Americans with Disabilities Act

Implemented July 26, 1990

Federal Law stating rights for citizens with disabilities in an effort to reduce the barriers to
equal access and provide opportunities for people with disabilities.

4 Titles of the ADA

Titles I: Employment Applies to anyone who hires anyone else to work (including
government) that they cannot discriminate based on a disability. This applies to businesses
with 15 or more employees and not for businesses with less that 15 employees.

Title 2: State and Local Government Required to make programs and services
accessible to people with disabilities. Includes: courts, schools, social services, hospitals,
legislature, city councils, and facilities for recreation (like libraries).

Title 3: Public Accommodations Any business open to the public must contain equal
access for people with disabilities to use the business and/or activities. Includes: retail
stores, anywhere you can shop, hotels, theaters, restaurants, banks, museums, parks, etc.
Applies to both for profit and non profit agencies. Size of employees does not matter

Title 4: Telecommunications Relay Services (TRS) Equal access for people who are
deaf, hard of hearing, and have speech impairment to telecommunication services.

IDEA

Individuals with Disabilities Education Act

October 30, 1990

The right to education for ALL children, with or without disabilities.

Before the law, there was no public education options for kids and families with
disabilities.

The proficiency of grade level students with disabilities lies around 10% showing
little growth year to year.

A majority of students with disabilities participate in the general education


classroom

20% of students with disabilities receive support through secondary intervention.

Assistive Technology Act (ATA)

Promotes awareness and access to assistive technology devices and services.


The goal of the act in providing assistive technology to students with disabilities
is to allow those students to fully participate in education, employment and
daily life just like their peers.

What is and assistive technology device? It is any item that enhances


capabilities of individuals with disabilities.

What is an assistive technology service? Any service that directly assists and
individual with a disability to work on a task.

Each state gets a grant to fund assistive technology services

Implementing ADA, IDEA, and ATA in


the Classroom

ADA: This is a given to me. I dont think it is a childs job to


walk into my classroom with their disability and have to
accommodate their learning to my teaching. It is the
opposite; it is my job to accommodate my teaching to all
childrens needs of learning.

IDEA: I want to see that 10% proficiency go up. I want to be


able to reach all students in my classroom, disability or no
disability. The 20% that receive secondary intervention is
not a bad thing. Some students need extra help and I want
to be a source of that extra help to all my students.

ATA: I think there are thousands of resources in technology


out there to help our students with disabilities be just as
capable as those without disabilities. The funding is there,
it needs to be utilized.
