LAW

Labour law is the body of laws,


administrative ruling ,and precedents
which address the legal rights of and
restriction on, working people and
their organization
SOME IMPORTANT LABOUR LAWS
APPLICABLE TO WORKMEN

Some of the relevant laws which are discussed here are as


follows:
The workmens Compensation Act,1923

The Child Labour (Prohibition and Regulation) Act,1986

and Rules
The Inter-State Migrant Workmen (Regulation of Service)

Act,1979
THE WORKMENS COMPENSATION
ACT,1923
An Act to provide for the payment by certain classes of employers to
the workmen of compensation for injury by accident.
Employer is liable to pay compensation to the employee
When employer is not liable
Amount of compensation
In case of death:- an amount equal to 50% of the monthly wage or
Rs.80,000/- whichever is more
In case of permanent total disablement:- 60% or Rs. 90,000/
whichever is more
In case of permanent partial disablement occurs then the
compensation is proportionate to the disability arrived
Notice: An injured person or his dependants have to give a notice to the
employer to pay compensation.
Recovery: The amount of compensation awarded by the Commissioner is
to be recovered as arrears of land revenue.
THE CHILD LABOUR (PROHIBITION AND
REGULATION ) ACT,1986
The basic objective of the Child Labour (Prohibition & Regulation) Act 1986, is
to ban employment of children below the age of 14 years in factories, mines and
hazardous employment's and to regulate the working conditions of children in other
employment's.
Applicability:
in extends to the whole of India
Hours and Period of work:
working hours in limited to three hours in a day, not to work between
7 p.m. to 8 a.m., no overtime(Sec.-7)
Weekly Holiday:
Every child shall be allowed in each week a holiday of one whole day(Sec.-8)
Penalties:
Under Sec.-3 with imprisonment for a term which shall not be less than three
months but which may extend to one year or with fine which shall not be less
than ten thousand rupees but which may extend to twenty thousand rupees or
with both.
