Human rights gained international recognition and acceptance in 1948 through the Universal Declaration of Human Rights. Fundamental entitlements that all persons receive from birth, which should never be taken away from them. These rights ensure that everyone including minority groups and individuals - are recongnised as human beings.

What rights to these people have?


Human rights violations can be seen in the previous two clips. The governments of Sudan and Syria failed to protect their citizens from crimes against humanity. In these cases the International Criminal Court can seek to prosecute these individuals for war crimes, crimes against humanity and the crime of genocide.

International recognition of the rights of the child

Human Rights in Australia


Since 1992, Australians have been able to lodge individual complaints with the United Nations Human Rights Committee (UNHRC). Australia has not adopted any civil or political rights into domestic law.

Case Law Toonen v. Australia (1994) 1 PLPR 50


1st complaint made to the UNHRC. Toonen complained that Tasmainias prohibition of male homosexuality directly violated an individuals right to privacy. The UNHRC found in favour of Toonen, however Tassie still did not change the law. Eventually, the federal government introduced a law that declared that individuals had a right to privacy. This law over rode any Tasmanian law. Why? The case shows that, although uncommon, the UNHRC can offer protection to minority or disadvantaged groups.
