FACTORIES ACT 1948

OBJECT & SCOPE


The factories act regulates conditions of work (Healthy, Safety etc) in factories. It safeguards the interest of workers & for the welfare of factory workers. This act received the assent of governor general of India on 23th Sep 1948 & came into force on April 1st, 1949 This act is applicable to any factory in which 10 or more than 10 workers are working.

THE FACTORIES ACT HAS A PROVISION IN RESPECT OF:Employee health & safety Hours of work Sanitary conditions & wholesome work environments

MAIN PROVISIONS OF THE ACT


1) Under Health & Sanitary Provisions: Cleanliness Disposal of Wastes & Effluents Ventilation & Temperature Dust & Fumes Artificial Humidification Overcrowding Lighting Drinking Water Latrines & Urinals Spittoons

2) Under Safety:

Encasing & Fencing of machinery Work on or near machinery in motion Employment of young persons on dangerous machinery Hoists & lifts Lifting machines, chains, ropes & lifting tackles Pressure plants Floor, stairs & means of access to different places Pits, sumps, openings in floors, etc. Excessive weights Protection of eyes Precautions against dangerous fumes Explosive or inflammable dust, gas etc Precautions in case of fire

3) Welfare: Washing facilities Facilities for sitting First aid appliances Canteens Shelters, rest-rooms & lunch rooms Creches Welfare Officers

4) Under Working Hours: Weekly Hours Weekly Holidays Daily Hours Intervals for rest Extra wages for over-time Restriction on double employment Register of adult workers Restrictions on employment of women

ANNUAL LEAVE WITH WAGES


A worker who has worked for 240 days or more during a calendar year shall be permitted during the subsequent calendar year, leave with wages for a number of days at the rate of:1) One day for every 15 days of work performed by a child worker 2) One day for every 20 days of work performed by an adult worker - A worker interested to take leave shall apply 15
