OCCUPATIONAL SAFETY & HEALTH LEGISLATION

OBJECTIVES

Define Occupational Safety and Health Act (OSHA) philosophies and objectives Describe Occupational Safety and Health (OSHA 1994)

Introduction

Occupational Safety and Health Act 1994 (Act 514) is a piece of Malaysian legislation which was gazetted on 25 February 1994 by the Malaysian Parliament. Factory and Machinery Act 1967 only covers occupational safety and health in the manufacturing, mining, quarrying and construction industries, whereas the other industries are not covered. More comprehensive included all industry sectors. Self regulation/ kawal selia sendiri

The principle of the Act


"To make further provision for securing that safety, health and welfare of persons at work, for protecting others against risks to safety or health in connection with the activities of persons at work, to establish the National Council for Occupational Safety and Health and for matters connected therewith.

Purposes/ Tujuan of OSHA (4)


a)To secure the safety, health and welfare of person at work/ Untuk memastikan keselamatan, kesihatan dan kebajikan orang-orang yang sedang bekerja b)To protect person (other than person at work) at a place of work against hazard/ Untuk melindungi orang-orang di tempat kerja (selain daripada orang-orang yang sedang bekerja).

c)To promote occupational environment adaptable to the persons physiological and psychological needs/ Untuk mengalakkan suatu persekitaran pekerjaan yang bersesuaian dengan fisiologi dan psikologi orang-orang yang sedang bekerja. d)To provide the means towards a legislative system based on regulations and industry codes of practice in combination with the provisions of the Act/ Untuk mengadakan suatu sistem perundangan yang berasas kepada peraturan-peraturan dan tata amalan industri disamping peruntukan Akta
