by not disclosing the record clearly outweighs the public interest served by disclosure of the record. A response to a written request for inspection or copies of public records that includes a determination that the request is denied, in whole or in part, shall be in writing. Finally, if you claim that any of the records requested contain exempt information, your duty would be to redact those exempt portions and provide the remainder of the record for inspection. Once the requested records are ready for viewing, please notify me so that we can arrange a time for viewing which is convenient for staff. As provided for under the law, I will expect the City response by no later than July 19, 2012. If I do not receive the City response within the required timeframe, or if any of the requested records are unlawfully withheld, I will have little choice but to consider all available legal remedies available to enforce my rights under the California Public Records Act and other available laws.
