Philippine nursing act of 2002(R.A. 9173) Article VI Nursing practice Section 28 -Scope of Nursing Duty of nurses: a. Providing nursing care through the utilization of the nursing process. b. Established linkages with the community resources and coordination with the health team. c. Provide health education to individuals, families and communities. d. Teach guide and supervise students in nursing education programs including the administration of nursing services in varied setting such as hospitals and clinics. e. Undertake nursing and health human resources development and research, which shall include , but not limited to the development of advanced nursing practice. Qualification and abilities of a Professional Nurse Profession nurse must possess specific qualifications and abilities. A. Professional preparation Professional nurse must: 1. Have a license to practice nursing in the country 2. Have a Bachelor of science degree in nursing 3. Physically and mentally fit. B. Personal qualities and professional proficiencies 1. Interest and willingness to work and learn with individuals/ groups in variety of setting 2. A warm personality and concern for people 3. Resourcefulness and creativity as well as well balance in emotional condition 4. Capacity an ability to work cooperatively with others 5. Initiative to improve self and service

R.A. 9172 Section 20 -Registration by reciprocity SEC.21 PRACTICE THROUGH SPECIAL/TEMPORARY PERMIT -shall be effective only for the duration of the project, medical mission or employment contract. SEC.12 LICENSURE EXAMINATION All applicants for registration as a nurse and issuance of a certificate of registration and professional identification card to practice nursing hall be required to pass the written examination. SEC.13 QUALIFICATIONS FOR ADMISSION TO THE LICENSURE a. Is a citizen of the Philippines b. Is a good moral character and c. Is a holder of a bachelor degree in nursing. SEC.14 SCOPE OF EXAMINATION -examiners answer questions that necessitate recognition and understanding of concepts, theories and principles as well as the skills and attitudes involved in a given test problem situation. Five broad areas of Nursing 1. Fundamentals of Nsg. 2. Maternal and Child Nsg. 3. Community Health Nsg. 4. Nsg. Of adolescents, adults and aged 5. Mental Health and Psychiatric Nsg.

Four parts organized around 4 major goals in nsg. 1. Promotive 2. Preventive 3. Curative

SEC.15 RATING -an examinee must obtain a general average of at least 75% with the rating not below 60% in any subj. Renewal examination- shall be taken within 2yrs.after the last failed examination. Reconsideration of ratings-request should be filed with the commission within 90 days from the date of the release of the examination results. Citizen Requirements ARTICLE IV SEC.1-5 of the 1987 PHILIPPINE CONSTITUTION SECTION 1 those who are citizens of the Philippines at the same time of the adoption of this constitution those who elect Philippine citizenship pursuant to the provisions of the constitution of 1935. SECTION 2 A female citizen of the Philippines who marries an alien shall retain her Philippine citizenship, unless by her act or omission she is deemed, under the law to have renounced her citizenship. SECTION 3 The Philippine citizenship may be lost or re acquired in the manner provided by law. SECTION 4 Natural born citizen jus sanguinis doctrine -child follows the citizenship of his father. Jus soli doctrine -nationality of a person determined by the law of the place of birth Naturalization -act of adopting a foreigner and giving him the privileges of a native citizen

Due process law -define as a law which hears before it condemns, which proceed upon inquiry and renders judgment only after trial. ARTICLE III SEC.4 of the NEW CONSTITUTION No person shall be held to answer for a criminal offense without the process of law. CHAPTER 3 Presidential Decree 223 -The POWER to regulate the established professions in the Philippines and to examine the applicants to practice the same is vested upon the PRC. -repealed by RA 8981, The PRC Modernization Act of 2000. RA 9173 -provides for the creation of a Professional Regulatory Board of Nursing. SECTION 4 Composition of the Board SECTION 3, ARTICLE III Nursing Act shall be composed of a Chairperson and six members, representing the three areas of nursing, namely, nursing education, nursing service, and community health nursing. Regular appointment -the PNA certifies for the appointment to the nursing board of the PRC -12 candidates who possess the required qualifications -12certified nominees are forwarded to the commissioner of the PRC for further screening. -commission in return submits the first 6 from the list to the president of the Philippines -president appoints the board members such appointment is confirmed by the commission on appointment. Ad Intern Appointment -board member is appointed in the mean time to fill in vacancy or perform the duties of an office during the absence of regular incumbent Doctrine of Hold-Over -member of the nursing board is permitted to continue to exercised the functions of the office after the end of his/her term until replaced. SECTION 5 Appointment Chairperson and six members shall be appointed by the president of the republic of the Philippines upon the recommendation of the commission.

Renewal of Nurse License -every RN shall renew his/her license every 3years with the PRC. Suspension -means that the nurse is not allowed to practice temporarily until final judgment of the case against him/her is rendered. -license is not confiscated. Revocation -license to practice is confiscated either temporary or permanent.

SECTION 6 Qualifications of the chairperson and members A natural born citizen and president of the Philippines. A member of Good standing of the accredited professional organization of nurses. A RN and holder of a masters degree in nsg.education or other applied profession Must have at least 10yrs. Continuous practice of the profession Must not have been convicted of any offense involving moral turpitude SECTION 7 COMPENSATION OF BOARD MEMBERS They are paid based on the principle of Quantum Meruit which means as much as they deserve. SECTION II Removal or suspension of board members President may remove or suspend any member of the board after having been given the opportunity to defined himself/herself in a proper administrative investigation.
