THE TRADE UNIONS ACT 1926


MEANING Trade union means an association of workers in a particular craft or industry. It means an association formed primarily for the purpose of regulating the relation between workmen and employers or between workmen and workmen or between employers and employers

The law relating to trade union is contained in the Trade Union Act 1926 and this act was passed to regulate condition governing the registration of trade unions Obligations imposed upon a registered trade union Rights and liabilities of registered trade unions

APPOINTMENT OF REGISTRARS State government appoints a person to be the registrar of trade union for the state Also appoint many Additional and Deputy registrar of trade union for exercising and discharging the powers and functions of the registrars They have to act under the control of the registrar Government also defines the local limit they shall exercise the powers

A trade union is entitled to registration only if The name of the trade union is specified The whole of its objects The whole of the purpose for which the general funds of the trade union shall be applicable The maintenance of the list of the members of the trade union The admission of ordinary members and also the admission of the number of temporary office-bearers of the trade union

The payment of the subscription by the members which shall be not less than 25paise per month per member conditions under which members shall be entitled to any benefits and conditions under which fines may be imposed The manner in which rules shall be amended, varied ,rescinded The manner in which the trade union may be dissolved

Becomes a body corporate by the name under which it is registered and becomes a legal entity It has perpetual succession and a common seal It has power to acquire and hold both movable and immovable properties It has the power to contract

DUTIES AND LIABILITIES OF A REGISTERED TRADE UNION


Change of registered office any changes in the address of the head office of trade union notice of change must be given to the registrar Objects on which general funds may spends Proportion of officers to be connected with the industry- not less than one half of the total number office bearers must be the persons employed in the industry. Remaining may be social or political workers

Returns- details regarding all receipts and expenditure and statement of all assets and liabilities for the year ending should be send to the registrar Disqualification of office bearers of trade unionit may happen in the case of office bearer who has not attained the age of 18 he has been convicted by the court India

DISSLUTION OF A TRADE UNIONON

When a trade union is dissolved , notice of dissolution signed by 7 members and by the Secretary of the trade union shall be sent to the Registrar within 14 days of the dissolution. If the registrar is satisfied , the dissolution has been affected in accordance with the rules of the trade union, he shall register the facts of dissolution The dissolution shall take effect from the date of such registration
